2 Presentation<br />

2.1 The requirements of <strong>JAR</strong>-<strong>23</strong> are presented in two columns on loose pages, each page being<br />

identified by the date of the Change number under which it is amended or reissued.<br />

2.2 In general, the <strong>JAR</strong> paragraphs carry the same number as the corresponding FAR Section. In<br />

cases where new <strong>JAR</strong> material is introduced on a subject already dealt with in FAR, this is included<br />

within the numbering system of the relevant FAR Section. In cases where new <strong>JAR</strong> material is<br />

introduced, and there is no corresponding section of FAR, a number is chosen for it which attempts to<br />

place the new material in the right context within the FAR numbering system; in such cases, the<br />

number is prefaced by the letter 'X' (e.g. <strong>JAR</strong> <strong>23</strong>X602) to indicate that it is a European number rather<br />

than one corresponding to an FAR number.<br />

2.3 Explanatory Notes not forming part of the <strong>JAR</strong> text appear in an italic typeface. These are<br />

used, for example, to show where FAR text has not been accepted for <strong>JAR</strong>. Also, sub-headings are in<br />

italic typeface.<br />

2.4 New, amended and corrected text is enclosed within heavy brackets.<br />

<strong>JAR</strong> <strong>23</strong>.1 Applicability<br />

Subpart A - General<br />

(a) This code prescribes airworthiness standards for the issue of type certificates, and changes to those<br />

certificates, for -<br />

(1) Aeroplanes in the normal, utility and aerobatic categories that have a seating configuration,<br />

excluding the pilot seat(s), of nine or fewer and a maximum certificated take-off weight of 5670 kg (12 500<br />

lb) or less; and<br />

(2) Propeller-driven twin-engined aeroplanes in the commuter category that have a seating<br />

configuration, excluding the pilot seat(s), of nineteen or fewer and a maximum certificated take-off weight of<br />

8618 kg (19 000 lb) or less.<br />

(b) Each person who applies for such a certificate or change must show compliance with the applicable<br />

requirements of this code.<br />

<strong>JAR</strong> <strong>23</strong>.2 Special retroactive requirements<br />

Not required for <strong>JAR</strong> <strong>23</strong>.
