SUBJECT: RULES FOR “CHALLENGE RE-EVALUATION OF<br />

THEORY EXAMINATION ANSWER BOOKS AND<br />

PROVIDING OF PHOTOSTAT COPIES OF<br />

ANSWERBOOKS PERTAINING TO ALL<br />

POST–GRADUATE COURSES”.<br />

WHEREAS by enactment of the Maharashtra University of Health<br />

Sciences Act 1998, Maharashtra University of Health Sciences has been<br />

established and all the courses including Post-Graduate Degree/Diploma<br />

and Super Specialty courses in the Health Sciences defined under section<br />

2 (17) of the said Act and have been affiliated to Maharashtra University<br />

of Health Sciences;<br />

AND<br />

WHEREAS by enacting the Maharashtra University of Health<br />

Sciences Act, 2001 and Maharashtra University of Health Sciences<br />

(Amendment and continuing) Act, 2002, Post Graduate Degree/Diploma<br />

and Super Specialty of Health Sciences were temporarily carved out of the<br />

jurisdiction of the Maharashtra University of Health Sciences and were<br />

reaffiliated to the Universities specified in the schedule to Maharashtra<br />

Universities Act 1994;<br />

AND<br />

Whereas under the Maharashtra Universities of Health Sciences<br />

(Amendment) Ordinance 2005 issue on the 31st October, 2005, the Post<br />

Graduate Degree/Diploma and Super Specialty courses in Health sciences<br />

have again been reaffiliated to the Maharashtra University of Health<br />

Sciences from the Academic year 2006 – 2007;<br />

AND<br />

WHEREAS it is the duty of the University to frame rules for<br />

teaching, training programme and examinations for Post – Graduate


courses in affiliated colleges / institutes in various faculties as provided<br />

under sub – section (1) of section 29 of the said Act;<br />

AND<br />

WHEREAS prescribing rules for conduct of examinations is a subject<br />

matter of Ordinance as provided under section 50 (vi) of the said Act;<br />

AND<br />

WHEREAS such an Ordinance for the rules for system for “challenge<br />

re-evaluation” of theory examination answer books pertaining to all Post –<br />

Graduate courses is not in existence;<br />

AND<br />

WHEREAS making of an Ordinance is a time consuming process;<br />

therefore, I Prof. Dr. Arun Jamkar, Vice–Chancellor of Maharashtra<br />

University of Health Science in exercise of powers conferred upon me<br />

under sub-section (8) of section 16 of Maharashtra University of Health<br />

Sciences Act, 1998 issue the following Direction.<br />

This Direction shall be called as "<strong>Rules</strong> for challenge re-evaluation of<br />

theory examination answer books and providing Photostat copies of<br />

answer books pertaining to all Post – Graduate courses”. It shall come<br />

into force with effect from the date of its issuance, and repeals all the<br />

previous circulars\Notifications, related to re-evaluation of all Post<br />

Graduate theory examinations and issue of Photostat copies of this<br />

University.<br />

1) Eligibility:-<br />

1.1) Under these rules, any candidate appeared for any Post<br />

Graduate Courses (P.G.Degree/P.G.Diploma/Super specialty)<br />

examination and failed in one or more subjects under the head<br />

theory examination or passed whole examination will be eligible<br />

to apply for challenge re-evaluation of theory examination<br />

answer books. Consequent to this new policy, henceforth the<br />

verification of Theory answer books will not be carried out.


1.2) The candidate, who failed only in one or more practical<br />

examination head, will be entitled to apply for verification of<br />

marks of the Practical answer sheets & marks list only in the<br />

prescribed format attached to this Direction (Annexure-A)<br />

along with prescribed fees through Dean\Principal\Head of the<br />

affiliated College/Institute, within clear seven days from the date<br />

of declaration of result by the University.<br />

2. Procedure for challenge revaluation :-<br />

2.1) The candidate who desirous to apply for challenge re-evaluation,<br />

at first should apply to the Controller of Examinations for the<br />

photocopy of the concerned subject answer book in the<br />

prescribed form (Annexure – „B‟) within clear seven days from<br />

the date of declaration of result by the University. The<br />

application should be complete in all respects and forwarded<br />

through Dean\Principal\Head of the affiliated College/Institute of<br />

the candidate along with prescribed fees. The candidate is<br />

entitled to demand the Photostat copy of his/her own answer<br />

book (s) only.<br />

2.2) The fees for photocopy of answer books will be Rs. 500 (Non-<br />

refundable) per subject. The University reserves the right to<br />

change the said fee from time to time by way of issuing suitable<br />

notification displaying on its website.<br />

2.3) The incomplete or incorrect or late submitted applications shall<br />

liable to be rejected without assigning any reason.<br />

2.4) After receiving the duly filled and correct application, the<br />

Controller of Examinations will send the photocopy of demanded<br />

answer books along with mark slip of original examiner within<br />

clear Fifteen days from the prescribed last date for application.<br />

The copies of answer books will be sent in a confidential manner<br />

by speed post/special messenger to the concerned parent<br />

college Dean/Principal/Head of the affiliated College/ Institute.<br />

The names of the examiner will be masked while providing copy<br />

of mark slip to avoid disclosing their identity. The university<br />

shall not be held responsible for postal delay. It is obsolete


esponsibility of the concerned college to handover the<br />

photocopy/photocopies of answer books to the concerned<br />

student at the earliest.<br />

2.5) The photocopy so obtained by candidate is only for his/her<br />

exclusive and relevant use. If the candidate desires he/she can<br />

use it only for the purpose of challenge re-evaluation.<br />

2.6) Candidate shall have no right to claim more marks based on<br />

his/her self assessment/comparison with other examinee’s<br />

marks or assessment/ assessment of photocopy by other<br />

expert(s) from parent or any other college.<br />

2.7) After getting the photocopy of the answer book and after<br />

careful observation of his/her-attempted answer, if the<br />

concerned candidate himself/herself finds any error in the<br />

assessment of his/her answer book, for example- incorrect<br />

totaling, un-assessed question, un-assessed sub-question,<br />

alleged poor/under/wrong assessment by examiner than<br />

expected by the examinee. Alternatively, if the candidate is not<br />

at all satisfied with the marks allotted to him/her by the original<br />

examiner, then only he/she can apply for challenge<br />

re-evaluation.<br />

2.8) The candidate who seeks challenge re-evaluation voluntarily and<br />

at his\her own risk shall have to apply in the prescribed format<br />

(Annexure–„C‟) to the Controller of Examinations directly. The<br />

said application should reach within clear ten days from the date<br />

of receipt of photocopy of answer book from the University.<br />

2.9) The candidate must sign the declaration provided in the<br />

application form in person which should be countersigned by<br />

his/her parent college Dean/Principal/Head of the affiliated<br />

College/Institute/any gazetted officer/faculty teacher.<br />

2.10) The candidate should pay challenge re-evaluation fee in the form<br />

of demand draft drawn on any Nationalized Bank in favour of<br />

“The Registrar, <strong>MUHS</strong>, Nasik” payable at Nasik.<br />

2.11) The fee for challenge re-evaluation will be Rs.-1500 per<br />

paper/answer book. This fee shall be non-refundable. The


University reserves the right to revise the said fee from time to<br />

time for challenge re-evaluation. Such change will be displayed<br />

on University website by way of suitable notification.<br />

2.12) Whatever may be contained in above said rules, it shall be lawful<br />

for the Controller of Examinations, who may publish a calendar<br />

along with examination result, and it may contain details of last<br />

date, for making application for photocopy, application for<br />

challenge re-evaluation and tentative date of publication of<br />

result of challenge re-evaluation etc.<br />

2.13) The application for challenge re-evaluation while in its scrutiny if<br />

found incomplete in any respect and without justification shall be<br />

rejected and fees paid shall not be refunded at any case.<br />

2.14) The application complete in all respects, received by the<br />

University office in prescribed time will be arranged faculty wise,<br />

course wise and subject wise. The Controller of Examinations will<br />

place these all applications before a three members committee<br />

(Board wise) appointed by Vice Chancellor for its consideration.<br />

The meeting of this committee will be called within ten days<br />

from prescribed last date for making challenge re-evaluation<br />

application. If the committee does not agree to the justification<br />

given by the candidate, or did not find any merits in the<br />

contention of concerned candidate, then the committee may<br />

dispose of the said application. The Controller of Examinations<br />

may communicate the decision of the committee to the<br />

concerned candidate in due course of time.<br />

2.15) If the committee finds any substance in the candidate’s<br />

justification & claim, then it may recommend re-evaluation of<br />

answer books of the candidate to the Controller of Examinations.<br />

2.16) The decision of the committee, regarding disposal of application<br />

or recommendation for re-evaluation, shall be final and binding<br />

on all concerned. No candidate shall make any appeal against<br />

decision of the committee to any authority/officer of the<br />

University or shall not appeal in any court of law.


2.17) After positive recommendation by the committee, the Controller<br />

of Examinations shall arrange the re-evaluation of recommended<br />

answer books in a very confidential manner at a suitable place<br />

within 45 days, from the date of the meeting of the committee.<br />

2.18) The appointments of examiners for challenge re-evaluation shall<br />

be made by the Controller of Examinations on the<br />

recommendation of Vice-chancellor\Pro-Vice chancellor from the<br />

approved panel. This panel contains the name of eligible<br />

examiners with minimum Ten years post-graduate teaching<br />

experience.<br />

2.19) The assessment of such answer books will be got done by the<br />

respective examiners. Fraction in marks if any in calculation<br />

shall be rounded off to next higher integer at last i.e. in final<br />

totaling of marks obtained for all questions by the candidate.<br />

These marks will be treated as Final marks obtained by that<br />

candidate as a result of challenge re-evaluation for that<br />

particular subject and particular examination.<br />

2.20) On the basis of the marks obtained by candidate in one or more<br />

subjects as applied by him/her, the Controller of Examinations<br />

shall tabulate the revised mark list.<br />

2.21) Subsequently, the revised results will be displayed on University<br />

web site by the Controller of Examinations.<br />

2.22) The revised mark sheet will be sent to the concerned candidate<br />

through his/her Parent College. Accordingly the previous mark<br />

sheet & result of the candidate will be cancelled being null &<br />

void.<br />

2.23) The positive or negative change of the marks obtained by the<br />

concerned candidate in challenge re-evaluation will be final and<br />

binding on the candidate.<br />

2.24) If any positive or negative change occurred, it shall be<br />

considered, for award of merit, medals and prizes if any.


3. Legal disclaimer<br />

3.1) The facility of providing photocopy of answer book and facility<br />

for challenge re-evaluation is to be considered, only as an<br />

additional facility and not as a right of candidate in the strict<br />

sense of term. The University reserves all rights to modify/<br />

amend or repeal the rules in this regard at any time without<br />

assigning any reason.<br />

3.2) Any delay in sending photostats copies of theory answer book<br />

and declaration of results of the challenge revaluation beyond the<br />

control of the University shall not confer any right upon the<br />

student to claim any kind of relief/benefit from the University.<br />

3.3) Matters, which are not specifically covered in the clauses herein<br />

above, and any queries raised on the interpretation of any<br />

provision of this Direction shall be decided by the Vice-<br />

Chancellor, and the decision taken by the Vice-Chancellor shall<br />

be final and binding in all respects.<br />

3.4) This Direction shall remain in force until statutes are made in this<br />

behalf by the University and assented by His Excellency the<br />

Chancellor.<br />
