ONI) A FEBRUARY 1, 1915.
; TRIBUTE TO BAR OF HAWAII PAID 'PERItV RE5I0VAL !
IN SENATE DEBATE ON APPEALS, ASKED IN MOTION :
Discussion of Bill Protested
Hefe Shows Local Men
Carry Weight
Hawaii's protest against the "ap
peals bill" was beard but not in time
to stop the legislation from going
through. The Congressional record of
January 14 gives an interesting report
on the debate tn the . senate. The
mrae of the local attorney who wrote
so effectively to Senators Sutherland
and Clark is not given, but the
chances are that Robert W. Breckons
knows something about it. Here is
some of the debate that preceded passage
of the bill:
I Mr. Sutherland Mr. President, I do
not want to delay the passage of this
bill, .because I regard it as a very
necessary piece of legislation; but 1
received this morning a letter from a
very prominent lawyer in Hawaii I
think the senator frortt Wyoming (Mr.
Clark) received a similar letter--i- n
which he st 9 ted that some members
of the bar there are very much opposed
to the provisions of the Mil
which seeks to take from the supreme
court of the United States the Juris-- ,
diction which it now his over appeals
and writs of error from' the supreme
court of Hawaii, where the amount
is $5000 or more.
I I confess that such information as I
have upon the subject inclines me to
the view that the 'provision of this
j proposed Itw Is a wise one. The su-- i
preme court of the United States
ought to be relieved from appeals in
that class of eases. But the writer
of tbfc letter also stated that a meeting
of the bar of Hawaii is In contemplation
at which this subject would
be taken up. I am reluctant to ask
that the bUl be delayed until the bar
can be heard from, because, as I have
already stated, I think it te a very
necessary piece of legislation, and It
it should be deliyed for any length
of time It probably could not be passed
at this session of Congress.
I am going to offer an amendment
to come in . at the end of section 2,
on page' 4 so that the matter may go
Into ' conference and' there be considered.
I have written the amendment
somewhat hurriedly, and fearing that
the secretary may not be able to reid
It I will read it myself. Add t the
end of section 2 1 ; f, V ?
"Writs" of error and appeals" from
tho final judgments and decrees of
the supreme courts of the territory ot
Hawaii and of Porto Rico wherein the
amount' Involved, 'exclusive of costs,
to bo ascertained by he oath of either
party or of other'competent witnesses,
exceeds value of S5000 may be taken
and prosecuted in ' the circuit courts
of ppealaJf :k .',,. ; - s, : .
"iThe circwtvCbiirU1 of, Appeals are
given Jurisdiction over the district
courts of HawaU and Porto Rico, and
it . might r be well if " thejiare; given
the j same' Jurisdiction over the . .su-
preme' courts of those territories.' At
any rat.'I offer the amendment, and
I nope' the senator in charge of the
bill 'will not. object to it and let li
.go Into the bill, and Inasmuch as the
' biU has to go to conference anyway
Writs or, errorn and .
the final judgments and decrees of
the supreme courts of the territory ot
Hawaii and of Porto Rico wnerein the
amount involved, exclusive of costs,
to be ascertained by the oath of either
party or of other competent witnesses,
exceeds ' the ; value of S5000 may be
taken and prosecuted in the circuit
court of appeals." ,'v,v. .. :'i
Mr: Sutherland The effect of it Is
is to give the circuit courts of appeals
to which Hawaii and Porto Rico are
attached the same appellate Jurisdic-
adding to the suggestion of the
senator from Utah, it will be rememt
bered .that to 'the orgahizaUon of the
terrltorv of Hawaii a different fndiplI
j system was provided ; than - had vr
beea, provided for any territory before
I that Ume, At the time that It becanle
j a; territorr, or at the ? time that It
1 became subject to the 'jurisdiction of
.the United States, they had a well-- ;
developed and fully equipped' local jur
j dietary system, and it was the purpose
1 to incorporate that in bulk aa far as
'possible Into ' the new territorial
in order that there might
not be any sudden disturbance of their
j judicial, procedure. Therefore a dif--.
ferent method was provided for reaching
the supreme court of' the United
States, and it' allowed appeals from
jthe supreme court of the Territory oi
Hawaii, composed entirely of a local
organization, to the supreme court of
the United States la cases where the
subject matter In controversy wis
over $5000
I I had, I suppose, a communication
In substance such as that received by
the senator from Utah ' (Mr. Suther-land),,
and it had been my . purpose,
had I been in the chamber when the
senator from Wat Virginia first called
) up this mcsuretoasfc-tha- t the bill
' might go over untU tomorrow, perhaps,
or the day after, in order that
the formal views of the Hawaiian bar
might receive consideration. . But 1
realize that that is too late,
v , : . --. .. .. .
i--
.
Personally I hare an exceedingly
high opinion of the hJr of the territory
of Hawaii. I doubt if any jurisdiction
in the United States of equal area
and equal or far more population has
a bar that would exceed in learning
land in bflity the bar of the territory
! of Hawaii. I would be glad if an op-- 1
portunity could be had for the views
I of their bar association to be express-- .
ed. I think, however, under the
meth-Jo- d
suggested by the senator from Utah
I that this appeal, instead of coming di
j rect to the supreme ccurt of the United
States, may be Mowed to the cir- -
I cuit court of appeals of the ninth cir
cuit Probably the differences and the
inconveniences can be equalized, and
I hope the amendment will prevail.
Vice-Preside- nt The The question is
on agreeing to the amendment proposed
by the senator from Utah (Mr.
Sutherland).
The amendment wis agreed to.
Mr; Cummins I ask that section 5
be read.
The Vice-Preside- that the court did not remember this
not know whether the section had
been amended as we had agreed on it
or not.
Mr. Chilton Yes; that has been
agreed upon as a committee amendment
Mr. Cummins I see it has.
Mr.' Saulsbury I desire to ask the .
senator in charge of the bill why the
first circuit was agreed upon as the
circuit to. which appeals might be
taken from the local courts in Porto
Rico and whether in determining
which circuit appeals should be considered
the committee took into consideration
either the second circuit or
the third circuit at Philadelphia.
1 wish to say to the senator , In
charge of the bill that h year or more
ago I was In quite close communication
with a number of lawyers in Por:
Of course the NewYork circuit
would be the most convenient, because
of the rapid exchange between New :
York and Porto Rico, but Philadelphia (
mlny suggestions were made. There ;
Chilton
were two reasons why the first circuit j
was agreed upon by the committee-- !
unanimously. ; une was tnat it was
thought that Boston, where the court
is held, comes within the line of travel
as nearly as any place would, and that
docket was not crowded with business.
and tht court would probably take .
care of the business more expeditious
ly thin any other circuit court of ap--'
ithis may be considered in connection
Mr. Saulsbury May I ask the senator
me, .tnat I received a ? communication
from Judge Hamilton, .who is at pres '
prefers the Bostoa district, I also
received, being chairman of the com-- i
mlttee on Pacific islands and Poho
Rloo, a communication from some1
ether party, saying that they thought
It. .was more 'desirable that.the Porto
Rican courts should be in the first
circuit than the one at Boston. As
tion the bill seeks to give over the
'
district courts.
: ;
Mr. Chilton Of course, I have no
right to accept-th- e amendment, ' but
after the statement of "
the senator
from Utah, who has given this matter
much attention, I urge no objection to
Its going into the bill. " It will probably
. go to conference and can 'be consid
