a trustee shall be done in the same manner as an advertisement of a grant of<br />
letters and in the jurisdiction of the deceased settlor’s domicile. The<br />
advertisement shall include the fact of the trust’s existence and the trustee’s<br />
name and address. New paragraph (3) provides that the personal<br />
representative of the settlor of a revocable trust shall send the trustee copies of<br />
the proof of publication of the advertisement of the grant of letters. 42<br />
§ 7765. Subsections (a), (b) and (c) are repealed in favor of a new subsection (a.1),<br />
which provides that a trustee may resign with court approval, without court<br />
approval if authorized to resign by the trust instrument, or pursuant to a<br />
nonjudicial settlement agreement. New subsection (a.1) eliminates the<br />
distinction between corporate and individual trustees regarding resignation. 43<br />
§ 7780.3. Subsection (k.1) is new and permits a current beneficiary of a trust who has<br />
capacity to nominate another person to receive, on behalf of the current<br />
beneficiary, the required notice. This subsection specifies the conditions by<br />
which the trustee satisfies his or her duty to give the required notice. 44<br />
§ 7792. This section is amended to provide that § 3532(c), which concerns receipts,<br />
releases and refunding agreements, applies to a trustee. 45<br />
§§ 7901 - 7906. These new sections, which comprise new Chapter 79, codify the<br />
Charitable Instruments Act of 1971 (10 P.S. §§ 201-206). 46<br />
§ 8113. Subsection (f) is amended to change the reference from the Charitable<br />
Instruments Act of 1971 to 20 Pa.C.S. Chapter 79. 47<br />
