THE 8 MARCH PRINCIPLES FOR A HUMAN RIGHTS-BASED APPROACH TO CRIMINAL LAW PROSCRIBINGCONDUCT ASSOCIATED WITH SEX, REPRODUCTION, DRUG USE, HIV, HOMELESSNESS AND POVERTYPRINCIPLE 5 – MENTAL STATE REQUIREMENTNo one may be held liable for a criminal offence unless that person has committedthe material elements of that offence with the mental state required in the definitionof the offence, such as intent, purpose, knowledge, recklessness, or criminalnegligence. Every criminal offence that is punishable with deprivation of libertymust include a mental state requirement with respect to each material element.PRINCIPLE 6 – GROUNDS FOR EXCLUDING CRIMINAL LIABILITYNo one may be held criminally liable for an offence if that person has a lawfuldefence for their conduct, including that the conduct is justified or excused, such asby reason of necessity, self-defence or duress.16
