PROGRAMME DESIGN Preamble The specific requirements for each level are indicated below. However as a general guide, the following should be considered: i. a basic Bachelors without the professional year (equivalent to the CLP) shall be taught over a minimum of three (3) years full-time; ii. for programmes with the professional years, a minimum of four (4) years of study is required with a minimum recommended credits of 140; iii. students with credit transfers and exemptions may do less semesters by virtue of the exemptions or transfer subjected to credit transfer policies in place at the time; and iv. the indicated credits are the minimum benchmarks. Institutions may offer higher credits in accordance to the needs of the programmes and specialisation. Diploma in Syariah 1. 2. 14 MQF Minimum Graduating Credits – 90 Programme Component: a) University Requirements: 10-20% b) Faculty Requirements: 80-90% of which: i. Core: 75-85% (This must include the following courses): • Usul Fiqh (Islamic Jurisprudence) • Qawaid Fiqh (Islamic Legal Maxims) • Fiqh Munakahat (Islamic Family Law) • Fiqh Jenayat (Islamic Criminal Law) • Fiqh Muamalat (Islamic Muamalat) • Malaysian Legal System ii. Elective: 2-5% iii. Student Placement: 1-5% (compulsory) Bachelors of Laws 1. MQF Minimum Graduating Credits – 120 2. The Bachelors of Laws shall stress: • Legal methodology (research, critical thinking, reasoning and decision making) • Use of information technology (should be incorporated in all courses) • Problem-based learning
• • • • Public speaking Comparative analysis of law and practice Mooting and mock trials Student placements All law programmes shall adopt the following guidelines: i. ii. Note: 1. 2. iii. Compulsory (15-25%) • • University: Bahasa Malaysia, English, Moral/Islamic Studies Programme: public speaking, mooting, student placement Core (42-55%) This must include the following courses: Course Minimum Credits Malaysian Legal System 3 Malaysian Islamic Legal System 3 Law of Contract 6 Constitutional Law 6 Criminal Law 6 Law of Tort 6 Land Law 6 Equity and Trusts 6 All core courses shall be taught only during long semester. The courses listed above are the minimum, higher education providers (HEPs) may opt to provide up to 55% with the inclusion of other core papers which shall be read by all students studying at the institution. This will encourage the development of institutional niche in specific areas. Electives (30-33%) The courses (either as a taught course or project paper) may include but are not limited to the following: • Intellectual Property Law • Law and Medicine • Law and Environment • Law and Society • Conflict of Laws • Evidence 15
