Anexo 13: Ley N° 2809 Decreto Reglamentario N° 1312-08 Resolución N° 4271 - MHGC/08 y Anexos g) La presentación debe ser acompañada con el respectivo soporte magnético en el que conste la totalidad de los cálculos efectuados para arribar al precio solicitado. Artículo 5° - Recibida la petición y corroborado el cumplimiento de lo establecido en el artículo 4° precedente, la Dirección General de Redeterminación de Precios verificará los cálculos presentados y emitirá el respectivo informe, en el cual se establecerán los nuevos precios contractuales al mes de entrada en vigencia de la Ley N° 2.809. Conjuntamente con el Informe, remitirá a la Jurisdicción comitente el Proyecto de Acta Acuerdo a suscribir, la que deberá aprobar la nueva estructura de ponderación y contener, como mínimo, los nuevos precios contractuales y sus correspondientes análisis de precios. Artículo 6° - Recibidas las actuaciones, la Jurisdicción comitente, de compartir el Informe citado en el artículo precedente, remitirá los actuados a la Sindicatura General de la Ciudad de Buenos Aires, a efectos de que tome la intervención prevista en el artículo 11 de la Ley N° 2.809, organismo que deberá expedirse conforme lo indicado en el artículo 7° del Anexo II de la presente Resolución. Artículo 7° - Cumplido lo establecido en los artículos precedentes, el funcionario que resulte competente de la Jurisdicción comitente suscribirá, ad referéndum de la aprobación del titular de dicha Jurisdicción, conforme la delegación de facultades establecida en el Decreto N° 948/08, el Acta Acuerdo correspondiente. Artículo 8° - Desde esta redeterminación en adelante, los precios se redeterminarán de conformidad con las reglas de la Ley N° 2.809, debiendo mantenerse fijo e inamovible un diez por ciento (10%) del precio total del contrato, durante la vigencia del mismo, tal cual estaba establecido en la normativa anterior. Artículo 9° - Las redeterminaciones que correspondan a períodos anteriores a la fecha de entrada en vigencia de la Ley N° 2.809 serán calculadas conforme lo establecido en el inciso E) de la cláusula transitoria 2a de la citada Ley, debiendo considerarse, para el caso de servicios expresamente incluidos, lo establecido en su respectiva documentación contractual. 10 de 10
