reason of determining and existence of forbidden agreement and / or agreed
practice which goal is obstruction, restriction or distortion of the competition in
the market of supply of services for technical inspection of motor vehicles and
trailers on the territory of Republic of Macedonia, at the session held on
19.07.2010 adopted the following
DECISION
1. If has been determined that

Have been taken part into forbidden agreement and / or agreed practice
in a manner of Avto Moto Sojuz na Makedonija, Skopje providing
decisions and price lists for the services of technical inspection of
motor vehicles and trailers to all of the Avto moto associations,
consequently the decisions and price lists have been put in place
directly or indirectly, via providing its own decisions and price lists
having identical prices with those determined by Avto Moto Sojuz na
Makedonija, what in turn leads to fixed sale prices for the service of
technical inspection of motor vehicles and trailers in the territory of
Republic of Macedonia, aiming towards obstruction, restriction or
distortion of the competition in the market of providing the service technical
inspection of motor vehicles and trailers in the territory of Republic of
Macedonia, and following have committed offence against the article 7,
paragraph (1), item 1) from the Law on Protection of Competition.
2. Timeframe of the offence from item 1.:
- Avto Moto Sojuz na Makedonija, Skopje has committed offence against the item 1)
within the period from26.07.2005 to the day of adopting this decision;
- Avto Moto Drustvo ,,Bregalnica Berovo has committed offence against the item
1) within the period from15.08.2005 to the day of adopting this decision;
- Avto Moto Drustvo ,,GJorgji Naumov Bitola has committed offence against the
item 1) within the period from01.08.2005 to the day of adopting this decision;
- Avto Moto Drustvo ,,Vinica Vinica, has committed offence against the item 1)
within the period from 01.08.2005 to the day of adopting this decision;
- Avto Moto Drustvo ,,Dico Panov Gevgelija, has committed offence against the item
1) within the period from 01.08.2005 to the day of adopting this decision;
- Avto Moto Drustvo ,,Gostivar Gostivar has committed offence against the item 1)
within the period from 03.01.2007 to the day of adopting this decision;
- Avto Moto Drustvo ,,Straso Pindzur Kavadarci, has committed offence against the
item 1) within the period from 01.08.2005 to the day of adopting this decision;
- Avto Moto Drustvo ,,Kicevo Kicevo, has committed offence against the item 1)
within the period from 01.08.2005 to the day of adopting this decision;

- Avto Moto Drustvo ,,Lopen Kocani , has committed offence against the item 1)
within the period from 28.07.2006 to the day of adopting this decision;
- Avto Moto Drustvo ,,Ohrid Ohrid, has committed offence against the item 1) within
the period from 01.08.2005 to the day of adopting this decision;
- Avto Moto Drustvo ,,Prilepec Prilep has committed offence against the item 1)
within the period from 01.08.2005 godina to 09.02.2009;
-Avto Moto Drustvo ,,Probistip Probistip has committed offence against the item 1)
within the period from 01.08.2005 to the day of adopting this decision;
- Avto Moto Drustvo ,,Struga Struga, has committed offence against the item 1)
within the period from 01.08.2005 to the day of adopting this decision;
- Avto Moto Drustvo ,,Strela Strumica, has committed offence against the item 1)
within the period from 01.08.2005 to the day of adopting this decision;
- Avto Moto Drustvo ,,Tetovo Tetovo, has committed offence against the item 1)
within the period from 28.07.2005 to the day of adopting this decision;
- Avto Moto Drustvo ,,Stip Stip, has committed offence against the item 1) within
the period from 26.07.2005 to the day of adopting this decision;
3. It has been prohibited to Avto Moto Sojuz na Makedonija to provide decisions and
fixed price lists for technical inspection of motor vehicles and trailers to the local
Avto Moto Associations (Drustva) and imposing any act or practice having
consequences as described in the item 1 of this decision.
4. 4. It has been prohibited Avto moto drustvo ,,Bregalnica Berovo, Avto moto
drustvo ,,GJorgji Naumov Bitola, Avto moto drustvo ,,Vinica Vinica, Avto moto
drustvo ,,Dico Panov Gevgelija, Avto moto drustvo ,,Gostivar Gostivar, Avto moto
drustvo ,,Straso Pindzur Kavadarci, Avto moto drustvo ,,Kicevo Kicevo, Avto
moto drustvo ,,Lopen Kocani, Avto moto drustvo ,,Ohrid Ohrid, Avto moto
drustvo ,,Probistip Probistip, Avto moto drustvo ,,Struga Struga, Avto moto
drustvo ,,Strela Strumica, Avto moto drustvo ,,Tetovo Tetovo, Avto moto
drustvo ,,Stip Stip further implementation of the prohibited decisions and price
lists having determined fixed price for the service of technical inspection of motor
vehicles and trailers.
5. It has been ordered to Avto moto drustvo ,,Bregalnica Berovo, Avto moto drustvo
,,GJorgji Naumov Bitola, Avto moto drustvo ,,Vinica Vinica, Avto moto drustvo
,,Dico Panov Gevgelija, Avto moto drustvo ,,Gostivar Gostivar, Avto moto
drustvo ,,Straso Pindzur Kavadarci, Avto moto drustvo ,,Kicevo Kicevo, Avto
moto drustvo ,,Lopen Kocani, Avto moto drustvo ,,Ohrid Ohrid, Avto moto
drustvo ,,Probistip Probistip, Avto moto drustvo ,,Struga Struga, Avto moto
drustvo ,,Strela Strumica, Avto moto drustvo ,,Tetovo Tetovo, Avto moto
drustvo ,,Stip Stip, independently to establish prices for conducting technical
inspection of motor vehicles and trailers, on the basis of system of expanses,
within 30 days from the day of delivery of this decision and to provide them to the
Commission for Protection of Competition within 8 days from the day if imposing
them.
6. Not obeying this decision denotes an offence in line with article 47 paragraph (1)
item 3) from the Law on Protection of Competition.

7. In the procedure initiated in line with official duty against Avto Moto Drustvo ,,
Kiro Burnaz Kumanovo ul. III-ta Makedonska Udarna Brigada bb, Kumanovo for the
reason of determining existence of prohibited agreement and / or agreed practice
aiming at obstruction, restriction or distortion of the competition in the market
for providing the services for technical inspection of motor vehicles and trailers in
the territory of Republic of Macedonia, The Commission for Protection of
Competition has determined it has not taken part in a prohibited agreement and /
or agreed practice in the provision of the services for technical inspection of
motor vehicles and trailers, that is it has applied different prices for the services
for technical inspection of motor vehicles and trailers from those applied by Avto
Moto Sojuz na Makedonija Skopje and the other Avto Moto Associations.
8. In the procedure initiated in line with official duty against Trgovsko drustvo
AMSM USLUGI STANICA ZA TEHNICKI PREGLED DOO-Skopje ul. Mitropolit
Teodosij Gologanov br.51, Skopje for the reason of determining existence of
prohibited agreement and / or agreed practice aiming at obstruction, restriction
or distortion of the competition in the market for providing the services for
technical inspection of motor vehicles and trailers in the territory of Republic of
Macedonia, The Commission for Protection of Competition has determined it has
not taken part in a prohibited agreement and / or agreed practice in the provision
of the services for technical inspection of motor vehicles and trailers, as it depends
on Avto Moto Sojuz na Makedonija Skopje and represents an economic entity with
Avto Moto Sojuz na Makedonija and as a such has right to apply same prices, that
is to represent confirmation of the prices which Avto Moto Sojuz na Makedonija
Skopje has determined already in the price list for technical inspection of motor
vehicles and trailers of AMSM Skopje br. 03-4135/1 from 11.07.2006.
Legal remedy: Against this decision a complaint for initiating
administrative procedure can be lodged within thirty (30) days from the day
of delivery.
