Smt. Sarita Rani filed CWP No. 11278 of 2011 in the Hon'ble Punjab and
Haryana High Court at Chandigarh praying
"for issuance of writ in the nature of Certiorari quashing the show Cause
Notice No. E-1/37/2011 dated 20.6.2011 (Annexure P-6), issued by the respondent
No.4, through its appear to be proposal to terminate the services of the petitioner,
but in fact, it is an order to terminate the services of the petitioner from the post of
Science Mistress on the ground that the petitioner have no subject combination
B.Sc. in Home Science at the time of initial appointment i.e. on 24.1.2006, which
notice has been issued contrary to the letter issued by the Director, Secondary
Education, Haryana dated 1.6.2011 (Annexure P-5), ignoring the fact that the show
cause could be issued only to those teachers who were suffering any deficiency on
the date of issue of letter i.e. on 1.6.2011 and she has experience of more than 5
years as Science Mistress of petitioner to their credit, being illegal, arbitrary and
contrary to the provision in the Statute itself.
AND
Further prayed that the operation of the show cause Notice/ order dated
20.6.2011 (Annexure P-6) may kindly be stayed and status quo with regard to the
services of the petitioner may kindly be ordered to be maintained during the
pendency of the present writ petition".
Brief facts of the case are as under:-
Smt. Santa was appointed as Science mistress in GMS Kishorpur (Palwal) on
24-11-2006. She was possessing the degree in B.Sc. Home Science, B.Ed at the
time of initial appointment as Guest Teacher. As she was not having the prescribed
qualification under rule for the post of Science Mistress, a show cause notice was
issued to terminate her services. She filed the above stated civil writ petition and
obtained stay order from the Hon'ble Court and accordingly she was allowed to
continue her services in the same school. Finally the CWP no. 11278 of 2011 filed
by Sarita Rani was disposed of by the Hon'ble Court with the following order.
"For orders, see order of even date passed in Civil Writ Petition No.
4587 of 2011, titled as "Naresh Kumar Vs. State of Haryana & Others."

The operative part of order passed in CWP No. 4587 of 2011 titled Naresh
Kumar Vs State of Haryana is also reproduced below for reference:-
"All these writ petitions are disposed of with a direction to the
petitioners to appear before the respective authorities which have issued show
cause notice in each case. The said authorities, after obtaining replies of the
respective petitioners to the show cause notice, shall forward the case to the
Director, Education School, by fixing a date of hearing before the Director in
consultation with the Director. The Director, School, thereafter, would afford
due opportunity of hearing to the petitioners and pass an order in accordance
with law. The petitioners shall be at liberty to raise all the pleas that they may
wish to urge against the proposed action. Needless to mention that the

Director would keep in mind the observations made by 1 st Division Bench in
Tilak Rat's Case (Suprel. The petitioners would be at liberty to impugn any
order passed by the Director in accordance with law. If any of the petitioner
makes a request for being represented by a counsel, the same shall be
considered by the Director and appropriate order made thereon. The interim
order passed in favour of the petitioners shall continue till the date of
decision by the Director.
The writ petition are, accordingly, dispose of."
That in compliance of the aforesaid directions of the Hon'ble Punjab and
Haryana High Court, case of the petitioner has been considered in the light of
various judgments passed in several civil writ petitions. The department gave
opportunity of personal hearing to Sarita Rani on 11-4-2012.
On considering all facts brought on the record, it is found that Smt. Sarita
Rani was appointed guest teacher without examining the requisite qualification as
prescribed under the service rules. She was possessing degree in B.Sc Home
Science, B.Ed at the time of initial appointment as guest teacher. The qualification
prescribed for this category of teacher under Haryana State Education School Cadre
(Group C) Service Rules 1998, Rule 7 (Appendix-B) was B.Sc. with B.T/B.Ed from a
recognized university in addition to Mathematics in B.Sc or B.Sc Education, a
combination of with at least two subjects out of i.e. Physics, Chemistry, Botony,
Zoology & Knowledge of Hindi upto Matric Standard. She has herself admitted that
she appeared in B.Sc. (Home Science) from Maharishi Dayanand University, Rohtak
and had passed her 1 st year examination with Physics, Chemistry, Sociology and
Family Dyanamics, English, Food Production and Gardening, Biological Science
and Hygiene, Physiology and requested not to remove her name from the list of
teachers whose services are rescinded due to non-combination of subjects.
Thereafter, she has not submitted any proof of the requisite qualification of
completing subject combination till now. Therefore, it can now be safely concluded
that she was not possessing the requisite qualification at the time of initial
appointment as Science Mistress or she has not acquired the prescribed
qualification during her tenure as guest teacher. While considering the cases of
guest teachers, Director, Secondary Education issued following instructions to
dispense with their services:-
Dispensing with the services of Guest Teachers who are not
having the requisite qualifications at the time of initial
appointment.
The file has been perused and the matter is decided as under:
Persons who have fulfilled the requisite academic qualification
prescribed in the Service Rule till the date of his continuation on
guest faculty basis are not to be removed from the said faculty in
view of judgment dated 30.03.2011 in Tilak Raj's case and
subsequent judgments of Hon'ble High Court in various other
cases.
Persons who have not completed the requisite academic
qualification prescribed in the Service Rule till the date of his
continuation on guest faculty basis are to be removed from the
said faculty.
3. Persons with B.A. B.Ed. qualification and holding JBT posts are
not to be removed in view of the NCTE Notification No. 61-1/2011-
NCTE (N&S), dated the 23rd August, 2010 and further amended by

Notification dated 10.06.2011 which made candidate with
B.A./B.Sc./B.Com with at least 50% marks and B.Ed. qualification
eligible for appointment to Class I to V upto 01.01.2012 as JBT
Teachers.

Hence, her case is not covered under the policy/instructions
issued by the department for adjustment of guest teacher whose services were even
not to be extended beyond 31.03.2012 in terms of orders passed in CWP No. 6090
of 2010 titled as Tilak Raj V/ s State of Haryana.
In view of position explained, there is no justification to allow
her to continue as Science Mistress on guest faculty basis. Moreover the
department has taken similar view in all such cases where the guest teacher was
not having the requisite qualification as prescribed under the service rules, their
services were terminated. Therefore, taking the similar view in the instant case, the
services of Smt. Sarita Rani, guest teacher are terminated with immediate effect.

In exercise of powers conferred under Rule 29(3) read with Rule 3 of Haryana School
Rules-2003 Education Department, Haryana permission is hereby granted to establish a new
proposed school on the terms and conditions mentioned below:-
() The Proposed School shall have the required infrastructure regarding land and
Building i.e. number & size of class rooms with varanda and other rooms for Head
of Institution/Office, Library, Laboratory, Stairs, Ramp and Toilets etc. as per Rule
30.
(ii) The Management of the school shall have to apply for permanent recognition within
the stipulated time in the prescnbed form-il with documents as per rule 31.
(ii) The Management shall not make admission beyond Classal before the sanction of
its recognition or in its anticipation.
(iv) The letter of permission is based on the undertaking given by the applicant as per
details given overleaf. Any violation of the undertaking automatically nullifies the
permission. This permission is further subject to 'No Objection certificate' from the
'Competent Authority' regarding the land use of the proposed site.
This is only a formal permission to establish a New School or Start Classes and does not
enable your school to get recognition automatically for which physical verification of
infrastnscnue and records in this respect shall be made by District Inspection Committee.
* The managing committee shall abide by the provisions of Haryana School Education Rules
2003 (amended) & R.T.E. Ruels 2011 and amendments it any thereafter. The Managing shall
be liable for disciplinary action in case of violation of any provisions of the rules.
