TENDER NOTICE 

Sealed Tenders are invited in two part bid system, for the following work from 

reputed/experienced contractors on the terms and conditions mentioned in this tender document:- 

1. Scope of Work : 

a) Collection of CRNGO scraps from Blanking Line pit (3 meters deep) on continual 

basis and its disposal to scrap yard. 

b) Collection of Packing Steel scraps on daily basis, its loading/ unloading and disposal to 

scrap yard. 

c) Collection of bundle cover scraps such as plastic jute and packing wood etc., its 

loading/unloading and transportation to scrap yard. 

2. Duration: The contract shall be valid for one year from date of work order and may be 

extended for six months on mutual agreement basis. 

3. Earnest Money: Rs 40,000 /- (Rupees Forty thousand only). Earnest Money may be 

deposited in Demand draft in favour of ‘Bharat Heavy Electricals 

Limited’ payable at SBI, IGFCC Jagdishpur. 

Tenders without Earnest Money are liable to be rejected. 

4. Security Deposit: Rs.100, 000 (Rs One Lakh) + 7.5% of the total order value exceeding 

Rs.10,00,000/-.

6. Technical & Commercial bid shall be opened on: - 30/05/2011 at15.00 hrs

ANNEXURE-A 

1. Offer must be accompanied with Earnest Money Deposit of Rs. 40,000/- (Rupees Forty 

thousand only) in the shape of Demand Draft drawn in favour of Bharat Heavy Electricals 

Limited payable at SBI, IGFCC Jagdishpur. EMD shall be forfeited, if the tenderer withdraws 

his offer during the validity period or fails to sign the contract agreement, after award of the 

contract. 

2. Successful bidders will have to deposit Security Money within seven days after award of LOI 

or contract which ever is earlier with the company for the due fulfillment of terms and 

conditions of Rs.1,00,000/- (Rs One Lakh) +7.5% of the total order value exceeding Rs. 

10,00,000/-. The security deposit will not carry any interest. It will be released within thirty 

days of satisfactory completion of contract. 

3. Tender will be opened in the Administrative Building, CSU, BHEL, Jagdishpur, on the above 

specified date and time in the presence of those bidders who may like to be present. 

4. BHEL reserves the right to reject any or all the tenders without assigning any reasons 

whatsoever and the decision of BHEL shall be final. 

5. The contract shall be valid for One Year and may be extended for further one year on mutual 

agreement basis. 

6. BHEL reserves the right to finalize the tender through Reverse Auction process. For details 

please see the Annexure E 

7. While submitting the bids, it will be ensured by the bidders that:- 

7.1 Techno/ Commercial Bid is kept in envelope No.1.-Super scribe this envelope as- 

Tender Enquiry no. BHEL/CSU/SCRAP/03 date –09/05/2011 - Techno/

7.2 Price bid is kept in envelope No.2- Super scribe this envelope as-Tender Enquiry no 

BHEL/CSU/SCRAP/03 date – 09/05/2011 - Price bid 

7.3 Envelope no.1 & no.2 are kept in a bigger envelope no.3 

7.4 All the papers (including the envelopes) should be signed & rubber stamped by the 

bidder 

8. All entries in the tender shall be typed or ink written. Any overwriting may render such tender 

to summary rejection. 

9. Late/ delayed tenders shall be rejected.


10. The tenderer shall furnish following, duly enclosing documents relating thereto: 

i. Authorized signatory shall be the person holding ‘power of attorney’ on behalf of the 

firm/company/bidder-concerned authorized/empowered to act on behalf for the 

specific purpose. 

ii. Power of Attorney: An attested copy of the Power of Attorney, in case an individual 

other than the sole proprietor signs the tender shall be submitted along with the 

tenders. 

iii. In case of an Individual, full name, address, place & nature of business and license 

relating to. 

iv. In case of Partnership Firms: The names of all the partners and their address. A copy 

of the partnership deed/instrument of partnership duly certified by the Notary Public 

shall be enclosed. The tender must be signed by all the partners of the firm or by the 

managing partner who has power to do. 

v. BHEL will not be bound by any other power of attorney granted or the change in 

composition of the firm made after the execution of the contract agreement. They 

may, however, recognize such power of attorney or change in status only after 

legal advice. 

11. The offer should remain valid for acceptance for a minimum period of 60 days from the date 

of bid opening. 

12. A consent letter should be given by the bidder that all terms & conditions of the tender are 

accepted by the tenderer 

13. Bidders have to submit the signed and stamped each and every paper of this tender document 

alongwith the technical bid. 

14. BHEL Reserves the right to: - 

11.1 Accept or reject any of the bid/all bids or cancel/withdraw the invitation for bid 

without assigning any reason whatsoever, and in such case no bidder/intending bidders 

shall have any claim arising out of such action by BHEL. 

11.2 Reject conditional tenders, tenders containing absurd or unworkable rates and tenders 

which are incomplete and otherwise considered defective and tenders not in 

accordance with the tender conditions, during the tender evaluation process. 

15. Contractor shall abide by all the rules, regulation and discipline at the shop floor during the 

course of working and shall ensure the safety & security of the instrument and the workers. 

16. Contractor will strictly follow the rules and regulations issued by the Central / State 

Government with respect to labour laws.

17. BHEL will not be responsible any way for any mishap / accident that may happen during the 

execution of works contracts. 

18. Contractor should fulfill all conditions of BHEL contracts as provided in instructions to 

contractors and statutory instructions to contractors as enclosed. 

19. Statuary compliances shall be essentially followed by the contractor and the contractor if 

found to have violated the statutory provisions as provided in the enclosed instructions would 

be liable to be terminated. 

20. There will be no sub-contracting of the work contract. 

21. List of labours to be deployed for work, their police verficiation, character certificate along 

with photo ID etc. are to be submitted to BHEL after award of work. 

22. The contractor shall provide following Personal Protection Safety Equipments to their 

Labours working in Plant: 

1. Helmet 

2. Leather Gloves 

3. Dangri 

4. Uniform 

5. Safety Shoes 

6. Safety glasses 

7. Soap 

23. The contactor has to submit a contract agreement on a non-judicial stamp paper of Rs.100/- at 

his own cost after award of work.

ANNEXURE – B 

1.1 Work of daily collection scrap from Blanking Line pit (3 metres deep) & Notching 

Machine, bundle covers, jute, paper, plastic, metal and wood scrap from process in CSU, 

its weighing and transportation to scrap yard/ identified place. 

1.2 The different types of scraps shall be collected separately, transported and disposed to 

separately identified places in scrap yard/identified place. 

1.3 The scrap size will be of 1250mm cut scrap or continuous scrap after blanking operation. 

1.4 The estimated quantities as shown in the tender documents are only indicative in nature. 

The actual quantity may vary. 

1.5 The scrap yard will be inside BHEL CSU premises as identified by BHEL.


1.6 Safe transportation of scrap removed from Blanking line and notching machine pit, bundle 

covers of coils etc. to the scrap yard will be sole responsibility of the contractor. 

1.7 All facilities, vehicles, tools & tackles for safe transportation of scrap shall be arranged by 

the contractor. 

1.8 The scrap collected shall be taken to Weighbridge and get measured and certified by 

BHEL official before disposal to scrap yard. 

1.9 The requirement is for unskilled nature of work of scrap collection and disposal as per 

requirement on regular basis from presses to keep the machines running without 

interruption. It must be ensured that the machine must not be stopped for scrap removal 

and that the machine should not suffer any stoppages for the reason of non-removal of 

scrap. In case of any clarification or explanation is required in understanding the work 

requirement it should be sought from the concerned shop Executive/ Supervisor. 

1.10 The workers deployed by the contractors may be unskilled labours. 

1.11 The successful contractor or his representative shall have to maintain day to day contract 

with CSU officials. Report on every working day at 8:00 AM to undertaking and 

supervision of the work. He has to deploy sufficient workers in I, II, III shifts, as per work 

requirement, even on Sundays and Holidays, if required. The contractor shall be 

responsible for the good conduct of his employees. 

1.12 Payment terms will be as following: 

i) Payment will be done on the basis of scrap removed as certified by BHEL Engineer. 

ii) Payment will be done according to the rates in Work Order issued to the contractor. 

The rates will remain firm for the entire contract period. 

iii) Payment will be done on monthly basis on submission of bill by contractor. 

iv) Service tax will be paid extra. 

v) Income Tax at the prevailing rate on gross value of work done and applicable surcharge 

and education cess shall be deducted from the running bills as per relevant rules unless 

exempted by the Income Tax Authorities. 

1.13 Penalty Clause: If any machine is found stopped due to non-removal of scrap in the 

scope of contract, a penalty of Rs.250/- per hour shall be deducted from contract’s bill 

upto a maximum of Rs. 1000/- per day. 

1.14 Following documents are to be submitted along with the tender documents: 

i) Service Tax registration. 

ii) Last 2 year Income tax returns. 

iii) ESI registration.

1.15 Basic purpose of works contract is to achieve planned production of the department on 

continual basis. It must be ensured that the machine must not be stopped for scrap 

removal and that the machine should not suffer any stoppages for the reason of nonremoval 

of scrap. 

1.16 In case planned monthly production is not met due to the reason of non-removal of scrap 

by the works contractor and the performance of the contractor is not found to be 

satisfactory BHEL reserves the right to cancel the order and the security deposit 

submitted will be forfeited. 

1.17 No idle labour charges will be admissible in the event of any stoppage of work resulting 

in the contractor’s workmen being rendered idle due to any reason at any time. 

1.18 All disputes between the parties to the contract arising out of or in relation to the 

contract, other than those for which the decision of the Engineer or any other person is 

by the contract expressed to be final and conclusive, shall after written notice by either 

party to the contract to the other party, be referred to sole arbitration of the Additional 

General Manager or his nominee.

ANNEXURE - E 

1.1. BHEL may go for Reverse Auction (on line bidding on Internet) instead of opening the 

submitted sealed price bid. The decision to go for Reverse Auction will be taken after 

techno-commercial evaluation. Information and general terms and conditions governing 

RA are given below. 

1.2. For the proposed reverse auction, technically and commercially acceptable bidders only 

shall be eligible to participate. 

1.3. BHEL will engage the services of a Service Provider who will provide all necessary 

training and assistance/ demonstration before commencement of on line bidding on 

internet. 

1.4. BHEL will inform the Vendors in writing the details of Service Provider to enable them 

to contact for training/ demonstration. 

1.5. Business rules like event date, time, start price, bid decrement, extensions etc. also will 

be communicated through Service Provider for compliance. 

1.6. Vendors have to fax the Compliance form in the prescribed format (provided by 

Service provider) before start of Reverse Auction. Without this, the vendor will not be 

eligible to participate in the event. 

1.7. BHEL will provide the calculation sheet which will help the Vendors to arrive at "Total 

Cost to BHEL” for each of the Vendors to enable them to fill-in the price and keep it 

ready for keying in during the Auction. 

1.8. Reverse auction will be conducted on a scheduled date & time. 

1.9. At the end of Reverse Auction event, the lowest bid value will be known on the 

network. 

1.10. The lowest bidder has to fax the duly signed filled-in prescribed format as provided to 

BHEL through Service Provider within 24 hours of Auction without fail. 

1.11. Any variation between the on-line bid value and the signed document will be 

considered as sabotaging the tender process and will invite disqualification of vendor to 

conduct business with BHEL as per prevailing procedure. 

In case BHEL decides not to go for Reverse Auction procedure for this tender enquiry, the Price 

bids already submitted and available with BHEL shall be opened as per BHEL’s standard 

practice.

in favour of BHEL payable at SBI, IGFCC Lucknow. Security deposit will not carry any interest. 

It will be returned to the contractor, within 30 days, after successful completion of the Contract. 

The security deposit and any other amount occurring to the contract will be liable for forfeiture in 

the event of the contractor violating any of the conditions of the contractor and will be set against


any claim or expenditure incurred by BHEL on account of acts of omission/negligence on the part 

of the contractor. 

Settlement of Disputes-If at any time, any dispute or difference whatsoever shall arise between the 

company and the contractor, upon or in relation to or in connections with the contract the same 

shall be referred to the sole arbitration of the head of centralized stamping unit, Jagdishpur or such 

other persons as nominated by the head of the unit or the person so appointed by him, had to deal 

with the matter to which the agreement relates. The award of unit incharge of CSU,BHEL 

Jagdishpur or the arbitrator so appointed shall be final and binding on the company and the 

contractor. The arbitration proceedings shall be held at CSU, BHEL, Jagdishpur,CSM Nagar 

(UP). Jurisdiction of CSM Nagar (UP) district court shall apply. 

Once the contract is signed, the contractor shall not sublet or transfer the full contract or any part 

threreof which will tantamount to violation of the contract. 

The contractor shall be responsible for all acts of their staff and sub agents and liabilities arising 

there from. 

Indemnity-The contractor shall indemnify the company against all losses, claims etc. arising out 

of any of his servants or agents.

the contractor in the performance, observance or discharge of any of the terms, conditions, 

stipulations or undertakings or any one of them as contained in the contract and/ or as to the 

extent of loss, damage, costs, charges and expenses caused to or suffered by the company by 

reason of the contractor making any default in the performance, observance or discharge of any 

of the terms, conditions, stipulations or undertakings or any one of them shall be conclusive and 

binding on the Guarantor irrespective of the fact whether the contractor admits or denies the


default or questions the correctness of any demand made by the company in any Court, Tribunal 

or Arbitration proceedings or before any other Authority. 

The company shall have the fullest liberty without affecting in any way the liability of the 

Guarantor under this Guarantee, from time to time to vary any of the terms and conditions of the 

contract or extend time of performance by the contractor or to postpone for any time and from 

time to time any of the powers excercisable by it against the contractor and either enforce or 

forebear from enforcing any of the terms and conditions governing the contract or securities 

available to the company and the Guarantor shall not be released from it's liability under these 

presents by any exercise by the company of the liberty with reference to the matters aforesaid or 

by reasons of time being given to the contractor or any other forbearance act or commission on 

the part of the company or any indulgence by the company to the contractor or any other matter 

or thing whatsoever which under the law relating to surities would, but for this provision have the 

effect of so releasing the Guarantor from it's liability under this guarantee. 

The Guarantor further agrees that the Guarentee herein contained shall remain in full 

force and effect during the period that would be taken for the performance of the contract and it's 

claim satisfied or discharged and till the company certifies that the terms and conditions of the 

contract have been fully and properly carried out by the contractor accordingly discharges this 

Guarantee, subject however, that the company shall have no claim under this Guarantee 

after.................... i.e, ( the present date of validity of Bank Guarantee unless the date of validity 

of this Bank Guarantee is further extended from time to time, as the case may be ) unless a 

notice of the claim under this Guarantee has been served on the Guarantor before the expiry of 

the said period in which case the same shall be enforceable against the Guarantor not 

withstanding the fact that the same is enforced after the expiry of the said period. 

The Guarantor undertakes not to revoke this Guarantee during the period it is in force 

except with the previous consent of the Company in writing and agrees that any liquidation or 

winding up or insolvency or dissolution or any change in the constitution of the contractor or the 

Guarantor shall not discharge the Guarantor's liability hereunder. 

It shall not be necessary for the company to proceed against the contractor before 

proceeding against the Guarantor and the Guarantee herein contained shall be enforceable 

against them not withstanding any security which the company may have obtained or obtain from 

the Contractor shall at the time when proceedings are taken against the Guarantor hereunder be 

outstanding or unrealized.
