<strong>Inquiry</strong> <strong>into</strong> <strong>the</strong> <strong>Road</strong> <strong>Safety</strong> <strong>Amendment</strong> (<strong>Car</strong> <strong>Doors</strong>) <strong>Bill</strong> <strong>2012</strong><br />

(daa) <strong>the</strong> impact of <strong>the</strong> offence on any victim of <strong>the</strong> offence; and<br />

(da) <strong>the</strong> personal circumstances of any victim of <strong>the</strong> offence; and<br />

(db) any injury, loss or damage resulting directly from <strong>the</strong> offence; and<br />

(e) whe<strong>the</strong>r <strong>the</strong> offender pleaded guilty to <strong>the</strong> offence and, if so, <strong>the</strong> stage in <strong>the</strong><br />

proceedings at which <strong>the</strong> offender did so or indicated an intention to do so; and<br />

(f) <strong>the</strong> offender's previous character; and<br />

(g) <strong>the</strong> presence of any aggravating or mitigating factor concerning <strong>the</strong> offender or<br />

of any o<strong>the</strong>r relevant circumstances.<br />

These issues (which include <strong>the</strong> injury caused to <strong>the</strong> victim) may assist Victoria Police in<br />

developing guidelines to determine whe<strong>the</strong>r a higher penalty is likely should <strong>the</strong> matter be pursued<br />

through <strong>the</strong> Magistrates’ Court.<br />

Increasing <strong>the</strong> maximum penalty for <strong>the</strong> offence will have little effect unless police take offenders<br />

before <strong>the</strong> Magistrate’s Court to seek a higher penalty. However, it will only be worthwhile for police<br />

to take a case before <strong>the</strong> Court if it is likely <strong>the</strong> Magistrate will impose a higher penalty, having<br />

regard to <strong>the</strong> matters he or she must consider under <strong>the</strong> Sentencing Act 1991. The Committee<br />

believes clear guidelines as to <strong>the</strong> circumstances in which an infringement notice must be issued<br />

and which matters should be taken to Court will ensure <strong>the</strong> existing offence is appropriately and<br />

consistently enforced. The development of guidelines would also give confidence to cyclists that<br />

offenders will be pursued by police and encourage cyclists to report all offences.<br />

Recommendation 1<br />

The Committee recommends Victoria Police:<br />

conduct training for police members regarding enforcement of <strong>the</strong> offence of ‘car dooring’,<br />

particularly those deployed in inner Melbourne municipalities with high cycling activity;<br />

and<br />

consider <strong>the</strong> development of guidelines to assist police to determine when it is<br />

appropriate for a ‘car dooring’ offence to be enforced through <strong>the</strong> Magistrates’ Court.
