laatste opbod weer aangenomen worden en zal
het opbieden hervat worden. De notaris beslist
bindend over eventuele geschillen die bij of tijdens
het bieden ontstaan.
3. Afrekening veilingbedrag en -kosten
3.1 Direct na afloop van de veiling dient de
koper zijn/haar betalingsverplichtingen
te vervullen op het veilingbureau. Indien
de koper hieraan niet voldoet, is DSHS
gerechtigd de bieding niet te erkennen
en ongeldig te verklaren en het gekochte
paard opnieuw te veilen, dan wel het gekochte
paard toe te wijzen aan de een na
hoogste bieder. De koper is in dat geval van
rechtswege in verzuim en is gehouden de
daardoor veroorzaakte schade aan DSHS
te vergoeden, onverminderd de overige
rechten van DSHS.
3.2 Het rekening bedrag wordt als volgt berekend:
Afslagprijs +
6% commissietoeslag +
1½% verzekering (optioneel) +
Rekening bedrag exclusief
21% Nederlandse omzetbelasting
Het rekening bedrag is per direct opeisbaar.
Betaling geschiedt per bank, het is niet mogelijk
het rekening bedrag in contanten te
voldoen. Verrekening van eventuele tegenvorderingen
is uitgesloten.
3.3 Het is DSHS toegestaan om informatie in te
winnen omtrent de financiële gegoedheid
van een betreffende bieder/koper en deelname
aan de veiling door en het sluiten van een
overeenkomst met de betreffende bieder/koper
afhankelijk te stellen van de ingewonnen
informatie.
In the event of any disputes arising with or during
the bidding process, the decision of the notary
shall be binding.
3. Settlement of auction amounts
and expenses
3.1 Immediately after completion of the auction
buyers are obliged to settle amounts due in
the auction office. If a buyer should fail to
comply with this obligation, DSHS shall be
entitled not to recognise the offer and to declare
the auction invalidate, after which the
purchased horse will again be made available
for auction or alternatively the purchased
horse is to be allocated to the second highest
bidder. The buyer shall in this event be
considered to be in legal default and shall
be liable to compensate DSHS for any damage
incurred, without prejudice to any other
rights that DSHS may have.
3.2 The amount due shall be calculated as follows:
Auction price +
6% commission charge +
1½% insurance (optional) +
Invoice amount is exclusive
of 21% Dutch VAT
The balance shall become payable immediately.
Payment is to be made by bank transfer
and cash payment of the amount shall
not be accepted. Settlement of any counterclaims
is excluded.
3.3 DSHS is entitled to gather information on
the financial situation of a specific bidder/
buyer and participant to the auction and may
decide to make the conclusion of an agreement
with the relevant bidder/buyer conditional,
based on the information obtained.
