vi) the proceeds <strong>of</strong> the trade are used exclusively for elephant c<strong>on</strong>servati<strong>on</strong> and community<br />

c<strong>on</strong>servati<strong>on</strong> and development programmes with<strong>in</strong> or adjacent to the elephant range; and<br />

vii) the additi<strong>on</strong>al quantities specified <strong>in</strong> paragraph g) v) above shall be traded <strong>on</strong>ly after the<br />

Stand<strong>in</strong>g<br />

Committee has agreed that the above c<strong>on</strong>diti<strong>on</strong>s have been met; and<br />

h) no further proposals to allow trade <strong>in</strong> elephant ivory from populati<strong>on</strong>s already <strong>in</strong> Appendix II<br />

shall be<br />

submitted to the C<strong>on</strong>ference <strong>of</strong> the Parties for the period from CoP14 and end<strong>in</strong>g n<strong>in</strong>e years from<br />

the<br />

date <strong>of</strong> the s<strong>in</strong>gle sale <strong>of</strong> ivory that is to take place <strong>in</strong> accordance with provisi<strong>on</strong>s <strong>in</strong> paragraphs g)<br />

i),<br />

g) ii), g) iii), g) vi) and g) vii). In additi<strong>on</strong> such further proposals shall be dealt with <strong>in</strong> accordance<br />

with<br />

Decisi<strong>on</strong>s 14.77 and 14.78.<br />

On a proposal from the Secretariat, the Stand<strong>in</strong>g Committee can decide to cause this trade to<br />

cease<br />

partially or completely <strong>in</strong> the event <strong>of</strong> n<strong>on</strong>-compliance by export<strong>in</strong>g or import<strong>in</strong>g countries, or <strong>in</strong><br />

the case<br />

<strong>of</strong> proven detrimental impacts <strong>of</strong> the trade <strong>on</strong> other elephant populati<strong>on</strong>s.<br />

All other specimens shall be deemed to be specimens <strong>of</strong> species <strong>in</strong>cluded <strong>in</strong> Appendix I and the<br />

trade <strong>in</strong><br />

them shall be regulated accord<strong>in</strong>gly.<br />

6 Cactaceae spp. Artificially propagated specimens <strong>of</strong> the follow<strong>in</strong>g hybrids and/or cultivars are<br />

not<br />

subject to the provisi<strong>on</strong>s <strong>of</strong> the <str<strong>on</strong>g>C<strong>on</strong>venti<strong>on</strong></str<strong>on</strong>g>:<br />

– Hatiora x graeseri<br />

– Schlumbergera x buckleyi<br />

– Schlumbergera russelliana x Schlumbergera truncata<br />

– Schlumbergera orssichiana x Schlumbergera truncata<br />

– Schlumbergera opuntioides x Schlumbergera truncata<br />

– Schlumbergera truncata (cultivars)<br />

– Cactaceae spp. colour mutants lack<strong>in</strong>g chlorophyll, grafted <strong>on</strong> the follow<strong>in</strong>g graft<strong>in</strong>g stocks:<br />

Harrisia<br />

'Jusbertii', Hylocereus trig<strong>on</strong>us or Hylocereus undatus<br />

– Opuntia microdasys (cultivars).<br />

7 Orchidaceae spp. Artificially propagated hybrids <strong>of</strong> the follow<strong>in</strong>g genera are not subject to the<br />

provisi<strong>on</strong>s<br />

<strong>of</strong> the <str<strong>on</strong>g>C<strong>on</strong>venti<strong>on</strong></str<strong>on</strong>g>, if c<strong>on</strong>diti<strong>on</strong>s, as <strong>in</strong>dicated under a) and b), are met: Cymbidium, Dendrobium,<br />

Phalaenopsis and Vanda:<br />

a) Specimens are readily recognizable as artificially propagated and do not show any signs <strong>of</strong><br />

hav<strong>in</strong>g<br />

been collected <strong>in</strong> the wild such as mechanical damage or str<strong>on</strong>g dehydrati<strong>on</strong> result<strong>in</strong>g from<br />

collecti<strong>on</strong>,<br />

irregular growth and heterogeneous size and shape with<strong>in</strong> a tax<strong>on</strong> and shipment, algae or other<br />

epiphyllous organisms adher<strong>in</strong>g to leaves, or damage by <strong>in</strong>sects or other pests; and<br />

b) i) when shipped <strong>in</strong> n<strong>on</strong>-flower<strong>in</strong>g state, the specimens must be traded <strong>in</strong> shipments c<strong>on</strong>sist<strong>in</strong>g<br />

<strong>of</strong><br />

<strong>in</strong>dividual c<strong>on</strong>ta<strong>in</strong>ers (such as cart<strong>on</strong>s, boxes, crates or <strong>in</strong>dividual shelves <strong>of</strong> CC-c<strong>on</strong>ta<strong>in</strong>ers) each<br />

c<strong>on</strong>ta<strong>in</strong><strong>in</strong>g 20 or more plants <strong>of</strong> the same hybrid; the plants with<strong>in</strong> each c<strong>on</strong>ta<strong>in</strong>er must exhibit a<br />

high degree <strong>of</strong> uniformity and health<strong>in</strong>ess; and the shipment must be accompanied by<br />

documentati<strong>on</strong>, such as an <strong>in</strong>voice, which clearly states the number <strong>of</strong> plants <strong>of</strong> each hybrid; or<br />

ii) when shipped <strong>in</strong> flower<strong>in</strong>g state, with at least <strong>on</strong>e fully open flower per specimen, no m<strong>in</strong>imum<br />

number <strong>of</strong> specimens per shipment is required but specimens must be pr<strong>of</strong>essi<strong>on</strong>ally processed
