The audiencein the courtroom was separated: the defendant’s family members sat on one side andthose of the injured party on the other.The Jakupi I caseOn 14 March 2005, International Prosecutor Cecilia Tillada indicted Lirim Jakupi oncharges of kidnapping, unlawful detention and blackmail. According to the indictment,as a member of a group under the command of Shefqet Musliu, the former commanderof the UCPMB, Jakupi, Besim Tahiri and others took part in the kidnapping of fourpersons (identified in the indictment as injured persons 1, 2, 3, and 4) in September2000 with a view to obtaining illicit material gain. The kidnapped persons are said tohave been abused and physically tortured by the kidnappers for several days. The trialbefore a mixed trial chamber of the Gnjilane/Gjilan District Court, presided over byInternational Judge Vinod Boolell, started on 13 July 2006 and ended on 14 February2007. Jakupi was sentenced to a term of imprisonment of six years. A total of five mainhearings were held. One hearing was held before the Vranje District Court [Serbia]. Thedefendant used silence as a defence. The injured parties were the only witnesses for theprosecution. Only two of them were examined. Since the other two gave evidence earlierin the Shefqet Musliu case, their statements were used as evidence without their beingdirectly examined.41The Jakupi II caseOn 13 July 2005, International Prosecutor Cecilia Tillada brought an indictmentagainst Lirim Jakupi for the attempted commission of the criminal offence of terrorism.According to the indictment, as a member of the ANA/AKSh, Jakupi took part with othersin an explosives and weapons smuggling operation preparatory to the commissionof terrorist acts. The incidents took place in March 2003 at a border crossing betweenKosovo and Serbia designated as G5 (CP 75).The trial started on 21 June 2007 before a mixed trial chamber of the Gnjilane/GjilanDistrict Court with Judge Vinod Boolell acting as president. The defendant raised objectionsabout the composition of the trial chamber, especially because it was presided overby the judge who had imposed on him a six-year prison sentence [for kidnapping] in aprevious proceeding. With the main hearing adjourned pending decision on the application,Jakupi escaped from prison. Lirim Jakupi, one of the seven detainees who escaped from Dubrava prison on 18 August 2007, is still at large.
