Aslam Motala SC<br />

Aslam matriculated in 1979 from<br />

Orient Islamic School (Durban). He<br />

<strong>the</strong>n studied at <strong>the</strong> University <strong>of</strong> Durban<br />

Westville and obtained his BA (Law)<br />

degree, a BSc (Hons) in ma<strong>the</strong>matics<br />

and <strong>the</strong>n an LLB degree. He completed<br />

his pupillage in 1987, and commenced<br />

practice <strong>the</strong> same year. Earlier in his<br />

career at <strong>the</strong> <strong>Bar</strong>, Aslam lectured parttime<br />

in ma<strong>the</strong>matics at <strong>the</strong> UDW. He<br />

is married with three children, and his<br />

interests include playing competitive<br />

cricket and chess, and <strong>the</strong> <strong>the</strong> arts and<br />

<strong>the</strong>atre.<br />

Rajesh Choudree SC<br />

Rajesh Choudree was born in Clairwood,<br />

Durban, in 1952. He was educated at<br />

<strong>the</strong> St Anthony’s State-Aided Primary<br />

School and Gandhi-Desai High School.<br />

He matriculated at <strong>the</strong> end <strong>of</strong> 1971 and<br />

graduated with <strong>the</strong> BA (1974) and LLB<br />

(1976) degrees from <strong>the</strong> University <strong>of</strong><br />

Durban-Westville. In 1977, he commenced<br />

practice at <strong>the</strong> Durban <strong>Bar</strong> as<br />

a founder member <strong>of</strong> Advocates Group<br />

Seven which has spawned many <strong>of</strong> <strong>the</strong><br />

judges – including <strong>the</strong> Chief Justice<br />

– currently serving on <strong>the</strong> Bench in<br />

South Africa. Rajesh was one <strong>of</strong> <strong>the</strong><br />

earliest members <strong>of</strong> <strong>the</strong> group who<br />

was briefed to handle human rights<br />

cases in <strong>the</strong> Eastern and Nor<strong>the</strong>rn<br />

Cape. He remained in practice in South<br />

Africa until 1986. In January 1987, he<br />

joined Freehill, Hollingdale & Page in<br />

Perth, Australia, as a solicitor, and in<br />

1989, he was employed as a barrister<br />

by <strong>the</strong> Aboriginal Legal Service <strong>of</strong><br />

Western Australia, eventually becoming<br />

its principal legal <strong>of</strong>ficer in 1991.<br />

In April 1992, Rajesh was recruited<br />

from Australia by <strong>the</strong> University <strong>of</strong><br />

Durban-Westville as a senior lecturer<br />

in <strong>the</strong> Department <strong>of</strong> Mercantile Law,<br />

and eventually headed that department.<br />

He was also elected associate dean<br />

<strong>of</strong> <strong>the</strong> Law Faculty. He subsequently<br />

obtained an LLM at UDW, and studied<br />

at <strong>the</strong> Harvard Law School after winning<br />

a fellowship <strong>of</strong> <strong>the</strong> Harvard-South<br />

Africa programme. He graduated with<br />

a second LLM in 1997.<br />

Rajesh was <strong>the</strong>n appointed to <strong>the</strong><br />

Ministry <strong>of</strong> Justice as an advisor and<br />

worked in <strong>Pretoria</strong> until 1998. Thereafter,<br />

he worked for <strong>the</strong> UN Mission<br />

in Bosnia Herzegovina as deputy head<br />

<strong>of</strong> <strong>the</strong> Judicial System Assessment<br />

Programme based in Sarajevo where<br />

he remained until July 2000, when he<br />

returned to practise at <strong>the</strong> Durban <strong>Bar</strong><br />

which he did until November 2001.<br />

During that period, he acted as a judge<br />

<strong>of</strong> <strong>the</strong> High Court in Durban (one<br />

term) and in Bloemfontein (two terms).<br />

Subsequently he was recruited by <strong>the</strong><br />

UN Development Programme (UNDP)<br />

to head its new governance centre<br />

based in Oslo. In 2002, he was transferred<br />

to <strong>the</strong> New York <strong>of</strong>fice <strong>of</strong> <strong>the</strong><br />

UNDP Bureau for Development Policy<br />

and was appointed its Global Justice<br />

Advisor. He returned to <strong>the</strong> Durban<br />

<strong>Bar</strong> in August 2003 where he remained<br />

until he was appointed as an advisor to<br />

<strong>the</strong> UN Counter-Terrorism Committee<br />

in August 2005.<br />

Rajesh is married to Indira, an attorney,<br />

and <strong>the</strong>y have a daughter, Yavani. His<br />

hobbies include photography, listening<br />

to Eastern and Western music <strong>of</strong> all<br />

kinds and playing golf with friends (and<br />

Yavani).<br />

Logesh Pillay SC<br />

Logesh was born on <strong>the</strong> 7 June 1964.<br />

In 1987 he completed his LLB at <strong>the</strong><br />

University <strong>of</strong> Natal (Durban) and commenced<br />

practice at <strong>the</strong> Durban <strong>Bar</strong> in<br />

1998. Logesh is married to Veena and<br />

<strong>the</strong>y have two daughters, Maya and<br />

Anandhi.<br />

<strong>Bar</strong>ry Lynn Skinner<br />

<strong>Bar</strong>ry was born on <strong>the</strong> 1 July 1956.<br />

He obtained <strong>the</strong> degrees <strong>of</strong> BA Hons<br />

(1978) University <strong>of</strong> Natal; MA (1980)<br />

Oxford; and LLB cum laude (1982)<br />

University <strong>of</strong> Natal. He was admitted<br />

as attorney in 1987 and began practice<br />

at <strong>the</strong> Durban <strong>Bar</strong> in 1988. <strong>Bar</strong>ry was a<br />

member <strong>of</strong> <strong>the</strong> Natal <strong>Bar</strong> <strong>Council</strong> during<br />

1998-99, and again from 2004-05.<br />

He is a member <strong>of</strong> <strong>the</strong> Advocates’ and<br />

Attorneys’ Liaison Committee. He was<br />

a member <strong>of</strong> <strong>the</strong> executive committee<br />

<strong>of</strong> NICRO, Durban, from 1994-98,<br />

and <strong>of</strong> <strong>the</strong> board <strong>of</strong> management <strong>of</strong><br />

Highway Hospice from 2000-03 (chair<br />

in 2002-03). He is married to Deirdre.<br />

Comrades<br />

Well done to all <strong>the</strong> members <strong>of</strong> <strong>the</strong><br />

<strong>Bar</strong> who took part in <strong>the</strong> Comrades<br />

Marathon. Particular inspiration can be<br />

drawn from Deshin Pillay who only a<br />

year ago was walking with crutches and<br />

a cast on his leg.<br />

Premises<br />

The majority <strong>of</strong> <strong>the</strong> advocates who<br />

had chambers in Salmon Grove have<br />

moved into ei<strong>the</strong>r Durban Club Place,<br />

<strong>the</strong> Marine or Masonic Grove.<br />

on <strong>the</strong> birth <strong>of</strong> her baby daughter.<br />

Baliedinee<br />

Nog ’n jaar spoed na sy einde by die<br />

<strong>Pretoria</strong> Balie. Dit was weer daardie<br />

tyd van die jaar waarin laataandkerse<br />

gebrand word om tafels skoongewerk<br />

te kry voor die Desemberreses. Die<br />

jaarlikse Baliedinee wat hierdie jaar<br />

plaasgevind het op 7 Oktober 2005, het<br />

darem die nodige afleiding besorg.<br />

Die ho<strong>of</strong>toesprake by die <strong>Pretoria</strong>se<br />

Baliedinee is gelewer deur Gerrit Grobler<br />

SC (links op die foto) en regter Bill Prinsloo<br />

(regs). Sanja Strauss (middel) het die junior<br />

toespraak gehou.<br />

Nog interessante nuus uit die laaste<br />

kwartaal is dat dit bekend geword het<br />

dat ’n groep lede beplan om aan die<br />

einde van 2006 na ’n nuwe gebou in<br />

Brooklyn te verhuis. En verder het die<br />

<strong>Pretoria</strong> Balie se mees ‘geharde’ vrygesel,<br />

Ig Bredenkamp, op 20 Augustus<br />

2005 uiteindelik in die huwelik getree<br />

het. Veels geluk, Ig en Louise!<br />

Continued legal education<br />

The <strong>Pretoria</strong> <strong>Bar</strong> has started a series <strong>of</strong><br />

lectures aimed at junior members. The<br />

initiative for continued legal education<br />

for practising advocates came from<br />

Roel<strong>of</strong> du Plessis, who is now convenor<br />

<strong>of</strong> <strong>the</strong> Committee for Continued Legal<br />

Education. The lectures are meant<br />

for practising advocates who already<br />

have some practical experience, but<br />

who might benefit from advice and<br />

a discussion <strong>of</strong> practical issues not<br />

dealt with during pupillage. When Du<br />

Plessis invited senior members <strong>of</strong> <strong>the</strong><br />

<strong>Bar</strong> to act as lecturers, <strong>the</strong> response<br />

was overwhelming. Some <strong>of</strong> <strong>the</strong> most<br />

respected and experienced seniors<br />

at <strong>the</strong> <strong>Pretoria</strong> <strong>Bar</strong> have volunteered<br />

<strong>the</strong>ir services to lecture on relevant<br />

issues such as practice management<br />

(P Ellis SC), cross-examination (MC<br />

and NGD Maritz SC), urgent applications<br />

(DA Smith SC), working with<br />

silks (JF Mullins SC) and many more.<br />

This is an excellent way <strong>of</strong> ensuring<br />

that high standards are not only maintained,<br />

but also improved. The programme<br />

will be continued next year.<br />

Die Balie is nog twee SC’s ryker.<br />

<strong>Bar</strong>nard Knoetze SC en Peet van<br />

Rooyen SC dra al reeds met groot trots<br />

hul nuwe togas. Die kollegas het veral<br />

die eetgoed en sjampanje wat hiermee<br />

saamgekom het, geniet. Die Balie spog<br />

nou met agt senior advokate.<br />

Op die tydstip waarop hierdie bydrae<br />

geskryf word, wag ons nog in spanning<br />

op die uitslae van die Balie-eksamen.<br />

Net een pupil het by ons die eksamen<br />

geskryf.<br />

Nicolett McKenzie het besluit om die<br />

Balie te verruil vir die geledere van die<br />

onafhanklike advokate. Dit bring die<br />

totale ledetal op 46 te staan, waarvan<br />

slegs vyf vroue-lede is.<br />

Die nuwe SCʼs<br />

<strong>Bar</strong>nard Knoetze SC<br />

<strong>Bar</strong>nard Knoetze is op Lichtenburg<br />

gebore en het in 1963 op Petrusburg<br />

gematrikuleer waar sy pa destyds<br />

landdros was. Hy het insgelyks by die<br />

Departement van Justisie aangesluit<br />

en terwyl hy deur Unisa studeer<br />

het, gewerk as klerk, staatsaanklaer,<br />

landdros en staats advokaat. Hy het in<br />

1979 by die Balie in Johannesburg<br />

Die Balie huur sedert die jare ‘90 drie<br />

vloere van die Iustitiagebou op die hoek van<br />

Aliwal- en St Andrewstraat in Bloemfontein.<br />

Die gebou is gerieflik geleë oorkant die<br />

hooggeregsh<strong>of</strong> en binne stapafstand van<br />

beide die landdrosh<strong>of</strong> en die Hoogste H<strong>of</strong><br />

van Appél. Die gebou maak voorsiening vir<br />

die parkeerbehoeftes van die lede.<br />

aangesluit. Gedurende 2000 het hy na<br />

Bloemfontein verhuis en aldaar begin<br />

praktiseer. Sodoende kan hy ook aandag<br />

gee aan sy Nguni- en Damaraboerdery.<br />

<strong>Bar</strong>nard het al as regter op die Vrystaatse<br />

regbank waargeneem.<br />

Hy en Es<strong>the</strong>r het twee kinders – ’n dogter<br />

Amor en ’n seun Martin.<br />

Peet van Rooyen SC<br />

Peet van Rooyen is op 24 Januarie 1948<br />

gebore en matrikuleer aan die Hoërskool<br />

Edenburg. Hy behaal in grade BIuris<br />

en LLB aan die Universiteit van die<br />

Vrystaat in 1970 en 1972 onderskeidelik.<br />

Hy word as prokureur toegelaat in<br />

1974 en as advokaat in 1986. Peet het al<br />

as regter waargeneem op die Vrystaatse<br />

regbank. Sy belangstellings sluit in<br />

fietsry en toer met sy motorfiets.<br />

Hy is getroud met Jolena, en die egpaar<br />

het twee kinders.<br />

Regbank<br />

Wat aanstellings op die regbank betref,<br />

het slegs Peter Fischer in die onlangse<br />

verlede as regter waargeneem, en wel<br />

in Transkei.<br />

Die Balie het ’n informele funksie gehou<br />

om die nuwe regter op die Vrystaatse<br />

regbank, regter CJ Musi, te verwelkom.<br />

Balieraad<br />

Huidiglik bestaan die Balieraad uit die<br />

volgende lede: Majellie Wessels SC<br />

(voorsitter), Corrie Ploos van Amstel<br />

SC, Jimmy Claassen, Peter Fischer,<br />

Johan Daffue, Stanley Reinders en<br />

Xolani Mabusela. Louis Pohl is die<br />

eresekretaris en hy word in sy pligte<br />

bygestaan deur Corné van Zyl.<br />
