There is no shortage of people and companies offering tree work 

services, but how do you choose between them? The Health and Safety 

Executive says, 

“…clients engaging contractors to undertake tree work need to carefully 

check they have the necessary skill and competence. Tree work is 

hazardous; to be done safely it requires properly trained and experienced 

people… Arboricultural trade associations can supply details of approved 

contractors and information to help you choose a competent tree work 

contractor…” 

It is equally important that advice given in respect to trees is correct and 

from reliable professionals. 

People and companies in this directory have satisfied the Arboricultural 

Association that they are competent to provide the consultancy and 

contractor services as described. 

The Arboricultural Association has been setting the national standard for 

tree work since 1964, helping arboriculturists meet that standard and 

helping people find arboriculturists who can consistently deliver a quality 

assured services to the national standard, regulated by their professional

is a continual process. New entrants may have occurred since 

this directory was published and occasionally some entries 

de-listed. If you need to check the currency of an entry refer to 


Occasionally non-listed companies will pretend to be listed and 

even use the Association’s logo. This is a criminal offence 

called passing off. If you suspect the AA’s logo (or a 

deceptively similar logo) is being used by an organisation that 

is not currently listed please report it with the evidence of the 

offence to the Arboricultural Association. The Association has

How to use 

this directory 

Selecting arboricultural services 

Few people employ arboriculturists regularly, yet many people 

will do so from time to time. There are notable exceptions; 

particularly local government officers and other estate 

managers who are responsible for large numbers of trees and 

may even have their own staff available to undertake 

arboricultural work. 

But for the majority of people, employing an arboriculturist is 

something they do infrequently and it is not always apparent 

where to start. This directory can help. 

There are two questions to be asked: 

1. Is an arboricultural contractor or an arboricultural 

consultant most appropriate? 

2. When it has been decided between a contractor and 

a consultant where can one be found who is sure to 

be competent? 

1. Contractor or consultant? 

Whilst there will always be some overlap an illustration of the 

differences between the two can be found by looking at other 

services and professions to see the way they divide between 

the contractor and the consultant (see table below). 

There are some similarities in the way that arboricultural work 

is split between contractors and consultants. A more detailed 

description of the services of each can be found at the 

beginning of the separate sections of this directory – 

consultants on page 5 and contractors on page 14.

Building Architect or structural engineer with overall 

responsibility for design and preparing 

specifications for building firms to implement. 

Diagnosis of building failure and specifying 

appropriate remedial action. 

Plumbing Plumbing and/or heating engineer designing 

systems, specifying boilers, principal service runs, 

diagnosing faults and specifying appropriate 

remedial action. 

Arboriculture (sometimes known as a tree advisor or 

arboriculturist) 

Tree survey and inspection, site supervision, 

tree work specification.

2. Choosing a competent arboricultural contractor 

or consultant 

There is no shortage of people and companies offering tree 

work services, but it is important to know how to choose 

between them. Firstly, are they all professionals? 

For many people the obvious place to start looking for an 

arboriculturist is yellow pages. Others may obtain referrals 

from a friend or ask the local authority. Other sources include 

notes pushed through doors, ‘now pruning trees in your area’ 

accompanied by a mobile phone number. 

It is critical to ensure that the arboriculturist selected is 

competent, safe, insured and reliable. Membership of a Trade 

Association may be an indication of professionalism but be 

aware that some organisations allow their members to use 

association logos without assessing the competence of the 

service provider. Less scrupulous companies may even 

use recognised logos without even being members of 

the organisation. 

This is the longest established directory of arboricultural 

consultants and contractors where 

● the companies and people in it have been assessed by 

their professional organisation, and 

● clients of these companies and people are backed up 

by a quality assured complaints procedure. 

As we say on page 3, be safe, be sure, beware and choose 

carefully. 

Building firm, small or large performing skilled 

building operations in accordance with plans 

specified by architects with some scope for 

personal interpretation. May specify smaller 

jobs and diagnose simple faults and 

implement remedies. 

Plumbing and/or heating contractor, small or large, 

performing skilled installation of heating and 

drainage systems in accordance with engineers 

plans. Equipment servicing. May include design 

of small domestic systems and fault diagnosis 

and remedy. 

(sometimes known as a tree surgeon or arborist) 

Carrying out tree work to specification, dismantling, 

felling, pruning, planting, bracing, guying and 

supporting trees.

The services of an 

Arboricultural Consultant 

(“tree advisor” or “arboriculturist”). See page 14 for Arboricultural Contractors (“tree surgeons” or “arborists”) 

Arboriculture is defined as the planting and care of individual 

and groups of trees as permanent landscape and amenity 

features, usually in gardens, parks or other populated settings 

for the enjoyment and benefit of the population, while meeting 

legal and moral obligations. Registered Consultants can 

advise on all arboricultural related issues which commonly 

include 

● Assessing trees for hazard and where appropriate 

specifying remedial work. 

● Investigating cases where trees are alleged to be involved 

in structural damage to buildings. 

● Providing advice in relation to tree preservation law and 

when necessary, expert evidence to the planning 

inspectorate. 

● Providing advice in relation to trees and development and 

when necessary, expert evidence to the planning 

inspectorate. 

● Formulating large scale tree population, amenity 

woodland, group and individual tree management plans 

in relation to risk, population dynamics, tree continuity 

etc. 

● Investigating accidents caused by tree failure. 

Arboricultural Association Registered 

Consultants 

Consultants listed in the following pages 

have submitted their work to the 

Arboricultural Association for 

assessment and have been found 

competent to provide arboricultural 

consultancy services to clients. 

Registered Consultants will give impartial advice in 

accordance with the instruction they have been given in order 

to provide you, the client, with a clear understanding of the 

implications of your trees in whatever circumstances they grow 

and in relation to your aspirations or concerns. 

Arboricultural Association Registered Consultants do not 

undertake work to trees (such as pruning, planting or felling) 

but will provide an independent schedule and specification of 

works if clients require them so to do, against which a suitable 

contractor may quote or work. 

The name of the Registered Consultant, their qualifications 

and contact details are listed together with the name of any 

company with whom they have contractual or business 

connection(s) which may be relevant to any advice given. 

It should be clearly understood that only the named consultant 

is registered by the Association and not any company or 

organisation with which they may be associated, or any of their 

employees unless also listed as a Registered Consultant in this 

directory. Prospective clients are advised to ensure that the 

named Registered Consultant is providing the required service. 

Fees should be agreed between client and consultant at the 

outset of a commission. Rates may depend on the type of 

work to be undertaken and may vary from region to region. 

Most Arboricultural Association Registered Consultants 

operate over the whole of the United Kingdom and some 

beyond. 

The Association requires that Registered Consultants 

operating within the UK must hold Professional Indemnity 

insurance to a level appropriate to the liabilities that their work 

may generate, and in all cases to a minimum of £500,000 at all 

times. Inclusion of a consultant within this directory should not 

be regarded as proof of current insurance cover – before 

entering into any contractual agreement clients should satisfy 

themselves that appropriate insurance is in place by asking for 

evidence from the consultant and/or their broker. 

In the unlikely event that clients are not satisfied with services 

from a Registered Consultant a complaints procedure may be 

followed as detailed on page 50. 

Whilst the Arboricultural Association makes every effort to 

ascertain the competence of its Registered Consultants it 

cannot accept liability in respect of any persons or companies 

named in this directory. The Arboricultural Association can not 

be held responsible for the advice or actions of any persons or 

companies named in this directory.

The services of an 

Arboricultural Contractor 

(“tree surgeons” or “arborists”). See page 5 for Arboricultural Consultants (“tree advisor” or “arboriculturist”) 

Services typically required of an arboricultural contractor (“tree 

surgeon” are: 

● Tree maintenance operations including pruning, and 

related works to relevant British Standards (see “Tree 

work terminology” section pages 52-54) 

● Tree planting operations and aftercare/establishment 

programmes 

● Tree felling, including dismantling of dangerous trees or 

trees in confined spaces 

● Advice and guidance on the above 

In addition some contractors may undertake pest and disease 

(‘P&D’) identification and control, bracing, soil decompaction 

and amelioration, tree fertilisation, mulching and other 

operations, including hedge trimming, fruit tree pruning, 

veteran tree management. However only those listed above 

are covered by the ‘ARB Approved Contractor Scheme’ (see 

below). 

These services are usually performed to an agreed 

specification which may come from: 

● The contractor after discussion with the client, or 

● A third party such as a Consultant employed, or 

● The Local Authority Tree Officer if a Tree Preservation 

Order etc. is in place 

In any case it is prudent for clients to obtain a written 

specification for the work and to agree the specification and 

price prior to commissioning the contractor. 


Contractors listed in the following 

pages have submitted their 

businesses and their tree work to the 

Arboricultural Association for 

assessment and have been found 

competent to provide arboricultural 

contracting services to clients. 

The Arboricultural Association’s assessment of Approved 

Contractors is not limited to their knowledge of trees and tree 

pruning but 

● Their understanding and practical application of current 

arboricultural practice 

● Their compliance with legislative requirements of 

arboricultural contracting 

● Their compliance with health and safety requirements of 

arboricultural contracting (endorsed by the CHAS 

scheme, see www.chas.gov.uk) 

● Their high levels of service to clients through efficient 

business management. 

Each ARB Approved Contractor is required to identify a 

principal or manager who is responsible to the Association for 

the company’s standards. The standard required by the 

Association is very high and Approved Contractors are subject 

to reassessments at regular intervals to ensure that standards 

are maintained. The standards themselves are regularly 

reviewed to ensure that they reflect contemporary 


arboricultural research findings, legislative and health and 

safety requirements, business practices and customer 

expectations. 

The Association requires that Approved Contractors within this 

directory must hold insurances to levels appropriate to the 

liabilities that their work may generate, and in all cases Public 

Liability insurance to a minimum of £5,000,000 with a 

maximum excess of £250 in any one incident. Employers’ 

Liability insurance (as applicable) to an appropriate level 

commensurate with the size of the business is needed. 

Professional Indemnity insurance, usually to a minimum of 

£500,000, may also be required if the contractor provides 

independent written advice. Inclusion of a contractor within 

this directory should not be regarded as proof of current 

insurance cover. Before entering into any contractual 

agreement clients should satisfy themselves that 

appropriate insurance is in place by asking for evidence 

from the contractor and/or their broker. 

Selecting an ARB Approved Contractor 

1. When making an appointment with an ARB Approved 

Contractor clients should advise the contractor whether 

advice on trees is required, or if a specification for works 

already exists against which the contractor’s quotation is 

sought 

2. Clients are advised to obtain more than one estimate or 

quotation for the purpose of comparison, but should 

remember that price is only one factor in selecting a 

service provider 

3. Estimates or quotations will normally be provided free of 

charge when quoting against a specification, however a 

fee may be charged if advisory work is involved. Clients 

are advised to be clear with the contractor from the outset 

4. When asking for an estimate or quotation indicate when 

you would like the work undertaken. The contractor will 

advise whether or not this is practical or possible 

5. Respond to estimates or quotations quickly – try to advise 

the contractor within 7–10 days whether or not you wish 

them to undertake the work and make clear the terms of 

acceptance 

6. Ensure issues of tree protection legislation including 

TPO’s/Conservation Area or other restrictions, i.e. 

covenants/third party trees are consented/resolved prior 

to commissioning works 

This directory lists ARB Approved Contractors by region 

however some will operate throughout the UK and even 

abroad. 

In the unlikely event that clients are not satisfied with services 

from an ARB Approved Contractor a complaints procedure 

may be followed as detailed on page 51 (NB this option is only 

available after all ‘reasonable’ attempts have been made to 

resolve the matter directly with the contractor concerned and 

evidence of such can be made available if required.)

ascertain the competence of ARB Approved Contractors it can 

not accept liability in respect of any persons or companies 

named in this directory. The Arboricultural Association can not 

be held responsible for the advice or actions of any persons or 

companies named in this directory.

In the unlikely event that a client is not satisfied with the services provided by anyone in this directory the Arboricultural Association 

operates a complaints assessment service. 

Complaints 

against AA registered consultants 

and AA approved contractors 

Complaints will normally only be accepted from Clients of the 

Consultant or Contractor. Complaints from non-clients will only 

be accepted at the discretion of the Chairman of the Association’s 

Professional Committee. 

1. All complaints must be in writing to the Director at The Malthouse, 

who will acknowledge by return of post and include a 

copy of this procedure. The Director will consider whether the 

complaint is both competent and relevant, that is, whether the 

incident(s) complained of, if substantiated, could amount to a 

breach of the Code of Ethics or Code of Professional Conduct. 

Should the complaint not be deemed competent and relevant 

the Director will respond to the Complainant accordingly 

stating the reasons for the rejection of the complaint. 

2. If the complaint is deemed competent and relevant the 

Consultant or Contractor complained about (the Complainee) 

shall be sent a copy of the complaint and invited to submit a 

written representation within a period not exceeding 28 days 

from this invitation. At the same time they will be sent a copy 

of this procedure. 

3. Copies of correspondence, including the complaint and the 

Complainee’s representation will be made available to both 

parties unless the Director is informed in writing that Court 

proceedings are pending. If proceedings are pending the 

Director will advise the Complainant in writing that the 

complaint cannot be dealt with until proceedings are over. 

4. After the period not exceeding 28 days, or once Court 

Proceedings are over the Director will provide copies of all 

correspondence to the Chair of Professional Committee. The 

Chair of Professional Committee will convene a Complaints 

Panel comprising him and two others, usually from Professional 

Committee to whom all correspondence shall be forwarded. 

The Complaints Panel does not have to meet; it may deal with 

a complaint by correspondence if it so wishes. The Chairman 

of the Professional Committee may also appoint a person with 

expert knowledge in a particular field if he thinks it 

appropriate. 

5. The Complaints Panel will first consider whether or not any 

additional information is needed from either party. If further 

information is requested from the Complainant, failure 

to reply within 28 days may result in the complaint 

being dismissed. If further information is requested from the 

Complainee failure to reply within 28 days may result 

in the complaint being resolved on the basis of 

information available. 

6. If further evidence is received it shall be copied to the other 

party after the 28 day period at which point each party shall 

then have a further 14 days in which to make final comment on 

the additional information of the other. 

7. The Complaint determination process begins after point 4, 5, 

or 6 as appropriate, at which point the Complaints Panel shall 

have 28 days in which to investigate and inform both parties of 

its decision. This time may be extended by 14 more days if a 

specialised or independent site visit is deemed necessary. 

Both parties shall be informed of such inspection and told that 

they may attend if they wish. The Complaints Panel may 

require the Complainee to attend a meeting if it deems it 

necessary for information purposes. In such a case the Panel 

must inform the Complainant of this and that he may attend. 

Neither party shall be allowed to make further representations. 

If the complaint relates to a matter that is the subject of Court 

proceedings the Committee may delay investigation until 

proceedings are over. 

8. If a complaint is upheld, the Complainant shall be informed of the 

penalties and told which has been applied in their case. The 

Complaints Panel may impose one of the following sanctions: 

a. Written Reprimand – The Panel admonishes a Complainee 

and the reprimand is noted on the Complainee’s record. The 

Panel Chairman has the option of publishing a note on the 

complaint in the Association’s ArbNews. The name of the 

Complainee is not usually published in this case. 

b. Severe Reprimand – The Complainee is firmly admonished 

by the Panel, who at this stage may take into account any 

previously upheld complaints against the Complainee. A 

severe reprimand will involve a reassessment of the 

Complainee for AA Registered Consultant or AA Approved 

Contractor status. The Panel Chairman has the option of 

publishing the complaint in the Associations newsletter, and 

in this instance the Complainee’s name could, at the 

discretion of the Chairman, be published. 

c. Removal of AA Approved Contractor or AA Registered 

Consultant Status and/or Association Membership – In 

response to a serious or second major complaint. 

Responsibility for removal rests with the Complaints Panel 

or the Appeals Panel. The Panel Chairman has the option of 

publishing the complaint in the Associations newsletter, and 

in this instance the Complainee’s name would usually be 

published. 

9. Any appeal against the decision must be to the Director and 

be made within 14 days of receipt of that decision. The appeal 

shall be heard by a panel appointed by and including the 

Chair of the Association and shall be handled to the same 

timescale as the original complaint. Supplementary evidence 

from both parties will not be allowed and appeals will only be 

allowed on procedure (the manner in which the complaint was 

handled) not content. The decision of the Appeals Panel shall 

be final. 

10. The Association will treat all complaints and appeals with total 

confidentially until such time as a complaint or appeal has 

been upheld or dismissed, when a decision may be taken to 

publish details anonymously or otherwise.

What’s in a word? 

Tree pruning may be necessary to maintain 

a tree in a safe condition, to remove dead 

branches, to promote growth, to regulate 

size and shape or to improve the quality of 

flowers, fruit or timber. Improper pruning can 

lead to trees becoming unsightly, diseased and/ 

or potentially dangerous. 

It is important that clients understand the basic 

terms commonly used to describe tree work 

operations so that they can ask for 

what they want or understand what the 

arboriculturist is recommending. Did you know, 

for example, that a ‘20% crown thin’ will not 

reduce the height of the tree? Nor will a ‘crown 

lift to 4m’. 

The three main pruning options are shown 

below, and after that a glossary of other terms 

that you may find helpful. These are very general 

Section 1: Main Pruning Definitions 

1. Crown Thinning 

Crown thinning is the removal of a portion of 

smaller/tertiary branches, usually at the outer 

crown, to produce a uniform density of foliage 

around an evenly spaced branch structure. It is 

usually confined to broad-leaved species. Crown 

thinning does not alter the overall size or shape 

of the tree. Material should be removed 

systematically throughout the tree, should not

guidance by leaflets and other publications.

exceed the stated percentage and not more than 

30% overall. Common reasons for crown thinning 

are to allow more light to pass through the tree, 

reduce wind resistance, reduce weight (but this 

does not necessarily reduce leverage on the 

structure) and is rarely a once only operation 

particularly on species that are known to 

produce large amounts of epicormic growth.

2. Crown Lifting (or Crown Raising) 

Crown lifting is the removal of the lowest branches and/or 

preparing of lower branches for future removal. Good practice 

dictates crown lifting should not normally include the removal 

of large branches growing directly from the trunk as this can 

cause large wounds which can become extensively decayed 

leading to further long term problems or more short term 

biomechanical instability. Crown lifting on older, mature trees 

should be avoided or restricted to secondary branches or 

shortening of primary branches rather than whole removal 

wherever possible. Crown lifting is an effective method of 

increasing light transmission to areas closer to the tree or to 

enable access under the crown but should be restricted to less 

than 15% of the live crown height and leave the crown at least 

two thirds of the total height of the tree. Crown lifting should be 

specified with reference to a fixed point, e.g. ‘crown lift to give 

5.5m clearance above ground level’. 

Section 2: Other useful terms 

associated with tree work 

Adaptive growth 

An increase in wood production in localised areas in response 

to a decrease in wood strength or external loading to maintain 

an even distribution of forces across the structure. 

Adventitious/epicormic growth 

New growth arising from dormant or new buds directly from 

main branches/stems or trunks. 

Bracing 

Bracing is a term used to describe the installation of cables, 

ropes and/or belts to reduce the probability of failure of one or 

more parts of the tree structure due to weakened elements 

under excessive movement. 

Branch bark ridge and collar 

See diagram 3 section 3. Natural features of a fork or union 

3. Crown Reduction 

The reduction in height and/or spread of the crown (the foliage 

bearing portions) of a tree. Crown reduction may be used to 

alleviate mechanical stress on individual branches or the 

whole tree, make the tree more suited to its immediate 

environment or to reduce the effects of shading and light loss, 

etc. The final result should retain the main framework of the 

crown, and so a significant proportion of the leaf bearing 

structure, and leave a similar, although smaller outline, and not 

necessarily achieve symmetry for its own sake. Crown 

reduction cuts should be as small as possible and in general 

not exceed 100mm diameter unless there is an over-riding 

need to do so. Reductions should be specified by actual 

measurements where possible and reflect the finished result, 

but may also refer to lengths of parts to be removed to aid 

clarity, e.g. ‘crown reduce in height by 2.0m and lateral spread 

by 1.0m, all round, to finished crown dimensions of 18m in 

height by 11m in spread (all measurements approximate.)’. Not 

all species are suitable for this treatment and crown reduction 

should not be confused with ‘topping’, an indiscriminate and 

harmful treatment.

that may or may not be visually obvious. Neither the branch 

bark ridge nor collar should be cut. 

Callus 

Undifferentiated tissue initiated as a result of wounding and 

which become specialised tissues of the repair over time. 

Cavity 

A void within the solid structure of the tree, normally 

associated with decay or deterioration of the woody tissues. 

May be dry or hold water, if the latter it should not be drained. 

Only soft decomposing tissue should be removed if necessary 

to assess the extent of decay. No attempt should be made to 

cut into or expose living tissue. 

Co-dominant stems 

Two or more, generally upright, stems of roughly equal size 

and vigour competing with each other for dominance. Where 

these arise from a common union the structural integrity of 

that union should be assessed.

Conservation Area 

See following section “Tree Protection” page 56. 

Coppicing 

The cutting down of a tree to within 300 mm (12 in) of the 

ground at regular intervals, traditionally applied to certain 

species such as Hazel and Sweet Chestnut to provide stakes 

etc. 

Crown 

The foliage bearing section of the tree formed by its branches 

and not including any clear stem/trunk. 

Deadwood 

Non-living branches or stems due to natural ageing or external 

influences. Deadwood provides essential habitats and its 

management should aim to leave as much as possible, 

shortening or removing only those that pose a risk. Durability 

and retention of deadwood will vary by tree species. 

Decline 

When a tree exhibits signs of a lack of vitality such as reduced 

leaf size, colour or density 

Dieback 

Tips of branches exhibit no signs of life due to age or external 

influences. Decline may progress, stabilise or reverse as the 

tree adapts to its new situation. 

Dormant 

The inactive condition of a tree, usually during the coldest 

months of the year when there is little or no growth and leaves 

of deciduous trees have been shed. 

Drop Crotching 

Shortening branches by pruning off the end back to a lateral 

branch which is at least 1 / 3 of the diameter of the removed 

branch. 

Felling Licence 


Fertilising 

The application of a substance usually to the tree’s rooting 

area (and occasionally to the tree) to promote tree growth or 

reverse or reduce decline. This will only be effective if nutrient 

deficiency is confirmed. If decline is the result of other factors 

such as compaction, physical damage, toxins etc, the 

application of fertiliser will not make any difference. 

Formative pruning 

Minor pruning during the early years of a tree’s growth to 

establish the desired form and/or to correct defects or 

weaknesses that may affect structure in later life. 


Fungi/Fruiting bodies 

A member of the plant kingdom that may colonise living or 

dead tissues of a tree or form beneficial relationships with the 

roots. The fruiting body is the spore bearing, reproductive, 

structure of that fungus. Removal of the fruiting body will not 

prevent further colonisation and will make diagnosis and 

prognosis harder to determine. Each colonisation must be 

considered in detail by a competent person to determine the 

long term implications of tree health and structure when 

considered alongside the tree species, site usage etc. 

Lopping and Topping 

Generally regarded as outdated terminology but still part of 

Planning legislation. Lopping refers to the removal of large 

side branches (the making of vertical cuts) and topping refers 

to the removal of large portions of the crown of the tree (the 

making of horizontal cuts, generally through the main stems). 

Often used to describe crude, heavy-handed or inappropriate 

pruning. 

Painting or Sealing 

Covering pruning cuts or other wounds with a paint, often 

bitumen based. Research has demonstrated that this is not 

beneficial and may in fact be harmful. On no account should 

timber treatments be used as these are definitely harmful to 

living cells. 

Pollard 

The initial removal of the top of a young tree at a prescribed 

height to encourage multistem branching from that point, 

traditionally for fodder, firewood or poles. Once started, it 

should be repeated on a cyclical basis always retaining the 

initial pollard point, or bolling as it becomes known. 

Retrenchment pruning 

A form of reduction intended to encourage development of 

lower shoots and emulate the natural process of tree aging. 

Root pruning 

The pruning back of roots (similar to the pruning back of 

branches). This has the ability to affect tree stability so it is 

advisable to seek professional advice prior to attempting root 

pruning. 

Topping

Tree Preservation Order (TPO) 


Vitality 

The degree of physiological and biochemical processes (life 

functions) within an individual, group or population of trees.

Section 3: The importance of the pruning cut 

Every pruning cut inflicts a wound on the tree. The ability of a 

tree to withstand a wound and maintain healthy growth is 

greatly affected by the pruning cut – its size, angle and 

position relative to the retained parts of the tree. As a general

Section 4: When to prune 

As a general rule pruning should be avoided during the time of 

leaf/needle production (when the tree draws on its energy 

reserves) and at the time of leaf/needle fall (when the tree 

stores energy). Outside these periods most trees can be 

pruned at any time of the year, with a few exceptions: 

Cherry, Plum, and related trees (Prunus species) should be 

pruned soon after flowering to reduce the risk of bacterial 

infection. 

Section 5: Legal Status 

Some trees are protected by legislation, and it is essential that 

you establish the legal status of trees prior to carrying out 

works to them. Unauthorised work to protected trees could 

lead to prosecution, resulting in substantial fines and a 

criminal record. Further information on tree protection can be 

found in the following section “Tree Protection” page 56.

or shortened to a lateral which is at least 1 / 3 of the diameter of 

the removed portion of the branch, and all cuts should be kept 

as small as possible. Examples of correct pruning cuts are 

shown as follows. 

Maple, Birch, Beech and Walnut should be pruned in leaf or 

just after leaf fall and Magnolia in high summer to avoid 

‘bleeding’ (exuding sap), which, although not considered 

damaging, can be unsightly. 

If possible, pruning should be avoided when recovery may be 

impaired, for example during a period of physiological stress 

following previous tree work or construction-related damage or 

seasonal weather factors such as drought.

Tree Protection brief guidance 

Including…Tree Preservation Orders, Conservation Areas, Planning Conditions, Felling Licences 

and Restrictive Covenants 

Many trees in the UK are legally protected, typically by Tree Preservation 

Orders, Conservation Areas, Planning Conditions, Felling Licences and/ 

or Restrictive Covenants. Anyone wishing to undertake work to a tree 

(for example a tree owner or tree contractor/arborist/tree surgeon) is 

advised to make suitable enquiries as to the legal status of the tree and 

any protection afforded to it in order to protect themselves and others 

from possible criminal prosecutions. Throughout this Guide the term 

tree (singular) could equally be applied to trees (plural). 

1. Tree Preservation Orders (TPOs) 

General 

TPOs are administered by Local Planning Authorities (LPAs, normally 

planning departments of local councils) and National Park Authority 

(NPA, where applicable). 

The LPA or NPA (hereinafter the LPA) should be able to advise, over the 

phone within 48 hours, if there is a TPO in place at any location within 

its administrative area. A TPO is placed on a tree where it is considered 

expedient to do so and where it offers, primarily, visual amenity to the 

area. 

Categories 

A TPO can be made on an individual tree (T1, T2 etc.), a group (G1, G2 

etc.), an area1 (A1, A2 etc.) or a woodland2 (W1, W2 etc.). TPOs can 

include any combination of these. 

Applications 

Anyone wishing to undertake work to a TPOd tree must first make an 

application to the LPA for those works. An application is required for any 

work not covered by an exemption (see exemptions section following). 

The standard application form supplied by the LPA or available from the 

Planning Portal website (www.planningportal.gov.uk) must be used for 

this purpose clearly identifying the tree, the work(s) and reason(s) for the 

proposed work. 

Where it is alleged a tree is dangerous or where a defect is present that 

allegedly may affect the safety of the tree evidence must be provided by 

a competent arboriculturist. Where tree related subsidence is alleged a 

structural engineer or chartered surveyor’s report will normally be 

required. 

LPAs usually acknowledge receipt of an application by return and must 

place a copy on a public register for anyone to see, it may also publicise 

it to the wider community. 

The LPA should then determine the application within 8 weeks, if it does 

not then an appeal can be made for non-determination but this is likely

to be a long winded process and it is usually better to approach the LPA 

direct and ask for a determination. However if the LPA does not respond 

the works cannot proceed. 

The possible determinations are:

refusal – the LPA will state the grounds for refusal. The applicant can 

appeal to the Secretary of State, usually the appeal must be within 

28 days of the determination 

consent with no conditions – either in whole or in part (e.g. an 

application for a 30% crown reduction is permitted but only to 15%. 

The applicant can appeal for the other 15% 

consent with conditions – as above, with duration conditions e.g. 

consent valid for 2 years, work quality conditions e.g. in accordance 

with good arboricultural practice such as BS 3998, replacement 

planting conditions e.g. a suitable replacement to be approved by 

the LPA and planted during the next available planting season, etc. 

An appeal maybe made against any condition imposed. 

NB: Most consents will be subject to some form of condition. 

All appeals are handled by the Planning Inspectorate and will normally 

be dealt with on the basis of the original application and the information 

provided in that application. Where it is anticipated that consent is likely 

not to be granted or the application may be controversial it becomes 

important to ensure that professional advice is sought and submitted as 

part of the application as there may be limited opportunity to produce it 

at a later date. The majority of appeals will be dealt with as written 

representations (a ‘fast-track’ procedure) although either party can 

request a hearing or public local inquiry. 

Penalties 

Anyone who cuts down, uproots, tops, lops (which can include 

unauthorised pruning even if it accords with good arboricultural 

practice), wilfully damages or wilfully destroys a tree subject to a TPO 

without permission is guilty of an offence. 

Serious financial penalties can be, and have been, incurred for 

contraventions including fines of up to £20,000 for the cutting down of a 

tree (wilful destruction), along with a requirement to replacement plant, 

or up to £2,500 for the lopping (pruning) of a tree (wilful damage). 

2. Conservation Areas (CAs) 

General 

As with TPOs, CAs are administered by the LPA. CAs are usually 

designated around listed buildings or sites of special architectural or 

historical interest and include all trees (75mm diameter or greater 

measured at 1.5m above ground level) regardless of species, as they 

may contribute to the landscape character or setting of the area.

Notifications 

Anyone wishing to undertake work to a tree in a CA must serve notice 

on the LPA 6 weeks prior to undertaking those works. A notice (often 

called a section 211 notice) is required for any works other than those 

covered by an exemption (see exemptions section following). The notice 

must be in writing and use of the standard application form (see section 

1 TPOs) is recommended for this purpose but is not obligatory – in all 

instances the notification must clearly identify the tree and the work(s). 

Information regarding the reasons for the proposals and the ownership 

of the tree is useful but not obligatory. 

LPAs should acknowledge receipt of the notice, state the 6 week expiry 

date and place it on a public register. Again the LPA may choose to 

publicise it to the wider community. 

Upon receipt of a notice LPAs can

make the tree concerned the subject of a TPO within the 6 weeks to 

prevent the proposed works being undertaken. A TPO may be made 

at any time after the expiry of the 6 week notice period but the tree 

would be unprotected between the expiry date of the notice and the 

date the TPO was served. If a TPO is made as a result of a CA 

notification anyone wishing to undertake work to the tree must apply 

as described in the TPO section above 

not make the tree concerned the subject of a TPO and allow the 6 

week notification period to expire thereby allowing the works to 

proceed. In this case the works notified may be carried out within a 

2 year time period. It would be an offence to undertake the works 

after the 2 year period without serving a new 6-week notification and 

waiting for the 6 weeks. It is advisable to check that the LPA agrees 

the 6 week period has expired and that a TPO has not been made, 

ideally by fax or email but if by telephone, note the date and time of 

the conversation and the name of the officer with whom the 

conversation was made 

not make the tree concerned the subject of a TPO and advise the 

contractor the works can proceed. In this case the 2 year time period 

applies as above 

negotiate with the notifier (for example if they are prepared to accept 

some works but not the full extent within the notice). If the notifier is 

prepared to negotiate and agrees to revise the works they must formally 

withdraw the notice and submit a new one detailing revised works. 

The LPA cannot refuse consent to a notice nor grant conditional consent, 

e.g. replacement tree planting (the CA notice is not the same as a TPO 

application and cannot be treated as such). 

Penalties 

Serious financial penalties can be incurred for unauthorised works to a 

tree within a CA similar to those which can be incurred for a TPOd tree 

(see above).

3. Planning Conditions 

General 

Planning conditions are often used by LPAs as a means of securing the 

retention of trees, hedgerows and other landscape features on sites 

where building developments will result from planning permission being 

granted. There is a general acceptance that, unless clearly stated 

otherwise, a planning condition in relation to trees, hedgerows and 

landscape features is valid for a maximum period of 10 years and 

probably only enforceable in most instances for 5 years. 

It follows that if it is proposed to retain trees long term at a site then TPOs 

should be used for this purpose rather than planning conditions. 

LPAs may be reluctant to confirm the presence of planning conditions at 

a site as it often involves trawling the planning files because 

comprehensive records may not be kept. If valid planning conditions are 

in place anyone wishing to undertake work to trees shown as part of the 

planning condition must ensure they liaise with the LPA and obtain any 

necessary consents. 

4. Felling Licences 

General 

Felling Licences are administered by the Forestry Commission (FC) under 

the Forestry Act 1967. A felling licence may be needed where the volume 

of the tree or total volume of the trees to be felled exceed 5 cubic metres 

of timber (roughly one very large broadleaf or 5 large conifers). Generally 

private domestic gardens, churchyards, parks and other areas of public 

open space are exempt from felling licence regulations, (see also 

exemptions section following). 

Obtaining a felling licence 

Where consent is needed to fell a tree(s) containing more than 5 cubic 

metres of timber an application must be made to the local FC 

conservancy which will consider the granting of a felling licence or 

approval under a Dedication Scheme.

5. Sites of Special Scientific Interest (SSSI) 

SSSIs are designated by the Statutory Nature Conservation Organisation 

(SNCO) for each country of the United Kingdom for particular wildlife or 

geological reasons and cover approximately 7% of the UK land area. Each 

SSSI will have a management plan and a list of operations requiring the 

SNCOs consent prior to carrying out works. Failure to secure agreement 

or following the conditions applied will cause an offence to be committed.

Any activity that recklessly or intentionally harms the SSSI or its flora or 

fauna will be an offence liable on summary conviction to a fine not 

exceeding £20,000 or on conviction on indictment to an unlimited fine. 

6. Restrictive Covenants 

General 

Covenants or other restrictions in the title of a property or conditions in 

a lease may require the consent of a third party prior to carrying out 

some sorts of tree work, including removing trees and hedges. This may 

be the case even if TPO, CA and felling licence regulations do not apply. 

It may be advisable to consult a solicitor. 

Restrictive covenants are in effect a form of private planning control: they 

are restrictions on the development or use of land, enforceable by one 

landowner against another. Subject to various rules (in particular, they 

must be negative or “restrictive” in their effect) they will still apply after 

changes in land ownership. 

For example, an estate of houses may be subjected to restrictive 

covenants, designed to protect the look and amenity of the estate – e.g. 

that front gardens remain unfenced, or that the parking of caravans is 

not allowed. 

7. Exemptions 

Exemptions allow certain works to a tree to be carried out without notice 

or application to either the Local Authority or the Forestry Commission. 

These may be based upon size or condition. Works to a tree that is 

dead, dying 3 or dangerous are exempt from the requirement to apply or

notify the relevant authority, although it is recognised as good practice 

to inform the authority. Where a protected tree is imminently dangerous, 

the minimum work necessary to abate the danger may be undertaken 

without reference to the relevant authority, any further work requiring an 

application or notification as appropriate. A protected fruit tree may be 

pruned without consent where the pruning is undertaken for the benefit 

of fruit production and is in accordance with good horticultural 

practice. 

Felling under an exemption normally requires the planting of a 

replacement tree of the same type and in the same place unless the 

relevant authority formally waives this requirement. 

Any person undertaking work to a protected tree under an exemption 

should carefully ensure that the exemption applies: if challenged by the 

relevant authority the evidential burden is upon the tree worker to 

demonstrate why the exemption applies. This could be done, for 

example, by providing evidence of the size and/or condition of the tree 

in the form of photographs, an expert’s report, or other documentation. 

If an exemption does not apply it is the tree worker’s responsibility to 

show that the necessary consents have been obtained: failure to be able 

to do so could lead to criminal prosecution. In some circumstances 

authorities will prosecute others (as well as the tree worker) such as the 

tree worker’s employer, agent or the land owner. 

This brief guide should not be taken as a definitive interpretation of the 

law as it affects trees but is intended purely to provide general guidance. 

When planning work to protected trees it is advisable to seek expert 

advice. This advice may not be wholly applicable outside England.

Success 

Significant issues have arisen over the years that have 

threatened the future of tree care and the arboricultural 

industry. For more than four decades the Association has 

pursued the interests of trees, their owners and those who 

care for them. 

Through the Association’s work arborists may 

still choose the type of harness that suits 

them best rather than being forced to use a full 

body harness with fall-arrest system. 

Legislation was proposed from Europe that 

could have made it impossible to manufacture chainsaws in 

Europe. Whilst the Association supports the 

concept of ‘cleaner’ saws manufacturers 

said they needed more time to develop 

technology. The Association

In 2003/4 the Association led the industry in helping find 

solutions to the insurance crisis faced by arboricultural 

contractors. It co-ordinated efforts and produced the 

commonly accepted contractors’ safety standards now 

published and recognised by the insurance industry. 

Working with the Health and Safety Executive 

and other regulators the Association 

developed a Guide to Good 

Climbing Practice which 

instructs climbers on techniques 

that are safe and conform to the 

Work at Height Regulations 2005, 

clarifying concerns about twinrope 

access and the use of 

Mobile Elevated Work Platforms. 

The Association 

initiated and with 

Lantra Awards 

developed tree 

inspection training to 

nationally accepted 

standards, 

standardising 

practices and 

reporting formats in 

this essential aspect 

of arboriculture affecting trees and public safety. It is also a 

major contributor to guidance published by the National Tree 

Safety Group.
