A RESOLUTION CALLING
A PUBLIC HEARING
PURSUANT TO CHAPTER
950 OF THE LAWS OF
1972 AND SECTION 202c
OF THE TOWN LAW IN
RELATION TO PROJECT
2006-001 OF
THE COLONIE SEWER
DISTRICT IMPROVEMENT
AREA AND DELETING
SAID AREA FROM THE
IMPROVEMENT AREA
WHEREAS, the Colonie
Sewer Improvement Area
has heretofore been created
by the Town Board of
the Town of Colonie, Albany,
County, New York pursuant
to the provisions of Chapter
950 of the Laws of 1972;
and
WHEREAS, a report,
map, plan and estimate of
cost has been prepared by
Greenman-Pedersen, Inc
engineers duly licensed by
the State of New York, in
relation to the proposed
construction of sanitary sewers
in proposed Breakell
Property; and
WHEREAS, said report,
map, plan and estimate of
cost are on fi le in the Town
Clerk’s Offi ce for public inspection;
and
WHEREAS, the Town
Board of the Town of Colonie
has heretofore on or about
the 5th day of October, 2007
following a Public Hearing
approved the construction of
said Project 2006-001; and
WHEREAS, all costs of
said Project, were to be paid
by the Developer for said
Project from funds escrowed
with the Town; and
WHEREAS, the Town
Board has received a petition
from said Developer

requesting a dissolution and
diminishing of the area of the
Colonie Sewer Improvement
Area by deleting the area
of Project 2006-001 and
refunding of unused escrow
funds to the Developer; and
WHEREAS, it is now desired

pursuant to the provisions
of paragraph b of §8 of such
Chapter 950 of the Laws of
1972, and Section 202c the
Town Law of the State of
New York.
NOW, THEREFORE,
IT IS RESOLVED, by the
Town Board of the Town of
Colonie, Albany County, New
York, as follows:
Section 1. A meeting
of the Town Board of the
Town of Colonie, Albany
County, New York shall be
held at the Town Hall, Newtonville,
New York on the
17th day of January, 2008
at 8:00 o’clock p.m., Local
Time, for the purpose of
conducting a public hearing
on the aforesaid request to
repeal the aforesaid Resolution
approving Project 2006-
001 and refunding unused
portions of the escrow monies
heretofore deposited
for construction of Project
2006-001.
Section 2. T h e
Town Clerk is hereby authorized
and directed to cause
a notice
of said public hearing to be
given by publishing and posting
a copy of this resolution
in the manner provided by §3
of Chapter 950 of the Laws of
1972, and the Town Law of
the State of New York.
Section 3. T his

WHEREAS, the Town Board
of the Town of Colonie has
heretofore established the
Latham Water District lying
within the said Town; and
WHEREAS, the Town
Board of the said Town of
Colonie is desirous of increasing
and improving the
facilities of the Latham Water
District as follows: 1) construction
of 12,600 lineal
feet of 36 inch transmission
main from Mohawk View
Water Treatment Plant to
the intersection of Sparrowbush
Road and Wade
Road extension; 2) construction
of 3,800 lineal feet of
24 inch transmission main
from upper Loudon Road
along Crumtie and Farrow
Road to Sandersen-Heath
Park; 3) construction of 300
lineal feet of 12 inch water
main construction on Pollock
Road; 4) construction
of 200 lineal feet of 8 inch
water main on Grandview
Drive; 5) construction of
2,500,000.00 gallon storage
tank at Sandersen-Heath
Site with pumping station;
6) removal of Latham Water
District Tanks at Utica
Avenue; 7) rehabilitation of
Latham pumping station; 8)
remediation of the Latham
Tank Site; 9) Demolition of
Ross Court Tank; 10) remediation
of the Ross Court
Tank Site
WHEREAS, the Town
Board has caused a report
and an Addendum thereto
of the aforesaid proposed
additions and improvements
to be prepared by C.T. Male
Associates, P.C., competent
engineers, duly licensed by
the State of New York; and
revised report, map, plan and
estimate of cost has been fi led
in the Town Clerk’s Offi ce, for
public inspection, estimated
maximum cost for said project
to the sum of Eleven
Million One Hundred Ten
Thousand ($11,110,000.00)
Dollars; and
WHEREAS, it is anticipated
all costs in the
amount Ten Million Four
Hundred Eighty Thousand
($10,480,000.00) Dollars
will be funded by payments
received from the Albany
County Airport Authority;
and
WHEREAS, all additional
costs of said Project estimated
to be Six Hundred Thirty
Thousand ($630,000.00)
Dollars including all principal
and interest on any bonds
or other obligations of said
Town authorized to be issued
therefor, shall be borne by
local assessment upon the
several lots and parcels of
lands which the Town Board
shall determine and specify
to be especially benefited
by said Project in just proportions
to the amount of
benefit which said Project
shall confer upon the same;
and
WHEREAS, it is now
desired to call a public hearing
upon said Project to the
provisions of the Town Law
of the State of New York;
NOW, THEREFORE, on
motion of J. Brian Hogan,
Councilman and seconded
by Ulderic J. Boisvert, Councilman
it is hereby
RESOLVED: by the
Town Board of the Town of
Colonie, Albany County, New
York,

Section 1. A meeting
of the Town Board of the

which time and place said
Town Board will hear all persons
interested in the subject
matter thereof.
Section 2. The

charges within the Water

from 8:30 AM until 4:30 PM
of each weekday, Monday
through Friday, at the Town
Hall of the Town of Colonie,
for the purpose of receiving
taxes assessed under such
roll. Offi ce hours will be extended
from Friday, January
25, 2008 and Monday, January
28 to Thursday, January
31, 2008 from 8:30 AM until
