According to the Rules of Criminal Procedure (RCr 3.02, 3.05, and 8.01) the arraignment of<br />

individuals whose case has been submitted directly to the grand jury shall take place as reasonably soon<br />

as possible. If you are interested in a case that has been submitted directly to the grand jury, then please<br />

contact the court division in which it has been assigned to obtain the time and date of the arraignment.<br />

Arraignment<br />

Mark Reynolds Bolan, 13CR0244 (Murder) Mr. Bolan (DOB 6/15/1966) is charged in<br />

connection with the December 17, 2012, shooting of Gilbert Robinson on the 300 Block of<br />

Shawnee Drive. The victim died as a result of a gunshot wound to the head on December 24,<br />

2012. Arraignment is scheduled for Monday, <strong>Feb</strong>ruary 4, 2013, at 9:00 a.m. in Division 2. Alice<br />

Jones is the prosecutor.<br />

Jerard Garrett & Billy Richardson, 13CR0246 (BOTH: Murder, Robbery I; GARRETT:<br />

also Wanton Endangerment I, Persistent Felony Offender I) Mr. Garrett (9/24/1981) and Mr.<br />

Richardson (DOB 9/13/1989) are charged with the murder and robbery of Jaime Young on<br />

December 29, 2012. Arraignment is scheduled for Monday, <strong>Feb</strong>ruary 4, 2013, at 9:00 in<br />

Division 2. James Lesousky is the prosecutor.


Hearing<br />

Daniel L. Barnes, 11CR2561 (Murder) Mr. Barnes (DOB 4/4/65) is charged in connection<br />

with the June 29, 2011, beating death of Edward Mather in the 800 block of South 4 th Street. A<br />

Competency hearing is scheduled for Thursday, <strong>Feb</strong>ruary 7, 2013, at 1:00 p.m. in Division 6.<br />

Katherine Kingren is the prosecutor.<br />

Joseph R. Banis (DOB 2/4/72) / Jeffery S. Mundt (DOB 2/20/72), 10CR1867 (BOTH:<br />

Murder, Robbery 1 st Degree, Tampering with Physical Evidence; BANIS: Burglary 1 st Degree,<br />

Possession of a Forged Instrument, Possession of a Controlled Substance, Possession of Drug<br />

Paraphernalia) The defendants are charged in connection with the June 17, 2010, discovery of<br />

the remains of James Carroll buried in the basement of residence in the 1400 block of S. 4 th<br />

Street. A Hearing has been scheduled for Thursday, <strong>Feb</strong>ruary 7, 2013, at 2:00 in Division 3 on<br />

motions in anticipation of Mr. Banis’ trial. Ryane Conroy is the prosecutor.<br />

Pre-trial conference<br />

Martin Keehn & Jeffrey Kingdon, 12CR2268 (Complicity to Murder, Wanton<br />

Endangerment First Degree and Tampering with Physical Evidence) Mr. Keehn (DOB 7/31/91)<br />

and Mr. Kingdon (DOB 6/20/90) are charged in connection with a shooting that caused the<br />

death of Rico Robinson Jr. on July 23, 2012, on a TARC bus near the corner of Goldsmith Lane<br />

and Bardstown Road. A Pre-Trial Conference is scheduled for Monday, <strong>Feb</strong>ruary 4, 2013, at<br />

9:00 a.m. in Division 7. Kristi Gray is the prosecutor.<br />

Keentay J. Hunter, 12CR2739 (Murder, Attempted Murder, Possession of a Handgun by a<br />

Convicted Felon, Assault in the First Degree, Fleeing or Evading Police in the First Degree,<br />

Tampering with Physical Evidence) Mr. Hunter (DOB 4/16/95) is charged with the shooting of<br />

two individuals on July 27, 2012, after which he fled from officers and discarded a handgun<br />

which was recovered by a K9 officer. A Pre-Trial Conference is scheduled for Monday, <strong>Feb</strong>ruary<br />

4, 2013, at 9:00 a.m. in Division 12. Josh Schneider is the prosecutor.<br />

Robert Keith Thornton, 08CR3866 (Robbery 1 st Degree 47 Counts, Violation of a<br />

Protective Order, Fleeing or Evading Police) Mr. Thornton (DOB 5/26/65) is charged in<br />

connection with numerous robberies in Jefferson County dating back to 2001, as well as a<br />

December 23, 2008, police chase following the robbery of the Wendy’s at 4041 Taylorsville Rd.<br />

A Pre-Trial Conference has been scheduled for Tuesday, <strong>Feb</strong>ruary 5, 2013, at 11:00 a.m. in<br />

Division 4. Erin White is the prosecutor.<br />

Gary Steven Bond, 10CR1550 (Murder, Sodomy 1 st Degree) Mr. Bond (DOB 2/15/52) is<br />

charged in connection with the May 12, 2010, strangling death of Julie Hendrick in an<br />

apartment in the Clifton neighborhood. A Pre-Trial Conference has been scheduled for<br />

Wednesday, <strong>Feb</strong>ruary 6, 2013, at 8:30 a.m. in Division 3. Chris Foster is the prosecutor.<br />

Janeaka N. Conn & Anquanette M. Davis, 11CR2966 (Murder) Ms. Conn (DOB 5/22/79)<br />

and Ms. Davis (DOB 2/21/78) are charged in connection with the September 22, 2005, shooting<br />

death of Kendra Boykin at her home on Grand Ave. A Pre-Trial Conference is scheduled for<br />

Wednesday, <strong>Feb</strong>ruary 6, 2013, at 9:30 a.m. in Division 10. Ryane Conroy is the prosecutor.<br />

John Robinson, III, 12CR3171 (Murder) Mr. Robinson (DOB 03/29/1995) is charged in<br />

connection with the stabbing death of Darnishia Peoples at 2231 Peaslee Road in September of


2012. Mr. Robinson is allegedly the ex-boyfriend of victim. A Pre-Trial Conference is scheduled<br />

for Wednesday, <strong>Feb</strong>ruary 6, 2013, at 9:30 a.m. in Division 11. Alicia Gomez is the prosecutor.<br />

Tony E. Whitfield, Jr,. 12CR3837 (Murder) Mr. Whitfield (DOB 5/12/1983) is charged in<br />

connection with a shooting death on December 13, 2012, outside a gentleman’s club at 3608<br />

South Seventh Street. A pretrial conference is scheduled for <strong>Feb</strong>ruary 7. 2013, at 9:30 a.m. in<br />

Division 12. Jessica A. Moore is the prosecutor.<br />

Joseph Johnson, 12CR3368 (Murder, Fleeing or Evading Police in the First Degree,<br />

Trafficking in a Controlled Substance, Disregarding a Traffic Control Device) Mr. Johnson<br />

(DOB 02/21/1949) is charged in connection with a collision that killed another person while Mr.<br />

Johnson was fleeing police. Investigators located cocaine in bags in Mr. Johnson’s vehicle. A<br />

Pre-Trial Conference is scheduled for Thursday, <strong>Feb</strong>ruary 7, 2013, at 9:30 a.m. in Division 11.<br />

Kristi Gray is the prosecutor.<br />

Veneeta Darnley-David & Diontray Jackson, 12CR2663 (DARNLEY-DAVID – Wanton<br />

Endangerment First Degree [3 cts], Failure to Report Child Abuse [2 cts]; JACKSON – Rape in<br />

the First Degree, Sodomy in the First Degree, Sexual Abuse in the First Degree, Attempted<br />

Sodomy in the First Degree, Wanton Endangerment First Degree, Distribution of Obsence<br />

Material to Minors, Persistent Felony Offender in the First Degree, Assault in the Fourth<br />

Degree) Mr. Jackson (DOB 12/2/79) is charged with sexual and physical abuse of three children<br />

of Ms. Darnley-David (DOB 11/8/71), who is herself charged with knowing about the abuse but<br />

doing nothing to stop or report it. A Pre-Trial Conference is scheduled for Thursday, <strong>Feb</strong>ruary<br />

7, 2013, at 9:30 a.m. in Division 2. Sara Farmer is the prosecutor.<br />

Antonio D. McFarland, 12CR1905 (Murder, Tampering with Physical Evidence, Wanton<br />

Endangerment 1 st [3 cts]) Mr. McFarland (DOB 10/25/90) is charged in connection with the<br />

shooting death of 15-year-old Tysha Spearman in June of 2012, near the area of 18th Street and<br />

Crop Alley. A Pre-Trial Conference is scheduled for Thursday, <strong>Feb</strong>ruary 7, 2013, at 11:00 a.m. in<br />

Division 13. Frank Dahl is the prosecutor.<br />

Jerry W. Stepp, 12CR3428 (Kidnapping, Sodomy in the First Degree [4 cts], Sexual Abuse in<br />

the First Degree, Rape in the First Degree [2 cts], Unlawful Imprisonment in the First Degree,<br />

Stalking in the First Degree, Assault in the Second Degree) Mr. Stepp (DOB 10/30/1946) is<br />

charged in connection with forcing a female victim into his truck and taking her to another<br />

location where he raped and sodomized her. A Pre-Trial Conference is scheduled for Friday,<br />

<strong>Feb</strong>ruary 8, 2013, at 8:45 a.m. in Division 8. Kristi Gray is the prosecutor.<br />

Deshawn Payne, 13 CR0185 (Robbery I [4 counts], PFO I) Mr. Payne is charged in<br />

connection with four business robberies between October and December, 2012, on Third Street<br />

Road and Southside Drive. A Pre-Trial Conference is scheduled for Friday, <strong>Feb</strong>ruary 8, 2013, at<br />

9:00 a.m. in Division 3. Alice Jones is the prosecutor.<br />

Bobbi Jo Clary, 11CR3329 (Complicity to Murder, Robbery First Degree, Tampering with<br />

Physical Evidence) Ms. Clary (DOB 9/10/76) is charged in connection with the October 30th,<br />

2011, death of George Arvin Murphy from massive head trauma near the 1700 block of Duncan<br />

Street. A Pre-Trial Conference is scheduled for Friday, <strong>Feb</strong>ruary 8, 2013, at 1:00 p.m. in<br />

Division 12. Stacy Grieve is the prosecutor.<br />

Sentencing


Marshall C. Smith III, 12CR2553 (Theft by Failure to Make a Required Disposition of<br />

Property Over $10,000 [12 cts], Theft by Failure to Make a Required Disposition of Property<br />

Over $500 [2 cts], Defrauding a Secured Creditor Over $100 [3 cts]) Mr. Smith (DOB 5/23/57),<br />

President of MCS Enterprises, dba “Tinker Toys”, a local RV dealership has pleaded guilty in<br />

connection with failing to pay owners of RV’s sold on consignment, failing to make payoffs on<br />

trade-ins, and failing to transfer several sold RV’s The amount stolen exceeds $300,000. This<br />

case was investigated and charged by the Attorney General’s <strong>Office</strong> as a result of consumer<br />

complaints filed with that office. A sentencing is scheduled for Thursday, <strong>Feb</strong>ruary 7, 2013, at<br />

9:30 a.m. Jeff Cooke is the prosecutor.<br />
