LEO FRANK WAS INNOCENT<br />

Leo Frank was innocent.<br />

A message from<br />

Rabbi Steven Lebow<br />

Those four words have eluded polite conversation in Atlanta for 95<br />

years. Frank, the superintendent of the National Pencil Factory, was<br />

accused of murdering Mary Phagan, a thirteen-year-old employee, in<br />

1913. Phagan took the trolley down to midtown Atlanta on Confederate<br />

Memorial Day to collect her paycheck. She was never heard from again.<br />

Her lifeless body was found at the bottom of an elevator shaft in the<br />

factory. The last man to admit seeing her alive was Leo Frank, the<br />

superintendent who hailed from Brooklyn, New York.<br />

At first the police arrested a half dozen men whom they thought had<br />

committed the crime. Lacking any evidence, they released all of the<br />

accused. Without a suspect they turned their gaze on Frank. The Jewish<br />

New Yorker was a suspicious outsider to those who were used to a<br />

homogenous South.<br />

Frank had an alibi <strong>and</strong> there was no forensic evidence to tie him to the<br />

crime. There were no witnesses to the ostensible murder until Jim<br />

Conley, the factory janitor, claimed that he saw Leo Frank with Mary<br />

Phagan.<br />

The prosecution produced female witnesses who claimed that Frank had<br />

once ogled them. Many of the witnesses eventually recanted their<br />

testimony. The trial <strong>and</strong> its appeal dragged on for two years as the case<br />

wound its way through the courts. It went as high as the Supreme Court,<br />

where three of the judges, the minority report, argued to release Frank.<br />

Finally, Frank was sentenced to death in 1915. Behind the scenes<br />

William Smith, the lawyer for Jim Conley, came forward <strong>and</strong> declared<br />

that it was his own client, <strong>and</strong> not Frank, who was guilty. Hundreds of<br />

Protestant ministers came forward to protest Frank’s innocence, but<br />

nothing was done.<br />

Finally, the most courageous politician of his era, Governor John Slaton,<br />

commuted Frank’s death sentence to life imprisonment in order to give<br />

Frank’s lawyers more time to argue for his innocence.<br />

As soon as he commuted the Frank sentence, Governor Slaton’s life<br />

was threatened by an angry mob. The National Guard had to be called<br />

out to protect the Governor’s home in Buckhead. Under the cover of<br />

darkness, Frank was spirited away to serve his term at the Georgia<br />

State Penitentiary in Milledgeville.<br />

On a hot August night, ninety five years ago, a prestigious group from<br />

Marietta planned to abduct Leo Frank from the penitentiary. They<br />

drove all night on small country roads to break Frank out of the prison.<br />

Frank was kidnapped from his cell in an act that writer Steve Oney<br />

calls “state sponsored terrorism.” They drove Frank to Marietta, <strong>and</strong><br />

lynched him about a block from the “Big Chicken,” on l<strong>and</strong> owned by<br />

the sheriff of Marietta. The lynch party was planned <strong>and</strong> orchestrated<br />

by a former Georgia governor, two Georgia state representatives, <strong>and</strong><br />

various judges.<br />

In 1986, the Georgia Board of Pardons <strong>and</strong> Paroles finally bestowed a<br />

pardon on Leo Frank based on the fact that the state did not protect<br />

Frank’s freedom.<br />

But what has never been truly acknowledged is Frank’s innocence of<br />

any guilt in the murder of Mary Phagan. Over the years I have<br />

interviewed judges, prosecuting attorneys <strong>and</strong> policemen. All have<br />

concurred that were Frank’s trial to be held today the case would be<br />

thrown out of court. There was no evidence, no real eyewitness, no<br />

confession. In 1995, on the 80th anniversary, I affixed a plaque to the<br />

building nearest the site of the Frank lynching. It reads, “Leo Frank -<br />

wrongly accused, falsely tried, wantonly murdered.” This week, 95<br />

years since the Frank lynching, the Georgia Historical Society will<br />

finally erect its own plaque. I have advocated for this historical marker<br />

for a number of years. It has been a long time coming, but the time is<br />

right.<br />

Almost a century later it is time for Georgia to acknowledge one simple<br />

fact, four words long.<br />

Leo Frank was innocent.<br />

MESSAGE FROM THE PRESIDENT<br />

Dear Congregants:<br />

As president of our Temple, I wanted to<br />

take the time to update everyone on the<br />

efforts <strong>and</strong> work of the Temple staff,<br />

volunteers <strong>and</strong> the Board of Trustees.<br />

During the spring of 2008, we have some<br />

very exciting programming taking place<br />

here for members of all ages.<br />

On March 8, Simcha 25 <strong>and</strong> <strong>TKE</strong> hosted Rick Recht, one of the<br />

top-touring musicians in Jewish music, playing over 150<br />

concerts a year in the United States <strong>and</strong> abroad. He has become<br />

an icon for Jewish youth in the United States, elevating the<br />

medium of Jewish music as a powerful <strong>and</strong> effective tool for<br />

developing Jewish pride <strong>and</strong> identity among the masses. It gave<br />

me great pleasure to welcome Rick to our temple as the host site<br />

for his Atlanta visit.<br />

Our second big spring event will be the finale to our year-long<br />

Simcha 25 celebration. At Shabbat services on Friday, May 16,<br />

we will welcome Rabbi Lennard Thal, the Senior Vice President<br />

of the Union for Reform Judaism (URJ). At that time, he will<br />

reinstall Temple Kol Emeth into the Union to mark our 25th<br />

anniversary as a congregation. The celebration continues on<br />

Saturday, May 17 with an “Evening of the Arts.” This event<br />

will feature a cantorial concert starring our own Cantor Mark<br />

Perman <strong>and</strong> some of his esteemed colleagues, along with an art<br />

auction featuring works by Regency Fine Art <strong>and</strong> some of our<br />

<strong>TKE</strong> artisans. As with all of our Simcha 25 events, admission is<br />

complimentary, so please mark your calendars. This is a<br />

weekend not to be missed.<br />

The board continues to manage the business of the temple while<br />

creating the spiritual <strong>and</strong> religious fulfillment we all want to<br />

experience. Last month, we replaced our current mortgage with<br />

a lower interest mortgage that will save the temple over $50,000<br />

per year. I want to thank all those who have committed to the<br />

capital campaign. We have over $2 million in commitments<br />

<strong>and</strong> over $600,000 collected to date. We currently have a $3.7<br />

million mortgage that was $5.1 million when our capital<br />

campaign began. With our members’ involvement we will get<br />

our mortgage paid off.<br />

Over the next few months, your Temple has some very exciting<br />

programs for all members. I hope you will join me at these<br />

events. If you have any questions, please feel free to contact<br />

If you’ve enjoyed some of our recent<br />

Shabbat musical programs at <strong>TKE</strong> such as<br />

Friday Night Live with Judy Cole <strong>and</strong> Co.,<br />

the service for Darfur featuring my friend,<br />

composer David S<strong>and</strong>ers <strong>and</strong> the<br />

outst<strong>and</strong>ing musicians who supported him,<br />

then would you consider making a<br />

contribution to the Temple Kol Emeth<br />

Music Fund? The <strong>TKE</strong> Music Fund gives<br />

us a chance to bring in some outst<strong>and</strong>ing<br />

guest artists <strong>and</strong> programs for our members.<br />

In the past we’ve invited some innovative klezmer musicians<br />

for our Jose Bowen Klezmer Service as well as the well known<br />

Israeli flutist Mattan Klein <strong>and</strong> we are hoping to do a great deal<br />

more in the future. If you would like to discuss with me some<br />

ideas about musical performers that you would like to see here<br />

at <strong>TKE</strong>, then by all means give me a call in the office or make<br />

an appointment to come speak with me.<br />

On another note I would like to wish everyone a Chag Sameach<br />

<strong>and</strong> a Passover experience that truly lifts you from whatever<br />

feeling of Mitzrayim (slavery) that might be holding you back<br />

in your life. While many people think of Passover as purely a<br />

historical experience it is actually one that is meant to engage us<br />

every year on a meaningful <strong>and</strong> spiritual journey of exodus from<br />

one place in our lives to another.<br />

Finally, there will be an outst<strong>and</strong>ing cantorial concert on<br />

Saturday night, May 17, featuring the talents of Cantor<br />

Meredith Stone, Cantor Barbara Margulis, Pianist extraordinaire<br />

Judy Cole <strong>and</strong> some guest performers from within our<br />

congregation. There will be more to follow, but hold that date<br />

for the final Simcha 25 event that promises a great time for all.<br />

CANTOR’S CORNER


Dear <strong>TKE</strong> Parents,<br />

THE FANNIE & JOE MARGOLIN RELIGIOUS SCHOOL<br />

I suppose this is the appropriate time to share<br />

with you the details of the visitation weekend<br />

recently experienced <strong>and</strong> to thank each of you<br />

for the part you played in making the weekend<br />

a success. Yes! The weekend was a success,<br />

regardless of what the ultimate results might<br />

prove. I do believe within my heart of hearts<br />

that we passed all tests <strong>and</strong> that we will receive our papers. I do<br />

want to remind you though, that there are times when we expect<br />

something to happen only to find that we have miscalculated,<br />

though I don’t anticipate that in this case. I am reminded of a<br />

story I once heard of one woman who was guilty of just such an<br />

error. Let me share it with you.<br />

A young lady was waiting for her flight in the boarding room of a<br />

big airport. As she would need to wait many hours, she decided to<br />

buy a book to read during this time. She also bought a packet of<br />

cookies. She sat down in an armchair, in the VIP room at the<br />

airport, to rest <strong>and</strong> read in peace. Beside the armchair where the<br />

packet of cookies lay, a man sat down in the next seat, opened his<br />

magazine <strong>and</strong> started reading.<br />

When she took out the first cookie, the man took one also. She<br />

felt irritated, but said nothing. She just thought: “What a nerve! If<br />

I was in the mood I would punch him for being so daring!” For<br />

each cookie she took, the man took one, too. This was infuriating<br />

her more <strong>and</strong> more, but she didn’t want to cause a scene. When<br />

only one cookie remained, she thought, “Ah... What’s this man<br />

going to do now?”<br />

Then, the man, taking the last cookie, divided it into half, giving<br />

her one half. Ah! That was too much! She was much too angry<br />

now! In a huff, she took her book, her things <strong>and</strong> stormed to the<br />

boarding place.<br />

When she sat down in her seat, inside the plane, she looked into<br />

her purse for her eyeglasses, <strong>and</strong>, to her surprise, her packet of<br />

cookies was right there, untouched, unopened! She felt so<br />

ashamed! She realized that she was wrong. She had forgotten that<br />

she put her cookies in her purse. The man had divided his cookies<br />

with her without feeling angered or bitter...while she had been<br />

very angry, thinking that she was dividing her cookies with him.<br />

And now there was no chance to explain herself...nor to<br />

apologize.<br />

There are four things that you cannot recover.<br />

The stone...after the throw!<br />

The word...after it’s said!<br />

The occasion...after the loss!<br />

The time...after it’s gone!<br />

We need to always remember that the story is never over until the<br />

last chapter has been written.<br />

RSPG Notes<br />

KUDOS to the <strong>TKE</strong> Fanny <strong>and</strong> Joe Margolin Religious School!<br />

Dr. Andron, the teaching staff, the volunteers from RSPG <strong>and</strong><br />

many others participated in an evaluation by the NATE<br />

(National Association of Temple Educators) team for<br />

accreditation of our religious school. If we receive the<br />

accreditation, <strong>TKE</strong> will have the only accredited religious<br />

school in Georgia. At the time of this writing, word is not yet<br />

official about receiving the accreditation, but the feedback from<br />

the evaluators was very positive. The process has been a long<br />

one, with a detailed evaluation over the past two years, finally<br />

resulting in a personal site evaluation by the NATE team the<br />

last weekend in February. All involved conducted themselves<br />

with the utmost professionalism <strong>and</strong> received the highest of<br />

compliments from the NATE team. We should all feel proud<br />

<strong>and</strong> privileged to know that we are sending our children to one<br />

of the best religious school programs in all of Georgia.<br />

Fundraising has been successful this semester! Thank you to all<br />

who have supported the efforts of the latest fundraisers. First,<br />

thank you to Dan Weinberg <strong>and</strong> his seventh, eighth <strong>and</strong> ninth<br />

graders who cooked those savory burgers to raise money for the<br />

Ner Tamid project. Over $300 was raised. The Passover<br />

Barton’s c<strong>and</strong>y sale was also a huge success, bringing in over<br />

$1,000 to help the religious school with supplies <strong>and</strong> textbooks.<br />

Looks like we are a hungry congregation!<br />

Happy <strong>and</strong> zissen (sweet) Passover. Passover is literally around<br />

the corner with the first seder on Saturday, <strong>April</strong> 19. Please<br />

note that because of <strong>pub</strong>lic school vacation dates <strong>and</strong><br />

observance dates for Passover, THERE WILL BE NO<br />

RELIGIOUS SCHOOL SUNDAY SESSIONS FOR THE<br />

ENTIRE MONTH OF APRIL. Please check the calendar for<br />

appropriate in-session dates for Tuesday <strong>and</strong> Wednesday<br />

classes.<br />

It is almost time to wrap up the school year. Please consider<br />

volunteering for year-end clean up or room parent or school<br />

office helper next year. Volunteering is a great way for others<br />

to get to know you <strong>and</strong> for you to get to know others. Besides,<br />

who among us really has so much free time that we can do this<br />

alone? If we all help a small amount, then overall a greater<br />

amount of work gets done.<br />

You may soon receive a survey or phone call regarding various<br />

programming as it relates to your child’s class. Please be<br />

thoughtful with your answers. Suggestions for future<br />

programming are welcome.<br />

YOUTH NEWS<br />

This past month has been quite exciting for KEFTY. We waited<br />

patiently for Spring Kallah where we hosted tons of smiling<br />

highschoolers from across the Southeast with fun activities that<br />

all enjoyed. We also just recently elected the 2008-2009<br />

KEFTY Board. Two Sundays ago, Jason Rogers, KEFTY<br />

President (2007-2008), <strong>and</strong> Lauren Ball, KEFTY advisor,<br />

oversaw KEFT elections. Turnout was tremendous <strong>and</strong><br />

everyone voted for what will become one of KEFTY’s greatest<br />

boards ever. The new board includes people from many<br />

different high schools <strong>and</strong> many different grades as well. The<br />

new board is:<br />

On a side note, KEFTY has a major event in the planning stage.<br />

This event, also open to all eighth graders who wish to attend, is<br />

KEFTY’s annual Mystery Bus Ride, where we will go<br />

somewhere for the day, <strong>and</strong> everyone always has a blast. The<br />

only catch is that you do not know what is going to happen until<br />

it does. We hope that we will get a big turnout for this, <strong>and</strong> hope<br />

to see you there.<br />

PRESCHOOL<br />

March was a busy month! The Purim Carnival was a huge<br />

success. We could not have done it without our parent<br />

volunteers. The kids really enjoyed the games, crafts <strong>and</strong><br />

moonwalk, <strong>and</strong> we had fun watching them all parade around in<br />

their costumes. We also had a school-wide Megillah reading. It<br />

was great having all the parents join us. We all have sore<br />

throats from booing at Haman! Also for Purim our students<br />

carried on the tradition of sending Mishlo’ach Manot baskets.<br />

Passover is around the corner <strong>and</strong> our classes are already<br />

preparing for their seders. We washed our h<strong>and</strong>s, rolled up our<br />

sleeves, <strong>and</strong> baked matzos which were delicious! In class we<br />

are busy learning about Moses <strong>and</strong> Pharaoh, making haggadahs<br />

<strong>and</strong> sedar plates.<br />

RITUAL COMMITTEE<br />

New Siddurim (Prayerbooks) Coming to <strong>TKE</strong><br />

Have you noticed that many of the siddurim (prayer books) at Temple Kol Emeth are in less than ideal condition? Due to high turnout<br />

at Shabbat services <strong>and</strong> the use of the same siddurim for over a decade, these books have seen a lot of use.<br />

Thanks to the generosity of many congregants who have donated to the Prayerbook fund over the last few years, <strong>and</strong> another large<br />

donation, Temple Kol Emeth is excited to announce that new Siddurim have been ordered for use at <strong>TKE</strong>’s Sabbath services for both<br />

Friday nights <strong>and</strong> Saturdays.<br />

Mishkan T'filah: A New Reform Siddur was initially <strong>pub</strong>lished late last year by the Central Conference of American Rabbis<br />

(CCAR). It is in high dem<strong>and</strong> <strong>and</strong> our order should arrive by the end of May. Aside from the fact that they will be in mint condition,<br />

congregants <strong>and</strong> clergy who have seen the new Siddur have praised the content <strong>and</strong> layout. The CCAR website provides the following<br />

description:<br />

Mishkan T’filah is the first new Siddur for the North American Reform Movement in more than thirty years. Including services for<br />

Shabbat, weekdays <strong>and</strong> festivals, as well as other occasions of <strong>pub</strong>lic worship, <strong>and</strong> texts for more than a hundred songs, Mishkan<br />

Torah Chanting – a new opportunity to continue learning<br />

In preparation for Bar/Bat Mitzvah, <strong>TKE</strong> students spend six months or more learning their Torah <strong>and</strong> Haftorah. Congregants <strong>and</strong><br />

guests of the B’nai Mitzvah families are rightfully proud of their students’ achievements.<br />

Temple Kol Emeth clergy <strong>and</strong> ritual committee want to encourage students to maintain their new Torah cantillation knowledge, but<br />

unfortunately, many of new young adults do not get an opportunity have a repeat performance. The ritual committee has encouraged<br />

<strong>TKE</strong> high school students to volunteer to chant Torah during Rosh Hashanah <strong>and</strong> Yom Kippur, <strong>and</strong> we intend to continue that<br />

tradition.<br />

In addition, the <strong>TKE</strong> ritual committee has initiated a new opportunity for students to chant Torah. Approximately a year after their<br />

Bar/Bat Mitzvah, students will be honored with an invitation to chant Torah, in short, a “repeat performance” at <strong>TKE</strong> Shabbat<br />

services.<br />

BROTHERHOOD<br />

Long long ago, in a l<strong>and</strong> not too far away, Mark Alhanti was<br />

President of Brotherhood.<br />

In an effort to get men to know each other better he came up<br />

with the idea of “The Men’s Club”. This would be gatherings<br />

for fun <strong>and</strong> enjoyment with no constructive purpose in mind.<br />

We had a night at the pool hall with a tournament <strong>and</strong> lots of<br />

laughs. We had poker games where the stakes were, shall we<br />

say, low. Not everyone knew how to play the different games,<br />

myself especially, but we had a good time.<br />

Mark heard that Harvey Schneider <strong>and</strong> I had been bowling one<br />

night a week for a number of years <strong>and</strong> put in his monthly<br />

article that anyone was welcome <strong>and</strong> should join us. We had<br />

called this giving our wives the night off after we helped put our<br />

daughters to bed. (They are now 20 <strong>and</strong> 21 years young.)<br />

This group has grown to as many as 8 on a Thursday night at<br />

Village lanes. We meet about 8:15 pm <strong>and</strong> bowl two games <strong>and</strong><br />

go for ice cream afterwards. We would be glad to see the group<br />

grow. The Rabbi <strong>and</strong> Cantor even come from time to time. We<br />

won’t talk about scores!<br />

Brotherhood would welcome new ideas for the “The Men’s<br />

Club” <strong>and</strong> people to coordinate them. We don’t need you to<br />

head a program that goes for years...just one night. A good idea<br />

<strong>and</strong> a relaxed evening for all involved is what it is all about.<br />

fabric in preparation for learning to tie the tzitzit (fringes) -<br />

Hannah Abbe Velcoff will become a Bat<br />

Mitzvah on <strong>April</strong> 5, her 13 th birthday. She<br />

is the daughter of Ellen Marion Townsend<br />

<strong>and</strong> Andy Velcoff <strong>and</strong> the sister of Jacob<br />

<strong>and</strong> Emma. Hannah, a graduate of the <strong>TKE</strong><br />

Preschool, is now a seventh grade honor<br />

student at Riverview Middle School.<br />

Hannah loves to play tennis. Another love<br />

of Hannah’s is fashion, whether it’s<br />

shopping or creating <strong>and</strong> sewing her own<br />

designs. Hannah’s mitzvah project is<br />

volunteering weekly at the Dawson County<br />

Humane Society. Every Friday, Hannah helps get the animals<br />

ready for the Petsmart Adoption Day by socializing kittens, bathing<br />

dogs, <strong>and</strong> playing fetch with the big dogs. The Humane Society is<br />

moving into its newly constructed shelter this month, <strong>and</strong> Hannah<br />

will continue to spend her Friday afternoons there. Visit<br />

Family Shabbat the fourth Friday of each month. Family<br />

Shabbat is created for children in first through fourth grades.<br />

The largest Brotherhood Event of<br />

the year, the Annual <strong>TKE</strong> Golf<br />

Bradshaw Farms Golf Course on<br />

Sunday, May 18, 2008. We will<br />

have an 8 a.m. shot gun start. We<br />

play a best ball format so during the<br />

day everyone’s shot gets to be the<br />

BETTY AND JERRY SINGER<br />

SCHOLARSHIP FUND<br />

It's that time of the year to apply for some college financial support from <strong>TKE</strong><br />

through the Betty <strong>and</strong> Jerry Singer Scholarship Fund.<br />

DEADLINE IS MAY 1, 2008<br />

We would like to take this opportunity to share the vision established for the Fund with everyone at <strong>TKE</strong><br />

<strong>and</strong> explain the application <strong>and</strong> award process. The vision is comprised of four elements.<br />

1. The purpose of the Betty <strong>and</strong> Jerry Singer Scholarship Fund is to encourage service, involvement <strong>and</strong><br />

leadership in <strong>TKE</strong>, especially KEFTY, the senior youth group.<br />

2. Through private donations, the fund will eventually become an endowed (self-perpetuating) fund. As<br />

such, it would have sufficient principal <strong>and</strong> as a result, the investment interest <strong>and</strong> dividends would<br />

fund yearly scholarship awards. This year the fund will provide a $1,000 scholarship. Once<br />

the fund becomes endowed <strong>and</strong> generates sufficient income, we hope that this amount can be<br />

increased to $2,000 or several awards of $1,000.<br />

3. The award will be provided to an individual with the following general qualifications:<br />

A. A high school senior who has been accepted to a college or university.<br />

B. A current member of <strong>TKE</strong> <strong>and</strong> KEFTY.<br />

C. Has performed exceptional service, involvement, <strong>and</strong> leadership to <strong>TKE</strong><br />

during high school years (grades 9 - 12).<br />

4. The scholarship is merit based. This means that everyone can apply regardless of their parent’s<br />

financial situation. The scholarship application is available NOW electronically by emailing Blake<br />

Singer at blakesinger@hotmail.com. You can complete it using MS Word but an electronic form of the<br />

required signatures will NOT be accepted.<br />

Again, c<strong>and</strong>idates must submit their completed applications in Blake Singer’s mailbox at the <strong>TKE</strong> office on<br />

or before May 1, 2008.<br />

The Scholarship Fund Committee will review the applications <strong>and</strong> select the recipient. The winner will be<br />

presented the award at the annual <strong>TKE</strong> meeting in May.<br />
