Conclusion
Old assumptions about the nature and extent of criminal liability for corporate
fraud have been transformed in various ways. The task of enforcement has
thereby been assisted. It may also be the case that the breadth and uncertainty of
the law will have a real deterrent effect in the commercial world. The major
question, however, is whether the law's change in form can be matched by
effective enforcement so as to achieve a change in substance.
