The <strong>period</strong> of time from when an <strong>election</strong> is announced until after <strong>the</strong> <strong>election</strong> is held has<br />

been known as ‘purdah’ but is now m<strong>or</strong>e often referred to as <strong>the</strong> <strong>pre</strong>-<strong>election</strong> <strong>period</strong>.<br />

Guidance is issued f<strong>or</strong> civil servants bef<strong>or</strong>e general and local <strong>election</strong>s, and to local<br />

auth<strong>or</strong>ities on <strong>the</strong>ir activities during <strong>the</strong> <strong>period</strong> bef<strong>or</strong>e local <strong>election</strong>s. The Note gives details<br />

of <strong>the</strong> guidance issued bef<strong>or</strong>e <strong>the</strong> general <strong>election</strong> in 2010 and <strong>the</strong> guidance issued by <strong>the</strong><br />

devolved executives in 2011.<br />

On 13 March 2013 guidance was issued to civil servants f<strong>or</strong> <strong>the</strong> <strong>period</strong> bef<strong>or</strong>e <strong>the</strong> local<br />

<strong>election</strong>s taking place on 2 May 2013. The <strong>period</strong> of sensitivity <strong>pre</strong>ceding <strong>the</strong>se <strong>election</strong>s is<br />

not fixed to any particular date, but <strong>the</strong> general convention is that particular care should<br />

be taken in <strong>the</strong> three weeks <strong>pre</strong>ceding <strong>the</strong> <strong>election</strong>s, this year from 11 April 2013.<br />

There is statut<strong>or</strong>y guidance f<strong>or</strong> local auth<strong>or</strong>ities about publicity during <strong>the</strong> <strong>period</strong> just bef<strong>or</strong>e<br />

local <strong>election</strong>s. The <strong>pre</strong>-<strong>election</strong> <strong>period</strong> is defined as beginning with <strong>the</strong> last date f<strong>or</strong> <strong>the</strong><br />

publication of notice of <strong>the</strong> <strong>election</strong>; this year this is Tuesday 26 March 2013. The Code of<br />

Recommended Practice on Local Auth<strong>or</strong>ity Publicity is issued under section 4 of <strong>the</strong> Local<br />

Government Act 1986.<br />

1 Background<br />

The <strong>period</strong> of time from when an <strong>election</strong> is announced until after <strong>the</strong> <strong>election</strong> is held has<br />

been known as ‘purdah’ but is now m<strong>or</strong>e often referred to as <strong>the</strong> <strong>pre</strong>-<strong>election</strong> <strong>period</strong>.<br />

Guidance is issued f<strong>or</strong> civil servants bef<strong>or</strong>e general and local <strong>election</strong>s, and to local<br />

auth<strong>or</strong>ities on <strong>the</strong>ir activities during <strong>the</strong> <strong>period</strong> bef<strong>or</strong>e local <strong>election</strong>s.<br />

2 Guidance f<strong>or</strong> civil servants<br />

The Cabinet Office issues guidance f<strong>or</strong> civil servants in UK departments on <strong>the</strong>ir role and<br />

conduct during <strong>election</strong> campaigns. This is available on <strong>the</strong> Cabinet office website. 1 On 13<br />

March 2013 guidance was issued f<strong>or</strong> civil servants f<strong>or</strong> <strong>the</strong> <strong>period</strong> bef<strong>or</strong>e <strong>the</strong> local <strong>election</strong>s<br />

taking place on 2 May 2013. 2 The Minister f<strong>or</strong> <strong>the</strong> Cabinet Office and Paymaster General<br />

announced <strong>the</strong> publication of <strong>the</strong> guidance in a written ministerial statement:<br />

Guidance has today been issued to civil servants in UK departments and those<br />

w<strong>or</strong>king in non-departmental public bodies (NDPBs) on <strong>the</strong> principles that <strong>the</strong>y<br />

should observe in relation to <strong>the</strong> conduct of Government business in <strong>the</strong> run up<br />

to <strong>the</strong> f<strong>or</strong>thcoming <strong>election</strong>s to local auth<strong>or</strong>ities in England and Wales, and f<strong>or</strong><br />

<strong>the</strong> directly elected may<strong>or</strong>s in Doncaster and N<strong>or</strong>th Tyneside. These <strong>election</strong>s<br />

will take place on Thursday 2 May 2013.<br />

The guidance sets out <strong>the</strong> need to maintain <strong>the</strong> political impartiality of <strong>the</strong> civil<br />

service, and <strong>the</strong> need to ensure that public resources are not used f<strong>or</strong> party<br />

political purposes. The <strong>period</strong> of sensitivity <strong>pre</strong>ceding <strong>the</strong> <strong>election</strong>s starts on 11<br />

April.<br />

The guidance sets out <strong>the</strong> general principles that should be observed by all civil servants,<br />

including special advisers, during this <strong>period</strong>:<br />

a) particular care should be taken over official supp<strong>or</strong>t, and <strong>the</strong> use of public<br />

resources, including publicity, f<strong>or</strong> Ministerial <strong>or</strong> official announcements which<br />

could have a bearing on matters relevant to <strong>the</strong> <strong>election</strong>s. In some cases it may<br />

be better to defer an announcement until after <strong>the</strong> <strong>election</strong>s, but this would<br />

need to be balanced carefully against any implication that deferral could itself<br />

influence <strong>the</strong> political outcome – each case should be considered on its merits;<br />

b) care should also be taken in relation to proposed visits;<br />

c) special care should be taken in respect of paid publicity campaigns and to<br />

ensure that publicity is not open to <strong>the</strong> criticism that it is being undertaken f<strong>or</strong><br />

party political purposes;<br />

d) <strong>the</strong>re should be even-handedness in meeting inf<strong>or</strong>mation requests from <strong>the</strong><br />

different political parties and campaigning groups.<br />

e) officials should not be asked to provide new arguments f<strong>or</strong> use in <strong>election</strong><br />

campaign debates. 4<br />

Earlier guidance, published f<strong>or</strong> civil servants bef<strong>or</strong>e <strong>the</strong> 2007 local and devolved assembly<br />

<strong>election</strong>s, is on <strong>the</strong> Cabinet Office website with <strong>the</strong> guidance published bef<strong>or</strong>e <strong>the</strong> 2010<br />

general <strong>election</strong>. 5<br />

The <strong>pre</strong>face to <strong>the</strong> 2010 general <strong>election</strong> guidance states:<br />

During an <strong>election</strong> campaign, <strong>the</strong> Government retains its responsibility to<br />

govern, and Ministers remain in charge of <strong>the</strong>ir Departments. Essential<br />

business must be carried on. However, it is customary f<strong>or</strong> Ministers to observe<br />

discretion in initiating any new action of a continuing <strong>or</strong> long-term character.<br />

Decisions on matters of policy on which a new Government might be expected<br />

to want <strong>the</strong> opp<strong>or</strong>tunity to take a different view from <strong>the</strong> <strong>pre</strong>sent Government<br />

should be postponed until after <strong>the</strong> <strong>Election</strong>, provided that such postponement<br />

would not be detrimental to <strong>the</strong> national interest <strong>or</strong> wasteful of public money. 6<br />

The detailed advice issued f<strong>or</strong> <strong>the</strong> 2010 general <strong>election</strong> noted how constituency<br />

c<strong>or</strong>respondence from f<strong>or</strong>mer MPs should be answered carefully, noting that it would be<br />

essential to avoid individual cases becoming party political issues. 7 There is specific advice<br />

f<strong>or</strong> special advisers, which warns that advisers who wish to accompany <strong>the</strong>ir Ministers in <strong>the</strong><br />

General <strong>Election</strong> campaign <strong>or</strong> help in a party headquarters <strong>or</strong> research unit must first resign<br />

<strong>the</strong>ir appointments.<br />

3 Guidance f<strong>or</strong> local auth<strong>or</strong>ities<br />

The <strong>period</strong> just bef<strong>or</strong>e local <strong>election</strong>s when <strong>the</strong>re are restrictions on local auth<strong>or</strong>ity publicity<br />

and rules concerning media rep<strong>or</strong>ting of <strong>the</strong> <strong>election</strong> campaign, <strong>the</strong> <strong>pre</strong>-<strong>election</strong> <strong>period</strong>, is<br />

defined as beginning with <strong>the</strong> last date f<strong>or</strong> publication of notice of <strong>the</strong> <strong>election</strong>. This year <strong>the</strong><br />

last date f<strong>or</strong> <strong>the</strong> publication of notice of <strong>election</strong> f<strong>or</strong> <strong>the</strong> local <strong>election</strong>s is Tuesday 26 March<br />

2013; <strong>the</strong> restrictions outlined below will <strong>the</strong>n apply.<br />

There is statut<strong>or</strong>y guidance f<strong>or</strong> local auth<strong>or</strong>ities about publicity during <strong>the</strong> <strong>pre</strong>-<strong>election</strong> <strong>period</strong><br />

just bef<strong>or</strong>e local <strong>election</strong>s. The Code of Recommended Practice on Local Auth<strong>or</strong>ity Publicity<br />

is issued under section 4 of <strong>the</strong> Local Government Act 1986 and local auth<strong>or</strong>ities must have<br />

regard to it. The Code, which was revised in 2011, can be found on <strong>the</strong> Department f<strong>or</strong><br />

Communities and Local Government website. 8<br />

Care during <strong>period</strong>s of heightened sensitivity<br />

33. Local auth<strong>or</strong>ities should pay particular regard to <strong>the</strong> legislation governing<br />

publicity during <strong>the</strong> <strong>period</strong> of heightened sensitivity bef<strong>or</strong>e <strong>election</strong>s and<br />

referendums – see paragraphs 7 to 9 of this code. It may be necessary to<br />

suspend <strong>the</strong> hosting of material produced by third parties, <strong>or</strong> to close public<br />

f<strong>or</strong>ums during this <strong>period</strong> to avoid breaching any legal restrictions.<br />

34. During <strong>the</strong> <strong>period</strong> between <strong>the</strong> notice of an <strong>election</strong> and <strong>the</strong> <strong>election</strong> itself,<br />

local auth<strong>or</strong>ities should not publish any publicity on controversial issues <strong>or</strong><br />

rep<strong>or</strong>t views <strong>or</strong> proposals in such a way that identifies <strong>the</strong>m with any individual<br />

members <strong>or</strong> groups of members. Publicity relating to individuals involved<br />

directly in <strong>the</strong> <strong>election</strong> should not be published by local auth<strong>or</strong>ities during this<br />

<strong>period</strong> unless ex<strong>pre</strong>ssly auth<strong>or</strong>ised by <strong>or</strong> under statute. It is permissible f<strong>or</strong><br />

local auth<strong>or</strong>ities to publish factual inf<strong>or</strong>mation which identifies <strong>the</strong> names,<br />

wards and parties of candidates at <strong>election</strong>s.<br />

35. In general, local auth<strong>or</strong>ities should not issue any publicity which seeks to<br />

influence voters. However this general principle is subject to any statut<strong>or</strong>y<br />

provision which auth<strong>or</strong>ises expenditure being incurred on <strong>the</strong> publication of<br />

material designed to influence <strong>the</strong> public as to whe<strong>the</strong>r to supp<strong>or</strong>t <strong>or</strong> oppose a<br />

question put at a referendum. It is acceptable to publish material relating to <strong>the</strong><br />

subject matter of a referendum, f<strong>or</strong> example to c<strong>or</strong>rect any factual inaccuracies<br />

which have appeared in publicity produced by third parties, so long as this is<br />

even-handed and objective and does not supp<strong>or</strong>t <strong>or</strong> oppose any of <strong>the</strong> options<br />

which are <strong>the</strong> subject of <strong>the</strong> vote.<br />

4 Scottish <strong>Parliament</strong> and National Assembly f<strong>or</strong> Wales<br />

The Scottish Government issued guidance about <strong>the</strong> role and conduct of people w<strong>or</strong>king in<br />

<strong>the</strong> Scottish Government, its agencies and national devolved public bodies during <strong>the</strong><br />

<strong>election</strong> <strong>period</strong> beginning March 23, 2011 bef<strong>or</strong>e <strong>the</strong> Scottish <strong>Parliament</strong> <strong>election</strong>s on 5 May<br />

2011. 9 The general principles are reproduced below:<br />

During <strong>the</strong> <strong>election</strong> <strong>period</strong>, <strong>the</strong> Scottish Government retains its responsibility to<br />

govern and Ministers remain Ministers and in charge of <strong>the</strong>ir p<strong>or</strong>tfolios.<br />

Essential business must be carried on. However, you can expect Ministers to<br />

observe discretion in initiating any new action of a continuing <strong>or</strong> long‐term<br />

character.<br />

Decisions on matters of policy on which <strong>the</strong> next administration might wish to<br />

take a different view from <strong>the</strong> current administration are expected to be<br />

postponed until after <strong>the</strong> <strong>election</strong>, provided that such postponement would not<br />

be detrimental to Scotland’s interest <strong>or</strong> wasteful of public resources. You can<br />

also expect Ministers to be largely engaged in <strong>the</strong> <strong>election</strong> campaign and<br />

<strong>the</strong>ref<strong>or</strong>e not want to be asked to make decisions on issues during <strong>the</strong> <strong>election</strong><br />

<strong>period</strong> unless it is essential that <strong>the</strong>y should do so. 10<br />

The Welsh Assembly Government published guidance f<strong>or</strong> civil servants f<strong>or</strong> <strong>the</strong> <strong>pre</strong>-<strong>election</strong><br />

<strong>period</strong> bef<strong>or</strong>e <strong>the</strong> 2011 <strong>election</strong>s f<strong>or</strong> <strong>the</strong> National Assembly f<strong>or</strong> Wales which ran from 1 April<br />

2011 to 5 May 2011. 11<br />
