RESOLUTION NO. 2011-12 A RESOLUTION OF THE MONTEREY REGIONAL WATER POLLUTION CONTROL AGENCY DECLARING LIENS AGAINST REAL PROPERTY FOR DELINQUENT SEWER USER CHARGES -o0o- WHEREAS, the owners of the real property lots described in "Exhibit A," which is attached hereto and incorporated herein by this reference thereto, which lots are situated and located within the boundaries of the Monterey Regional Water Pollution Control Agency (the “MRWPCA”), Monterey County, California, and have within the past year received sewer and wastewater treatment and disposal services to said properties from the MRWPCA, for which said owners or persons occupying said properties, on behalf of or with the consent of said owners, have failed and refused to pay; and WHEREAS, pursuant to Health and Safety Code Sections 5470-5474.10 the MRWPCA has elected by ordinance to have such delinquent charges collected on the tax roll in the same manner as general property taxes; and WHEREAS, pursuant to law, the MRWPCA has duly notified all of the persons listed on "Exhibit A" of the charges and fees which are delinquent with regard to their respective properties; and WHEREAS, certain of such persons have, as of and to this date, failed to pay said delinquent charges; and Page 1 of 4
WHEREAS, the Secretary of the MRWPCA has filed his report of the charges which remain delinquent, and has caused all persons owning such property on this date to be duly notified of a hearing on said report, which notice contains a statement of the total delinquency to be charged against each such person and property; and WHEREAS, this is the time set for the hearing on said report and the MRWPCA Board of Directors has considered and determined all protests and objections made to it concerning said report and has confirmed said report as to those persons and properties and in the amounts hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Monterey Regional Water Pollution Control Agency that: 1. Certain billing errors and other categories of protests to the lien action are hereby referred to MRWPCA staff by the Board to be investigated and cleared up on an individual basis prior to the date of delivering (June 30, 2011) said "Exhibit A" to the Monterey County Tax Collector, as more fully stated at the hearing on said delinquent charges, and staff is given full authority and discretion to remove certain properties and names from said "Exhibit A," if matters and questions concerning same are cleared up prior to said date. 2. The Secretary of the MRWPCA is hereby authorized and directed to cause the aforesaid delinquent charges, as set forth on "Exhibit A" and as same may be revised to reflect payments and staff adjustments, to be placed on the property tax bills for the parcels so indicated in order that said charges may be collected for MRWPCA by the Monterey County Tax Collector along with the real property taxes on said parcels. 3. A certified copy of this resolution, with the attached "Exhibit A," as revised following this hearing, shall be recorded in the Office of the County Recorder of Monterey County, California.
