However it should beborne in mind that the court had problems organizing interpretation and translationinto Swedish, which the defendant understands best, requested and to which he wasentitled.The Morina case On 20 October 2003, International Prosecutor Cecilia Tillada brought an indictmentagainst Xhavit Morina on charges of terrorism, commanding a terrorist organization,murder, multiple murder, illegal possession of arms and causing public danger which heallegedly committed as a member of the Kosovo Liberation Army (KLA), the Preševo,Medveđa and Bujanovac Liberation Army (UCPMB) and the Albanian National Army(ANA/AKSh), which UNMIK declared a terrorist organization by its Regulation 2003/9.The defendant was charged with killing three Macedonian citizens – two members ofthe Democratic Union for Integration (BDI) and a passer-by.37The first-instance trial took place before the Priština/Prishtinë District Court from 29March 2004 to 26 April 2004. After seven main hearings the international trial chamber,presided over by Carol Peralta, sentenced Morina to 13 years in prison. The SupremeCourt of Kosovo quashed the sentence and referred the case back for retrial. The retrialstarted on 27 February 2007 and ended on 8 March 2007. After four main hearings theinternational trial chamber, presided over by Judge Vinod Boolell, sentenced Morina to12 years in prison. The one witness examined during the retrial reiterated in whole thestatement he had made at the previous trial.The Kurteshi and Sylejmani caseOn 14 August 2006, International Prosecutor Cecilia Tillada brought an indictmentagainst Mirsad Kurteshi and Kadri Sylejmani on charges of serious criminal offencesagainst general safety, participating in a group that commits criminal acts and incitingnational, racial and religious hatred, discord and intolerance against persons of Serbnationality during the March 2004 violence in Obilić/Obiliq. Specifically, the defendants Xhavit Morina was one of the seven detainees who escaped from Dubrava prison on 18 August 2007. His body wasdiscovered on 2 November 2007 near the village of Odri in Macedonia, following a clash with the armed group ofAgim Krasniqi.
