USHANSELAIshicilelwa okwesibili4. Imisebenzi kashansela(1) Ushansela unesikhundla sokuba yinhloko yale Nyuvesi.(2) Ushansela, noma uma engekho loyo muntu oqokelweukubambela ushansela, kuba wuye owengamela yonkeimibuthano yeNyuvesi futhi, egameni leNyuvesi, athweseiziqu nawo onke amadiploma nezitifiketi.(3) Ushansela wenza neminye imisebenzi ayinikwewumkhandlu.5. Ukukhethwa nokuqokwa kukashansela(1) Ushansela ukhethwa wumkhandlu ngale ndlela elandelayo:(a)(b)Usihlalo womkhandlu unquma usuku umhlanganowomkhandlu ozobanjwa ngalo ngenjongoyokukhetha ushansela;Unobhala womkhandlu ukhipha isaziso esifanelekilekumalungu omkhandlu azisa ngosuku, isikhathi kanyenendawo yalo mhlangano oshiwo kuleli binzana (1)(a);(c) Unobhala womkhandlu umema amalunguomkhandlu, ithimba lezigele kanye nesithangamisesikhungo ukuba bale<strong>the</strong> amagamaabawaphakamisela isikhundla sikashansela;(d) Amagama aphakanyisiwe ashiwo kuleli binzana (1)(c) kumele afike kunobhala womkhandlu okungenaniizinsuku zokusebenza ezingama-20 (amashumiamabili) ngaphambi komhlangano oshiwo kulelibinzana (1)(a);(e)Amagama aphakanyisiwe ngokusho kwebinzana(1)(c) kumele abe ngabhalwe phansi futhi kumelekube nemvume ebhaliwe yomphakanyiswa kanyenemininingwane-kuzazisa (CV) efingqiwe.8


Ishicilelwa okwesibili(f)Unobhala womkhandlu, ezinsukwini ezi-5 (ezinhlanu)zokusebenza emva kokuvalwa kokuphakanyiswakwamagama, kumele azise ngokubhalwephansi amalungu omkhandlu, ithimba lezigele,kanye nesithangami sesikhungo ngamagamaaphakanyisiwe atholakele.(g) Kumele kubanjwe umhlangano okhe<strong>the</strong>kilewesithangami sesikhungo ngaphambi komhlanganongokusho kwebinzana (1)(a) ngenjongoyokucabangela la magama aphakanyisiwenokweluleka umkhandlu ngaphambi komhlanganowokukhetha ngokuqokelwa komncintisani isikhundlasikashansela;(h) Ushansela ukhethwa ngokuvota kwangasesenangeningi lamalungu omkhandlu akhonaemhlanganweni ngokusho kwebinzana (1)(a);(i)Uma kungekho mncintisani othola iningi lamavoti,kuzolokhu kwenziwa iziwombe zokuvotangokulandelana; kuthi(j) Esiwombeni sokuvota esilandelayo ngasinyeumncintisani othole amavoti ambalwa kakhuluaphume emncintiswaneni.(2) Emva kokuba umkhandlu usukhe<strong>the</strong> ushansela, usihlalowomkhandlu umemezela igama likashansela.6. Ubungako besikhathi ushansela esesikhundleni(1) Ushansela uba sesikhundleni iminyaka emine, ngaphandlekokuba esula noma ekhishwa esikhundleni ngokuvumelananebinzana (5).(2) Akuvumelekile ukuba umuntu akhethwe njengoshanselangaphezu kwamahlandla alandelanayo amabiliesesikhundleni.9


Ishicilelwa okwesibili(3) Uma, nganoma siphi isizathu, ushansela engenakukwaziukufeza imisebenzi yesikhundla sakhe, noma uma isikhundlasikashansela siba ngesingenamuntu, usekela-shanselanoma iphini likasekela-shansela, noma-ke uma kungakazekingalaba abathintwe ngenhla omunye umuntu oqokwewumkhandlu uzofeza imisebenzi kashansela.(4) Ubungako besikhathi sikashansela esesikhundlenibuyanqamuka uma kwenzeka loku:(a)(b)(c)ukufa noma ukungakwazi ukusebenza;ukwesula esikhundleni; nomaumkhandlu umsusa esikhundleni.(5)(a)(b)(c)(d)ushansela unokususwa esikhundleni wumkhandlukuphela ngezwi lesinqumo elenziwe okungenaniyizingxenye ezimbili kwezintathu zamalunguomkhandlu.ngaphambi kokuthathwa kwesinqumo ngokushokwebinzana (a) ngenhla kumele kufakwe kunobhalawomkhandlu isinqumo esisadingidwa kubekwaizizathu ngokugcwele.Unobhala womkhandlu kumele akopishele ushanselalesi sinqumo esisadingidwa okufanele aphendulengokubhalwe phansi, ngokwelungelo lakhelokuphendula, zingakapheli izinsuku ezingama-20(amashumi amabili) esitholile lesi sinqumoesisadingidwa.Emva kwezinsuku ezingama-20 (amashumi amabili)njengokucacisa kwebinzana (c) ngenhla, nomaemva kokutholakala kwempendulo evela kashansela(kuye ngokuthi kwenzeka kuphi kuqala) unobhalawomkhandlu kumele abize umhlangano okhe<strong>the</strong>kile10
