The. caso of the colored child, Thcrraa W. B. King,<br />

against the Board of Kdnration nmnos on for argument<br />

to-morrow in tho Court of Appeals. This caso involves<br />

a number of novel questions, and has created a great<br />

deal of interest. Tha child asked to be admitted to the<br />

school of her district, Public School No. B, which is<br />

located at the corner of Johnson and Dnffteld streets,<br />

but tho principal of tho school , John Oallagher,<br />

excluded her ou account of Iter color. His action<br />

was subsequently approved by tho Board of Education.<br />

Through her father as guardian at) f.'d'i/t, she then ap-<br />

plied to the City Court for » maiiilanuiM to compel her<br />

admission to tho school. Judge, Neilsou, at Special<br />

Term, denied the application, aud his action was subse-<br />

quently affirmed at General Term by Judges McCuo<br />

and lloynolds. One of the points relied on by tha<br />

counsel for tho child is that under the laws of<br />

tho State as ihcy stood prior to the adoption of tho<br />

Fourteenth Amendment to tho Constitution of tho<br />

Hutted States, neither the Board of Education nor any<br />

of its officers was R\itlmri7.ed to exclude the colored<br />

children from tho schools of their districts, and to<br />

compel them to attend the three colored schools<br />

mnintniiied iu tho city. Another point is that if<br />

their exclusion was authorized by any such law<br />

the law was repealed and annulled by the clauses of<br />

tho Fourteenth Amendment which provide that<br />

"no State shall make or enforce any law, which<br />

shall abridge the privileges or immunities of citizens of<br />

the. United States. • » • Nor deny to any person<br />

within its jurisdiction the equal protection of the laws."<br />

Still another point relied on is that tho act passed in<br />

(his Slate in 187.'!, and called tho Ci vil Bights act, pre-<br />

vents any sort of discrimination against ^leopio<br />

011 account of color. Tho Board of Education con-<br />

tends, on tho other hand, that tho Fourteenth<br />

amendment docs not protect tho colored people<br />

in the matter of school privileges ; that they must rely<br />

solely on the laws of the State, whatever they may be.<br />

The Board further claims that there is no discrimina-<br />

tion against the colored child, becauso sho can attend<br />

one of Ihe colored schools if she pleases.<br />

Tho case will ho argued liy F. AV. Catlin for tho<br />

colored child and by F. E. Dana for tho Board of Edu-<br />

cation.<br />

Mr. Austin Corbin, as President of Iho Brooklyn<br />

and Long Island Trunk Lino liailroad Company, sent<br />

This aoplication ia submitted to your honorable<br />

Board in the firm belief that Brooklyn's best interests<br />

demand steam communication between the teruli tins of<br />

the bridge and the central as well as the outlying wards;<br />

that tho property along the line of the proposed rottto<br />

would ho benefited by its construction , and that tho<br />

value of taxable property throughout the city will bo<br />

Mayor Low's proposition for the extension of Flat-<br />

bush avenue. It avoids all churches- save Ihe Johnson<br />

street JI. E. Church. The route proposed by the 5Iayor<br />

ran through a number of churches, including tho<br />

cathedral on Jay street. Mr. Corbin's lino crosses<br />

Myrtle aveuuo at the corner of Law rence street ;<br />

Johnson at Jay, Pearl at 'Hilary, Prince at Fleet and<br />

WiUoughby street near Duilicld, Tho balance of the<br />

line runs diagonally through blocks.<br />

Sin—By chapter 351, Laws of 1S83, section 8, "the<br />

Mayor of each city in this Stale having a population<br />

of iiO.OOO or over, as shown by the last census, is au-<br />

thorized to prescribe such regulations for the admis-<br />

sion of persons into the civil service of such eity as<br />

inav best promote the ctlicicncy thereof."<br />

.Acting under this section, I wish to prescribe<br />

such regulations for admission into the civil service,<br />

of Brooklyn. In so doing, 1 very greatly desire Iho<br />

co-operation of the Slate Civil Service. Commission.<br />

This civ il service law is a step in the right di rection.<br />

Whatever defects the law may havo will be shown best<br />

through an endeavor lo work under it. When the de-<br />

fects are known, if there be any such, they can be reme-<br />

died. Meanwhile, I pledge you my hearty efforts to<br />

make the law sneered here. . .<br />

If vou will kindly inline a day when it will be con-<br />

venient for your commission to sit in Brooklyn. I will<br />

was appropriated for tho work iu tlio last tax budge t ,<br />

and Commissioner Uniics will ask the Aldermen to-day<br />

to apiiroprinto .70,1170 more, in order that he may award<br />

the contract to Kelly.<br />
