IN SENATE DEBATE ON APPEALS, ASKED IN MOTION :<br />

Hawaii's protest against the "ap<br />
peals bill" was beard but not in time<br />
to stop the legislation from going<br />
through. The Congressional record of<br />
January 14 gives an interesting report<br />
on the debate tn the . senate. The<br />
mrae of the local attorney who wrote<br />
so effectively to Senators Sutherland<br />
and Clark is not given, but the<br />
chances are that Robert W. Breckons<br />
knows something about it. Here is<br />
some of the debate that preceded passage<br />
of the bill:<br />
I Mr. Sutherland Mr. President, I do<br />
not want to delay the passage of this<br />
bill, .because I regard it as a very<br />
necessary piece of legislation; but 1<br />
received this morning a letter from a<br />
very prominent lawyer in Hawaii I<br />
think the senator frortt Wyoming (Mr.<br />
Clark) received a similar letter--i- n<br />
which he st 9 ted that some members<br />
of the bar there are very much opposed<br />
to the provisions of the Mil<br />
which seeks to take from the supreme<br />
court of the United States the Juris-- ,<br />
diction which it now his over appeals<br />
and writs of error from' the supreme<br />
court of Hawaii, where the amount<br />
is $5000 or more.<br />
I I confess that such information as I<br />
have upon the subject inclines me to<br />
the view that the 'provision of this<br />
j proposed Itw Is a wise one. The su-- i<br />
preme court of the United States<br />
ought to be relieved from appeals in<br />
that class of eases. But the writer<br />
of tbfc letter also stated that a meeting<br />
of the bar of Hawaii is In contemplation<br />
at which this subject would<br />
be taken up. I am reluctant to ask<br />
that the bUl be delayed until the bar<br />
can be heard from, because, as I have<br />
already stated, I think it te a very<br />
necessary piece of legislation, and It<br />
it should be deliyed for any length<br />
of time It probably could not be passed<br />
at this session of Congress.<br />
I am going to offer an amendment<br />
to come in . at the end of section 2,<br />
on page' 4 so that the matter may go<br />

somewhat hurriedly, and fearing that<br />
the secretary may not be able to reid<br />

high opinion of the hJr of the territory<br />
of Hawaii. I doubt if any jurisdiction<br />
in the United States of equal area<br />
and equal or far more population has<br />
a bar that would exceed in learning<br />

! of Hawaii. I would be glad if an op-- 1<br />
portunity could be had for the views<br />
