Certificate is recorded in the Public Records of Volusia County, Florida. The costs<br />

of preparing and recording the Certificate shall be borne by the unit owners desiring<br />

the exchange or transfer. A copy of the recorded Certificate shall be provided to the<br />

Association for its records.<br />

G. Pets, Tenants and Guests: Pets shall be as allowed and regulated in the<br />

rules and regulations (Exhibit "4"). However, tenants and guests shall not be permitted to have pets.<br />

H. Exclusive Use; Common Facilities: The Association may lease to unit<br />

owners for appropriate temporary periods of time those portions ofthe common elements rationally<br />

appropriate and desirable for exclusive use (for example, social rooms, and card rooms)..<br />

I. Nuisance Prohibited: No person shall engage in any practice, exhibit<br />

any behavior, nor permit any condition to exist that will constitute anuisance or become areasonable<br />

source of annoyance or disturbance to any occupant of the <strong>Condo</strong>minium.<br />

13. LEASE, CONVEYANCE, DISPOSITION: The purpose and object of this<br />

paragraph is to maintain a quiet, tranquil, non-transient, and single-family oriented atmosphere with<br />

residents living in compatible coexistence with other financially responsible persons who are of like<br />

mind and acceptable both in character and comportment. This objective is considered to be both<br />

important andjustified because ofthe necessity of sharing facilities and because ofthe large personal<br />

financial investment of each owner. Therefore, the lease, conveyance, disposal, and financing of the<br />

units by owners (subject to the exceptions provided in Paragraph 18.A) shall be subject to the<br />

following provisions:<br />

A. Association Approval Required: Except for Developer sales no owner<br />

may sell, lease, give, or otherwise transfer ownership of a unit or any interest therein in any manner<br />

without the prior written notification of the Association. The notification shall be a written<br />

instrument in recordable form (except for leases) which shall include, without limitation, the nature<br />

of the transfer (sale, lease, etc.), the parties to the transaction (sellers, purchasers, etc.) the unit<br />

number, the name of the <strong>Condo</strong>minium, and the Official Record Book (O.R. Book) and Page<br />

numbers in which this Declaration was originally recorded. For all unit transfers of title other than<br />

from the Developer, the approval must be recorded simultaneously in the Volusia County, Florida<br />

Public Records with the deed or other instrument transferring title to the unit.<br />

(1) Leases: Approvals of leases need not be recorded. Only entire units<br />
