Contributions and any other contributions of the
above-referred three (3) employees of the 2 nd
Respondent resident in Kuala Lumpur; AND
(7) That this Honourable Court may declare that the
2 nd Respondent has breached its fiduciary duties
not to act in conflict with its duty to the Petitioner
and against the Petitioner’s interest in that the 2 nd
Respondent had abused its power by using the 1 st
Respondent’s money to pay the salaries including
bonuses, income taxes, employee provident fund
contributions and any other contributions of the
above-referred accounts staff of the 2 nd
Respondent working in its Lawas store; AND
(8) That this Honourable Court may declare that the
3 rd Respondent has breached the fiduciary duty she
owed to the 1 st Respondent as the director
responsible for implementing, allowing or
permitting the breaches of fiduciary duties stated
in paragraphs (5) to (7) above; AND
(9) That the 3 rd Respondent may be ordered to pay
damages for any damage or loss sustained by the
1 st Respondent because of the 3 rd Respondent’s
conduct; AND
(10) That the 2 nd Respondent cause its subsidiary or
related company Maestro Products Sdn Bhd to
withdraw and cancel all the unlawful interest, bank
and penalty charges charged on the 1 st Respondent;
AND
(11) That the 2 nd Respondent render restitution to the 1 st
Respondent of all the payments of salaries
including bonuses, income taxes, employee
provident fund contributions and any other
contributions paid for and on behalf of the abovereferred
three (3) employees of the 2 nd Respondent
residing in Kuala Lumpur; AND
