How Much Is My House Worth<br />

How much is the house worth? Should you ask for less than the listed price? Your <strong>TreeHouse</strong> Broker provides the<br />

answers to these and many other questions by completing a Comparative Market Analysis (CMA), which takes into<br />

account all the variables that may affect the value and potential price of the home you intend to purchase.<br />

Comps<br />

Research of similar homes currently on the market, as well as recent sales and expired listings, help determine<br />

your home’s fair market value.<br />

THE MARKET<br />

Economic outlook and seasonal trends, as well as the number of competitive homes on the market, can affect<br />

demand for the home you are intending to purchase.<br />

UNDER CONTRACT PROCESS TITLE COMMITMENT UNDER CONTRACT PROCESS INSPECTION<br />

1 ST PHASE – TITLE COMMITMENT<br />

Title insurance protects your investment against loss arising from title defects.<br />

Once under contract, the buyer will receive the Preliminary Title Commitment. This usually happens within one week. This will be sent from<br />

the title company researching the chain of title, and handling the transfer of deed and closing.<br />

2 nd PHASE – Property Inspection<br />

The broker will recommend reputable inspectors the buyer can choose from to perform a thorough inspection of the home. It is recommended<br />

that the buyer attend the inspection to learn as much as possible about the home and any problems that might exist. This is the moment in<br />

the transaction where the buyer should attempt to become comfortable with every aspect of the home they intend to purchase, and<br />

renegotiate the deal, if necessary, given the findings of the inspection.<br />

Over time, real property may go through several ownership changes referred to as the “chain of title.” Each time a property changes hands,<br />

the title company must record the deed along with any mortgages. Since this is a human process, mistakes can be made. Unpaid expenses<br />

might also remain attached to the property when title is transferred. For these reasons, the title company must examine public records for<br />

matters affecting title. Colorado law requires the seller to purchase a Title Insurance Policy for the buyer every time title to a property is<br />

transferred to a new owner.<br />

The title insurance policy is a very important document and should be kept in a safe place in the event any issues<br />

with title arise down the road.<br />

HOW LONG DOES THE INSPECTION LAST?<br />

The inspection could last anywhere from one to five hours. Every<br />

inspector is different and it also depends on the square footage of<br />

the home or condo he-she is inspecting.<br />

WHAT HAPPENS AFTER THE INSPECTION?<br />

You will either be sent an email or given a full, detailed report of<br />

the inspection. Usually the inspector labels every component<br />

from above as:<br />

Satisfactory – Indicates the component is functionally<br />

consistent with its original purpose but may show signs of<br />

normal wear and tear and deterioration.<br />

Marginal – Indicates the component will probably require<br />

repair or replacement anytime within five years.<br />

Poor – Indicates the component will need repair or replacement<br />

now or in the very near future.<br />

Major Concerns – A system or component that is considered<br />

significantly deficient or is unsafe.<br />

Safety Hazard – Denotes a condition that is unsafe and in need<br />

of prompt attention.<br />

After the inspection, the broker will help determine what the<br />

buyer might request from the sellers as far as repairs and/<br />

or replacements, and will prepare the Inspection Objection. It is<br />

always important to keep in mind what is appropriate and<br />

reasonable to ask for in the spirit of the original deal made with<br />

the seller. If too many defects exist and the property becomes<br />

unappealing, the buyer has the unconditional option to terminate<br />

the contract and receive a full refund of their earnest money. If the<br />

buyer and seller agree on a mutually acceptable way forward,<br />

that is memorialized in the Inspection Resolution.

3 rd PHASE – APPRAISAL<br />

What Is A Property Appraisal?<br />

An appraisal is a standard part of the mortgage process. Banks and mortgage companies will give the borrower a loan amount based on<br />

the appraised value of the property. The appraiser visits the home and, through the use of comparable properties, issues the Appraisal<br />

Report. The loan will be issued using the home’s value as collateral, so it is important the home appraises at or above the contract price.<br />

What Happens if the Appraisal Comes in Low?<br />

If the Appraisal Report comes in below the contract price it represents a problem for the buyer. In the event this is the case there are<br />

generally three options for the buyer:<br />

• Renegotiate the contract to the appraised value<br />

4 th PHASE – LOAN OBJECTION/CONDITIONS<br />

Loan Objection Deadline<br />

The Loan Objection deadline date, is the date by which the loan must be<br />

satisfactory to the buyer in their subjective discretion. Specifically, “the<br />

contract is conditional upon buyer determining, in buyer’s subjective<br />

discretion, that the availability, terms, conditions, and cost of such new<br />

loan are satisfactory to buyer.” By that date, if the buyer does not obtain<br />

loan approval from their lender, the buyer may choose to terminate the<br />

contact and receive a full refund of their earnest money.<br />

Loan Conditions<br />

The Loan Conditions are the terms provided by the lender to<br />

the buyer under which the lender agrees to issue the loan. They<br />

include the interest rate, length of loan agreement, and any<br />

requirements the buyer must meet prior to obtaining the loan.<br />

• Make up the delta between the appraised value and the contract price with additional cash at closing<br />

• Terminate the contract and receives a full refund of their earnest money<br />

Don’t Buy If You Can’t Stay Put<br />

If a buyer cannot commit to remaining in the house for at least a few years, then buying is probably not a good idea. With the transaction<br />

costs of buying and selling a home, the possibility of losing money is real, even in a rising market. When prices are falling, it can be an even<br />

worse proposition.<br />

Start By Shoring Up Your Credit<br />

Since most buyers borrow money when they purchase a home, it is essential to must make sure credit history is as clean as possible. A few<br />

months before the house hunting begins, get copies of all credit reports, make sure the facts are correct, and promptly attempt to repair<br />

any problems that are discovered.<br />

Aim For A Home You Can Really Afford<br />

Buyer’s Agent<br />

A Buyer’s Agent works solely on behalf of the buyer to promote the<br />

interest of the buyer with the utmost good faith, loyalty and fidelity.<br />

The Agent negotiates on behalf of, and acts as an advocate for the<br />

buyer. The Buyer’s Agent must disclose to potential sellers all<br />

adverse material facts actually known by the Buyer’s Agent<br />

including the buyer’s financial ability to perform the terms of the<br />

transaction and if it is a residential property, whether the buyer<br />

intends to occupy the property. A separate written Buyer Agency<br />

Agreement is required, to set forth the duties and obligations of the<br />

Broker and the buyer.<br />

Listing Agreement<br />

A Seller’s Agent (or Listing Agent) works solely on behalf of the<br />

seller to promote the interests of the seller with the utmost good<br />

faith, loyalty and fidelity. The Agent negotiates on behalf of, and<br />

acts as an advocate for the seller. The Seller’s Agent must disclose<br />

to potential buyers all adverse material facts actually known by<br />

the Seller’s Agent about the property. A separate written listing<br />

agreement is required, to set forth the duties and obligations of<br />

the Broker and seller.<br />

Transaction Broker<br />

A Transaction Broker assists the buyer, or seller, or both throughout<br />

a real estate transaction by performing terms of any written or oral<br />

agreement. To fully inform the parties, preset all offers and assist<br />

the parties with any contracts, including the closing of the<br />

transaction without being an agent or advocate for either of the<br />

parties. A transaction broker must use reasonable skill and care in<br />

the performance of any oral or written agreement and must make<br />

the same disclosures as agents about all adverse material facts and<br />

actually known by the transaction broker concerning a property or<br />

a buyer’s financial ability to perform the terms of a transaction and,<br />

if it si a residential property, whether the buyer intends to occupy<br />

the property. No written agreement is required.<br />

Customer<br />

A Customer is a party to a real estate transaction with whom the<br />

Broker has no brokerage relationship because such party has not<br />

engaged or employed the Broker, either as the party’s Agent or as<br />

the party’s Transaction Broker.<br />
