the Judicial politics of
economic integration
The Andean Court as an Engine of
Development
osvaldo saldias
The Judicial Politics of Economic Integration analyses
development strategies and regional integration in the
Andean Community (the former Andean Pact) of Latin
American nations; focusing on the establishment of the
Andean Court of Justice and its case law, as well as the
intellectual underpinnings that made such an impressive
reform possible. The court is a transplant taken from the
European integration process, and it materializes the
visions, expectations, and dreams of the transnational
development movement of “integration through law”.
The book discusses the outcomes of the Court in the
light of the debates about judicial reform in the process
of development and regional integration. Although it
clearly confirms several earlier claims that “one size
does not fit all”, it provides new evidence that legal
reform is not futile. On the contrary, the book argues, if
driven reflexively it can be a considerable contribution to
the creation of capabilities and improvement of a
democratic rule of law.
ethical and theoretical issues. This collection charts the
important interface between studies of law, science and
society, as explored from the perspectives of socio-legal
law, place and Maps *
Balancing Protection and Exclusion
Antonia layard
This book analyses laws distinctively normative
contribution to place-making. In an original,
cross-disciplinary, analysis drawing on scholarship in
law, geography, philosophy and politics, Antonia
Layard considers how law operates in the fixing of
borders that both protect and exclude. Centred upon
four legal case studies – on public space; housing
regulation; rules on the manifestation of religion; and
geographic indications in intellectual property law –
the book pursues a critical geographical consideration
of how place is integral to ideas about identity,
belonging and territory.
TEXTBOOK
Managing Mining Hazards
Regulation, Safety and Trust
neil Gunningham and darren sinclair
Over the last 15 years the coal mining industry has
achieved impressive gains in its work health and safety
(WHS) performance. These are widely attributed to
the development of a new WHS architecture based
on structured risk management concepts and WHS
management systems. Based on over 150 interviews
mining industry stakeholders and on in depth access
to multiple mine sites within individual companies, the
authors conclude that corporate systems and other
tools of management-based regulation only work well
when WHS is institutionalised, and when it gets into
the “bloodstream” of the organisation at site level.
Only when the formal systems (audits, reporting,
monitoring) are supported by informal systems (trust,
commitment, engagement) will they be fully effective.
Microtrade
A New System of International Trade with
Volunteerism Towards Poverty Elimination
Edited by Yong-shik lee, University of
Manchester, UK
Series: Routledge Research in International
Economic Law
This book sets out the case for an innovative solution
to extreme poverty in developing countries through
the use of microtrade. Microtrade is international
trade on a small scale allowing residents to export
local products to affluent foreign markets without the
need for large levels of capital and capacities for mass
production. The book explores the theory, application,
and legal framework for microtrade, showing how it
could if effectively administered on a global scale do
much to help economic development.
