della prima metà del Settecento. Il corpo di sezione tronco conica a<br />

incernierato e manico in legno di noce con ricciolo. Esempio di una<br />
parte della produzione inglese di questo periodo che con le superfici<br />
lisce senza decorazione rieccheggiava uno stile ed una forma in<br />
contrasto con gli elementi francesi importati nella cultura inglese<br />

adattati a candelabri La parte inferiore è un candeliere a base<br />
quadrata di manifattura francese fine XVIII Secolo con il fusto a<br />
colonna svasata, baccellato a sbalzo e rifinito a cesello poggiante<br />
su base a cui è congiunto da un nodo con fogliette. Il bocciolo<br />
è realizzato con un lungo vaso su cui sono applicati festoni a<br />
sbalzo con frutta. La parte superiore è il risultato di un’aggiunta<br />
realizzata a Roma per modificare il candeliere in candelabro. Opera<br />
di pregevolissima fattura realizzata nella bottega di Pietro Paolo<br />
Spagna (1817-1861 riferimento C.G.Bulgari “Argentieri, Gemmari<br />
e Orafi romani”). Figlio di Giuseppe III e Anna MAria Reale, nasce<br />
a Roma nel 1793. Con il padre acquisiscono l’eredità della Bottega,<br />
dei disegni e dei bozzetti di Giuseppe Valadier e dimorano nella casa<br />
Valadier fino al 1860. La modifica si articola in tre bracci mistilinei<br />

bocciolo portacandela, nella perfezione della fusione tratti della<br />

che verrà considerato responsabile di qualunque danno da lui causato<br />
all’<strong>orologi</strong>o o al movimento. Il nostro esperto di <strong>orologi</strong> sarà disponibile<br />
a fornire ogni informazione o delucidazione sugli <strong>orologi</strong> esposti.<br />
Condition Reports<br />
Dettagliati rapporti sullo stato di conservazione dei lotti (“condition<br />
report”) sono disponibili dietro richiesta specifica fatta al reparto. Il<br />
condition report riporta le seguenti caratteristiche: Stato di<br />
funzionamento dell’<strong>orologi</strong>o al momento della catalogazione<br />
Suggerimenti su possibili restauri da effettuare.<br />
<strong>Bloomsbury</strong> Auctions non può garantire il perfetto funzionamento<br />
dell’<strong>orologi</strong>o al momento dell’acquisto. Tutti gli <strong>orologi</strong> sono stati<br />
revisionati rimuovendo il fondello della cassa: per questa ragione non<br />
possiamo garantire che gli <strong>orologi</strong> “water resistant” rimangano tali.<br />

NORMATIVA IN MATERIA DI ESPORTAZIONE<br />

Esportazione di materiali derivati da<br />
specie protette<br />
I potenziali acquirenti devono essere informati che in alcuni paese è<br />
vietata l’importazione di alcuni materiali quali avorio, tartaruga,<br />
coccodrillo, ossi di balena, corni di rinoceronte, scheletri di balena,<br />
alcune specie di corallo e palissandro brasiliano; in altri paesi, invece,<br />
l’importazione di lotti contenenti i suddetti materiali è possibile previo<br />
rilascio da parte del Ministero dell’Ambiente e della Tutela del<br />
Territorio di una licenza CITES. E’ dunque consigliato al potenziale<br />
acquirente di informarsi circa le leggi di importazione di detti<br />
materiali presso il Paese di destinazione prima di partecipare all’asta.<br />
<strong>Bloomsbury</strong> Auctions non annullerà la vendita già effettuata qualora<br />
il cliente compratore non potesse importare od esportare lotti<br />
contenenti materiali provenienti da specie protette.<br />
Si rende noto che molti <strong>orologi</strong> illustrati nel presente catalogo<br />
possono essere caratterizzati da cinturini realizzati da materiali<br />
provenienti da specie protette. Anche in questo caso, sarà necessario<br />

Rolex<br />
A causa delle locali norme di importazione, <strong>Bloomsbury</strong> Auctions non<br />
potrà spedire ed effettuare consegne della marca Corum e Rolex negli<br />
Stati Uniti.Generalmente, un compratore ha la facoltà di importare<br />
personalmente sono un <strong>orologi</strong>o negli USA.<br />
Si rende noto che l’impossibilità di importare tali oggetti negli USA<br />
non costituisce motivo per l’annullamento della vendita.<br />

Miglioramenti<br />
Il potenziale acquirente deve essere informato del fatto che molte pietre preziose possono essere state<br />
trattate attraverso svariati metodi al fine di migliorarne l’aspetto, sia in termini di colore che di<br />
trasparenza. I rubini e gli zaffiri, per esempio, vengono comunemente trattati con metodi di<br />
riscaldamento, gli smeraldi vengono migliorati grazie a degli olii trasparenti o delle resine speciali,<br />
mentre la giadaite viene comunemente scolorita. Questi trattamenti – inclusi irradiamento e<br />
verniciamento – vengono generalmente accettati dagli operatori del settore perché considerate delle<br />
procedure comuni. Sebbene molte di queste metodiche siano considerate permanenti, può verificarsi<br />
che alcune pietre preziose trattate con olii necessitino di ripetere la procedura. Queste metodologie<br />
influiscono sul valore di mercato delle pietre preziose e <strong>Bloomsbury</strong> Auctions presume che tutte le pietre<br />
potrebbero essere state migliorate, a meno che non venga riportato diversamente in catalogo.<br />
<strong>Bloomsbury</strong> Auctions ha siglato una partnership con IGI, Istituto Gemmologico Italiano. Qualora lo<br />
ritenesse opportuno, <strong>Bloomsbury</strong> Auctions richiederà un certificato gemmologico ad esclusivo uso<br />
interno per una descrizione più accurata ed esatta di diamanti, pietre preziose, pietre dure o perle<br />
contenute negli oggetti posti in asta. I potenziali acquirenti possono richiedere un certificato<br />
gemmologico che attesti la qualità dell’oggetto acquistato; tale servizio è a pagamento. Per informazioni,<br />
si può contattare il Reparto Gioielli, Orologi e Argenti. Non è comunque possibile ottenere un certificato<br />
per tutte le pietre offerte in asta.<br />
In assenza di un rapporto gemmologico, non sarà possibile per <strong>Bloomsbury</strong> Auctions fornire commenti su<br />
ogni singola pietra che compone un lotto, né indicarne eventuali trattamenti e miglioramenti.<br />
Le descrizioni contenute in catalogo e i condition reports forniti da <strong>Bloomsbury</strong> Auctions, fanno<br />
riferimento alle linee guida riportate nel “Blue Book” del CIBJO (International Confederation of Jewellery).<br />

b) Con l’indicazione di un punzone , bollo o marchio ritenuto autentico<br />
c) “Firmato da”: l’oggetto riporta una firma ritenuta autentica<br />
d) “Attribuito a”: l’oggetto è stato prodotto da un <strong>gioielli</strong>ere sebbene non risulti una firma evidente<br />

Authentication<br />
All watch movements have been expected by <strong>Bloomsbury</strong> Auctions<br />
watchmaker and specialists and we have verified all inventory and<br />
movement numbers.<br />
For the information or potential bidders, all inventory and movement<br />
numbers are printed in the catalogue description for the relevant lot.<br />
Inspection of movements<br />
Clients are requested NOT to remove the backs of watches by<br />
themselves to examine movements during the public view. The removal<br />
of watch backs and inspection of watch movements may only be carried<br />
out under the supervision of <strong>Bloomsbury</strong> qualified watchmaker, or<br />
relevant watch specialist. Clients should also be aware that they will be<br />
held liable for any damage and subsequent repairs so caused to watches<br />
and their movements. Please ask members of <strong>Bloomsbury</strong> staff for<br />
assistance in viewing watch movements.<br />
Condition Reports<br />
Detailed condition reports for all lots are available upon direct request to<br />
the department. <strong>Bloomsbury</strong> condition report will identify whether a<br />
watch functions at the time of cataloguing and suggest possible, but not<br />
comprehensive, restoration work that may need to be carried out for the<br />
watch to function properly.<br />
<strong>Bloomsbury</strong> Auctions does not guarantee that any watch will function<br />
when purchased.<br />
As we have examined all watch movements by removing the case backs,<br />
we cannot garantee that water resistant watches will remain water<br />
resistant following purchase from us.<br />
<strong>Bloomsbury</strong> Auctions reccommend that any watches purchased from us<br />
is subsequently overhauled by a competent watchmaker to ensure proper<br />
functioning.<br />
REGARDING EXPORT AND IMPORT RULES<br />

like ivory, tortoiseshell, crocodile skin, rhinoceros horn, whale bone and<br />

<strong>Bloomsbury</strong> Auctions does advice to prospective buyers to inform<br />
themselves about these specific materials importation laws before<br />
bidding.<br />
<strong>Bloomsbury</strong> Auctions will not cancel the sale if the buyer will not be able<br />
to import or export lots made by protected species materials.<br />
Most of the illustrated watches included in the catalogue could be have<br />
bands made with protected and endangere species materials (i.e. crocodile)<br />
that will not have the permit to be exported without a CITES permit.<br />
Importation of Corum and Rolex in the<br />
United States<br />
<strong>Bloomsbury</strong> Auctions is not allowed to ship Corum and Rolex watches<br />

Prospective bidders should be aware that many coloured gems have been historically treated by a<br />
variety of methods to improve their appearance. Rubies and sapphires are routinely heat treated,<br />
emerads are enhanced through the use of transparent oils and resins, and jadeite is routinely stained.<br />
These treatments, and other including irradiation and coating, are generally accepted by the jewellery<br />
trade as standard practice. Although most treatments are considered to be permanent, those<br />
gemstones that have been oiled may need to be re-trated to maintain their appearance. Any such<br />
treatments affect the market value of coloured gemstones and <strong>Bloomsbury</strong> Auctions assumes that<br />
all gemstones, unless otherwise stated in the catalogue, may have been enhanced. <strong>Bloomsbury</strong><br />
Auctions signed an agreement with IGI, Istituto Gemmologico Italiano (Italian Gemmological<br />
Institute). <strong>Bloomsbury</strong> Auctions may obtain a gemmological report for internal use only if necessary,<br />
when more detailed descriptions about diamond, gemstones, hard stones or pearls is needed.<br />
Prospective bidders could ask for gemmological certificate of bought lots: this service ha sto be prepaid.<br />

1. <strong>Bloomsbury</strong> Auctions Italia S.r.l.,società unipersonale con sede legale<br />
in Roma, Via Giosué Carducci n. 4 e sede operativa in Roma, Piazza SS.<br />
Apostoli 80, Iscrizione al Registro delle Imprese di Roma e Codice Fiscale<br />
n. 09479031008, R.E.A. RM-1165993, Capitale Sociale Euro 105.000 i.v.<br />
sottoposta ad attività di direzione e coordinamento, ai sensi dell’articolo<br />
2497bis del Codice Civile da parte della società <strong>Bloomsbury</strong> Auctions<br />
Limited con sede in Londra, Gran Bretagna (qui di seguito definita<br />
“<strong>Bloomsbury</strong>”), nello svolgimento della sua attività di vendita agisce quale<br />
mandataria in esclusiva in nome proprio e per conto di ciascun Venditore<br />
il cui nome viene trascritto negli appositi registri di Pubblica Sicurezza<br />
tenuti presso <strong>Bloomsbury</strong>. La vendita deve considerarsi intervenuta tra<br />
il Venditore e l’Acquirente (qui di seguito definito l’ “Aggiudicatario”); ne<br />
consegue che <strong>Bloomsbury</strong> non assume in proprio alcuna responsabilità<br />
oltre a quella ad essa derivante dalla propria qualità di mandataria.<br />
2. Gli oggetti offerti all’asta saranno aggiudicati al miglior offerente. Qualora<br />
durante lo svolgimento di un’asta sorga controversia sull’Aggiudicatario, il<br />
Banditore potrà, a sua assoluta discrezione, rimettere l’oggetto in vendita<br />
all’asta e procedere ad una nuova aggiudicazione.<br />
3. <strong>Bloomsbury</strong> si riserva la facoltà di ritirare dall’asta qualsiasi lotto a sua<br />
assoluta discrezione e senza alcun preavviso. Durante l’asta il Banditore,<br />
a sua discrezione, potrà variare l’ordine di vendita, abbinare e/o separare<br />
i lotti <strong>Bloomsbury</strong> si riserva, inoltre, di non procedere all’aggiudicazione<br />
e/o di ritirare i lotti per i quali le offerte d’asta non raggiungano il prezzo<br />
minimo di riserva concordato con il Venditore.<br />
4. Il rilancio minimo in aumento delle offerte è fissato nella misura del<br />
10% del prezzo base d’asta, salvo diverse comunicazioni da parte del<br />
Banditore.<br />
5. L’offerente, con la formulazione della propria offerta, si impegna a<br />
corrispondere a <strong>Bloomsbury</strong> il prezzo di aggiudicazione del lotto oltre<br />
alla commissione per i diritti d’asta, imposte ed altri oneri applicabili alla<br />
vendita ed alla commissione.<br />
6. La proprietà dei lotti aggiudicati passa all’Aggiudicatario solo previo<br />
pagamento integrale del prezzo di aggiudicazione e delle commissioni<br />
per i diritti d’asta, di cui al successivo punto 7. Vengono accettate le<br />
seguenti modalità di pagamento:<br />
a) in contanti fino ad Euro 1.000;<br />
b) mediante carta di credito (non si accettano American Express e<br />
PAGAMENTI A DISTANZA) per ogni pagamento con carta di credito verrà<br />
applicata una maggiorazione del 3%;<br />
c) mediante assegni circolari e/o bancari non trasferibili intestati a<br />
BLOOMSBURY AUCTIONS<br />
<strong>Bloomsbury</strong> Auctions Italia S.r.l.<br />
d) mediante bonifico bancario su c/c n.<br />
400851407 intestato a <strong>Bloomsbury</strong> Auctions Italia S.r.l., in essere<br />

307, contraddistinto dalle seguenti coordinate bancarie: IBAN<br />

. Nel caso di pagamento con assegni o bonifici bancari, il pagamento<br />
s’intende effettuato solo dopo che la banca di <strong>Bloomsbury</strong> abbia<br />
confermato il buon esito dell’assegno e/o dell’accredito.<br />
7. Le commissioni per i diritti d’asta dovute a <strong>Bloomsbury</strong><br />
dall’Aggiudicatario sono le seguenti:<br />
- 25% del prezzo di aggiudicazione fino ad un importo di<br />
Euro 100.000,00.<br />
- 18% del prezzo di aggiudicazione sugli importi eccedenti Euro<br />
100.000,00<br />
7 bis. (Δ) Lotto stock <strong>Bloomsbury</strong>, fuori dal regime del margine.<br />
L’importo complessivo a carico del Compratore, per ciascun<br />
lotto, è composto da: Prezzo di aggiudicazione 25% del prezzo di<br />
aggiudicazione fino ad un importo di €100.000<br />
18% del prezzo di aggiudicazione sugli importi eccedenti €100.000<br />
21% Iva sulla commissione d’asta<br />
21% Iva sul prezzo di aggiudicazione<br />
L’Iva sul prezzo di aggiudicazione è rimborsabile solo a fronte di provata<br />
esportazione Extra-UE avvenuta entro tre mesi dalla data della vendita la<br />
cui documentazione di prova, nelle forme previste dalla legge italiana, sia<br />
pervenuta a <strong>Bloomsbury</strong> entro quattro mesi dalla suddetta data. L’iva sulle<br />
commisioni e sul prezzo di aggiudicazione non è applicabile a soggetti Iva<br />
non italiani residenti in paesi UE.<br />
8. LOTTI CONTRASSEGNATI DEL SIMBOLO α. Ai sensi del D. Lgs. n. 118/2006<br />
vige in Italia il cosiddetto “Diritto di Seguito”, ossia il diritto dell’autore<br />
vivente di opere di arti figurative e di manoscritti ovvero dei suoi eredi,<br />
ove l’autore sia deceduto da meno di 70 anni, a percepire un compenso<br />
calcolato in forma percentuale sul prezzo di vendita degli originali delle<br />
proprie opere in occasione delle vendite successive alla prima. Per i lotti<br />
contrassegnati da questo simbolo l’acquirente si impegna a pagare il<br />
“Diritto di Seguito”, che spetterebbe al venditore pagare in base all’art.<br />
152, I comma, Legge 22 aprile 1941, n. 633, nella misura determinata<br />
nella sezione “Diritto di Seguito”. Tale diritto sarà calcolato sul prezzo di<br />
aggiudicazione uguale o superiore a Euro 3.000. Tale diritto non potrà<br />
comunque essere superiore a Euro 12.500 per ciascun lotto. L’importo del<br />
diritto da corrispondere è così determinato:<br />
4% per la parte del prezzo di aggiudicazione fino a Euro 50.000,00<br />
3% per la parte del prezzo di aggiudicazione compresa tra Euro<br />
50.000,01 e Euro 200.000<br />
1% per la parte del prezzo di aggiudicazione compresa tra Euro<br />
200.000,01 e Euro 350.000<br />
0,50% per la parte del prezzo di aggiudicazione compresa tra Euro<br />
350.000,01 e Euro 500.000<br />
0,25% sul prezzo di aggiudicazione oltre Euro 500.000.<br />
Il diritto di seguito addebitato al compratore sarà versato da <strong>Bloomsbury</strong><br />
alla SIAE in base a quanto stabilito dalla legge.
9. Coloro che desiderano partecipare ad un’asta, dovranno<br />
preventivamente compilare e sottoscrivere una scheda di partecipazione,<br />
indicando tutti i loro dati personali e le loro referenze bancarie. Tali dati<br />
saranno trattati in conformità alla vigente normativa sulla tutela della<br />
riservatezza dei dati personali (c.d. Privacy), come da informativa che verrà<br />
consegnata ai partecipanti. <strong>Bloomsbury</strong> si riserva la facoltà di rifiutare le<br />
offerte provenienti da persone non registrate ed identificate o che non<br />
abbiano presentato adeguate referenze bancarie.<br />
10. <strong>Bloomsbury</strong> si riserva la facoltà di accettare mandati per l’acquisto<br />
di determinati lotti da parte di clienti ad essa noti, nel qual caso, il<br />
Banditore effettuerà rilanci sulla base delle istruzioni ricevute dal cliente<br />
in competizione con le offerte formulate in sala. In caso di offerte del<br />
medesimo importo, prevarrà l’offerta comunicata dal Banditore su quella<br />
dell’offerente in sala.<br />
11. <strong>Bloomsbury</strong> agisce in qualità di mandataria del Venditore e declina<br />
qualsiasi responsabilità in ordine alla descrizione degli oggetti contenuta<br />
nei cataloghi, nelle brochures ed in qualsiasi altro materiale illustrativo;<br />
tali descrizioni, così come ogni altra indicazione o illustrazione, dovranno<br />
considerarsi puramente indicative e non possono generare affidamenti<br />
di alcun tipo negli Aggiudicatari. Tutte le aste saranno precedute da<br />
un’esposizione al fine di permettere un esame approfondito circa<br />
l’autenticità, lo stato di conservazione, la provenienza, il tipo e la qualità<br />
degli oggetti. Dopo l’aggiudicazione né <strong>Bloomsbury</strong> né i Venditori<br />
potranno essere ritenuti responsabili per i vizi relativi allo stato di<br />
conservazione, per l’errata attribuzione, l’autenticità, la provenienza, il<br />
peso o la mancanza di qualità degli oggetti. Né <strong>Bloomsbury</strong> né il personale<br />
incaricato da <strong>Bloomsbury</strong> potranno rilasciare una qualsiasi garanzia in<br />
tal senso, salvi i casi previsti dalla legge. Fermo quanto sopra e quanto<br />
previsto da norme inderogabili di legge qualsiasi richiesta risarcitoria<br />
vuoi nei confronti della <strong>Bloomsbury</strong> che del Venditore non potrà eccedere<br />
l’importo di aggiudicazione del relativo lotto.<br />
12. Le stime relative al prezzo base di ciascun lotto, espresse in euro,<br />
sono stampate sotto la descrizione dei lotti riportata nel catalogo e non<br />
includono i diritti d’asta dovuti dall’Aggiudicatario. Tali stime possono<br />
essere soggette a revisione in qualsiasi momento, per cui i lotti potranno<br />
essere offerti all’asta ad un prezzo base diverso da quello indicato nel<br />
catalogo. Anche le descrizioni dei lotti nel catalogo potranno essere<br />
soggette a revisione mediante comunicazioni al pubblico durante l’asta.<br />
13. L’Aggiudicatario dovrà corrispondere a <strong>Bloomsbury</strong> il prezzo di<br />
aggiudicazione più i diritti d’asta immediatamente dopo la conclusione<br />
dell’asta e, comunque, entro 7 giorni lavorativi, salvo diverso preventivo<br />
accordo scritto con <strong>Bloomsbury</strong>.<br />
14. Nel caso di ritardi nel pagamento del prezzo di aggiudicazione e<br />
dei diritti d’asta, <strong>Bloomsbury</strong> potrà addebitare all’Aggiudicatario una<br />
penale nella misura del 12% annuo calcolato per i giorni di ritardo nel<br />
pagamento, salvo il diritto della stessa, decorsi sette giorni dalla data<br />
dell’asta, di considerare revocata l’aggiudicazione e di procedere alla<br />
vendita dei lotti a trattativa privata ovvero in una successiva asta in danno<br />
dell’Aggiudicatario, trattenendo, comunque, a titolo di penale, eventuali<br />
acconti ricevuti. Gli oggetti di cui sopra verranno custoditi da <strong>Bloomsbury</strong><br />
a rischio e spese dell’Aggiudicatario fino a quando non saranno venduti<br />
come previsto al precedente paragrafo oppure restituiti al Venditore su<br />
richiesta del medesimo, fermo restando che, fino alla data di restituzione<br />
o di vendita, l’Aggiudicatario, sarà tenuto a corrispondere a <strong>Bloomsbury</strong> la<br />
penale sopra menzionata.<br />
15. L’Aggiudicatario, dopo che avrà saldato il prezzo e le commissioni per<br />
diritti d’asta, dovrà ritirare i lotti acquistati a propria cura, rischio e spese<br />
entro 7 giorni dall’aggiudicazione. Decorso tale termine, <strong>Bloomsbury</strong><br />
è esonerata da ogni responsabilità nei confronti dell’Aggiudicatario in<br />
relazione alla custodia, all’eventuale deterioramento o deperimento<br />
degli oggetti ed avrà diritto a trasferire i lotti non ritirati a spese e rischio<br />
dell’Aggiudicatario presso i propri uffici ovvero magazzini pubblici o<br />
privati. <strong>Bloomsbury</strong> potrà organizzare l’imballaggio ed il trasporto dei lotti<br />
a spese e rischio dell’Aggiudicatario su espressa richiesta di quest’ultimo e<br />
previo pagamento dei relativi costi.<br />
16. Gli Aggiudicatari saranno tenuti, per gli oggetti sottoposti alla notifica<br />
da parte dello Stato, all’osservanza di tutte le disposizioni di cui al D. Lgs.<br />
22 Gennaio 2004 n. 42 (c.d. “Codice dei Beni Culturali”). L’esportazione di<br />
oggetti da parte di Aggiudicatari residenti e non residenti in Italia sarà<br />
regolata dalla suddetta normativa nonché dalle leggi doganali, valutarie<br />
e tributarie in vigore. <strong>Bloomsbury</strong> non assume alcuna responsabilità<br />
nei confronti degli Aggiudicatari in ordine ad eventuali restrizioni<br />
all’esportazione dei lotti aggiudicati né in ordine ad eventuali licenze od<br />
attestati che l’Aggiudicatario di un lotto debba ottenere in base alla legge<br />
italiana. L’Aggiudicatario, in caso di esercizio del diritto di prelazione da<br />
parte dello Stato, non potrà pretendere da <strong>Bloomsbury</strong> e/o dal Venditore<br />
alcun rimborso di eventuali interessi sul prezzo delle commissioni d’asta<br />
già corrisposte.<br />
17. In caso di contestazioni ritenute fondate da <strong>Bloomsbury</strong> per oggetti<br />
contraffatti o falsificati o recanti vizi sostanziali, purché la relativa<br />
comunicazione scritta pervenga a <strong>Bloomsbury</strong> entro 21 giorni dalla data<br />
di aggiudicazione, quest’ultima potrà, a sua discrezione, annullare la<br />
vendita o rivelare all’Aggiudicatario che lo richieda il nome del Venditore,<br />
dandone preventiva comunicazione a quest’ultimo.<br />
18. Per quanto riguarda le aste di libri, non saranno accettate contestazioni<br />
relative a danni alla legatura, macchie, fori di tarlo, carte o tavole rifilate e<br />
ogni altro difetto che non leda la completezza del testo e/o dell’apparato<br />
illustrativo; mancanza di indici di tavole, fogli bianchi, inserzioni,<br />
supplementi e appendici successivi alla pubblicazione dell’opera. Non<br />
saranno, inoltre, accettate contestazioni relative a libri non descritti in<br />
catalogo.<br />
19. Nel caso in cui <strong>Bloomsbury</strong> sia stata informata o venga a conoscenza<br />
di un’eventuale pretesa o diritto di terzi inerente alla proprietà, possesso<br />
o detenzione di uno o più lotti, essa potrà, a sua discrezione, trattenere in<br />
custodia tali lotti nelle more della composizione della controversia o per<br />
tutto il periodo ritenuto ragionevolmente necessario a tale composizione.<br />
20. Le presenti Condizioni di Vendita si intendono integralmente e<br />
tacitamente accettate da quanti concorrono all’asta e sono a disposizione<br />
di qualsiasi interessato che ne faccia richiesta. Per qualsiasi controversia<br />
relativa alle presenti condizioni ed allo svolgimento dell’asta si applicherà<br />
la legge italiana e sarà competente in via esclusiva il Foro di Roma, salva la<br />
facoltà di <strong>Bloomsbury</strong> di agire innanzi al foro del convenuto.<br />

1. <strong>Bloomsbury</strong> Auctions Italia S.r.l., a company with only one shareholder, with<br />

09479031008 [Company Register Code RM-1165993], with capital stock fully paid<br />
of Euro 105.000,00 operating under the direction and coordination, pursuant to<br />
Art. 2497bis of the Italian Civil Code, by <strong>Bloomsbury</strong> Auctions Limited with offices<br />
in London, Great Britain (hereinafter referred to as “<strong>Bloomsbury</strong>”), in carrying out<br />
its selling activity, acts as an agent on an exclusive basis in its name but on behalf<br />
of each Seller, whose name is registered in the special books held at <strong>Bloomsbury</strong>’s<br />
office pursuant to the Police Regulations. The sales shall be deemed concluded<br />
directly between the Seller and the Buyer (hereinafter referred to as the “Buyer”); it<br />
follows that <strong>Bloomsbury</strong> undertakes no responsibility except that deriving from its<br />
role as agent.<br />
2. The lots are knocked down to the highest bidder. If any dispute arises between<br />
two or more bidders, the disputed lot may, at the sole discretion of the Auctioneer,<br />
immediately be reoffered and resold.<br />
3. <strong>Bloomsbury</strong> reserves the right to withdraw any lot in its absolute discretion<br />
and without need of any notice. During the auction, the auctioneer in its absolute<br />
discretion is entitled to change the order of sale, to join and/or separate any two or<br />
more lots. <strong>Bloomsbury</strong>, moreover, shall also withdraw lots if the bids do not reach<br />
the reserve price, as agreed between <strong>Bloomsbury</strong>and the Seller.<br />
4. The minimum rate by which a bid may be increased is 10% of the minimum<br />
starting price, unless otherwise communicated by the Auctioneer.<br />
5. The highest bidder by making its bid undertakes to pay to <strong>Bloomsbury</strong> the hammer<br />
price of the lot plus the commission for the auction rights due to <strong>Bloomsbury</strong> plus<br />
taxes and other charges applicable to the sale and to the commission.<br />
6. Title to the lots is transferred to the highest bidder only upon full payment of the<br />
hammer price and of the commissions referred to in<br />
paragraph 7 herein below.<br />
The following modalities of payment are accepted:<br />
a. by cash up to Euro 1.000;<br />
b. by credit card (No American Express and NO REMOTE CREDIT CARD PAYMENT) a<br />
surcharge of 3% is payableon all payments made by credit card;<br />
c. by banker’s draft and/or certified non negotiable<br />
cheque payable to <strong>Bloomsbury</strong> Auctions Italia S.r.l.;<br />
d. by bank transfer to the banking account<br />

case of payment made by cheque or banking remittance, the payment shall be<br />
deemed made only when <strong>Bloomsbury</strong>’s bank has confirmed the encashment of<br />
the cheque or the receipt of the remittance.<br />
7. The commissions due to <strong>Bloomsbury</strong> by the Buyer are the following:<br />
- 25% of the hammer price of each lot up to an amount of Euro 100.000,00;<br />
- 18% of the hammer price on any amount in excess of<br />
Euro 100.000,00.<br />
7 bis. (Δ) Means: lots of <strong>Bloomsbury</strong>’s stock that are outside the margin scheme.<br />
The total amount payable by the buyer will include:<br />
the hammer price<br />
25% of the hammer price up to €100.000 18% on the excess of the hammer price<br />
above €100.000<br />
21% VAT on the auction commission<br />
21% VAT on the hammer price<br />
VAT on the hammer price is refundable only in cases of certified exportation<br />
outside the EU within three months of the date of sale, on condition that the<br />
relevant certifying documentation, as provided for by the italian law, is delivered to<br />
<strong>Bloomsbury</strong> within four months of the date of sale. The VAT on the hammer price<br />
and on the auction commision is not applicable to non italian persons subject to VAT<br />
who reside within the EU.<br />
8. LOTS WITH THE SYMBOL α. In Italy the Legislative Decree No. 118/2006 provides a<br />
so called “Diritto di Seguito” (artist’s resale right) namely the right of the artist, who<br />
created figurative works or manuscripts, during his entire life and the right of his heirs<br />
for a period of 70 years from the artist’s death, to receive a payment calculated at a<br />
percentage of the sale price of the originals of his works on occasion of subsequent<br />
sales of the artist’s works. For lots that appear with this symbol the buyer is committed<br />
to pay the ”droit de suite” which entitles the seller to pay according to the art. 152,<br />
I comma, Law 22 aprile 1941, n. 633. Such artist’s compensation is at charge of the<br />
Buyer and is calculated on the hammer price if it is equal or higher than Euro 3.000,00.<br />
This compensation cannot in any case be higher than Euro 12.500,00 for each lot.<br />
The amount of the compensation to be paid is calculated as follows:<br />
4% for the sum of the hammer price up to Euro 50.000,00;<br />
3% for the sum of the hammer price between<br />
Euro 50.000,01 and Euro 200.000,00;<br />
1% for the sum of the hammer price between<br />
Euro 200.000,01 and Euro 350.000,00;<br />
0,50% for the sum of the hammer price between<br />
Euro 350.000,01 and Euro 500.000,00;<br />
0,25% of the hammer price in excess of Euro 500.000,00.<br />
The artist’s compensation charged to Buyer shall be paid by <strong>Bloomsbury</strong> to SIAE,<br />
pursuant to what prescribed by the Italian law.
9. Each prospective Buyer must complete and sign a registration form, including<br />
personal data and bank references prior to each auction. Said data shall be treated<br />
confidentially pursuant to the applicable laws on privacy, as indicated in details in<br />
the appropriate notice delivered to the prospective buyers.<br />
<strong>Bloomsbury</strong> reserves to itself the right to refuse bids made by persons not registered<br />
or not identified or who has not given adequate bank references.<br />
10. <strong>Bloomsbury</strong> will be entitled to execute bids for specific lots on behalf of clients<br />
known to it, making bids through the auctioneer in competition with the other<br />
bidders attending the sale. In the event of two identical bids, the bid communicated<br />
by the auctioneer shall prevail over the bid made by other bidders.<br />
11. <strong>Bloomsbury</strong> acts as mere agent of the Sellers and shall not be held liable for<br />
the description of the lots in the catalogues, brochures and other publications.<br />
Statements in the catalogue or condition reports or any other indication or<br />
illustration regarding the lots, are purely statements of opinion and are not to be<br />
relied upon as statements of warranty. Before every auction, an exhibition of the lots<br />
shall take place in order to allow a through evaluation of the authenticity, the state<br />
of preservation, the provenance and the type and quality of any lot.<br />
Following the sale, neither <strong>Bloomsbury</strong>’s nor the Sellers shall be liable for any<br />
defects relative to the state of preservation, nor do they warrant the correctness of<br />
statements concerning attribution, authenticity, provenance, weight or quality in<br />
any item. Neither <strong>Bloomsbury</strong>’s nor its personnel shall have the authority to make<br />
or give any representation or warranty in this respect, except for cases provided by<br />
law. Without prejudice to what established hereinabove or by imperative provisions<br />
of law any liability for damages either by <strong>Bloomsbury</strong> or by the Seller shall be limited<br />
to the hammer price of the related lot.<br />
12. The estimates regarding the possible sale price of each lot are expressed in Euro<br />
and are printed under their description in the catalogue and are not inclusive of the<br />
commissions payable by the Buyer to <strong>Bloomsbury</strong>. Estimates are subject to revision<br />
at any moment, so that the lots may be offered at the auction at a price different<br />
from that indicated in the catalogue. The description of the lots in the catalogue<br />
can also be subject to revision by way of appropriate communications to the public<br />
during the auction.<br />
13. The Buyer shall pay to <strong>Bloomsbury</strong> the hammer price plus the commission due<br />
to <strong>Bloomsbury</strong> for the action fees immediately after the conclusion of the auction<br />
and, in any case, within seven working days, unless otherwise previously agreed in<br />
writing with <strong>Bloomsbury</strong>.<br />
14. In the event of delays in the payment of the hammer price plus commissions by<br />
the Buyer, <strong>Bloomsbury</strong> may charge to the Buyer liquidated damages at the rate of<br />
12% per year calculated for the actual days of delay, saving the right of <strong>Bloomsbury</strong>,<br />
after the elapse of seven days from the auction, to cancel the sale of the lot and to<br />
resell the lot by future auction or by private sale, withholding in any case, as liquidated<br />
damages, advance payments, if any, made by the Buyer. The unpaid lots shall be kept in<br />
custody by <strong>Bloomsbury</strong> at risk and cost of the Buyer until they are sold, as provided for in<br />
the precedent paragraph, or returned to the Seller upon his request, it being understood<br />
that, until the sale or the return of the lots to the Seller, the Buyer shall be obliged to pay<br />
to <strong>Bloomsbury</strong> the above mentioned liquidated damages.<br />
15. The Buyer, after the payment of the hammer price and of the commission,<br />
should collect the lots at his own risk and costs within seven days from auction.<br />
After this time, <strong>Bloomsbury</strong> shall not be held liable towards the Buyer with<br />
reference to the custody, to any possible deterioration or wear and tear of the lots<br />
and will have right to transfer lots which have not been collected at the expense<br />
and risk of the Buyer to its office or to private or public warehouse.<br />
<strong>Bloomsbury</strong> may arrange to have the lots packed, insured and shipped at the<br />
express request, expense and risk of the Buyer, upon receipt of the related payment.<br />
16. The Buyer, with respect to the lots declared of significant interest by the Italian<br />
State, shall comply with the provision set forth in the Legislative Decree No. 42 of<br />
January 22, 2004 (so called “Codice dei beni culturali”).<br />
The export of lots by the Buyers, both resident and not resident in Italy, is governed<br />
by the above mentioned provisions of law and are also subject to customs, currency<br />
and tax-regulations in force.<br />
<strong>Bloomsbury</strong> shall not be held liable for any<br />
restrictions on export of the sold lots or for any licenses or permits that the Buyer<br />
must obtain under Italian law. In the event that the Italian State exercise the right of<br />
pre-emption, the Buyer shall not be entitled to receive either from <strong>Bloomsbury</strong> or<br />
from the Seller any refund of the interest on the sale price and on the commissions<br />
already paid to <strong>Bloomsbury</strong>.<br />
17. If, within 21 days from the date of the sale, the Buyer has notified <strong>Bloomsbury</strong> in<br />
writing that he/she has grounds for believing that the lot concerned is a forgery or<br />
has substantial defects, <strong>Bloomsbury</strong> shall be entitled, in its sole discretion, to cancel<br />
the sale and disclose to the Buyer the name of the Seller, giving prior notice to him/<br />
her.<br />
18. In any case of auctions concerning books, the Buyer shall not be entitled to<br />
dispute any damage to bindings, foxing, wormholes, trimmed pages or plates<br />
or any other defect affecting the integrity of the text and/or illustrative material,<br />
including missing indices of plates, blank pages, insertions, supplements and<br />
additions subsequent to the date of publication of the work. No refund will be<br />
considered for books not described in the catalogue.<br />
19. In the event that <strong>Bloomsbury</strong> is notified or become aware of a claim by a third<br />
party about the ownership or possession or control of one or more lots, it may, in its<br />
absolute discretion, retain possession of the lots for such period as it is reasonable<br />
for the settlement of the claim.<br />
20. These general conditions of sale shall be deemed accepted entirely and<br />
automatically by the sale participants and are available to any person requesting<br />
them. Any dispute relating to these general conditions on the auctions shall be<br />
submitted to the exclusive jurisdiction of the Rome Courts and shall be governed<br />
by Italian Law, saving <strong>Bloomsbury</strong> rights to submit the claim to the Court where the<br />
defendant is resident.<br />
