The 24 hour hotline for <strong>Home</strong> <strong>Detention</strong> is:<br />

874-1479<br />

Do not call the <strong>Home</strong> <strong>Detention</strong> office using any<br />

other phone number. This line is for medical<br />

emergencies and job location changes. This is a<br />

recorded line, you must leave a message. State your<br />

first and last name, and then spell your last name.<br />

Leave your phone number, and a brief description<br />

of your reason for calling. Do not just leave a<br />

message asking for a return call. Calls are returned<br />

in the order received. Do not expect an immediate<br />

return call as it may be several hours before your<br />

call is heard.<br />

The only time you can leave your residence or<br />

workplace is when you have verbal or written<br />

permission to do so. If you do not get<br />

permission, do not leave. Calling the recorder<br />

does not constitute permission. See rule w11.04.<br />

All faxes must have your full name. Do not fax inmate requests.<br />

MEDICAL EMERGENCIES<br />

If you have a medical emergency and must go<br />

to the hospital, call the <strong>Home</strong> <strong>Detention</strong><br />

Office as soon as possible. Give the type of<br />

emergency and which hospital you are going<br />

to, including the address. Be sure to spell your<br />

name and give the name and relationship of<br />

the person seeking medical attention if it is<br />

not you. Call every two hours with updates.<br />

Obtain proof of your hospital visit and bring<br />

that proof to your next <strong>Home</strong> <strong>Detention</strong><br />

Office visit. Emergency travel outside of the<br />

<strong>Sacramento</strong> area must be approved by <strong>Home</strong><br />

<strong>Detention</strong> Staff prior to departure. See rule<br />

W-03.02.<br />

WORK LOCATIONS<br />

If you are calling in a work location change,<br />

give your name (including spelling), the<br />

address where you are now, and the address<br />

you are headed to, as well as the phone<br />

number where you can be contacted. See rule<br />

W-11.06.<br />

WHEN YOU GET HOME<br />

SEE PICTURE NEXT PAGE.<br />

Open the black hard case marked “DualTrak.” Inside you will find the DualTrak<br />

<strong>Home</strong> Monitoring Unit (HMU), a power adapter and a phone cord. Remove all<br />

items from the case. You should place the equipment in a central location, at<br />

countertop height, not next to a refrigerator, microwave or other major appliance.<br />

Do not place the unit under a bed, in a drawer, or hidden behind anything. Do not<br />

cover the DualTrak with anything.<br />

Using the supplied power adapter, plug the silver and black connector to the back of<br />

the DualTrak in the jack marked “POWER.” Twist the threaded connector into the<br />

jack. The other end of the power adapter must be plugged into a regular household<br />

power outlet. Be sure the outlet is not on a switch.<br />

Using the supplied phone cord, insert one end into the back of the DualTrak jack<br />

marked “LINE.” The other end of the phone cord must be attached to the phone<br />

jack on your wall jack (where the phone would normally be). If you have been<br />

assigned a MEMS alcohol testing device, skip the next step. Plug your phone into<br />

the jack on the back of the DualTrak marked “PHONE.” Do not disable the ringer<br />

on your phone. No cordless phones!<br />

The power light on the front of the DualTrak will come on. The power light will be<br />

on when the unit is plugged in and power is on. The “Charge” light will light<br />

occasionally when the internal battery is being charged. The LCD screen will<br />

indicate the date and time. Occasionally, the LCD screen will indicate “Starting<br />

Call” followed by “Call Successful.”<br />

The buttons located on the front of the DualTrak are disabled. There is no need to<br />

press them. The DualTrak has a motion sensor built into it. Do NOT move the<br />

DualTrak unless given permission to do so.<br />

While on <strong>Home</strong> <strong>Detention</strong> answer the phone after the third ring. Answer your<br />

phone 24 hours per day.<br />

You must stay in your residence. You may not go into your back yard or front<br />

yard while on <strong>Home</strong> <strong>Detention</strong>.<br />

If you have been assigned an alcohol<br />

testing device-MEMS (ElmoTech):<br />

SEE PICTURE NEXT PAGE.<br />

Wait 5-10 minutes after connecting the DualTrak to both phone and<br />

power before connecting the MEMS alcohol testing device.<br />

Remove the MEMS, power cable (two parts), phone cord, and straw<br />

from the nylon carry case. Attach the provided straw to the front of<br />

the MEMS device. Assemble the two pieces of the power<br />

cord/adapter. Plug the power adapter to the back of the MEMS in the<br />

jack labeled “12VDC,” and the other end to a regular household<br />

power outlet. A green light on the back of the MEMS will light up.<br />

Set the MEMS in a way that will ensure the power cable will not be<br />

pulled from the MEMS.<br />

Wait 5 more minutes.<br />

Connect the provided phone cord into the back of the MEMS device<br />

in the jack labeled “LINE.” The other end of this phone cord must be<br />

connected to the DualTrak in the jack labeled “Phone.”<br />

You must then plug your phone into the back of the MEMS device in<br />

the jack labeled “PHONE.” Attach the provided straw to the front of<br />

the MEMS device.<br />

Do not use the telephone for the next 10 minutes.<br />

Taking a breath alcohol test:<br />

The MEMS device will sound an audible alarm and light the “PRESS<br />

START” button to summons you for a breath alcohol test. Keep a<br />

glass or bottle of water near the MEMS device so you can rinse your<br />

mouth of any food, smoke or drinks. Put on a shirt and pants or<br />

shorts. Turn on a light. Press the start button within 45 seconds of<br />

the alarm.<br />

After pressing the start button, the “FACE THE MIRROR” and<br />

“BLOW” buttons will light up. Blow into the straw, keeping your<br />

hands off the straw. Continue to face the mirror/camera while<br />

blowing into the straw. The LED lights around the mirror will light<br />

up to take your picture. Once your picture has been taken you may<br />

stop blowing. The “TEST COMPLETED” light will come on if you<br />

successfully took the test. If you fail to blow hard enough, or long<br />

enough, the “BLOW HARDER” light will come on and a second test<br />

will begin.<br />

The MEMS device will report the alcohol test and upload the picture<br />

using your phone line. Stay off the phone for the next few minutes.<br />

Do not use any mouthwash or products that contain alcohol, for<br />

example: Listerine, Scope, Nyquil, Robitussin, Orajel. Do not<br />

smoke just prior to taking a test. You must take all alcohol tests<br />

sent to you. Be sure to turn on lights in the room. You must wear<br />

clothes while taking the alcohol tests, shirts and shorts at a<br />

minimum.<br />

The MEMS device has a motion sensor built into it. Do NOT move<br />

the MEMS device unless given permission to do so.<br />

Do not attempt to defeat the purpose of the MEMS device. Any<br />

attempts to cheat the system will result in removal from <strong>Home</strong><br />

<strong>Detention</strong>. If you do not get alcohol tests for an entire day notify<br />

the HDP office.<br />

If you have been assigned a GPS tracking<br />

device:<br />

IF assigned a base station: Follow the directions as above for the<br />

DualTrak for correct installation.<br />

The GPS tracking device (UniTrak) remains attached to your leg. It is<br />

water resistant and tamper evident. Blocking the device from getting<br />

or maintaining a GPS position will result in your removal from the<br />

<strong>Home</strong> <strong>Detention</strong> Program.<br />

The UniTrak is to be charged twice per day for one hour each time,<br />

one time in the morning and one time in the evening. Failing to<br />

charge the UniTrak resulting in a device shut down will result in your<br />

removal from the <strong>Home</strong> <strong>Detention</strong> Program.<br />

A red light on the UniTrak may flash or remain lit during the charging<br />

cycle.<br />

If you are assigned to the Voice<br />

Verification system:<br />

You must answer your phone 24 hours per day while on the voice<br />

verification system. Do NOT miss any phone calls.<br />

1) Repeat the numbers when prompted.<br />

2) Speak clearly. If you are soft spoken, you will need to speak<br />

louder than your normal conversational volume.<br />

3) Use a good quality landline telephone. Worn wires and<br />

cordless phones will impede normal voice input.<br />

4) You may NOT use a speaker mode.<br />

5) Be sure there is no background noise or talking while doing<br />

the voice verification. TVs and stereos should be turned off.<br />

6) Do not lie down while taking the test.<br />

When on the <strong>Home</strong> <strong>Detention</strong> Voice Verification Program, you<br />

cannot leave the residence unless you or an immediate family<br />

member has a medical emergency. Refer to page 3 “Medical<br />

Emergencies” of this rule book.<br />

You may have no more than 2 visitors between the hours of<br />

8:00AM and 9:00PM. Refer to section W05.01 on page 20 of this<br />

rule book.<br />

You and any occupants or visitors to your residence are not<br />

allowed to be in possession of any alcoholic beverages, illegal<br />

drugs, firearms/ammunition or swords. Refer to section W13.01 on<br />

page 31 of this rulebook.<br />

DISCIPLINARY CATEGORIES<br />

Rule violations fall into 4 Categories. It is your responsibility to read<br />

and understand these rules. Ignorance is not an excuse!<br />

Category 1 (Minor Violation)<br />

Violation of a Category 1 rule will result in a verbal reprimand.<br />

Category 2 (Major Violation)<br />

Violation of a Category 2 rule or a repeat violation of a Category 1<br />

rule will result in disciplinary action which may include loss of one to<br />

three days of accrued good time.<br />

Category 3 (Major Violation)<br />

Violation of a Category 3 rule, or a repeat violation of a Category 2<br />

rules will result in disciplinary action which may include: Loss of<br />

specific privileges and/or loss of from 3 to 10 days of accrued good<br />

time and/or return to standard incarceration (Main or Branch Jail).<br />

Category 4 (Major Violation)<br />

Violation of a Category 4 rule or a repeat violation of a Category 3<br />

rule will result in disciplinary action which may include: Loss of from<br />

10 to the entire amount of accrued good time, return to standard<br />

incarceration, and/or arrest and prosecution.<br />

If you commit a subsequent violation while being processed for a rule<br />

violation, the second violation will be considered independent to the<br />

original incident and an additional violation report may be submitted.<br />

Multiple violations committed as one offense may be considered<br />

when determining the severity of the violation, but shall be handled<br />

as a single incident and included in the same violation report.<br />

HEARING PROCEDURE<br />

An inmate charged with a rule violation is entitled to a hearing. At<br />

the hearing the inmate will be allowed to make a statement and<br />

present a defense to the charge.<br />

No hearing will take place sooner than twenty four (24) hours after<br />

the charge has been lodged unless the inmate elects to waive the 24<br />

hour delay, and requests an immediate hearing. The accused may call<br />

witnesses, but is not entitled to legal representation.<br />

Should the inmate choose to wait 24 hours before the hearing, the<br />

hearing will be conducted at the <strong>Home</strong> <strong>Detention</strong> Office (Main Jail or<br />

RCCC if in custody there). You will be advised of the time and date<br />

of the hearing when you are given a copy of the incident report.<br />

Appeals regarding the Hearing Officer’s decision must be made<br />

within five (5) days, and must be in written form to the Division<br />

Commander, who will make a final disposition within twenty (20)<br />

days.<br />

If you are removed from the <strong>Home</strong> <strong>Detention</strong> Program for a rules<br />

violation, your return to the <strong>Home</strong> <strong>Detention</strong> program is at the<br />

supervisor’s discretion.<br />

Inmate Grievance<br />

A participant may file a written grievance with an officer if he/she<br />

feels a condition of confinement or his/her personal, human, or<br />

constitutional rights are infringed upon by an act or policy either<br />

written or unwritten. A grievance may not be filed against a<br />

disciplinary action (i.e. , Major Incident Report).<br />

The grievance must be submitted within five (5) working days after<br />

the occurrence. The grievant shall complete an “Inmate Grievance<br />

form” and submit it to a sworn staff officer. Forms are available at<br />

the <strong>Home</strong> <strong>Detention</strong> Office, 700 N. Fifth St, Monday through Friday,<br />

8:00 A.M. to 3:30 P.M.<br />

A reply to the grievance will be forwarded to the grievant within five<br />

(5) days. The grievant has five (5) working days to appeal the<br />

grievance response to the <strong>Home</strong> <strong>Detention</strong> Program Commander.<br />

Inmate Requests (Kites)<br />

Requests for permission to attend medical, dental, or other necessary<br />

appointments will be submitted during the weekly <strong>Home</strong> <strong>Detention</strong><br />

Office visit prior to the appointment. Inmate request forms (kites)<br />

should be completed PRIOR to arrival at the <strong>Home</strong> <strong>Detention</strong> office.<br />

Requests may NOT be faxed, mailed, emailed or brought in by<br />

anyone else. All non court ordered requests submitted will result in<br />

removal or decrease of Personal Business Time. Due to medical<br />

necessity, you may obtain telephone approval to attend an<br />

appointment. See rule W06.01<br />

Failure to obtain approval prior to attending an appointment is a<br />

major violation. Participants attending appointments must bring<br />

back written confirmation of attendance. See rule W03.05 for what<br />

constitutes proof of attendance.<br />

PERSONAL BUSINESS TIME<br />

Most <strong>Home</strong> <strong>Detention</strong> inmates are afforded up to 4 consecutive hours once<br />

per week to conduct personal business. Personal business includes grocery<br />

shopping, check cashing, laundry, haircuts and shopping for personal items<br />

such as clothing and other work or school related items. You may do yard<br />

work at your own residence only. Visiting a mall is NOT allowed unless you<br />

must patronize a specific store for a valid reason. You must schedule all<br />

appointments (i.e. doctor or probation) to occur during your personal<br />

business time.<br />

Your personal business time must be scheduled, and on file at the <strong>Home</strong><br />

<strong>Detention</strong> Office. You may have up to 4 consecutive hours that begin no<br />

earlier than 8:00 A.M., and end no later than 5:00 P.M. The day for your<br />

personal business time must be 1 day or 2 days before your weekly fee<br />

payment and drug testing at the <strong>Home</strong> <strong>Detention</strong> Office.<br />

Personal business is not “free time” to do as you please such as<br />

visiting friends, going to the movies or just “hanging out.” No<br />

recreational activity is ever allowed. You may not stop at any<br />

restaurant, or use a “drive through” at any time while on <strong>Home</strong><br />

<strong>Detention</strong>. You may not go to a friend’s house at any time while<br />

on <strong>Home</strong> <strong>Detention</strong>. You may not leave <strong>Sacramento</strong> <strong>County</strong>. Do<br />

not come to the <strong>Home</strong> <strong>Detention</strong> office during your PTO unless<br />

told to do so by HDP staff.<br />

Violations of this privilege shall result in major write ups and may result in<br />

loss of good time, or removal from the <strong>Home</strong> <strong>Detention</strong> Program.<br />

CHANGING RESIDENCES<br />

<strong>Home</strong> <strong>Detention</strong> inmates are not allowed to move unless unusual<br />

circumstances exist. You must turn in an application to move and<br />

provide a new working phone line 14 days prior to your move date.<br />

The application will not be accepted until a new phone number has<br />

been installed. You cannot transfer your existing phone line to the<br />

new residence. All adults at the new residence must sign a new<br />

“Consent To Search” form. Turn in the application two weeks prior<br />

to moving.<br />

RULES AND REGULATIONS<br />

Waiver<br />

Exceptions to any of the rules, as stated in the <strong>Home</strong> <strong>Detention</strong> Rule<br />

Book, must be pre-approved in writing by the <strong>Home</strong> <strong>Detention</strong><br />

Supervisor.<br />

RULES OF CONDUCT<br />

W-01.01 REQUESTS SHALL NOT BE RESUBMITTED<br />

If you submit a request, either verbally or in writing, to any<br />

officer, and that request is denied, you shall not submit the<br />

same request to another officer. (Category 3)<br />

W-01.02 EQUIPMENT MUST NOT BE TAMPERED<br />

WITH<br />

You are responsible for the equipment assigned to you. No<br />

equipment or property may be maliciously destroyed,<br />

tampered with, opened, altered, or defaced. (Category 4)<br />

Also see sections W-16.<br />

W-02.01 ACCESS TO RESIDENCE WILL BE ALLOWED<br />

As a condition of the <strong>Home</strong> <strong>Detention</strong> Program, all adults<br />

(over 18) residing or staying at your residence must have<br />

signed a “Permission to Search” form at the <strong>Home</strong> <strong>Detention</strong><br />

Office. You, as well as anyone living or visiting your<br />

residence, will allow all representatives of the <strong>Sacramento</strong><br />

Sheriff’s <strong>Department</strong> and other law enforcement agencies<br />

immediate access to your residence. This rule applies even if<br />

you are not home.<br />

If you have a dog at your residence, the <strong>Home</strong> <strong>Detention</strong><br />

Program requires that at any time a Peace Officer comes to<br />

your residence you must immediately secure the dog in the<br />

backyard. It does not matter what type or size of dog. This is<br />

for the safety of both the officer and your dog. (Category 3).<br />

W-02.02 SEARCHES WILL BE ALLOWED OF PERSON,<br />

VEHICLE, RESIDENCE. IDENTIFY YOUR<br />

INMATE STATUS TO LAW ENFORCEMENT.<br />

You shall allow any Deputy Sheriff of the <strong>Sacramento</strong><br />

Sheriff’s <strong>Department</strong> or allied agency to search any portion of<br />

your person, the vehicle in which you are riding, or place of<br />

residence for contraband.<br />

In event of contact with law enforcement you are required to<br />

identify yourself as a <strong>Sacramento</strong> <strong>County</strong> <strong>Home</strong> <strong>Detention</strong><br />

inmate. (Category 3)<br />

W-02.03 ARRANGEMENTS FOR HOME DETENTION<br />

OFFICE VISITS<br />

As a participant of the <strong>Home</strong> <strong>Detention</strong> Program, you will be<br />

required to come to the <strong>Home</strong> <strong>Detention</strong> Office once per<br />

week. Some participants may be required to come in 3, 5 or<br />

even 7 days per week for drug testing. Please bring a pen<br />

with you to the <strong>Home</strong> <strong>Detention</strong> Office. You shall make all<br />

arrangements necessary to comply with mandatory<br />

appointments at the <strong>Home</strong> <strong>Detention</strong> Office. The <strong>Home</strong><br />

<strong>Detention</strong> Office does not close for holidays. You may take<br />

several blank request forms home with you, and bring them in<br />

completed. (Category 3)<br />

See rule codes W-08. Do not come to the <strong>Home</strong> <strong>Detention</strong><br />

office during your Personal Business Time.<br />

APPOINTMENTS<br />

W-03.01 MEDICAL, DENTAL OR OTHER<br />

APPOINTMENTS MUST HAVE APPROVAL<br />

You will not attend medical, dental, or any other appointment<br />

(Probation Office, Court) without prior approval from a <strong>Home</strong><br />

<strong>Detention</strong> Officer unless that appointment is on your<br />

“Personal Business Time.” See rule W06.01 for instructions<br />

how to obtain approval. Elective surgeries (i.e.: cosmetic or<br />

corrective eye) are not allowed for <strong>Home</strong> <strong>Detention</strong> inmates<br />

unless previously scheduled and unable to be postponed.<br />

Your 4 hour block of “Personal Business Time” will be<br />

reduced to reflect the time requested in the “Inmate<br />

Request Slip.” (Category 3)<br />

W-03.02 NOTIFICATION OF MEDICAL<br />

EMERGENCIES WILL BE MADE<br />

If a medical emergency threatens you or an immediate<br />

family member’s (spouse, parent, sister, brother or your<br />

child) well being you may seek medical attention. You (or<br />

someone else if you are unable) must notify the <strong>Home</strong><br />

<strong>Detention</strong> Office of any medical emergency as soon as<br />

reasonably possible. You must stay in the <strong>Sacramento</strong><br />

area.<br />

You must give the exact location or address and phone<br />

number of where you are, as well as the nature of the<br />

emergency. You must also call every two hours with an<br />

update on the status until you return home (unless told by a<br />

<strong>Home</strong> <strong>Detention</strong> Officer that you no longer need to call in).<br />

You must bring proof on your next visit to the <strong>Home</strong><br />

<strong>Detention</strong> Office. The proof MUST show your name, date and<br />

time you were at the hospital. (Category 2)<br />

W-03.03 IMMEDIATE NOTIFICATION OF INJURY OR<br />

ILLNESS<br />

You must notify <strong>Home</strong> <strong>Detention</strong> staff immediately of any<br />

injury or illnesses that requires medical treatment. If you call<br />

in sick to work, report to work later than scheduled, or leave<br />

early from work for any reason, you must notify <strong>Home</strong><br />

<strong>Detention</strong> staff. (Category 2)<br />

W-03.04 THE MOST DIRECT MEANS TO ANY<br />

DESTINATION AND BACK<br />

You must always use the most direct means to work, or any<br />

approved appointment. You may NOT stop to shop, visit,<br />

have lunch (including drive through), or run errands. You are<br />

not to leave <strong>Sacramento</strong> <strong>County</strong> without prior approval.<br />

(Category 3)<br />

W-03.05 MUST OBTAIN PROOF OF APPOINTMENTS<br />

(MEDICAL, DENTAL, ETC.)<br />

If you have been approved to attend a medical appointment,<br />

court appearance or other type of leave from your residence,<br />

you must obtain proof of attendance. This must be brought<br />

to your next weekly visit at the <strong>Home</strong> <strong>Detention</strong> Office.<br />

Proof must be on an official letterhead with the name, phone<br />

number and signature of a staff member. Your name must<br />

be on the document. Arrival and leave times must be<br />

included. If you are unable to attend your appointment, you<br />

must call <strong>Home</strong> <strong>Detention</strong> staff before the appointment time.<br />

(Category 2)<br />

FINANCES<br />

W-04.01 PAYMENT OF FEES IS PARTICIPANT’S<br />

RESPONSIBILITY<br />

You are responsible to pay all <strong>Home</strong> <strong>Detention</strong> fees. Cash,<br />

Money Order, Cashiers Checks, ATM, Visa and MasterCard<br />

are accepted Monday through Friday during your weekly<br />

<strong>Home</strong> <strong>Detention</strong> Office visit. The Cashier’s Office is open<br />

from 7:00AM to 4:00PM Monday through Friday only. The<br />

cashiers office is closed on all <strong>County</strong> holidays.<br />

On Saturdays, Sundays and <strong>County</strong> holidays a Cashiers Check<br />

or Money Order is the only form of payment accepted.<br />

Complete a payment envelope (provided) and deposit in the<br />

drop box in the <strong>Home</strong> <strong>Detention</strong> lobby. You may take several<br />

payment envelopes home and have them ready for deposit<br />

upon arrival.<br />

NO personal checks are ever accepted. (Category 3)<br />

W-04.02 FEES ARE PAID IN ADVANCE FOR A 1 WEEK<br />

PERIOD<br />

The <strong>Home</strong> <strong>Detention</strong> fees are paid in advance for a one (1)<br />

week period. Failure to keep your account paid may cause<br />

you to be removed from the program. (Category 4)<br />

VISITS<br />

W-05.01 VISITORS ALLOWED ONLY DURING HOURS<br />

OF 8:00 AM TO 9:00 PM<br />

You may have visitors in your home between the hours of<br />

8:00 AM and 9:00 PM. You may not have more than two (2)<br />

adult visitors at any time. You must provide the names of any<br />

and all visitors to your place of residence when requested by<br />

an officer. Garage sales are not allowed at your residence<br />

while on <strong>Home</strong> <strong>Detention</strong>. (Category 3)<br />

W-05.02 WILL NOT ASSOCIATE WITH WANTED<br />

PERSONS, ON PROBATION, ON PAROLE<br />

You must not associate with parolees, probationers, or anyone<br />

with one or more warrants. You must not be in an area where<br />

alcohol, drugs or illegal activity is taking place. You are NOT<br />

allowed to visit prisoners at any correctional facility.<br />

REQUESTS AND RECORDS<br />

W-06.01 REQUESTS FOR APPOINTMENTS WILL BE<br />

SUBMITTED IN ADVANCE<br />

The only time to submit a request is during your weekly visit<br />

to the <strong>Home</strong> <strong>Detention</strong> Office. Completely fill out the<br />

“INMATE REQUEST SLIP,” also known as a “KITE,”<br />

including the date, time, address, telephone number and the<br />

purpose of the appointment. You must also provide the<br />

method of transportation and estimated time away from the<br />

residence or job location. Requests may NEVER be faxed to<br />

the <strong>Home</strong> <strong>Detention</strong> Office. Only one (1) request per form,<br />

per week. Request forms must be filled out completely<br />

prior to arrival at the <strong>Home</strong> <strong>Detention</strong> office.<br />

Your four hour block of “Personal Business Time” will be<br />

reduced to reflect the time requested on the “Inmate Request<br />

Slip.” (Category 1)<br />

The only phone number you may call is 874-1479, which is<br />

for medical emergencies and job locations. All other requests<br />

must wait until your next <strong>Home</strong> <strong>Detention</strong> office visit.<br />

W-06.02 MUST HAVE A VALID PICTURE I.D.<br />

(DRIVERS LICENSE, CA I.D.)<br />

You must have, and always keep with you, a picture<br />

identification such as a driver’s license or I.D. card issued by<br />

a government agency. Do not forget to bring your ID to the<br />

<strong>Home</strong> <strong>Detention</strong> Office on your weekly office visit. In event<br />

of contact with law enforcement you are required to identify<br />

yourself as a <strong>Sacramento</strong> <strong>County</strong> <strong>Home</strong> <strong>Detention</strong> inmate.<br />

W-06.03 IMMEDIATE NOTIFICATION OF SCHEDULE<br />

CHANGES<br />

Whenever there is a change in your schedule (leave and return<br />

times), it is YOUR responsibility to notify <strong>Home</strong> <strong>Detention</strong><br />

Office immediately.<br />

Notification of work schedule changes must be done by your<br />

supervisor, by fax, at least 24 hours in advance. This includes<br />

overtime work and vacation time. You will receive a call<br />

confirming receipt of your schedule. If you do not receive a<br />

call you must call and verify the schedule has been received.<br />

(Category 2)<br />

W-06.04 HOME DETENTION STAFF NOTIFIED OF<br />

ANY DEVIATION IN NORMAL SCHEDULE<br />

In the event of a medical emergency you are required to notify<br />

the <strong>Home</strong> <strong>Detention</strong> Office. You are to telephone the <strong>Home</strong><br />

<strong>Detention</strong> Office before leaving any location and upon<br />

arriving unless previously approved. Do NOT call the <strong>Home</strong><br />

<strong>Detention</strong> Office if you have already been scheduled to leave<br />

(i.e. work, AA meetings, <strong>Home</strong> <strong>Detention</strong> visit days). You<br />

are not allowed to leave or deviate from your schedule<br />

unless authorized. (Category 2)<br />

W-06.05 DO NOT FALSIFY RECORDS OR ANY OTHER<br />

INFORMATION<br />

Under no circumstances are you to forge or falsify records, or<br />

any other information that may be required for the <strong>Home</strong><br />

<strong>Detention</strong> Program . (Category 4)<br />

MEALS<br />

W-07.01 MEALS SHALL BE CONSUMED AT WORK<br />

SITE OR HOME<br />

You must consume all meals at your work site, or at home.<br />

You are not allowed to leave your work site or home for the<br />

purpose of purchasing food to go or consuming meals. Also<br />

strictly prohibited is the use of “drive-through” windows.<br />

Commercially prepared food may be eaten, provided it is<br />

brought to you at your jobsite or school by someone else.<br />

(Category 3)<br />

W-09.01 YOU SHALL NOT GO TO RESTAURANTS<br />

Under no circumstances are you to go to restaurants or bars.<br />

You may not stop and use a drive through, even for coffee.<br />

(Category 3)<br />

HOME DETENTION OFFICE VISITS<br />

Hats, sunglasses, saggy pants, hoodies over your head<br />

and gang affiliated clothing are not allowed at the<br />

<strong>Home</strong> <strong>Detention</strong> Office. Cell phones are to be turned<br />

OFF.<br />

W-08.01 YOU MUST ATTEND ALL SCHEDULED<br />

APPOINTMENTS AT THE HOME DETENTION<br />

OFFICE<br />

You must attend all scheduled appointments at the <strong>Home</strong><br />

<strong>Detention</strong> Office. You will be scheduled to appear once a<br />

week for program fee payments and drug testing. You will be<br />

required to submit a urine sample for drug testing. If you<br />

have a balance due for program fees, the weekly payment<br />

must be made at this time. See also W02.03. (Category 3)<br />

W-08.02 YOU MUST BE ON TIME FOR ALL<br />

SCHEDULED APPOINTMENTS AT HOME<br />

DETENTION<br />

You are required to be on time for all scheduled appointments<br />

at the <strong>Home</strong> <strong>Detention</strong> Office. If you have problems that are<br />

beyond your control, and will be late, you must call the <strong>Home</strong><br />

<strong>Detention</strong> Office at the phone number listed at the front of<br />

this book. DO NOT LEAVE EARLY FOR THIS OR ANY<br />

OTHER APPOINTMENT!<br />

<strong>Home</strong> <strong>Detention</strong> office visits are scheduled when you are<br />

booked onto the program. Monday through Friday office<br />

visits are at 7:00AM. Saturday and Sunday appointments are<br />

2:00PM. (Category 3)<br />

ALCOHOL/DRUGS<br />

W-09.01 YOU SHALL NOT GO TO RESTAURANTS<br />

/DELIS/BARS/COFFEE SHOPS<br />

Under no circumstances are you to go to restaurants or bars.<br />

You may not stop and use a drive through, even for coffee.<br />

See W-07.01 rule. (Category 3)<br />

W-09.02 YOU WILL SUBMIT TO A BREATH AND<br />

URINE TEST UPON REQUEST<br />

All <strong>Home</strong> <strong>Detention</strong> Program participants will submit to a<br />

breath or urine test upon the request of <strong>Home</strong> <strong>Detention</strong> Staff<br />

at any time while you are on the <strong>Home</strong> <strong>Detention</strong> Program.<br />

Failing to provide a sample within 30 minutes can be<br />

considered a refusal resulting in the loss of good time or<br />

removal from HDP. (Category 4)<br />

W-09.03 SHALL NOT FALSIFY OR ATTEMPT TO<br />

FALSIFY ANY TESTS FOR DRUGS<br />

You must not falsify, attempt to falsify, mask or tamper with<br />

any tests for drugs or alcohol. (Category 4)<br />

W-09.04 NO ALCOHOLIC BEVERAGES WILL BE<br />

ALLOWED AT RESIDENCE<br />

NO alcoholic beverages are allowed at your residence. This<br />

includes “non-alcoholic” beer, cooking wine, cough syrups<br />

with alcohol, and bottles used for “display” or “decoration.”<br />

This also includes alcoholic beverage containers that do not<br />

belong to you.<br />

Do not use mouthwash if it contains alcohol (Listerine, Scope<br />

or similar). Alcohol free mouthwashes will be labeled as such.<br />

Also see section W-13.01. (Category 4)<br />

W-09.05 NO EMPTY ALCOHOLIC CONTAINERS<br />

ALLOWED AT RESIDENCE<br />

NO empty alcoholic beverage containers will be allowed in<br />

or outside of your residence. This includes alcoholic<br />

beverage containers that do not belong to you, even if you<br />

collect cans and bottles for recycling. (Category 3)<br />

***It is your responsibility to know the rules. Not knowing<br />

a rule is not an excuse to violate the rule!***<br />

TRANSPORTATION<br />

W-10.01 MOTOR VEHICLES WILL NOT BE<br />

OPERATED UNLESS LEGALLY LICENSED<br />

You shall not operate a motor vehicle unless you are legally<br />

licensed to do so by the State of California. A copy of your<br />

valid drivers license is to be provided to the <strong>Home</strong> <strong>Detention</strong><br />

office. (Category 4)<br />

W-10.02 MOTOR VEHICLES WILL NOT BE<br />

OPERATED UNLESS INSURED/REGISTERED<br />

You shall not operate any motor vehicle unless proof of valid<br />

insurance and valid registration is on file at the <strong>Home</strong><br />

<strong>Detention</strong> Office. Vehicles that belong to your employer and<br />

operated as required in the scope of your employment are<br />

exempted from this requirement. (Category 3)<br />

W-10.03 HITCHHIKING IS NOT ALLOWED, YOU<br />

MUST RIDE WITH AN APPROVED DRIVER<br />

You shall not hitchhike. You shall not ride with anyone other<br />

than an approved driver. See next rule. (Category 3)<br />

W-10.04 PROVIDE LIST OF ALL DRIVERS AND<br />

VEHICLE DESCRIPTION<br />

Participants being transported by private vehicles will provide<br />

the <strong>Home</strong> <strong>Detention</strong> staff with a list of all drivers and their<br />

vehicles, including a description of each vehicle. The vehicle<br />

description shall include the color, make, model, year and<br />

license plate number. You must also provide a photocopy of<br />

the drivers vehicle registration, proof of insurance, and<br />

VALID California driver’s license. (Category 2)<br />

W-10.05 WILL NOT DEVIATE FROM APPROVED<br />

TRANSPORTATION WITHOUT PERMISSION<br />

You are not to deviate from your approved method of<br />

transportation or vehicle without authorization from <strong>Home</strong><br />

<strong>Detention</strong> staff. (Category 3)<br />

EMPLOYMENT/SCHOOL<br />

W-11.01 GO DIRECTLY TO WORK SITE AND RETURN<br />

HOME DIRECTLY FROM WORK<br />

You must go directly to your work/school site and return<br />

directly to your home. You may NOT shop, visit anyone,<br />

stop to eat, or run any errands. Any exceptions will require<br />

approval on an Inmate Request Form (Kite). Exception: If<br />

you are approved and scheduled to attend NA, AA, or some<br />

other type of appointment immediately after or before<br />

work/school, you may do so without going home first.<br />

Split shifts are not allowed. School schedules must not have<br />

an unreasonable amount of time between classes. PE classes<br />

are not allowed. (Category 3)<br />

W-11.02 NOTIFY HOME DETENTION IF NOT GOING<br />

TO WORK/SCHOOL<br />

If you are not going to work/school at your regularly<br />

scheduled time or day, you must notify the <strong>Home</strong> <strong>Detention</strong><br />

Office BEFORE your scheduled leave time. (Category 2)<br />

W-11.03 BEING FIRED OR LAID OFF REQUIRES<br />

IMMEDIATE NOTIFICATION / SCHOOL<br />

SEMESTERS END/BEGIN<br />

If you have a reduction in your work schedule to less than 20<br />

hours, or have a break in employment, or get fired or laid off<br />

you must notify <strong>Home</strong> <strong>Detention</strong> Office immediately. Being<br />

fired or laid off will not necessarily cause you to be<br />

removed from <strong>Home</strong> <strong>Detention</strong>.<br />

If your school semester ends, notify <strong>Home</strong> <strong>Detention</strong> Staff the<br />

week prior to final exams. You will also need to provide a<br />

new schedule to <strong>Home</strong> <strong>Detention</strong> the week prior to the new<br />

semester beginning. (Category 2)<br />

W-11.04 YOU MAY NOT LEAVE YOUR RESIDENCE<br />

WITHOUT AUTHORIZATION FROM HOME<br />

DETENTION<br />

You may not leave your residence without specific<br />

authorization to do so. You must return by the appointed<br />

time, unless you have specific authorization from <strong>Home</strong><br />

<strong>Detention</strong> Staff. Tardiness is UNACCEPTABLE!<br />

(Category 4)<br />

W-11.05 YOU MAY NOT LEAVE YOUR JOB SITE<br />

UNLESS GIVEN AUTHORIZATION FROM<br />

HOME DETENTION<br />

You are not to leave your job/school location at any time<br />

unless authorized by the <strong>Home</strong> <strong>Detention</strong> Staff. You may not<br />

leave work during any break, even an unpaid lunch break. If<br />

released early from work you must immediately telephone<br />

the <strong>Home</strong> <strong>Detention</strong> Office and notify that you are enroute<br />

home and why. (Category 4)<br />

W-11.06 YOU MUST NOTIFY HOME DETENTION OF<br />

JOB LOCATION CHANGES AND GIVE NEW<br />

LOCATION<br />

If, in the type of work you do, you must change job locations<br />

during the workday (i.e., construction workers or delivery<br />

staff) you must notify the <strong>Home</strong> <strong>Detention</strong> Office of the new<br />

location, including address, lot number (if known) and street,<br />

before leaving. You may not leave the <strong>Sacramento</strong> area. You<br />

must notify the <strong>Home</strong> <strong>Detention</strong> Office as soon as you arrive<br />

at the new location. (Category 3)<br />

W-11.07 OVERTIME PERMITTED ONLY IF<br />

AUTHORIZED. SCHEDULES MUST BE FAXED<br />

Overtime work is permitted only when requested in advance<br />

and approved by <strong>Home</strong> <strong>Detention</strong> staff. No overtime is<br />

allowed at the end of a shift unless it is an emergency. If<br />

overtime is required, the employer must fax <strong>Home</strong> <strong>Detention</strong><br />

Office 24 hours prior to the overtime. The employer must fax<br />

a letter on company letterhead, indicating your full name, the<br />

hours to be worked, and must be signed by your supervisor.<br />

Regularly scheduled shifts are to be no longer than 10 hours<br />

and/or 6 days per week. (Category 2)<br />

W-11.08 MUST LEAVE FOR WORK/SCHOOL ON TIME<br />

UNLESS GIVEN AUTHORIZATION<br />

You must leave for work/school on time (not early, not late)<br />

unless the <strong>Home</strong> <strong>Detention</strong> staff has given you permission to<br />

leave at a different time. (Category 2)<br />

W-11.10 MAY NOT SEEK NEW EMPLOYMENT<br />

WITHOUT PERMISSION FROM HOME<br />

DETENTION<br />

You may not seek new employment without permission from<br />

<strong>Home</strong> <strong>Detention</strong> staff (except on Personal Business Time).<br />

You may not start a new job or school without prior approval<br />

from the <strong>Home</strong> <strong>Detention</strong> office. You will be required to<br />

submit a new application and provide an employer letter.<br />

Confirmation with the employer or school will be done prior<br />

to you being able to start. (Category 2)<br />

W-11.11 MUST NOT LEAVE RESIDENCE BEFORE<br />

SCHEDULED TIME<br />

You may not leave your residence before your scheduled<br />

leave time without prior approval from <strong>Home</strong> <strong>Detention</strong> staff.<br />

See also section W-15.02, escape. (Category 3)<br />

COMMISSARY<br />

W-12.01 MAY NOT DO PERSONAL SHOPPING<br />

WITHOUT PRIOR APPROVAL OF HOME<br />

DETENTION STAFF<br />

Except for your “Personal Business Time” (see page 3) you<br />

are not to do any type of personal shopping without prior<br />

approval from <strong>Home</strong> <strong>Detention</strong> staff. You may not stop at<br />

any restaurants or drive through windows. Restaurant food<br />

must be picked up or delivered by someone else. See also<br />

rule 07.01. (Category 3)<br />

CONTRABAND<br />

W-13.01 POSSESSION OF ALCOHOL, FIREARMS OR<br />

ILLEGAL DRUGS<br />

The following items are not allowed in your residence or on<br />

your property: Alcoholic beverages, firearms, OC (Oleoresin<br />

Capsicum Pepper Spray), mace, Tasers, stun guns, swords or<br />

defense/offense type cutting weapons, illegal drugs, firearms,<br />

ammunition, martial arts fighting equipment, or any illegal<br />

weapons. You also must not have any “Airsoft,” BB or<br />

paintball type guns. (Category 4)<br />

GENERAL RULES OF CONDUCT<br />

W-14.01 WILL NOT BE RUDE, CURSE, SWEAR AT OR<br />

MAKE OBSCENE GESTURES<br />

You shall not, through word, gesture, or action, be<br />

intentionally rude, curse, swear at, make obscene gestures<br />

toward, or use any derogatory language to an officer or<br />

civilian employee of the Sheriff’s <strong>Department</strong>, or any other<br />

law enforcement agency. (Category 3)<br />

W-14.02 MUST COMPLY WITH ALL DIRECTIVES<br />

BOTH WRITTEN AND VERBAL<br />

You must comply with all directives, both written and verbal,<br />

issued by employees of the Sheriff’s <strong>Department</strong>.<br />

(Category 3).<br />

W-14.03 SHALL NOT LIE OR FALSELY REPRESENT<br />

THE TRUTH TO A DEPUTY<br />

You must not lie or falsely represent the truth to any officer or<br />

civilian employee of the Sheriff’s <strong>Department</strong>.<br />

(Category 3).<br />

W-14.04 HOME DETENTION STAFF TO BE<br />

ADDRESSED BY TITLE<br />

You are to address all <strong>Home</strong> <strong>Detention</strong> staff by their title (i.e.,<br />

Deputy, Officer, Mr., Ms., etc.) and their last name.<br />

(Category 2).<br />

VIOLATION OF STATUE OR LAW<br />

W-15.01 SHALL NOT VIOLATE ANY COUNTY, STATE<br />

OR FEDERAL LAW<br />

You shall not violate any City, <strong>County</strong>, State or Federal code<br />

or law. You shall not conspire, assist, or counsel another<br />

person to violate any City, <strong>County</strong>, State or Federal law.<br />

(Category 4).<br />

HS 11590, PC 290, PC 457.1 REGISTRANTS ARE NOT<br />

EXCUSED FROM REGISTRATION REQUIREMENTS<br />

WHILE ON HOME DETENTION.<br />

W-15.02 ESCAPE<br />

Leaving your place of confinement (residence) or failing to<br />

return on time without authorization will subject you to<br />

felony prosecution for escape under Section 4532 of the<br />

California Penal Code, a Felony. (Category 4).<br />

W-15.03 SHALL NOT BE UNDER THE INFLUENCE OF<br />

ALCOHOL OR DRUGS<br />

At no time are you to be under the influence of, or have a<br />

positive level in your system, any alcoholic beverage,<br />

unauthorized drug, or narcotic. You must notify <strong>Home</strong><br />

<strong>Detention</strong> staff of any prescription medications you are<br />

taking. You must also provide a copy of the prescription. If<br />

you have been issued a MEMS device (alcohol testing device)<br />

you must take every test given. Failure to do so could be<br />

considered a positive test for alcohol. (Category 4).<br />

<strong>Home</strong> <strong>Detention</strong> Program will not accept any medical<br />

marijuana cards nor allow the use of Marinol, Adderall,<br />

Phentermine or Amphetamine salts while on the program.<br />

You should consult your physician for alternative<br />

medications while on the program. You shall not consume<br />

any poppy seed products while on the program.<br />

W-15.04 SHALL NOT BE IN POSSESSION OF<br />

ANOTHER’S PRESCRIBED MEDICATION<br />

You must not possess any medication not prescribed to you.<br />

You must NOT take medication prescribed to anyone else.<br />

You must provide proof of your prescribed medications with<br />

the original bottle or prescription. (Category 4)<br />

W-15.05 YOU SHALL NOT VIOLATE TERMS OF<br />

PROBATION<br />

If you are on Probation, you shall not violate any conditions<br />

or terms of your probation while on the <strong>Home</strong> <strong>Detention</strong><br />

Program. (Category 4)<br />

W-15.06 MAY NOT POSSESS DRUG PARAPHERNALIA<br />

At no time may you be in possession of any type of drug<br />

paraphernalia. Possession includes anywhere on your person,<br />

immediate reach, inside your vehicle or the vehicle in which<br />

you are riding in, and inside your home or anywhere on your<br />

property. (Category 3)<br />

EQUIPMENT<br />

You may take showers with the ankle transmitter on. Do not take<br />

baths, but if you must, keep the transmitter out of the water. You may<br />

not go swimming or use a hot tub while on <strong>Home</strong> <strong>Detention</strong>.<br />

YOU ARE RESPONSIBLE FOR ALL EQUIPMENT<br />

ASSIGNED TO YOU. READ RULE W-16.02.<br />

W-16.01 MONITORING EQUIPMENT WILL NOT BE<br />

DISCONNECTED. POWER AND PHONE LINE<br />

SERVICE TO BE MAINTAINED<br />

You are solely responsible to insure the <strong>Home</strong> <strong>Detention</strong><br />

monitoring base unit (and MEMS alcohol testing device if<br />

issued to you) is not disconnected from the electricity or the<br />

telephone line. This equipment must remain connected to<br />

both phone and power at all times. You must pay your phone<br />

and utility bill so service is not disconnected. You may NOT<br />

have an answering machine or any call services.<br />

You must plug a corded phone into the back of the<br />

monitoring device issued to you. The ringer must be<br />

turned on and you must answer your phone 24 hours per<br />

day.<br />

Analog landline phone service is required. Digital and<br />

VOIP (i.e.: Comcast Cable, any Broadband, Vonage,<br />

Magic Jack) phone services are NOT acceptable. Lifeline<br />

and U-Verse phone services are NOT acceptable.<br />

If there is a power outage at your residence, call the <strong>Home</strong><br />

<strong>Detention</strong> Office as soon as possible. Call again when power<br />

is restored. (Category 3).<br />

W-16.02 EQUIPMENT WILL NOT BE REMOVED OR<br />

TAMPERED WITH<br />

You are solely responsible to insure that no one removes or<br />

attempts to remove the transmitter attached to your ankle.<br />

You are not to tamper with the transmitter in any way. Do not<br />

let anyone else tamper with the transmitter. If the transmitter<br />

is somehow damaged inadvertently you must notify <strong>Home</strong><br />

<strong>Detention</strong> immediately.<br />

All equipment is to remain plugged into power and phone<br />

plugs as directed.<br />

You are solely responsible to insure that no one tampers with<br />

the receiver (or alcohol testing device if issued) in any way.<br />

You will be charged for any damage to any equipment<br />

assigned to you. This includes the electronic equipment,<br />

cases, power and phone cables. (Category 4).<br />

W-16.03 YOU MUST REMAIN IN RANGE OF<br />

MONITORING EQUIPMENT AT ALL TIMES<br />

You must remain within the range of the <strong>Home</strong> <strong>Detention</strong><br />

monitoring unit at all times. You must stay in your residence<br />

and in range of the receiver. You may not go into your front,<br />

side or backyard. See also rules W11.04 and W15.02. The<br />

only exception is if you have been authorized to be out of<br />

You may not change your telephone number without prior approval<br />

from <strong>Home</strong> <strong>Detention</strong> staff.<br />

You must provide the phone number of any cell phone or alternate<br />

phone number you have. (Category 3)<br />

The day you are scheduled to be released: Arrive at the<br />

<strong>Home</strong> <strong>Detention</strong> Office at 7:00 AM, including holidays and<br />

weekends. You must bring all monitoring equipment, equipment<br />

box(es), GREY phone cable and power cord. Do NOT cut off your<br />

transmitter until told to do so at the <strong>Home</strong> <strong>Detention</strong> Office.<br />

You may confirm your release date during your office visit one week<br />

before you are scheduled to be released.<br />
