STATEMENT OF THE CASE<br />
Plaintiffs in this action are Iraqis who were mistakenly detained in<br />
prisons operated by the <strong>United</strong> <strong>States</strong> military during 2003 and 2004.<br />
According to military reports, up to 90 percent <strong>of</strong> the persons imprisoned in<br />
Iraq were innocents arrested by mistake. 1 All <strong>of</strong> the Plaintiffs fall into this<br />
category <strong>of</strong> persons, as each was voluntarily released by the military without<br />
any charges, convictions, or referrals to Iraqi authorities. During their<br />
tenures in prison, Plaintiffs were victims <strong>of</strong> serious abuse.<br />
The Saleh Plaintiffs learned from the military’s own reports that there<br />
were two corporate actors complicit in this abuse, Titan Corporation (now L-<br />
3) and CACI. L-3 employees served as translators; CACI employees served<br />
as interrogators at the Abu Ghraib prison. After learning <strong>of</strong> the corporate<br />
complicity in the abuse, the Saleh Plaintiffs brought suit in June 2004,<br />
alleging that L-3 translators conspired with others and abused them.<br />
Thereafter, the Ibrahim Plaintiffs filed suit in the <strong>District</strong> <strong>Court</strong> <strong>for</strong> the<br />
<strong>District</strong> <strong>of</strong> <strong>Columbia</strong>, alleging similar conduct, although without alleging<br />
any involvement by military personnel.<br />
Defendants successfully sought to transfer the Saleh lawsuit, which<br />
was consolidated with the Ibrahim lawsuit in the <strong>District</strong> <strong>Court</strong> <strong>for</strong> the<br />
