24. DEVELOPMENT EASEMENTS AND RESTRICTIONS: Developer, for<br />
itself and its successors and assigns, reserves easements over the <strong>Condo</strong>minium property as<br />
necessary to complete future development, if any, including construction access and utilities.<br />
25. SEVERABILITY AND NONWAIVER: Ifany provisions ofthis Declaration or<br />
its exhibits as now constituted or as later amended or any paragraph, sentence, clause, phrase, or<br />
word, or the application thereof in any circumstance, is held invalid, the validity of the remainder<br />
and of the application of any such provision, section, sentence, clause, phrase or word in other<br />
circumstances shall not be affected thereby. The failure ofthe Association in any instance to enforce<br />
any covenant or provision of this Declaration or any of the <strong>Condo</strong>minium documents shall not<br />
constitute a waiver of its rights to do so thereafter in other instances.<br />
