asset received by the Relief Defendants from the telemarketing of<br />

EchoStar Satellite programming, then the <strong>Order</strong> shall be reopened<br />

<strong>and</strong> (i) suspension of the judgment shall be lifted <strong>for</strong> the<br />

purpose of requiring payment of a civil penalty in the full<br />

amount of the judgment ($4,374,768) from the Defendants, <strong>and</strong><br />

(2) the Court shall require The Myers Irrevocable Trust <strong>and</strong> its<br />

Beneficiaries to turn over to the Plaintiff the full amount of<br />

assets The Myers Irrevocable Trust <strong>and</strong> its Beneficiaries received<br />

from the telemarketing of EchoStar Satellite programming. All<br />

Defendants <strong>and</strong> Relief Defendants agree to waive any statute of<br />

limitations defense they may have. The respective judgment <strong>and</strong><br />

~amount to be turned over to Plaintiff, less any amounts paid to<br />

the. Commission, shall become immediately due <strong>and</strong> payable by<br />

r~espective Defendants <strong>and</strong> Relief Defendants The Myers Irrevocable<br />

Trust <strong>and</strong> its Beneficiaries, with interest computed at the rate<br />

prescribed under 28 U.S.C. § 1961, as amended, which shall<br />

immediately begin to accrue on the unpaid balance. Provided,<br />

however, that in all other respects this <strong>Order</strong> shall remain in<br />

full <strong>for</strong>ce <strong>and</strong> effect, unless otherwise ordered by the Court.<br />

F. In accordance with 31 U.S.C. § 7701, Defendants are<br />

hereby required, unless they have done so already, to furnish to<br />

Plaintiff <strong>and</strong> the FTC their taxpayer identifying number(s)<br />

(social security numbers or employer identification numbers)<br />

which shall be used <strong>for</strong> purposes of collecting <strong>and</strong> reporting on<br />
