Air Carriers should always comply with the regulati<strong>on</strong>s <strong>and</strong> requirements of their competent Authority.<br />

(2) refusal to follow a lawful instructi<strong>on</strong> given by the aircraft comm<strong>and</strong>er, or <strong>on</strong> behalf of the<br />

aircraft comm<strong>and</strong>er by a crew member, for the purpose of ensuring the safety of the aircraft<br />

or of any pers<strong>on</strong> or property <strong>on</strong> board or for the purpose of maintaining good order <strong>and</strong><br />

discipline <strong>on</strong> board.<br />

Secti<strong>on</strong> 2: Assault <strong>and</strong> Other Acts Endangering Safety or Jeopardizing Good Order <strong>and</strong> Discipline <strong>on</strong><br />

Board a Civil Aircraft<br />

(1) Any pers<strong>on</strong> who commits <strong>on</strong> board a civil aircraft an act of physical violence against a pers<strong>on</strong><br />

or of sexual assault or child molestati<strong>on</strong> thereby commits an offence.<br />

(2) Any pers<strong>on</strong> who commits <strong>on</strong> board a civil aircraft any of the following acts thereby<br />

commits an offence if such act is likely to endanger the safety of the aircraft or of any<br />

pers<strong>on</strong> <strong>on</strong> board or if such act jeopardizes the good order <strong>and</strong> discipline <strong>on</strong> board the<br />

aircraft:<br />

(a) assault, intimidati<strong>on</strong> or threat, whether physical or verbal, against another<br />

pers<strong>on</strong>;<br />

(b) intenti<strong>on</strong>ally causing damage to, or destructi<strong>on</strong> of, property;<br />

(c) c<strong>on</strong>suming alcoholic beverages or drugs resulting in intoxicati<strong>on</strong>.<br />

Secti<strong>on</strong> 3: Other Offences Committed <strong>on</strong> Board a Civil Aircraft<br />

Any pers<strong>on</strong> who commits <strong>on</strong> board a civil aircraft any of the following acts thereby commits an<br />

offence:<br />

(1) smoking in a lavatory, or smoking elsewhere in a manner likely to endanger the safety of the<br />

aircraft;<br />

(2) tampering with a smoke detector or any other safety-related device <strong>on</strong> board the aircraft;<br />

(3) operating a portable electr<strong>on</strong>ic device when such act is prohibited.<br />

2.2 Definiti<strong>on</strong> of <strong>Unruly</strong>/Disruptive <strong>Passenger</strong><br />

The term unruly or disruptive refers to passengers who fail to respect the rules of c<strong>on</strong>duct <strong>on</strong> board<br />

aircraft or to follow the instructi<strong>on</strong>s of crew members, thereby disturbing good order <strong>and</strong> discipline <strong>on</strong><br />

board <strong>and</strong> compromising safety.<br />

ICAO Annex 17 to the C<strong>on</strong>venti<strong>on</strong> <strong>on</strong> Internati<strong>on</strong>al Civil Aviati<strong>on</strong> (the Chicago C<strong>on</strong>venti<strong>on</strong>) Security<br />

Safeguarding Internati<strong>on</strong>al Civil Aviati<strong>on</strong> Against Acts of Unlawful Interference (March 2011) defines a<br />

disruptive passenger as:<br />
