COMPLIANCE WITH THE ISPS CODE<br />

The International <strong>Ship</strong> <strong>and</strong> Port Facility<br />

Security (ISPS) Code has entered into<br />

force <strong>and</strong> nearly 100% of all applicable<br />

<strong>Marshall</strong> <strong>Isl<strong>and</strong>s</strong> registered tonnage is compliant<br />

with the Code. In addition, on June 17,<br />

2004, the Minister of Foreign Affairs for the<br />

Republic of the <strong>Marshall</strong> <strong>Isl<strong>and</strong>s</strong> declared, in a<br />

Organization (IMO), that the <strong>Marshall</strong> <strong>Isl<strong>and</strong>s</strong><br />

Majuro Port Facilities located at the Lagoon<br />

Anchorage, Delap Wharf, Uliga Wharf <strong>and</strong><br />

Jaluit Wharf have been certified as complying<br />

with the relevant provisions of the ISPS Code.<br />

To ensure these ports would be in compliance<br />

with the Code, a <strong>Marshall</strong> <strong>Isl<strong>and</strong>s</strong> Ports<br />

Security Committee had been formally established.<br />

The Committee began working together<br />

in mid-2003 to produce the Port Security<br />

Assessments <strong>and</strong> Port Security Plans <strong>and</strong> to set<br />

into place Port Security Regulations.<br />

"We made an early start in developing the necessary<br />

management systems, in communicating<br />

relevant requirements to our shipowners, ship<br />

managers, masters <strong>and</strong> Recognized Security<br />

Organizations (RSOs), <strong>and</strong> in having technical<br />

assistance arrangements in place. We started<br />

planning for the ISPS Code implementation the<br />

week after the conclusion of the Diplomatic<br />

Conference that developed the Code," stated<br />

AT POSIDONIA 2004<br />

Posidonia, the shipping industry's largest<br />

maritime convention, saw a 25% increase<br />

in visitors in 2004 over that in 2002. Not<br />

only was this a time for the <strong>Marshall</strong><br />

<strong>Isl<strong>and</strong>s</strong> Registry to network with current<br />

clients <strong>and</strong> new contacts, but it was also a<br />

time for celebration. The Registry reached<br />

its goal of 22 million gross tons during the<br />

week of Posidonia <strong>and</strong> invited many of the<br />

industry players to celebrate during IRI's<br />

reception at the Piraeus Yacht Club. "The<br />

Greek shipping community is one of the<br />

Registry's greatest supporters. Posidonia is<br />

a time when we can thank our clients for<br />

their continued support of the Registry,"<br />

said Melissa Hurst, Vice President <strong>and</strong><br />

General Counsel.<br />

"We are an active participant at Posidonia -<br />

both this year <strong>and</strong> in the past. Here is<br />

where everyone who's anyone in shipping<br />

congregates to get updates, find out who's<br />

MARPOL Annex VI to enter into force.<br />

Regulations for the Prevention of Air<br />

Pollution from <strong>Ship</strong>s are set to enter into<br />

force on May 19, 2005. The 1997 Protocol<br />

to the MARPOL Convention, which<br />

includes Annex VI, sets limits on sulphur<br />

oxide <strong>and</strong> nitrogen oxide emissions from<br />

ship exhausts <strong>and</strong> prohibits deliberate emissions<br />

of ozone-depleting substances. With<br />

the entry into force of Annex VI, the full set<br />

of MARPOL international regulations for<br />

the prevention of pollution by ships will be<br />

in force. These requirements are retroactive<br />

to January 1, 2000, as previously advised.<br />

The winds of change are blowing -<br />

so we were told at the beginning of<br />

the year, after Mr. Efthimios<br />

Mitropoulos had been appointed as<br />

Secretary General of the International<br />

Maritime Organization (IMO) - throughout<br />

the maritime world <strong>and</strong> within the IMO<br />

<strong>and</strong> its Secretariat. Since the time when<br />

winds drove ships, the requirements for<br />

ships <strong>and</strong> shipping have evolved, but it is<br />

only in more recent years that there has<br />

been an international body with the specific<br />

function of permitting States to discuss<br />

<strong>and</strong> adopt international regulations to benefit<br />

maritime safety, protect the environment,<br />

<strong>and</strong> more recently, secure ships <strong>and</strong><br />

ports.<br />

During this term, Mr. Mitropoulos inherited<br />

a broad range of issues for the<br />

Organization, which focus on heightened<br />

maritime safety, security <strong>and</strong> environmental<br />

sions that must be<br />

made concerning all<br />

of these issues, the<br />

public image of the<br />

IMO is critical. To<br />

achieve a realistic balance<br />

between commercial<br />

shipping <strong>and</strong><br />

regulations, assurances<br />

are needed that<br />

trade will not be hampered<br />

or brought to a<br />

st<strong>and</strong>still with the<br />

development of more<br />

rules. One way to<br />

improve the public<br />

perception of the IMO<br />

<strong>and</strong> the regulations<br />

that result is to develop<br />

a more "public" image. To achieve<br />

transparency, proposals to open all committee<br />

meetings to the press <strong>and</strong>/or the<br />

public are being discussed.<br />

Public image is not the only hurdle facing<br />

the IMO. For the IMO to retain its role as<br />

the premier body for the development of<br />

<strong>and</strong> responsibility to maritime safety <strong>and</strong><br />

environmental issues, it is necessary for it<br />

to be proactive. There is considerable danger<br />

from activities in other UN bodies or<br />

of regional or national regulations being<br />

developed <strong>and</strong> implemented, which could<br />

encroach on the areas of expertise of the<br />

IMO <strong>and</strong> destroy the global implementation<br />

of international st<strong>and</strong>ards that<br />

have been achieved by the IMO since<br />

its inception.<br />

A further dilemma is the fact that the IMO<br />

does not have enforcement powers - these<br />

being delegated to the member States.<br />

With the member State audit scheme<br />

being developed, the Secretariat will provide<br />

an oversight function - a greater function<br />

than that provided in connection with<br />

the STCW white list. But still, the<br />

Secretariat may only make recommendations,<br />

or possibly arrange for technical<br />

assistance to be given to a State. The IMO<br />

cannot take sanctions or force a State to<br />

take any action. So, as a way forward,<br />

should there be further evolving of the role<br />

of the IMO into that of an enforcement<br />

body? That is up to the member States to<br />

determine in the future.<br />

The IMO is guaranteed to encounter many<br />

more obstacles in its pursuit to assure safety,<br />

security <strong>and</strong> environmental awareness<br />

on the high seas, but it will always play a<br />

key international role in the maritime<br />

world. May the wind always be at the<br />

back of Secretary General Mitropoulos<br />

<strong>and</strong> allow him to use his considerable<br />

diplomatic skills to ensure the continuing<br />

unity of the membership, <strong>and</strong> to maintain<br />

the IMO spirit of consensus.<br />

Hans Krijger joined IRI as a full-time Nautical Inspector<br />

based in The Netherl<strong>and</strong>s <strong>and</strong> is reporting<br />

to the London office. His duties<br />

include conducting inspections for<br />

<strong>Marshall</strong> <strong>Isl<strong>and</strong>s</strong> registered vessels to<br />

determine their structural condition <strong>and</strong><br />

compliance with international <strong>and</strong><br />

national safety, security, <strong>and</strong> environmental<br />

protection requirements <strong>and</strong><br />

conduct oversight of the <strong>Marshall</strong><br />

<strong>Isl<strong>and</strong>s</strong> nautical inspector program <strong>and</strong><br />

of the performance of the recognized organizations acting on behalf<br />

of the Registry. Mr. Krijger graduated from the Maritime Institute,<br />

Vlissingen as a marine engineer. He obtained his chief engineer’s<br />

license after sailing a variety of ships such as general cargo, tugboats,<br />

reefer <strong>and</strong> passenger ships. Since 1995 he has been working on the<br />

ship management side as superintendent for Vroon <strong>Ship</strong>ping <strong>and</strong> later<br />

for a dredging company. He will primarily be working in the<br />

Northern Europe, Africa <strong>and</strong> the Middle East regions.<br />

The Maritime Administration is in the process of reviewing its nautical<br />

inspection procedures due to the rapid growth of the Registry. This<br />

review process will entail an update of the nautical inspector guidelines,<br />

rewrite of the <strong>Report</strong> of Operational Safety Inspection form, <strong>and</strong><br />

evaluation of existing <strong>and</strong> needed nautical inspection service coverage.<br />

One of the main objectives of this review process is to ensure that<br />

nautical inspectors are provided with past port <strong>and</strong> flag State inspection<br />

results, Class survey results, <strong>and</strong> other necessary information, so<br />

that a focused inspection on certain ships may be conducted. The end<br />

result of this revamped process provides inspectors with a list of areas<br />

of concern that will be verified by the Maritime Administration. The<br />

Registry is moving away from a "check-the-box" mentality. Mr.<br />

Krijger is a key player in this new inspection process as he will be the<br />

<strong>Marshall</strong> <strong>Isl<strong>and</strong>s</strong> exclusive flag State surveyor for ships in need of an<br />

extended inspection.<br />

AROUND THE WORLD<br />

IRI's Legal Department in Reston has recently<br />

exp<strong>and</strong>ed with the addition of Conor Warde.<br />

Along with Melissa Hurst, Vice President <strong>and</strong><br />

General Counsel, are:<br />

Conor Warde, Assistant Counsel, who joined<br />

IRI's Legal Department in March 2004. Prior to joining<br />

IRI, Mr. Warde served as a law clerk at the<br />

Office of the United States Trade Representative.<br />

Additionally, he has worked for the Crown<br />

Prosecution Service in London <strong>and</strong> lived in<br />

Luxembourg, where he worked as a Securities<br />

Administrator for a financial services company. Mr.<br />

Warde received his B.A. with degrees in Economics<br />

<strong>and</strong> English Literature from Georgetown University<br />

<strong>and</strong> his J.D. from The George Washington<br />

University Law School in Washington, DC. He is a<br />

member of the Maryl<strong>and</strong> State Bar <strong>and</strong> is currently<br />

awaiting admission to the District of Columbia Bar.<br />

Phillip “Phil” Egelston, Associate Counsel, who<br />

has been with IRI since November 2000, earned his<br />

B.A. in History from Cornell College, a M.A. in<br />

History from Virginia Polytechnic <strong>and</strong> State<br />

University (VA Tech), <strong>and</strong> a J.D. from Catholic<br />

University's Columbus School of Law. He was<br />

awarded the Roop Scholarship for his Master's studies<br />

at VA Tech <strong>and</strong> served as the editor of Catholic<br />

University's Columbus School of Law "Journal of<br />

Contemporary Health <strong>and</strong> Law." He is a member of<br />

the Maryl<strong>and</strong> Bar <strong>and</strong> American Bar Association.<br />

Diane Gilner, Assistant Counsel, joined the company<br />

in 1991. She received her undergraduate degree<br />

from The State University of New York at<br />

Binghamton <strong>and</strong> her J.D., with a concentration in<br />

international business law, from American<br />
