COMPLIANCE WITH THE ISPS CODE
The International Ship and Port Facility
Security (ISPS) Code has entered into
force and nearly 100% of all applicable
Marshall Islands registered tonnage is compliant
with the Code. In addition, on June 17,
2004, the Minister of Foreign Affairs for the
Republic of the Marshall Islands declared, in a
Also in attendance from IRI were Clay Maitland and Tony Guida,
Managing Partners; Bill Gallagher, President; Pat McDermott,
Director of Marketing-Corporate; Jack Enright, Senior Vice
President, Business Development; and Capt. John Giannopoulos,
Managing Director, IRI (Greece).
letter to Mr. Efthimios Mitropoulos, Secretary
General of the International Maritime
Organization (IMO), that the Marshall Islands
Majuro Port Facilities located at the Lagoon
Anchorage, Delap Wharf, Uliga Wharf and
Jaluit Wharf have been certified as complying
with the relevant provisions of the ISPS Code.
To ensure these ports would be in compliance
with the Code, a Marshall Islands Ports
Security Committee had been formally established.
The Committee began working together
in mid-2003 to produce the Port Security
Assessments and Port Security Plans and to set
into place Port Security Regulations.
"We made an early start in developing the necessary
management systems, in communicating
relevant requirements to our shipowners, ship
managers, masters and Recognized Security
Organizations (RSOs), and in having technical
assistance arrangements in place. We started
planning for the ISPS Code implementation the
week after the conclusion of the Diplomatic
Conference that developed the Code," stated
Bill Gallagher, President, International
Registries, Inc. (IRI).
CELEBRATING
CELEBRATING
22
MILLION GROSS TONS ONS
AT POSIDONIA 2004
Posidonia, the shipping industry's largest
maritime convention, saw a 25% increase
in visitors in 2004 over that in 2002. Not
only was this a time for the Marshall
Islands Registry to network with current
clients and new contacts, but it was also a
time for celebration. The Registry reached
its goal of 22 million gross tons during the
week of Posidonia and invited many of the
industry players to celebrate during IRI's
reception at the Piraeus Yacht Club. "The
Greek shipping community is one of the
Registry's greatest supporters. Posidonia is
a time when we can thank our clients for
their continued support of the Registry,"
said Melissa Hurst, Vice President and
General Counsel.
"We are an active participant at Posidonia -
both this year and in the past. Here is
where everyone who's anyone in shipping
congregates to get updates, find out who's
"Although the Code is not going to be a miracle
cure for the terrorist threat, if properly implemented,
it will reduce the opportunities avail-
able to those who seek to attack ships or use
them for their own nefarious purposes, whether
they be pirates or terrorists," added Gallagher.
"A strong commitment to the Code by all the
participants will also yield unexpected safety
benefits. The challenge now, for the maritime
industry in general, is to make sure the ISPS
Code is implemented properly and in the right
spirit so that it becomes a central element of
shipping's safety and security culture."
new in the shipping industry and network
with each other," said Bill Gallagher. "This
year, unprecedented profitability levels
have been reached by the shipping industry.
I think this contributed to the success of the
show and the high spirits that everyone displayed
during the week," he continued.
MARPOL Annex VI to enter into force.
Regulations for the Prevention of Air
Pollution from Ships are set to enter into
force on May 19, 2005. The 1997 Protocol
to the MARPOL Convention, which
includes Annex VI, sets limits on sulphur
oxide and nitrogen oxide emissions from
ship exhausts and prohibits deliberate emissions
of ozone-depleting substances. With
the entry into force of Annex VI, the full set
of MARPOL international regulations for
the prevention of pollution by ships will be
in force. These requirements are retroactive
to January 1, 2000, as previously advised.
By: Captain David Bruce
The winds of change are blowing -
so we were told at the beginning of
the year, after Mr. Efthimios
Mitropoulos had been appointed as
Secretary General of the International
Maritime Organization (IMO) - throughout
the maritime world and within the IMO
and its Secretariat. Since the time when
winds drove ships, the requirements for
ships and shipping have evolved, but it is
only in more recent years that there has
been an international body with the specific
function of permitting States to discuss
and adopt international regulations to benefit
maritime safety, protect the environment,
and more recently, secure ships and
ports.
...assurances are needed that
trade will not be hampered or
brought to a standstill...
During this term, Mr. Mitropoulos inherited
a broad range of issues for the
Organization, which focus on heightened
maritime safety, security and environmental
concerns. In light of the difficult deci-
sions that must be
made concerning all
of these issues, the
public image of the
IMO is critical. To
achieve a realistic balance
between commercial
shipping and
regulations, assurances
are needed that
trade will not be hampered
or brought to a
standstill with the
development of more
rules. One way to
improve the public
perception of the IMO
and the regulations
that result is to develop
a more "public" image. To achieve
transparency, proposals to open all committee
meetings to the press and/or the
public are being discussed.
Public image is not the only hurdle facing
the IMO. For the IMO to retain its role as
the premier body for the development of
and responsibility to maritime safety and
environmental issues, it is necessary for it
to be proactive. There is considerable danger
from activities in other UN bodies or
of regional or national regulations being
developed and implemented, which could
encroach on the areas of expertise of the
IMO and destroy the global implementation
of international standards that
have been achieved by the IMO since
its inception.
A further dilemma is the fact that the IMO
does not have enforcement powers - these
being delegated to the member States.
With the member State audit scheme
being developed, the Secretariat will provide
an oversight function - a greater function
than that provided in connection with
Secretariat may only make recommendations,
or possibly arrange for technical
assistance to be given to a State. The IMO
cannot take sanctions or force a State to
take any action. So, as a way forward,
should there be further evolving of the role
of the IMO into that of an enforcement
body? That is up to the member States to
determine in the future.
The IMO is guaranteed to encounter many
more obstacles in its pursuit to assure safety,
security and environmental awareness
on the high seas, but it will always play a
key international role in the maritime
world. May the wind always be at the
back of Secretary General Mitropoulos
and allow him to use his considerable
diplomatic skills to ensure the continuing
unity of the membership, and to maintain
the IMO spirit of consensus.
Hans Krijger joined IRI as a full-time Nautical Inspector
based in The Netherlands and is reporting
to the London office. His duties
include conducting inspections for
Marshall Islands registered vessels to
determine their structural condition and
compliance with international and
national safety, security, and environmental
protection requirements and
conduct oversight of the Marshall
Islands nautical inspector program and
of the performance of the recognized organizations acting on behalf
of the Registry. Mr. Krijger graduated from the Maritime Institute,
Vlissingen as a marine engineer. He obtained his chief engineer’s
license after sailing a variety of ships such as general cargo, tugboats,
reefer and passenger ships. Since 1995 he has been working on the
ship management side as superintendent for Vroon Shipping and later
for a dredging company. He will primarily be working in the
Northern Europe, Africa and the Middle East regions.
The Maritime Administration is in the process of reviewing its nautical
inspection procedures due to the rapid growth of the Registry. This
review process will entail an update of the nautical inspector guidelines,
rewrite of the Report of Operational Safety Inspection form, and
evaluation of existing and needed nautical inspection service coverage.
One of the main objectives of this review process is to ensure that
nautical inspectors are provided with past port and flag State inspection
results, Class survey results, and other necessary information, so
that a focused inspection on certain ships may be conducted. The end
result of this revamped process provides inspectors with a list of areas
of concern that will be verified by the Maritime Administration. The
Registry is moving away from a "check-the-box" mentality. Mr.
Krijger is a key player in this new inspection process as he will be the
Marshall Islands exclusive flag State surveyor for ships in need of an
extended inspection.
