Illegal parking
From Page 1A
Alfaro was fi nishing up some paperwork
and about to turn in when he got
the news that a towing company, accompanied
by Plainview police, had
put a lock on his trailer and was ready
to start towing — not just him but the
fi ve or so other trucks parked there,
too.
The man threatening to tow the
trucks was Hector Magallanes, manager
of A-1 Affording Towing in Tulia.
Magallanes said everything Alfaro
said is true — and perfectly legal, too.
Magallanes is contracted to tow
trucks that are illegally parked there by
the owner of the property, which, according
to the Hale County Appraisal
District, is First Christian Powers, a
corporation that owns Christian Manor
senior apartment complex. First Christian
Powers was given the property
by Wal-Mart by Prairie House Living
Center when Prairie House went from
being non-profi t to profi t.
“There are (no parking) signs where
they drive in,” Magallanes said, pointing
out there are two ways to enter the
lot, and both have signs. “They’ve been
up there for a couple of months.”
Alfaro said he didn’t see the signs —
which are about one-foot by one-foot
and posted on about a six-foot high
post — before he decided to park there.
“You come in from the road, it’s late
at night, you’re tired, it’s dark . . .,” he
said. “You see trucks parked there and
you say, ‘OK, I should have no problem
there.’ ”
Even though Alfaro knows now he
was illegally parked, he thinks the
truckers should be cut some slack and
shown “common courtesy.”
“How come they don’t knock on my
window and say, ‘Hey, you need to
move,’ ” he said. “I was kind of perturbed.”
Magallanes disagrees.
“We’re not contracted to drive 30
miles at night just to knock on doors,”
the towing company manager said.
“Once we’re there we have a legal
right to tow them.”
In fact, Magallanes added, he gives
truck drivers an option to pay the $400
fee for him to release their rigs or he
can tow them to Tulia, which would
wind up costing a lot more.
“It would probably be double the
price” if they were towed, he said.
Ed Vadder, chairman of the board of
First Christian Powers, said truckers
parking on the property has become a
huge problem.
“One time there were 16 trucks
parked there,” Vadder said, adding that
there are times when truckers drive on
the property when it’s muddy. “They
were rutting it up. Plus you run the
risk of there being a tanker truck being
there and it leaking some kind of
hazardous material.”
Vadder said First Christian Powers
contracted with A-1 Affordable Towing
to handle the situation. He said the
towing company collects all the fees;
First Christian Powers does not see
any of the money collected, nor does
the city.
“The property owners don’t get a
dime of what we do on that property,”
confi rmed Magallanes, who said he
knows what he does upsets truckers.
“If I put myself in their shoes, I understand
their situation. Their living is
driving trucks, and our living is towing,”
he said.
Magallanes said truckers should understand
where the property owners
are coming from, too.
“They don’t want them there,” he
said. “You wouldn’t want someone to
park on your property. If you don’t follow
the signs, then you have to pay the
consequences.
“A lot of people say it’s a scam. I understand
how they (truckers) feel about
it,” Magallanes added. “For some of
them their company pays (the fee), and
some of them don’t.”
Alfaro’s $400 fee came straight out
of his pocket.
“That week my salary was probably
$200, and that’s after 10 days on the
road,” he said. “That ($400 fee) is a lot
of money, especially in this economy.
That was part of Christmas for my
kids, so I couldn’t really afford to give
them much, just a package of socks
and underwear. That was all they got
because I couldn’t afford it.”
Magallanes said in the two months
or so the signs have been posted, he’s
visited the property “three or four
times.
“Most of the time it’s just one or two
(trucks) parked there,” he said.
Alfaro said it gives the city a bad
reputation, especially when the towing
company is accompanied by the
police.
Magallanes said he always calls law
enforcement before going to the property
because of the potential for a bad
situation.
Alfaro meanwhile, thinks he knows
how to solve the problem.
“I just think they need to invest in
some bigger signs,” he said.
