says drug store
aided drug habit

A former Westland man and
his Soulhfield attorney could
collect 11.9 million if the
Michigan Supreme Court rules
a drugstore contributed to the
man's drug addiction.
John J. Oriel, 37, now living
in Garden City, ia "paycboUc

told the high court last week.

lifelong care and intermittent

award. The jury put the figure
at $3.8 million, but a judge cut

own "criminal activity" in
taking illegal druga contribut

Oriel himself said during his
trial: "I sort of became a product
of society. My environment
was drug, you know, infested,
so I became like the rest."
He has been in Northville-
State Hospital, Providence.
Oakwood and other hospitals
12 to 14 times from 1982 to
1986.
"There is absolutely no evidence
that Onel ever obtained
Desoxyn from the appellant
(Scott) without a preacription,"
replied John Highland, a
Southfieid attorney representing
the store's insurer.
"As a matter of public policy.
this court cannot turn our
civil and criminal docket into a
chaotic, overloaded circus of
litigation where drug addicts
are no longer criminally responsible
for their conduct,"

Supreme court hears tax fight case

TACT, a Wayne County homeowners
group, asked the Michigan
Supreme Court to throw out a
1981 real estate transfer tax because
voters never had a chance
to decide it.
County attorneys .asked the
high court to uphold the tax because
"we'd have to refund the tax
for 14 years. The consequences to
the state would be fiscal disaster."
said Kevin Moody, attorney
from the firm of Miller Canfield,
representing Wayne County.
The seven justices have up to a
year from Thursday's oral arguments
to decide the question.
The case presents several thorny
questions:

In 1980 Michigan had a 55cents-per-$500
real estate transfer
tax. The Legislature passed a law
allowing counties of more than
two million population to raise it
to 75 cents. At the time. Chief
Justice James Brickley presided
over the state Senate as lieutenant
governor.
Only one county, Wayne, fit the
definition. The county Board of
Commissioners raised the rate on
Feb. 19, 1981.
