PRAKATA<br />
Agensi Kelayakan Malaysia merupakan satu-satunya organisasi jaminan kualiti pendidikan<br />
tinggi negara yang memudah cara pengawalan kualiti melalui penghasilan dokumen<br />
jaminan kualiti. Dokumen yang dimaksudkan ialah Kerangka Kelayakan Malaysia, Kod<br />
Amalan, Garis Panduan Amalan Bijak <strong>dan</strong> <strong>Standard</strong> <strong>Program</strong>. Kesemua dokumen ini harus<br />
digunakan sebagai rujukan dalam mengendalikan program pendidikan tinggi di Malaysia.<br />
<strong>Standard</strong> <strong>Program</strong> dibangunkan bagi menyediakan panduan spesifik kepada pemberi<br />
pendidikan tinggi (PPT) dalam bi<strong>dan</strong>g tertentu bagi memenuhi keperluan <strong>dan</strong> kehendak<br />
Kerangka Kelayakan Malaysia. Dengan pematuhan <strong>dan</strong> pelaksanaan yang betul <strong>dan</strong> bijak,<br />
standard program ini mampu menjana pembangunan program pendidikan di Malaysia <strong>dan</strong><br />
mengekalkan kualitinya. Seterusnya, ia dapat meningkatkan kualiti graduan dalam aspek<br />
pekerjaan <strong>dan</strong> mobiliti.<br />
<strong>Standard</strong> <strong>Program</strong> <strong>Un<strong>dan</strong>g</strong>-<strong>un<strong>dan</strong>g</strong> <strong>dan</strong> <strong>Syariah</strong> ini diformulasi bagi meningkatkan<br />
pembangunan program akademik dalam bi<strong>dan</strong>g <strong>un<strong>dan</strong>g</strong>-<strong>un<strong>dan</strong>g</strong> <strong>dan</strong> <strong>Syariah</strong> pada tahap<br />
Diploma hingga Kedoktoran. Ia merangkumi panduan khusus bagi matlamat <strong>dan</strong> objektif<br />
program, hasil pembelajaran program, reka bentuk program (termasuk ca<strong>dan</strong>gan struktur<br />
program), penilaian pelajar, staf akademik, sumber pendidikan <strong>dan</strong> penambahbaikan kualiti<br />
berterusan.<br />
Panel pakar yang terlibat dalam pembangunan standard program ini mewakili pelbagai pihak<br />
berkepentingan termasuklah agensi kerajaan <strong>dan</strong> swasta serta pemberi pendidikan tinggi<br />
(PPT). <strong>Bagi</strong> memastikan penerimaan sepenuhnya, dokumen standard program ini telah<br />
dibentangkan dalam bengkel pihak berkepentingan yang telah diadakan pada 6 Disember<br />
2007. Pan<strong>dan</strong>gan umum telah diteliti <strong>dan</strong> digabungkan dalam penghasilan dokumen akhir<br />
standard program tersebut.<br />
Setinggi-tinggi penghargaan ditujukan kepada mereka yang terlibat <strong>dan</strong> pegawai Agensi<br />
Kelayakan Malaysia yang telah menyumbang sepenuh tenaga <strong>dan</strong> masa dalam merealisasikan<br />

berbekalkan sokongan padu individu dari pelbagai institusi pemberi pengajian tinggi,<br />

STANDARD PROGRAM:<br />
UNDANG-UNDANG DAN SYARIAH<br />
PENGENALAN<br />
<strong>Standard</strong> <strong>Program</strong> <strong>Un<strong>dan</strong>g</strong>-<strong>un<strong>dan</strong>g</strong> <strong>dan</strong> <strong>Syariah</strong> adalah bertujuan untuk menyediakan<br />
panduan amalan bijak bagi menjalankan <strong>dan</strong> melindungi integriti kesemua program<br />
<strong>un<strong>dan</strong>g</strong>-<strong>un<strong>dan</strong>g</strong> <strong>dan</strong> <strong>Syariah</strong>.<br />
Ia telah dibangunkan oleh sekumpulan peguam bela <strong>dan</strong> peguam cara serta pakar akademik<br />
daripada profesion Sivil <strong>dan</strong> <strong>Syariah</strong> serta ba<strong>dan</strong> atau agensi kerajaan yang berkaitan. Dokumen<br />
yang kini menjadi standard yang dipersetujui di peringkat kebangsaan bagi <strong>un<strong>dan</strong>g</strong>-<strong>un<strong>dan</strong>g</strong> <strong>dan</strong><br />
<strong>Syariah</strong> ini, telah dibentang <strong>dan</strong> dibincangkan dalam bengkel bersama pihak berkepentingan.<br />
<strong>Standard</strong> ini memperakui bahawa pendekatan <strong>dan</strong> mekanisme dalam jaminan kualiti pendidikan<br />
tinggi sentiasa berkembang. Oleh itu, ia mengguna pakai pendekatan yang bersifat membangun,<br />
tidak preskriptif <strong>dan</strong> tidak muktamad. <strong>Standard</strong> ini juga menggariskan prinsip umum yang<br />
berkecenderungan kepada pihak berkepentingan <strong>dan</strong> tidak sepatutnya dilihat sebagai satu<br />
manual arahan kerana ia tidak menyediakan butiran terperinci tentang sebarang pendekatan <strong>dan</strong><br />
prosedur.<br />
Pemberi pendidikan tinggi (PPT), staf akademik <strong>dan</strong> pelajar patut melihat dokumen ini sebagai<br />
sumber yang berguna dalam meningkatkan kualiti program per<strong>un<strong>dan</strong>g</strong>an <strong>dan</strong> <strong>Syariah</strong>. Seperti<br />
sedia maklum, konsep kualiti terletak pada prinsip penilaian rakan sebaya <strong>dan</strong> kebolehan<br />
mempertahankan. Maka, pemberi pendidikan tinggi (PPT) yang menggunakan dokumen ini harus<br />
sedar akan desakan keperluan industri <strong>dan</strong> permintaan pihak berkepentingan dalam menyediakan<br />
persekitaran pembelajaran <strong>dan</strong> pengajaran yang terbaik.<br />
Pembangunan kurikulum juga seharusnya mengambil kira pelbagai perkembangan yang<br />
mempengaruhi pengisytiharan <strong>un<strong>dan</strong>g</strong>-<strong>un<strong>dan</strong>g</strong> baru <strong>dan</strong> pindaan pada <strong>un<strong>dan</strong>g</strong>-<strong>un<strong>dan</strong>g</strong> yang<br />
sedia ada, serta pelaksanaan <strong>dan</strong> pentadbiran per<strong>un<strong>dan</strong>g</strong>an dalam sistem <strong>Syariah</strong> <strong>dan</strong> Sivil.<br />
Tidak dapat disangkal lagi bahawa perubahan ini memberi implikasi terhadap reka bentuk <strong>dan</strong><br />
penyampaian kurikulum dalam pendidikan <strong>un<strong>dan</strong>g</strong>-<strong>un<strong>dan</strong>g</strong> <strong>dan</strong> <strong>Syariah</strong>. Contoh perkembangan<br />
penting termasuk:<br />

keperluan melaksanakan resolusi alternatif kepada sesuatu pertikaian;<br />
trend ke arah globalisasi <strong>dan</strong> liberalisasi yang memerlukan pemahaman mendalam tentang<br />
perkara seperti <strong>un<strong>dan</strong>g</strong>-<strong>un<strong>dan</strong>g</strong> komersial, kewangan korporat antarabangsa, perdagangan<br />
<strong>dan</strong> perkapalan serta keperluan terhadap kemahiran teknologi, pembelajaran sepanjang hayat<br />
<strong>dan</strong> standard amalan yang jelas <strong>dan</strong> selari dengan standard antarabangsa;<br />

penggunaan Bahasa Malaysia dalam mahkamah Sivil <strong>dan</strong> <strong>Syariah</strong>;<br />
peningkatan penggunaan ICT dalam kemahiran <strong>dan</strong> amalan per<strong>un<strong>dan</strong>g</strong>an. Contohnya,<br />
perbincangan <strong>dan</strong> perundingan atas talian, portal klien atas talian, pengantaraan atas talian,<br />
pemfailan elektronik dokumen <strong>dan</strong> pewuju<strong>dan</strong> e-mahkamah;<br />
5. kemunculan bi<strong>dan</strong>g baru dalam <strong>un<strong>dan</strong>g</strong>-<strong>un<strong>dan</strong>g</strong> seperti <strong>un<strong>dan</strong>g</strong>-<strong>un<strong>dan</strong>g</strong> siber, isu bio-valley<br />
(paten, genetik, bioetika), privasi, keganasan, bantuan per<strong>un<strong>dan</strong>g</strong>an antara dua negara dalam<br />
siasatan <strong>dan</strong> prosiding jenayah, ekstradisi, pembersihan wang, perdagangan antarabangsa<br />
<strong>dan</strong> hak kemanusiaan;<br />
6. peningkatan dalam kerjasama <strong>dan</strong> pengharmonian <strong>un<strong>dan</strong>g</strong>-<strong>un<strong>dan</strong>g</strong> <strong>dan</strong> konvensyen<br />
antarabangsa;<br />
7. peningkatan minat <strong>dan</strong> perkembangan dalam <strong>un<strong>dan</strong>g</strong>-<strong>un<strong>dan</strong>g</strong> Islam, sebagai tambahan<br />
kepada <strong>Un<strong>dan</strong>g</strong>-<strong>un<strong>dan</strong>g</strong> Keluarga Islam seperti muamalat <strong>dan</strong> takaful;<br />
8. trend ke arah penyeragaman <strong>un<strong>dan</strong>g</strong>-<strong>un<strong>dan</strong>g</strong> Islam; <strong>dan</strong><br />
9. kriteria <strong>dan</strong> prosedur kemasukan dalam praktis di Mahkamah <strong>Syariah</strong> antara negeri.<br />
Semua kenyataan <strong>dan</strong> keperluan adalah sehingga Disember 2007 <strong>dan</strong> mencerminkan keadaan<br />
semasa dalam industri. Walau bagaimanapun, kenyataan berhubung Certificate in Legal Practice<br />
merupakan ca<strong>dan</strong>gan hasil perbincangan ahli panel <strong>dan</strong> tidak boleh dilihat sebagai pan<strong>dan</strong>gan<br />
<strong>dan</strong> polisi Lembaga Kelayakan Profesion Per<strong>un<strong>dan</strong>g</strong>an.<br />
<strong>Standard</strong> <strong>Program</strong> ini tidak menunjukkan kesemua penamaan kelayakan dalam <strong>un<strong>dan</strong>g</strong>-<strong>un<strong>dan</strong>g</strong><br />
<strong>dan</strong> <strong>Syariah</strong>. Walau bagaimanapun, ia menyatakan penamaan yang umum seperti Sarjana Muda<br />
<strong>Un<strong>dan</strong>g</strong>-<strong>Un<strong>dan</strong>g</strong> yang membentuk amalan semasa. Ini harus merangkumi LL.B., Sarjana Muda<br />
Pengajian Per<strong>un<strong>dan</strong>g</strong>an <strong>dan</strong> Sarjana Muda Jurisprudens.
MATLAMAT DAN OBJEKTIF<br />
Diploma <strong>Syariah</strong><br />
Objektif program adalah untuk melahirkan pelajar yang:<br />

memahami kaedah penyelesaian permasalahan <strong>Syariah</strong> <strong>dan</strong> per<strong>un<strong>dan</strong>g</strong>an dalam masyarakat<br />
<strong>dan</strong> isu-isu semasa;<br />
mengetahui peluang dalam bi<strong>dan</strong>g <strong>dan</strong> kerjaya yang berkaitan pentadbiran <strong>dan</strong> per<strong>un<strong>dan</strong>g</strong>an<br />
Islam bagi memenuhi keperluan sumber manusia negara, industri <strong>dan</strong> masyarakat; <strong>dan</strong><br />
mengetahui etika profesional <strong>dan</strong> berakhlak mulia.<br />
Sarjana Muda <strong>Un<strong>dan</strong>g</strong>-<strong>un<strong>dan</strong>g</strong><br />
Objektif program [program tiga (3) tahun] adalah untuk:<br />
1. melengkapi pelajar dengan pemahaman asas prinsip, konsep <strong>dan</strong> teori per<strong>un<strong>dan</strong>g</strong>an, <strong>dan</strong><br />
kemampuan untuk mengaplikasikannya secara praktikal;<br />
2. menyemai kemahiran kritikal, analitikal <strong>dan</strong> penyelesaian masalah;<br />
3. memastikan pelajar mempunyai unsur-unsur yang diperlukan untuk kemahiran praktikal<br />
termasuk kemahiran berkomunikasi (bertulis <strong>dan</strong> lisan), berunding, kaunseling <strong>dan</strong> interviu<br />
klien, ‘mooting’ <strong>dan</strong> penyelidikan;<br />
4. menimbulkan kesedaran tentang tanggungjawab sosial <strong>dan</strong> moral pelajar;<br />
5. menimbulkan kesedaran tentang standard amalan <strong>dan</strong> etika profesion per<strong>un<strong>dan</strong>g</strong>an; <strong>dan</strong><br />
6. mendedahkan pelajar kepada persekitaran kerja yang berkaitan dengan <strong>un<strong>dan</strong>g</strong>-<strong>un<strong>dan</strong>g</strong><br />
melalui penempatan pelajar (seperti mahkamah, firma guaman, sektor korporat <strong>dan</strong> pusat<br />
bantuan per<strong>un<strong>dan</strong>g</strong>an).<br />
Sebagai tambahan kepada objektif di atas, tahun profesional (juga dikenali sebagai tahun akhir)<br />
Sarjana Muda <strong>Un<strong>dan</strong>g</strong>-<strong>un<strong>dan</strong>g</strong> adalah untuk:<br />
1. menyediakan pelajar bagi memenuhi jangkaan klien, profesion <strong>dan</strong> masyarakat;<br />
2. melatih pelajar dalam kemahiran per<strong>un<strong>dan</strong>g</strong>an praktikal seperti mendraf pembelaan, dokumen<br />
kontraktual, kemahiran guaman, perundingan <strong>dan</strong> kemahiran yang diperlukan bagi resolusi<br />
alternatif kepada sesuatu pertikaian;<br />
3. memastikan pelajar mempunyai kecekapan <strong>dan</strong> kemahiran dalam proses mahkamah selaras<br />
dengan amalan, peraturan <strong>dan</strong> prosedur mahkamah, sama ada jenayah, Sivil atau bi<strong>dan</strong>g<br />
lain;<br />
4. melengkapkan pelajar dengan kesedaran tentang tanggungjawab sosial <strong>dan</strong> moral mereka;<br />
<strong>dan</strong><br />
5. memastikan pelajar dapat menggunakan Bahasa Malaysia <strong>dan</strong> Bahasa Inggeris dengan<br />
cekap sama ada secara bertulis atau lisan.<br />

Objektif program adalah untuk:<br />

kontraktual, kemahiran guaman, perundingan <strong>dan</strong> kemahiran yang diperlukan bagi resolusi<br />
alternatif kepada sesuatu pertikaian;<br />
memastikan calon mempunyai kecekapan <strong>dan</strong> kemahiran dalam proses mahkamah selaras<br />
dengan amalan, peraturan <strong>dan</strong> prosedur mahkamah, sama ada jenayah, Sivil atau bi<strong>dan</strong>g<br />
lain;<br />
menyemai nilai etika <strong>dan</strong> profesionalisme dalam diri pelajar, selaras dengan Akta Profesion<br />
Per<strong>un<strong>dan</strong>g</strong>an 1976;<br />
melengkapi calon dengan kesedaran tentang tanggungjawab sosial <strong>dan</strong> moral mereka; <strong>dan</strong><br />
memastikan calon dapat menggunakan Bahasa Malaysia <strong>dan</strong> Bahasa Inggeris dengan cekap<br />
sama ada secara bertulis atau lisan.<br />
Sarjana Muda <strong>Syariah</strong><br />
Objektif program adalah untuk melahirkan pelajar yang:<br />
1. menguasai bi<strong>dan</strong>g <strong>Syariah</strong> <strong>dan</strong> per<strong>un<strong>dan</strong>g</strong>an Islam secara teori <strong>dan</strong> praktikal dari sumbernya<br />
yang asal;<br />
2. mendapat pendedahan asas per<strong>un<strong>dan</strong>g</strong>an Sivil;<br />
3. memiliki kemahiran menyelesaikan permasalahan <strong>Syariah</strong> <strong>dan</strong> per<strong>un<strong>dan</strong>g</strong>an dalam masyarakat<br />
<strong>dan</strong> isu semasa;<br />
4. mendapat pendedahan kemahiran praktikal guaman <strong>dan</strong> kehakiman Syarie;<br />
5. memenuhi keperluan kerjaya dalam pentadbiran <strong>dan</strong> per<strong>un<strong>dan</strong>g</strong>an Islam yang memenuhi<br />
keperluan modal insan negara, industri <strong>dan</strong> masyarakat secara profesional; <strong>dan</strong><br />
6. mematuhi etika profesional <strong>dan</strong> berakhlak mulia.<br />
Sarjana Muda <strong>Un<strong>dan</strong>g</strong>-<strong>Un<strong>dan</strong>g</strong> (<strong>Syariah</strong> <strong>dan</strong> Sivil)<br />
Objektif program adalah untuk melahirkan pelajar yang:<br />
1. menguasai bi<strong>dan</strong>g <strong>Syariah</strong> <strong>dan</strong> per<strong>un<strong>dan</strong>g</strong>an Islam secara teori <strong>dan</strong> praktikal dari sumbernya<br />
yang asal;<br />
2. menguasai bi<strong>dan</strong>g per<strong>un<strong>dan</strong>g</strong>an Sivil secara teori <strong>dan</strong> praktikal;<br />
3. memiliki kemahiran menyelesaikan permasalahan <strong>Syariah</strong>, per<strong>un<strong>dan</strong>g</strong>an Islam <strong>dan</strong> Sivil dalam<br />
masyarakat <strong>dan</strong> isu semasa;<br />
4. mendapat pendedahan kemahiran praktikal guaman <strong>dan</strong> kehakiman <strong>Syariah</strong> <strong>dan</strong> Sivil;<br />
5. memenuhi keperluan kerjaya dalam pentadbiran <strong>dan</strong> per<strong>un<strong>dan</strong>g</strong>an Islam <strong>dan</strong> Sivil yang<br />

REKA BENTUK PROGRAM<br />
Pengenalan<br />
Keperluan khusus bagi setiap tahap adalah seperti berikut. Walau bagaimanapun, sebagai<br />
panduan umum, keperluan berikut perlu dipertimbang:<br />
i. sarjana muda asas tanpa tahun profesional (bersamaan dengan CLP) akan diajar selama tiga<br />
(3) tahun paling minimum;<br />
ii. bagi program dengan tahun profesional, minimum empat (4) tahun pengajian diperlukan<br />
dengan ca<strong>dan</strong>gan minimum 140 kredit;<br />
iii. pelajar dengan pindahan <strong>dan</strong> pengecualian kredit boleh mengurangkan jumlah semester<br />

Pengenalan<br />
Keperluan khusus bagi setiap tahap dinyatakan di bawah. Walau bagaimanapun, sebagai panduan<br />

Foreword<br />
The Malaysian Qualifications Agency (<strong>MQA</strong>), as the sole national higher education quality<br />
assurance organisation, facilitates quality through the development of quality assurance<br />
documents. These documents are Malaysian Qualifications Framework (MQF), Codes of<br />
Practice, The Guidelines to Good Practices and <strong>Program</strong>me <strong>Standard</strong>s, all of which must be<br />
used as a reference point in the conduct of a programme of study in Malaysia.<br />
<strong>Program</strong>me <strong>Standard</strong>s are developed to provide specific guidelines to providers in a particular<br />
field or course of study so as to fulfil the MQF requirements. These guidelines, if followed<br />
closely and wisely, enable the development and sustenance of quality programmes in Malaysia,<br />
consequently improving the quality of graduates and their employability and mobility.<br />
The <strong>Program</strong>me <strong>Standard</strong>s: Law and <strong>Syariah</strong> is formulated to promote the development of<br />
academic programmes in the field of Law and <strong>Syariah</strong> from diploma to the doctoral levels. It<br />
includes specific guidelines on programme aims and objectives, programme learning outcomes,<br />
programme design (including a proposed programme structure), admission criteria, student<br />
assessment, academic staff, educational resources and continuous quality improvement.<br />
The panel of experts involved in the development of this <strong>Program</strong>me <strong>Standard</strong>s represent<br />
various stakeholders including the government and private agencies, and higher education<br />
providers (HEPs). To ensure greater acceptance of the document, a larger stakeholder workshop<br />
was held on 6 th December 2007 where the draft was presented and views consolidated into<br />
this final document.<br />

PROGRAMME STANDARDS: LAW AND SYARIAH<br />
INTRODUCTION<br />
This <strong>Program</strong>me <strong>Standard</strong>s: Law and <strong>Syariah</strong>, herein referred to as the <strong>Standard</strong>s, is aimed at<br />
providing good practices for the conduct of and to safeguard the integrity of all the law and <strong>Syariah</strong><br />
programmes.<br />
It is established by a focus group consisting of practising advocates and solicitors, academic<br />
experts from both the Civil and <strong>Syariah</strong> professions and related government bodies or agencies.<br />
This document which now becomes the nationally agreed standard for law and <strong>Syariah</strong> was put<br />
through a stakeholder consultative workshop.<br />
The <strong>Standard</strong>s recognises that approaches and mechanisms in quality assurance of higher<br />
education are often evolving; hence it adopts a developmental, non-prescriptive and non-exhaustive<br />
approach. It sets out general principles that are of interest to a range of stakeholders and should<br />
not be seen as an instruction manual, as it does not provide detailed accounts of approaches and<br />
procedures.<br />
Higher education providers (HEPs), academic staff and students should find this document a<br />
useful resource in enhancing the quality of the law and <strong>Syariah</strong> programmes. Needless to say,<br />
the concept of quality rests on the principles of peer evaluation and defensibility. Thus, providers<br />
using this document must be aware of the tensions within the industry and the demands of the<br />
stakeholders to provide for the best learning and teaching environment.<br />
The development of curriculum should also take into cognisance the many developments that<br />
greatly influence the promulgation of new laws and amendments to existing ones as well as<br />
the implementation and administration of laws in both the <strong>Syariah</strong> and the Civil systems. The<br />
changes undoubtedly have implications on the design and delivery of the curriculum in both law<br />
and <strong>Syariah</strong> education. Some examples of these important developments locally, nationally and<br />
globally include:<br />

the need for conducting alternative dispute resolution;<br />
the trend towards globalisation and liberalisation which requires greater understanding of<br />
matters such as commercial law, international corporate finance, trade and shipping as well<br />
as the need for technological skills, life-long learning and clear standards of practice that are<br />
congruent with international standards;<br />
the use of Bahasa Malaysia in both Civil and <strong>Syariah</strong> courts;<br />
increasing use of ICT in the provision of legal skills and practice. For example, online discussion<br />
and negotiation, online client portals, online mediation, electronic filing of documents and the<br />
creation of e-courts;<br />

the emergence of new areas in law such as cyber law, bio-valley issues (patent, genetics,<br />
bioethics), privacy, terrorism, mutual legal assistance, extradition, money laundering,<br />
international trade and human rights;<br />
the increasing international collaboration and harmonisation of laws and international<br />
conventions;<br />
increasing interest and development in Islamic law, in addition to Islamic Family Law such<br />
as muamalat and takaful;<br />
the trend towards uniformity of Islamic law; and<br />
the criteria and procedure for admission into practice at the <strong>Syariah</strong> Courts between the<br />
states.<br />
All statements and requirements are as at December 2007 and reflect the current standing in the<br />
industry. However the statements with regards to the Certificate in Legal Practice are suggestions<br />
as a result of the Panel discussion and reflection cannot be seen as a truth of the views and<br />
policies of the Legal Profession Qualifying Board.<br />
The standards do not indicate all possible nomenclatures in law and <strong>Syariah</strong>. They however indicate<br />
the generic ones such as Bachelors of Laws, which form the current practices should include the<br />
traditional LL.B., Bachelors of Legal Studies and Bachelors of Jurisprudence.
AIMS AND OBJECTIVES<br />
Diploma in <strong>Syariah</strong><br />
The objectives of the programme are to ensure students:<br />

understand the principle of <strong>Syariah</strong> and Islamic law from its authentic sources;<br />
understand <strong>Syariah</strong> and law problem solving method in society and current issues;<br />
aware of field and career opportunities related to Islamic law and administration to fulfill<br />
manpower needs of the nation, industry and society; and<br />
aware of professional ethics and moral obligations.<br />
Bachelors of Laws<br />
The objectives of the programme [three (3) year programme] are to:<br />
1. equip students with the understanding of fundamental legal principles, concepts and theories<br />
and to have the ability to apply these in practical situation;<br />
2. instil student with critical, analytical and problem-solving skills;<br />
3. ensure students have the necessary elements of practical skills including communication skills<br />
(written and oral), negotiation skills, client counseling and interview, mooting and research;<br />
4. create awareness of the students’ social and moral obligations;<br />
5. create awareness of the practice and etiquette of standards for the legal profession; and<br />
6. expose the students to law-related working environments via student placement (such as the<br />
courts, law firms, corporate sector and legal aid centres).<br />
In addition to the above, the professional year of a Bachelors of Laws aims to:<br />
1. prepare students to meet the expectation of clients, the profession and society;<br />
2. train students in the practical legal skills such as in drafting of pleadings, drafting of contractual<br />
documents, advocacy skills, negotiation skills and skills necessary for alternative dispute<br />
resolution;<br />
3. ensure students have competency and proficiency in the court processes in accor<strong>dan</strong>ce with<br />
the courts practices, rules and procedures whether in criminal, Civil or other areas;<br />
4. equip students with awareness of their social and moral obligations and responsibilities; and<br />
5. ensure students are able to use Bahasa Malaysia and English proficiently, whether written or<br />
oral.<br />
Certificate in Legal Practice<br />
The aims of the programme are to:<br />
1. prepare candidates to meet the expectation of clients, the profession and society;<br />
2. train candidates in the practical legal skills such as in drafting of pleadings, drafting of<br />
contractual documents, advocacy skills, negotiation skills, and skills necessary for alternative<br />
dispute resolution;<br />

Preamble<br />
The specific requirements for each level are indicated below. However as a general guide, the<br />
following should be considered:<br />
i. a basic Bachelors without the professional year (equivalent to the CLP) shall be taught over a<br />
minimum of three (3) years full-time;<br />
ii. for programmes with the professional years, a minimum of four (4) years of study is required<br />
with a minimum recommended credits of 140;<br />
iii. students with credit transfers and exemptions may do less semesters by virtue of the exemptions<br />
or transfer subjected to credit transfer policies in place at the time; and<br />

ACADEMIC STAFF<br />
Preamble<br />
The specific requirement for each level is as indicated below. However as a general guide, it is<br />
important to note that:<br />
i. the academic leadership of the school/faculty/department should be with a person with<br />
Doctorate with three (3) years of work experience or Masters with seven (7) years of work<br />
experience in related field;<br />
ii. a faculty should have a minimum of 60% full-time staff who form the core academic resource<br />
of the school; and<br />
iii. where applicable a sufficient number of teacher-practitioner should be appointed.<br />
Diploma in <strong>Syariah</strong><br />

Bachelors (Academic Years)<br />
The higher education providers (HEPs) should demonstrate that they are striving to achieve the<br />
following:<br />
1. all academic staff shall have a minimum of Masters in the relevant fields or a Bachelors of<br />
Laws with ten (10) years of professional legal experience;<br />
2. 30% of academic staff should have a Doctorate;<br />
3. 30% academic staff should have professional qualification (chambered and called to the Bar<br />
or equivalent);<br />
4. academic staff should have at least one (1) publication or conference paper per year; and<br />
5. ratio academic staff to student is 1:25.<br />
For programme that has the professional years (professional year) or Certificate in Legal Practice<br />
(CLP):<br />
1. 20% of academic staff with Doctorate or a Masters with a minimum of five (5) years work<br />
experience in the related area;<br />
2. Masters or a Bachelors with at least CLP or equivalent and five (5) years of work experience;<br />
and<br />

Note:<br />
Whilst it is noted the HEPs should have full-time lecturers who are advocates and solicitors, it is<br />
important that there are part-time lecturers who are in active practice with at least seven (7) years<br />
experience.<br />

EDUCATIONAL RESOURCES<br />

The higher education provider (HEP) is required to have the following:<br />

Access to an appropriate collection of books, reports, journals, audiovisual and electronic<br />
resources;<br />
Computer laboratories with facilities for word processing, spreadsheet, database, and<br />
presentation tasks, Internet connection, and online-searching of databases; and<br />
Moot court.<br />
CONTINUOUS IMPROVEMENT<br />
For all Levels (Diploma – Doctorate)<br />
The higher education provider (HEP) is expected to provide evidence of ability to keep pace with<br />
changes in the field and requirements of stakeholders. These may be demonstrated by but not<br />
limited to:<br />
1. curriculum review, conducted at least once every in cycle, for example, once in three (3) to five<br />
(5) years;<br />
2. use of external-independent verification in assessment processes, such as the appointment of<br />
External Examiners;<br />
3. links with professional bodies and industry;<br />
4. continuous review of industrial attachment practices and record;<br />
5. dialogue sessions with stakeholders at least once every two (2) years;<br />
6. active participation of staff at relevant conferences, seminars, workshops and short courses<br />
and publications in refereed journals;<br />
7. presentations by invited speakers; and<br />
8. organisation of conferences, seminars and workshops such as joint lectures/seminar/talk with<br />
the professional bodies and industry.
