I’m Happy, Happy, Happy about<br />

this year’s BAAA Trade Show. The location<br />

was great, lots of room to move<br />

around, the exhibitors went all out to<br />

make this an outstanding event and<br />

everyone enjoyed being able to arrive<br />

and leave in the daylight. Once all the<br />

evaluations are returned, we’ll make<br />

a decision on where we’ll be in 2011.<br />

Please be sure to thank our Associates<br />

for all they do for BAAA. We couldn’t<br />

run our communities without these<br />

hardworking men and women.<br />

Here we are in the middle of summer,<br />

and not only is the weather hot,<br />

<strong>2010</strong> BAAA President, Robert Griffiths Property Management<br />

Education Conference in New Orleans.<br />

They are reporting that the conference<br />

was filled with great seminars, meetings<br />

and a little fun as well.<br />

Our own Marc Rosenwasser<br />

hosted the conference as the Chairman<br />

of NAA, and Region 9 supported him<br />

with great attendance, which made for a<br />

wonderful event. This could be a record<br />

breaking event for NAA.<br />

President Bush was a highlight of<br />

the conference. The entire event was<br />

great and very well attended and Maintenance<br />

Mania was one of the big shop<br />

stoppers for Region 9 with five Maniac<br />

in the competition. Way to go!<br />

We have several outstanding events<br />

coming up in <strong>July</strong> with our Auction<br />

on <strong>July</strong> 15th and three Education<br />

Express Seminars, Social Networking,<br />

Fair Housing Update and Leasing<br />

Update. There is also a CAPS Training<br />

scheduled plus the Florida <strong>Apartment</strong><br />

<strong>Association</strong> will meet at the end of the<br />

month in Orlando. That’s all in addtion<br />

to the 4th of <strong>July</strong> holiday.<br />

Last month, at our lunch Board<br />

Meeting, Michael Slater, Triad Research<br />

& Consulting gave us an Economic Update<br />

that will hopefully keep us Happy,<br />

Happy, Happy, as the economy starts<br />

to rebound by giving us good news<br />

that our industry is doing better and is<br />

back on the upswing for our Associate<br />

members especially.<br />

We are putting on a CAS (Certified<br />

<strong>Apartment</strong> Supplier) Program in the<br />

first week in August at the request of<br />

several of our Associate members. This<br />

is a great way for suppliers and vendor<br />

members to better understand how the<br />

multi-family industry works.<br />

I also want to thank Harry Heist<br />

from Heist, Weiss & Davis, PA for<br />

helping out with our first Legal Maintenance<br />

Update. Harry gives tirelessly<br />

of his time to many local associations<br />

in Florida.<br />

<strong>July</strong> 21st is the date for the next<br />

BAAA “sweat equity” work day for<br />

Community Service. This time we’ll be<br />

working with Amazing Love Ministries<br />

at their new location in Ybor City.<br />

City and county governments<br />

are struggling to cut costs, personnel,<br />

and programs in order to make up for<br />

diminishing property tax revenues.<br />

Local government budgets have been<br />

battered by a “double-whammy” during<br />

the past few years. In January 2008, the<br />

Legislature and Governor Crist encouraged<br />

Floridians to vote for Amendment<br />

1. The constitutional amendment<br />

passed which resulted in a doubling<br />

of the Homestead Exemption and the<br />

portability of the “Save Our Homes”<br />

property tax cap. About the same<br />

time, Florida’s growth-fueled economy<br />

crashed, unemployment more than<br />

doubled, and property values dropped.<br />

Ever since, local governments have been<br />

scrambling to balance their budgets ...<br />

and in many jurisdictions, apartment<br />

property owners have had to pay more<br />

in fees and assessments.<br />

Government Fiscal Challenges<br />

Can Be Costly for<br />

<strong>Apartment</strong> Owners<br />

Alachua County has established<br />

a fi re assessment which will be used<br />

to pay for fi re services, facilities, and<br />

programs. The fi re assessment amount<br />

for an apartment property is based on<br />

the number of “Fire Protection Units”<br />

assigned to each building. A building’s<br />

assigned “Fire Protection Units” are<br />

based on the building’s “Hazard Classifi<br />

cation” (e.g., age or construction materials),<br />

the building’s square footage,<br />

and the historical demand for services<br />

which is based on fi re rescue incident<br />

reports. A typical 66-unit apartment<br />

community is being assessed $4,145.86<br />

for fi scal year <strong>2010</strong>-11. Alachua County<br />

has promised there will be a reduction<br />

in the ad valorem millage rate to compensate<br />

for the new fee.<br />

The City of St. Petersburg is<br />

considering a less-complicated fi re as-<br />

sessment fee. The City would charge<br />

$5.00 per month per tax parcel ... not<br />

per building, not per apartment unit.<br />

The proposed fee would raise more<br />

than $5 million to cover a portion of<br />

the fi xed costs of the Fire Rescue Department<br />

and eliminate the need to cut<br />

fi re services and personnel in the City.<br />

If passed by City Council, Mayor Bill<br />

Foster has indicated that he may veto<br />

the fee idea. The <strong>Bay</strong> <strong>Area</strong> <strong>Apartment</strong><br />

<strong>Association</strong>, collaborating with the Pinellas<br />

Realtor Organization, is monitoring<br />

the deliberations in St. Pete.<br />

Another approach to address the<br />

economic downturn is being considered<br />

in the City of Sarasota. The City<br />

Commission is proposing economic<br />

development ad valorem tax exemptions<br />

for qualifying new businesses and<br />

expansions of existing businesses. The<br />

ordinance states: “The granting of ad<br />

valorem tax exemptions to qualifying<br />

businesses will provide the City of<br />

Sarasota with an additional economic<br />

development incentive which will<br />

enhance the desirability of the City of<br />

Sarasota as a location for new businesses<br />

and expansions of existing businesses.”<br />

New businesses and expanded businesses<br />

mean new jobs ... and you know<br />

the impact of job growth on apartment<br />

occupancy rates. The City will ask the<br />

voters if they would support the tax<br />

break. I think you know which way I<br />

would vote, if I lived in Sarasota.<br />

As we celebrate the Fourth of <strong>July</strong><br />

and our Declaration of Independence,<br />

it’s interesting to ponder how the idea of<br />

taxation has changed in 234 years. •

Litigation associated with bedbugs<br />

is increasing throughout the United<br />

States. The National Lease Program<br />

has added language to several addenda<br />

addressing the issue. The Inventory and<br />

Condition Form now requires residents<br />

to acknowledge upon move-in that the<br />

apartment is bedbug-free. Additional<br />

language in the Community Policies<br />

addendum requires residents to notify<br />

owners or management in the case of an<br />

infestation and to follow all instructions<br />

during the mitigation and extermination<br />

process.<br />

No property owner can ensure<br />

against an infestation. Bedbugs are<br />

equal opportunity offenders, attacking<br />

class A and D properties alike. Owners<br />

will minimize legal exposure by having<br />

a system in place to handle complaints<br />

and treat pests when identified.<br />

(NAAEI) will once again celebrate<br />

National <strong>Apartment</strong> Careers Month in<br />

February, 2011. National <strong>Apartment</strong><br />

Careers Month was created to bring<br />

awareness and promote the attractive<br />

and recession-resistant careers in the<br />

apartment industry.<br />

New this year, NAAEI is calling for<br />

submissions for its “Get Reel” Career<br />

Video Challenge on YouTube, where<br />

winners can be eligible to win a trip to<br />

the 2011 NAA Conference & Exposition<br />

Defeat Rent Freeze<br />

The Los Angeles City Council<br />

on May 21 ended five weeks of panic<br />

among owners and managers of the<br />

636,000 apartments subject to the<br />

city’s rent control ordinance by striking<br />

down a proposed moratorium on their<br />

ability to increase rent. The <strong>Apartment</strong><br />

<strong>Association</strong> of Greater Los Angeles,<br />

the <strong>Apartment</strong> <strong>Association</strong> - California<br />

Southern Cities and the National<br />

<strong>Apartment</strong> <strong>Association</strong> banded to rally<br />

members against the proposal, implementing<br />

an all-out grassroots effort that<br />

included e-mail action alerts, phone<br />

banking and the targeted mailing of<br />

20,000 post cards to owners and managers<br />

of properties subject to the city’s<br />

rent control law. The effort prompted<br />

members of each association to flood<br />

the offices of city council members with<br />

hundreds of calls, faxes and e-mails in<br />

opposition to the moratorium; at least<br />

300 rental property owners and managers<br />

were present in the council chamber<br />

for the May 21 vote.<br />

Q. As I was leaving a resident’s<br />

apartment after posting a Three Day<br />

Notice, I met the resident in the breezeway.<br />

The resident told me that he had<br />

filed bankruptcy earlier in the week. I<br />

returned to the office and checked with<br />

my staff, and we have not received any<br />

notice from anyone, by fax or mail,<br />

with regard to a bankruptcy filing for<br />

this resident. What do I do?<br />

A. You can call the resident and seek<br />

additional information about the supposed<br />

filing, reconfirming to the resident<br />

that you have not yet received any official<br />

notification of the alleged bankruptcy<br />

petition. You can inquire about bankruptcy<br />

case number, which law firm is<br />

handling the bankruptcy filing, or if he<br />

doesn’t have an attorney, what city in<br />

which the case was filed. Then you should<br />

call your attorney and follow his advice.<br />

The Florida Bankruptcy Courts have an<br />

automated information line on which<br />

you can check to confirm bankruptcy<br />

filings using the case number, debtor’s<br />

social security number or the debtor’s<br />

name. The State of Florida is divided into<br />

three Federal Court Districts, which also<br />

serve as the Bankruptcy Court Districts:<br />

the Northern, Middle, and Southern<br />

Districts of Florida. If you know the city<br />

in which the resident filed, then you only<br />

need to make one phone call to the appropriate<br />

District. Otherwise, you must<br />

call the information line for each District.<br />

While it may seem obvious to you that the<br />

resident would file in the District that<br />

covers your apartment community, it is<br />

not necessarily so. If the resident has just<br />

recently moved to your apartment community,<br />

then his bankruptcy filing may be<br />

in another District. If he has just moved<br />

to Florida from another state, his bank-<br />

ruptcy filing may be in his former state.<br />

A look at the resident’s rental application<br />

will give you his prior residence information.<br />

When anyone files bankruptcy, the<br />

Bankruptcy Court Clerk’s office is very<br />

good about timely mailing out notices of<br />

the bankruptcy filing, usually within ten<br />

(10) days. The Court mails the notices to<br />

everyone who the person filing bankruptcy<br />

lists as a creditor, or who otherwise may<br />

have an interest in the bankruptcy filing.<br />

That being said, the clerk’s mailing is only<br />

as complete as the list given by person filing<br />

bankruptcy. If your name is not on<br />

the list, then you will not receive notice.<br />

Whether you receive written notice or<br />

not, bankruptcy law holds that you have<br />

actual notice if you receive any information<br />

that would alert a reasonable person<br />

that a filing has occurred. This includes<br />

oral statements to you by the resident, or<br />

a letter from the resident’s attorney. If<br />

your tenant is a listed debtor in an active<br />

bankruptcy case, you will need to obtain<br />

an order from the bankruptcy court indicating<br />

that the automatic stay provisions<br />

are lifted or otherwise not in effect prior<br />

to proceeding with an eviction.<br />

Q. My maintenance person delivers<br />

our Three Day Notices. Our lawyer<br />

informed us that both the maintenance<br />

person and I (the community manager)<br />

will have to come to the court hearing<br />

on the eviction. We are a small property<br />

and will have to shut down the office<br />

and maintenance to have us both appear<br />

in court.<br />

A. If the person who delivers the notices<br />

is also a person who handles the books<br />

and records of the landlord, then only<br />

one person has to come to court. In legal<br />

terms, a person who handles the books<br />

and records has “custody and control” of<br />

the books and records. More than one<br />

person at a property can have custody and<br />

control of the books and records, i.e., the<br />

regional manager, the on-site manager,<br />

the assistant manager, leasing agents, etc.<br />

A person who has custody and control of<br />

the books and records has the requisite<br />

knowledge to testify that the ledger, the<br />

lease and the other documents in the<br />

resident’s file are accurate, and when<br />

they are copies, true and exact copies. If<br />

maintenance staff delivers the Three Day<br />

Notices, then the situation may arise at<br />

an eviction hearing when two people from<br />

the property will be required to attend<br />

the hearing - someone from management<br />

to testify as to the resident’s file and the<br />

maintenance person who delivered the<br />

Three Day Notice to testify that it was<br />

delivered. Foresight on who delivers the<br />

legal notices can save the property an<br />

unproductive half-day at a hearing for<br />

two of its personnel.<br />

Q. A new resident with a pet dog<br />

moved in forty-five days ago. We are<br />

now dealing with a serious flea problem<br />

in the new resident’s apartment<br />

as well as adjoining apartments. Since<br />

the adjoining apartments do not have<br />

any pets, we believe the source of the<br />

fleas is the new resident’s dog. The<br />

new resident is denying that her dog<br />

is the problem. Since the resident is<br />

refusing to cooperate in remedying the<br />

problem, we want to exercise our option<br />

to withdraw our permission for the pet<br />

and demand its removal. Since our pet<br />

addendum gives us the right to do so<br />

in our absolute discretion, do you see<br />

any problems?<br />

A. The term “in the landlord’s absolute<br />

discretion” is not as all encompassing<br />

as it seems. While the inclusion of the<br />

term is a good idea, it does not permit the<br />

landlord to take arbitrary action. It is<br />

constrained by the requirement in Florida<br />

law that the exercise of such discretion is<br />

not an abuse of the discretion. Also, The<br />

Florida Landlord/Tenant Act incorporates<br />

the requirement of “good faith” into all<br />

landlord-resident dealings and agreements.<br />

The Florida Landlord/Tenant Act<br />

empowers a court to refuse to enforce any<br />

provision of a lease or addenda that the<br />

court finds is unconscionable on its face<br />

or in its implementation. Alternatively,<br />

the court can limit the application of<br />

the offending lease or addenda in such<br />

a way as to prevent an unconscionable<br />

result. The bottom line is that you need a<br />

reason to demand the dog’s removal. You<br />

will be required to prove that reason in<br />

court if challenged by the resident. Your<br />

suspicions or deductions that this dog is<br />

the culprit are not proof. The testimony of<br />

your pest control service person concerning<br />

the source of the fleas, in his or her expert<br />

opinion, would be good. However, proving<br />

the source of fleas may be difficult if<br />

the surrounding apartments have had<br />

guests with pets visiting. One solution<br />

may be a written offer to reimburse the<br />

resident for the pet’s visit to a veterinarian,<br />

up to a certain dollar amount. Placing a<br />

reasonable dollar limit on your offer will<br />

prevent it from becoming an open-ended<br />

expense for the pet’s vet bill. If you should<br />

projects and inspire others. Take a<br />

proactive role in defusing negative and<br />

• Get face time with the boss: Look<br />

out for projects that will let him/her<br />

managing one single-family rental<br />

house? Managing several, or one apartment<br />

building, or even more stressful,<br />

more than one apartment building. It<br />

is true that there are people who have<br />

several apartment buildings and they<br />

are able to manage them just fine. However,<br />

these people are often under a lot<br />

of stress and they usually don’t have a<br />

lot of free time for themselves.<br />

So what causes all the stress when<br />

you are doing your own property<br />

management? There is a simple answer:<br />

everything.<br />

While some people love to drive,<br />

there are many people who find driving<br />

itself to be stressful. And if you have to<br />

travel to several properties, then you<br />

have to contend with traffic as well as<br />

long drives. Then there’s the paperwork.<br />

You have to keep files on all of your residents.<br />

You have to advertise to get new<br />

residents whenever there is a vacancy.<br />

You have to do background checks, employment<br />

verifications, credit checks,<br />

talk to former landlords, and even look<br />

up rent history. You have to deal with<br />

and having to pay lawyer, filing, and<br />

court fees.<br />

So is it possible to truly have stress<br />

free property management? Believe it<br />

or not, it is. Hiring a property management<br />

company will save you from<br />

having to worry about just about everything.<br />

In fact, you’ll be free to live<br />

your own life and just enjoy owning<br />

rental property. Of course you’ll have<br />

to make the most major and the final<br />

decisions, but you won’t have to handle<br />

all the everyday things.<br />

It’s important to know what you are<br />

looking for when you hire a company to<br />

manage your property. Are you looking<br />

for someone who will take payments<br />

from residents, report vacancies and<br />

needed repairs to you, and who just<br />

handles the most basic tasks? Or do you<br />

want a company that will handle everything<br />

for you, from the maintenance<br />

and repairs to background checks to<br />

finding new residents?<br />

Some companies will only do the<br />

basics for you. They take the money,<br />

do a certain amount of maintenance,<br />

and you keep most of the tasks still as<br />

yours. Other companies offer full services.<br />

They handle all the maintenance<br />

and repairs, getting new residents, all<br />

the background checks, and handle<br />

the money. Some of them only take<br />

cash while others offer you even more<br />

services by allowing your residents to<br />

pay by credit card or even direct debit.<br />

This means that your payments are<br />

more secure, and if the management<br />

company takes care of everything for<br />

you then all you have to do is offer your<br />

final approval and be available if there is<br />

a problem. In fact, many companies will<br />

even handle doing inspections for you.<br />

Some will actually take care of evictions<br />

as well, paying the fees associated<br />

with an eviction so that you keep more<br />

money in your own pocket.<br />

Do your research before you choose<br />

a property management company. Just<br />

because a company offers services at a<br />

very low price doesn’t mean they are<br />

the best, just as the most expensive<br />

company may not be the best. Some<br />

companies will let you use your own<br />

maintenance services or use third party<br />

ones, while others insist on using inhouse<br />

services that may cost you more.<br />

Some have excellent customer service<br />

that will keep you up to date all the<br />

time while others have customer service<br />

that will make you track them down. It’s<br />

up to you what you want, but do your<br />

research so you can make sure that you<br />

can take care of your properties without<br />

any stress. •

making the decision to lease an apartment. The market<br />

is competitive and many communities offer similar styles<br />

and concepts for around the same price. Forget specials,<br />

newspaper. The classifi ed was for a leasing<br />

agent at the very same apartment<br />

community I was living in. The job<br />

sounded ideal since it was really close<br />

to home and it would give me a change<br />

to meet my neighbors. I had lived in<br />

Fort Wayne for about six months and<br />

really hadn’t made any friends. I have<br />

social anxiety that makes it diffi cult for<br />

me to reach out and met new people.<br />

I was shy, and still shy today, but have<br />

since learned how to appear confi dent<br />

my nose meets my face. I have always<br />

wanted to have it removed. I worried<br />

that people were staring at it when I<br />

talked, so I wouldn’t talk. I didn’t want<br />

to draw any attention to myself. Then<br />

one day I realized that lots of people<br />

have similar points of interest on their<br />

bodies. I realized that people were not<br />

going to stare at my mole, and if they<br />
