N A T I O N A L P O L I C Y<br />

Combating terrorism is <strong>on</strong>e of the priorities of the<br />

foreign and domestic policy of <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g>, the<br />

implementati<strong>on</strong> of which is impossible without<br />

c<strong>on</strong>stant development of the state legal system in<br />

the c<strong>on</strong>text of new threats and challenges.<br />

The law of <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> "On basis of nati<strong>on</strong>al security of<br />

<str<strong>on</strong>g>Ukraine</str<strong>on</strong>g>", adopted in June 2003, determines that the<br />

main directi<strong>on</strong>s of state security policy are the<br />

following:<br />

• <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g>’s participati<strong>on</strong> in measures to combat<br />

internati<strong>on</strong>al organised criminal groups and<br />

internati<strong>on</strong>al terrorism and counteracti<strong>on</strong> of the<br />

expansi<strong>on</strong> of nuclear weap<strong>on</strong>s and other<br />

weap<strong>on</strong>s of mass destructi<strong>on</strong> and their<br />

transportati<strong>on</strong>;<br />

• <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g>’s participati<strong>on</strong> in internati<strong>on</strong>al cooperati<strong>on</strong><br />

<strong>on</strong> combating internati<strong>on</strong>al criminality,<br />

terrorism, drug trafficking and illegal migrati<strong>on</strong>.<br />

Main principles of combating terrorism<br />

According to nati<strong>on</strong>al legislati<strong>on</strong>, combating<br />

terrorism is based <strong>on</strong> the following principles:<br />

• legality and steady adherence to the rights and<br />

freedoms of pers<strong>on</strong>s and citizens;<br />

• complex usage, with this purpose, of political,<br />

socio-ec<strong>on</strong>omic, informati<strong>on</strong>, propaganda and<br />

other possibilities;<br />

• priority of preventive measures;<br />

• priority of the protecti<strong>on</strong> of the life and rights of<br />

pers<strong>on</strong>s who are threatened by terrorist activity;<br />

• co-operati<strong>on</strong> <strong>on</strong> combating terrorism with foreign<br />

states and their law enforcement and special<br />

services, as well as with internati<strong>on</strong>al<br />

organisati<strong>on</strong>s combating terrorism.<br />

L E G A L F R A M E W O R K<br />

The legal basis for the fight against terrorism is<br />

provided by the C<strong>on</strong>stituti<strong>on</strong> of <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g>, the Criminal<br />

Code of <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g>, the Law of <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> "On combating<br />

terrorism" and other Laws of <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g>, internati<strong>on</strong>al<br />

agreements, orders and decrees of the President of<br />

<str<strong>on</strong>g>Ukraine</str<strong>on</strong>g>, resoluti<strong>on</strong>s and decisi<strong>on</strong>s of the Cabinet of<br />

Ministers of <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g>, as well as other legal acts that<br />

are adopted for the implementati<strong>on</strong> of the laws of<br />

<str<strong>on</strong>g>Ukraine</str<strong>on</strong>g>.<br />

The series of measures <strong>on</strong> the implementati<strong>on</strong> of<br />

internati<strong>on</strong>al agreements and appropriate resoluti<strong>on</strong>s<br />

of UN Council was c<strong>on</strong>ducted with the purpose of<br />

establishing an effective counter-terrorism system.<br />

In particular, the Verhovna Rada (Parliament) of<br />

<str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> has adopted a new Criminal Code that<br />

includes an article entitled "<strong>Terrorist</strong> act" and about<br />

thirty other articles of an anti-terrorist orientati<strong>on</strong>,<br />

that also embrace questi<strong>on</strong>s <strong>on</strong> combating this<br />

offence, and a special Law "On combating<br />

terrorism", which entered into force <strong>on</strong> 20 April<br />

2003, that defines the legal and organisati<strong>on</strong>al basis<br />

of the fight against this dangerous phenomena.<br />

Furthermore, the Law of <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> "On introducing<br />

amendments into some legislative act of <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g>”<br />

was adopted as a result of the adopti<strong>on</strong> of the Law<br />

of <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> "On combating terrorism" which made<br />

changes to the Criminal Procedural Code of <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g><br />

and to, inter alia, the Laws of <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> "On operativeresearch<br />

activity", "On security service of <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g>",<br />

"On State Border Service of <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g>" and "On<br />

regulati<strong>on</strong> of nuclear security questi<strong>on</strong>s".<br />

The Law of <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> "On combating terrorism" sets<br />

out a list of unlawful terrorist-related acti<strong>on</strong>s, which<br />

meet the requirements of UN Security Council<br />

Resoluti<strong>on</strong> 1373 (2001).<br />

The Anti-terrorist Activities Programme for 2005-<br />

2007, approved by a decree of the President of<br />

<str<strong>on</strong>g>Ukraine</str<strong>on</strong>g>, aims at the further development of legal<br />

regulati<strong>on</strong>s in the field of combating terrorism and<br />

the improvement of the organisati<strong>on</strong>al and<br />

instituti<strong>on</strong>al system.<br />

The relevant central executive bodies of <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> are<br />

working <strong>on</strong> a draft Law of <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> “On combating<br />

extremism”.<br />

According to the internati<strong>on</strong>al treaties it has<br />

c<strong>on</strong>cluded, <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> co-operates in the fight against<br />

terrorism with foreign states and their law<br />

enforcement and special services, as well as with<br />

internati<strong>on</strong>al organisati<strong>on</strong>s working in the fight<br />

against terrorism.<br />

Very active work <strong>on</strong> enhancing the legal basis in this<br />

field is being carried out together with other<br />

countries.


Liability<br />

<str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> sticks to the principle that punishment for<br />

participati<strong>on</strong> in terrorist activities is inevitable.<br />

The Ukrainian legislati<strong>on</strong> in force qualifies terrorism<br />

as a socially dangerous activity, that is the<br />

c<strong>on</strong>scious, intenti<strong>on</strong>al use of violence, by taking<br />

hostages, starting fires, murdering, using torture,<br />

intimidating the populati<strong>on</strong> and authorities or<br />

otherwise putting at risk the life or health of<br />

individuals, or by threatening to commit such crimes,<br />

with a view to achieving criminal goals.<br />

The Criminal Code of <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> 1 qualifies terrorism as<br />

<strong>on</strong>e of the most serious crimes and envisages a<br />

severe penalty for the commissi<strong>on</strong> of terrorist acts,<br />

including the most severe penalty, life impris<strong>on</strong>ment,<br />

as stipulated by the legislati<strong>on</strong> in force.<br />

According to nati<strong>on</strong>al legislati<strong>on</strong>, pers<strong>on</strong>s accused of<br />

terrorist activities are brought to justice according to<br />

the procedures envisaged by the law.<br />

The investigati<strong>on</strong> of all cases, including those<br />

c<strong>on</strong>nected with terrorism, is c<strong>on</strong>ducted exclusively<br />

within the framework of the Code of Criminal<br />

Procedure of <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g>.<br />

Furthermore, an organisati<strong>on</strong> resp<strong>on</strong>sible for the<br />

commissi<strong>on</strong> of terrorist acts and which has been<br />

recognised by the court as a terrorist organisati<strong>on</strong> is<br />

subject to liquidati<strong>on</strong> with c<strong>on</strong>fiscati<strong>on</strong> of its<br />

property.<br />

In the case of a Ukrainian court decisi<strong>on</strong> finding the<br />

activity of an organisati<strong>on</strong> (subsidiary and<br />

representative offices) to be terrorist, taking into<br />

account its internati<strong>on</strong>al and legal obligati<strong>on</strong>s and<br />

registrati<strong>on</strong> outside <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g>, the activity of this<br />

organisati<strong>on</strong> should be prohibited, its Ukrainian office<br />

(subsidiary or representative office) should be<br />

liquidated <strong>on</strong> the basis of a court decisi<strong>on</strong> and the<br />

organisati<strong>on</strong>’s property <strong>on</strong> the territory of <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g><br />

should be c<strong>on</strong>fiscated.<br />

Applicati<strong>on</strong>s to bring organisati<strong>on</strong>s involved in<br />

terrorist activities to justice should be submitted to<br />

the court by the General Prosecutor of <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g>, or by<br />

regi<strong>on</strong>al or city prosecutors, in accordance with the<br />

procedures stipulated be the law.<br />

Victim protecti<strong>on</strong><br />

With the aim of protecting natural or juristic pers<strong>on</strong>s<br />

who are the victims of terrorist attacks, Ukrainian<br />

legislati<strong>on</strong> provides for the compensati<strong>on</strong> of damage<br />

caused by the terrorist attack.<br />

At the same time, where necessary, they are<br />

provided with psychological, medical or legal<br />

support, accommodati<strong>on</strong>, professi<strong>on</strong>al rehabilitati<strong>on</strong><br />

and employment.<br />

Preventi<strong>on</strong> of financing of terrorism<br />

The preventi<strong>on</strong> of the financing of terrorism is of<br />

great importance to the fight against terrorism. In<br />

order to implement the requirements of UN Security<br />

Council Resoluti<strong>on</strong>s 1267 1999), 1333 (2000),<br />

1373 (2001), 1390 (2002), 1455 (2003), <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> has<br />

made arrangements to counter the financing of<br />

terrorism.<br />

Thus, the Law of <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> "On banks and bank<br />

activity" 2 provides for the possibility of arresting the<br />

funds and other assets of juristic and natural<br />

pers<strong>on</strong>s that are held in a bank, and of preventing<br />

payments to the accounts of juristic and natural<br />

pers<strong>on</strong>s.<br />

The Law of <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> "On m<strong>on</strong>ey laundering<br />

preventi<strong>on</strong> and counteracti<strong>on</strong>'' places an obligati<strong>on</strong><br />

<strong>on</strong> legal entities and natural pers<strong>on</strong>s who suspect or<br />

have reas<strong>on</strong> to suspect that financial operati<strong>on</strong>s are<br />

c<strong>on</strong>nected with, related to or intended for the<br />

financing of terrorist activities, to report such<br />

financial operati<strong>on</strong>s immediately to the special body<br />

authorised by the executive power <strong>on</strong> countering<br />

m<strong>on</strong>ey laundering and terrorist financing - the State<br />

Committee <strong>on</strong> Financial M<strong>on</strong>itoring<br />

(Derzhfinm<strong>on</strong>itoring) or to the law enforcement<br />

authorities as defined in legislati<strong>on</strong> (Security Service<br />

of <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g>).<br />

At the same time, changes have been made to the<br />

Criminal Code of <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> and other legislati<strong>on</strong> <strong>on</strong><br />

combating m<strong>on</strong>ey laundering and terrorist financing.<br />

In order to fulfill the requirements of UN Security<br />

Council Resoluti<strong>on</strong>s 1267(1999), 1333 (2000), 1390<br />

(2002), 1455(2003), a number of Resoluti<strong>on</strong>s have<br />

been adopted by the Cabinet of Ministers of <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g><br />

and there are measures <strong>on</strong> blocking the m<strong>on</strong>ey and<br />

other financial resources of Osama Ben Laden and<br />

his adherents, where this is detected.<br />

The draft Law of <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> "On introducing<br />

amendments into the Law of <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> "On preventi<strong>on</strong><br />

of m<strong>on</strong>ey laundering and its counteracti<strong>on</strong>"” was<br />

elaborated to further implement the 40<br />

recommendati<strong>on</strong>s of the Financial Acti<strong>on</strong> Task Force<br />

(FATF) and its special recommendati<strong>on</strong>s <strong>on</strong> terrorist<br />

financing. This draft law takes into account the<br />

provisi<strong>on</strong>s of the Internati<strong>on</strong>al C<strong>on</strong>venti<strong>on</strong> for the<br />

Suppressi<strong>on</strong> of the Financing of Terrorism and of UN<br />

Security Council Resoluti<strong>on</strong> 1373 (2001). This<br />

instrument is being coordinated by the relevant<br />

interested central executive bodies of <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g>.<br />

On the instructi<strong>on</strong>s of the Ukrainian Government, the<br />

ministries and departments c<strong>on</strong>cerned with this<br />

problem take measures to improve legislati<strong>on</strong> <strong>on</strong><br />

blocking of m<strong>on</strong>ey that bel<strong>on</strong>gs to legal entities and<br />

natural pers<strong>on</strong>s engaged in terrorist activities.<br />

In particular, legal agreements/c<strong>on</strong>tracts aimed at<br />

m<strong>on</strong>ey laundering and terrorist financing are<br />

declared void.<br />

Legal entities which c<strong>on</strong>duct financial operati<strong>on</strong>s<br />

related to m<strong>on</strong>ey laundering and terrorist financing,<br />

are dissolved by the court.<br />

The Criminal Code of <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> foresees a penalty of<br />

15 years’ impris<strong>on</strong>ment for providing financial or<br />

other assistance in the formati<strong>on</strong> or activities of<br />

terrorist groups or organisati<strong>on</strong>s.<br />

Individuals found guilty of laundering m<strong>on</strong>ey gained<br />

as a result of terrorist activities are sentenced to 15<br />

years’ impris<strong>on</strong>ment with the expropriati<strong>on</strong> of the<br />

criminally gained assets.<br />

<str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> co-operates with FATF, the Edgem<strong>on</strong>t<br />

financial intelligence group, the Council of Europe<br />

Select Committee of Experts <strong>on</strong> the Evaluati<strong>on</strong> of<br />

Anti-M<strong>on</strong>ey Laundering Measures (MONEYVAL), the<br />

Eurasian Group <strong>on</strong> m<strong>on</strong>ey laundering counteracti<strong>on</strong>,<br />

and other law enforcement and special foreign<br />

bodies in order to raise the level of co-operati<strong>on</strong> with<br />

other countries in the sphere of the fight against<br />

m<strong>on</strong>ey laundering.<br />

To date, 23 internati<strong>on</strong>al interdepartmental<br />

agreements have been c<strong>on</strong>cluded by the<br />

Derzhfinm<strong>on</strong>itoring with foreign financial intelligence<br />

services. Work <strong>on</strong> enlarging the legislative basis in<br />

this sphere with other states is <strong>on</strong>going.<br />

<str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> is eager to play an active part in<br />

internati<strong>on</strong>al co-operati<strong>on</strong> in the field of the fight<br />

against m<strong>on</strong>ey laundering and terrorist financing<br />

with the competent bodies of foreign countries and<br />

internati<strong>on</strong>al organisati<strong>on</strong>s.<br />

I N S T I T U T I O N A L F R A M E W O R K<br />

The Cabinet of Ministers of <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> is competent to<br />

make the arrangements for combating terrorism in<br />

<str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> and to provide the necessary forces, means<br />

and resources.<br />

The central executive bodies take part in combating<br />

terrorism within their field of competence, which is<br />

defined by law and other legal acts.<br />

On 11 December 1998, the Anti-<strong>Terrorist</strong> Centre<br />

(ATC) at the Security Service of <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> was<br />

established by a Decree of the President of <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g><br />

with the purpose of further improving the nati<strong>on</strong>al<br />

anti-terrorist system. The main task of the Centre is<br />

to coordinate executive governmental bodies'<br />

activities in the preventi<strong>on</strong> and suppressi<strong>on</strong> of<br />

terrorist acts against statesmen, essential<br />

infrastructure facilities, high-risk targets, and acts<br />

which threaten the life and health of a large number<br />

of people.<br />

The Security Service of <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> is entrusted with the<br />

tasks of preventing, investigating, suppressing and<br />

detecting crimes in the field of terrorism.<br />

According to the Law of <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> "On combating<br />

terrorism", the ATC coordinates the activities of the<br />

Ministries and Departments of <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> in the<br />

executi<strong>on</strong> of a complex programme aimed at<br />

widening <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g>’s diplomatic, ec<strong>on</strong>omic and military<br />

potential to counter threats c<strong>on</strong>nected with<br />

internati<strong>on</strong>al terrorism.<br />

The Centre has now developed an organisati<strong>on</strong>al and<br />

legal mechanism which comprises the forces and<br />

means of the ministries and departments (17 in<br />

total) involved in carrying out antiterrorist<br />

operati<strong>on</strong>s.<br />

In order to ensure the effective usage of the<br />

available resources, the most sensitive objects were<br />

categorised and preventive plans <strong>on</strong> the carrying out<br />

of antiterrorist operati<strong>on</strong>s were drafted to take into<br />

account the particular forces and means. Their<br />

implementati<strong>on</strong> is being carried out within the<br />

framework of complex training (about 100 annually),<br />

including training <strong>on</strong> an internati<strong>on</strong>al level. Since<br />

2005, the Centre has initiated training <strong>on</strong> "sudden<br />

introductory data".<br />

According to the Edict of the President of <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g><br />

"On procedure of co-operati<strong>on</strong> with internati<strong>on</strong>al<br />

antiterrorist organisati<strong>on</strong>s", the ATC and the Ministry<br />

of Foreign Affairs of <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> are entrusted with the<br />

task of coordinating the bodies of <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g>’s<br />

executive power in the fulfilment of its internati<strong>on</strong>al<br />

obligati<strong>on</strong>s in the field of combating terrorism.<br />

Internati<strong>on</strong>al organisati<strong>on</strong>s and representatives of<br />

foreign states respect <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g>’s experience and<br />

accept it as a serious partner in the fight against<br />

terrorism. Clear evidence of this fact lies in the<br />

numerous requests received by the special services'<br />

chiefs for documents c<strong>on</strong>cerning the functi<strong>on</strong>ing of<br />

the Centre, the United Nati<strong>on</strong>s Office <strong>on</strong> Drugs and<br />

Crime’s (Vienna, Austria) identificati<strong>on</strong> of <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> as<br />

a state which can serve as a model for CIS members<br />

in view of its organisati<strong>on</strong>al measures <strong>on</strong> combating<br />

terrorism and positive resp<strong>on</strong>ses from NATO


parliamentarians, as well as the creati<strong>on</strong> of<br />

coordinati<strong>on</strong> instituti<strong>on</strong>s similar to the Anti-<strong>Terrorist</strong><br />

Centre in many countries of the world.<br />

With a view to improving co-operati<strong>on</strong> <strong>on</strong> combating<br />

terrorism and coordinating measures in the<br />

implementati<strong>on</strong> of state policy in the field of the<br />

preventi<strong>on</strong> and suppressi<strong>on</strong> of the critical situati<strong>on</strong>s<br />

that emerged as the result of extremist and terrorist<br />

activities in November 2002, in accordance with the<br />

Decree of the President of <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g>, the Anti-Crisis<br />

Centre was created. The President of <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> is at<br />

the head of this Centre. The headquarters of the<br />

Anti-<strong>Terrorist</strong> Centre became its working body.<br />

Thus in <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> a determined, clear and logicallystipulated<br />

structure of specialised state bodies has<br />

been created to organise and coordinate the fight<br />

against terrorism. This structure is supported by a<br />

flexible and operati<strong>on</strong>al system of forces, measures<br />

and a legally-based scheme of anti-terrorist<br />

operati<strong>on</strong>s management, which can also deal with<br />

possible crisis situtati<strong>on</strong>s resulting from terrorist<br />

activities.<br />

C<strong>on</strong>trol and supervisi<strong>on</strong> of the legality of the<br />

fight against terrorism<br />

In accordance with the C<strong>on</strong>stituti<strong>on</strong> of <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g>, the<br />

Verhovna Rada of <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> is resp<strong>on</strong>sible for ensuring<br />

that the fight against terrorism is carried with due<br />

respect for the legislati<strong>on</strong> in force.<br />

At the same time, the President and the Cabinet of<br />

Ministers of <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> supervise the countering of<br />

terrorists in accordance with the C<strong>on</strong>stituti<strong>on</strong> of<br />

<str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> and Ukrainian law.<br />

Supervisi<strong>on</strong> of the respect for legislati<strong>on</strong> by the<br />

bodies taking part in anti-terrorist acti<strong>on</strong> is carried<br />

out by the Attorney General of <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> and by the<br />

empowered attorneys in accordance with Ukrainian<br />

law.<br />

I N T E R N A T I O N A L C O - O P E R A T I O N<br />

Exchanges of informati<strong>on</strong><br />

With a view to providing relevant informati<strong>on</strong> to the<br />

nati<strong>on</strong>al Anti-<strong>Terrorist</strong> and Anti-Crisis Centres, all<br />

possible measures are currently being undertaken in<br />

order to implement the telecommunicati<strong>on</strong> element<br />

of the joint automated informati<strong>on</strong> system <strong>on</strong><br />

combating terrorism - the System of Protected<br />

Electr<strong>on</strong>ic Mail.<br />

With a view to preventing and effectively combating<br />

terrorism, <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> has established effective<br />

operati<strong>on</strong>al exchanges of informati<strong>on</strong> <strong>on</strong> questi<strong>on</strong>s<br />

c<strong>on</strong>nected with combating internati<strong>on</strong>al terrorism.<br />

Mutual bilateral exchanges of informati<strong>on</strong> with<br />

foreign states <strong>on</strong> problems c<strong>on</strong>nected with<br />

combating internati<strong>on</strong>al terrorism are carried out <strong>on</strong><br />

the basis of signed agreements.<br />

In accordance with the requirements of nati<strong>on</strong>al<br />

legislati<strong>on</strong> and its internati<strong>on</strong>al legal commitments,<br />

<str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> provides informati<strong>on</strong> to foreign states <strong>on</strong><br />

problems c<strong>on</strong>nected with combating internati<strong>on</strong>al<br />

terrorism <strong>on</strong> the basis of requests.<br />

At the same time, informati<strong>on</strong> <strong>on</strong> these problems<br />

can be provided without a prior request from a<br />

foreign country if it does not hinder the pre-trial<br />

inquiry or court hearing of a case and if it can help<br />

the competent bodies of the foreign state in<br />

preventing terrorist attacks.<br />

Work <strong>on</strong> c<strong>on</strong>cluding agreements with other states <strong>on</strong><br />

the mutual recogniti<strong>on</strong> of lists of named<br />

organisati<strong>on</strong>s and pers<strong>on</strong>s is c<strong>on</strong>ducted with the aim<br />

of creating an appropriate legal bases for the use of<br />

proper sancti<strong>on</strong>s.<br />

In this case, great importance is attached to<br />

exchanges of informati<strong>on</strong> <strong>on</strong> the possible<br />

preparati<strong>on</strong> of terrorist attacks and <strong>on</strong> terrorist<br />

organisati<strong>on</strong>s and people involved in terrorist<br />

activities.<br />

Nowadays, the exchange of informati<strong>on</strong> <strong>on</strong> the<br />

above-menti<strong>on</strong>ed problems is c<strong>on</strong>ducted most<br />

actively within the framework of the CIS member<br />

states’ Anti-<strong>Terrorist</strong> Centre.<br />

The work <strong>on</strong> exchanges of informati<strong>on</strong> is carried out<br />

within the framework of the GUUAM Virtual Centre<br />

and GUUAM Interstate Informati<strong>on</strong> Management<br />

System.<br />

Measures to further improve exchanges of<br />

informati<strong>on</strong> between the security services and law<br />

enforcement bodies of other states are implemented<br />

for the purposes of preventi<strong>on</strong> and of providing an<br />

operati<strong>on</strong>al resp<strong>on</strong>se to any indicati<strong>on</strong>s of terrorist<br />

attacks.<br />

Mutual legal assistance and extraditi<strong>on</strong><br />

In the interests of ensuring the security of<br />

individuals, society and the state, <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> pursues<br />

within its territory pers<strong>on</strong>s involved in terrorist<br />

activity. This includes cases where terrorist attacks<br />

or crimes of a terrorist nature are planned or<br />

committed bey<strong>on</strong>d <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g>’s borders, but may cause<br />

damage to <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g>, and other cases provided for by<br />

internati<strong>on</strong>al treaties.


The Law of <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> "On combating terrorism" 3<br />

provides for the extraditi<strong>on</strong> of individuals who take<br />

part in terrorist activities. The extraditi<strong>on</strong> of these<br />

individuals with the aim of instituting criminal<br />

proceedings against them and of executing<br />

enforcement acts of foreign states is carried out in<br />

accordance with Ukrainian legislati<strong>on</strong> and with the<br />

obligati<strong>on</strong>s assumed by <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> up<strong>on</strong> its ratificati<strong>on</strong><br />

of the European C<strong>on</strong>venti<strong>on</strong> <strong>on</strong> Extraditi<strong>on</strong> (1957),<br />

the European C<strong>on</strong>venti<strong>on</strong> <strong>on</strong> the Suppressi<strong>on</strong> of<br />

Terrorism (1977), and other internati<strong>on</strong>al treaties<br />

that are obligatory according to the decisi<strong>on</strong> of<br />

Verhovna Rada of <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g>, and <strong>on</strong> the basis of<br />

mutuality.<br />

<str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> undertakes the necessary measures <strong>on</strong><br />

applying appropriate sancti<strong>on</strong>s to organisati<strong>on</strong>s and<br />

individuals involved in terrorist activities listed by the<br />

UN Security Council.<br />

Measures at internati<strong>on</strong>al level<br />

In accordance with the internati<strong>on</strong>al treaties<br />

c<strong>on</strong>cluded by <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g>, it co-operates in the fight<br />

against terrorism with foreign states, law<br />

enforcement bodies and special services, as well as<br />

with internati<strong>on</strong>al organisati<strong>on</strong>s combating terrorism.<br />

<str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> is a party to all 12 of the universal antiterrorist<br />

c<strong>on</strong>venti<strong>on</strong>s, including those <strong>on</strong> countering<br />

the financing of terrorism, and the European<br />

C<strong>on</strong>venti<strong>on</strong> <strong>on</strong> the Suppressi<strong>on</strong> of Terrorism (1977).<br />

Steps are currently being taken toward the<br />

ratificati<strong>on</strong> of the Protocol amending the European<br />

C<strong>on</strong>venti<strong>on</strong> <strong>on</strong> the Suppressi<strong>on</strong> of Terrorism of 1977,<br />

signed <strong>on</strong> 15 May 2003.<br />

At the Third Summit of Heads of State and<br />

Government of the Council of Europe (Warsaw, May<br />

2005), <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> signed the Council of Europe<br />

C<strong>on</strong>venti<strong>on</strong> <strong>on</strong> the Preventi<strong>on</strong> of Terrorism.<br />

At present, <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> is examining the possibility of<br />

signing the UN Internati<strong>on</strong>al Treaty for the<br />

Suppressi<strong>on</strong> of Acts of Nuclear Terrorism, the draft<br />

of which was adopted <strong>on</strong> 13 April 2005 during the<br />

plenary sessi<strong>on</strong> of the UN General Assembly.<br />

<str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> recognises the importance of the<br />

development of internati<strong>on</strong>al co-operati<strong>on</strong> <strong>on</strong><br />

combating terrorism and collaborates actively with<br />

internati<strong>on</strong>al organisati<strong>on</strong>s. In order to execute the<br />

relevant UN Security Council resoluti<strong>on</strong>s and<br />

transpose the c<strong>on</strong>venti<strong>on</strong>s <strong>on</strong> countering terrorism<br />

into its nati<strong>on</strong>al legislati<strong>on</strong>, <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> co-operates with<br />

the UN Security Council <strong>Counter</strong>-Terrorism<br />

Committee and annually submits reports <strong>on</strong> the<br />

acti<strong>on</strong> it has taken.<br />

Internati<strong>on</strong>al co-operati<strong>on</strong> in the field of combating<br />

terrorism aims at the implementati<strong>on</strong> of anti-terrorist<br />

measures, which are foreseen by the EU Acti<strong>on</strong> Plan<br />

<strong>on</strong> Combating Terrorism in the sphere of justice and<br />

home affairs, as well by the special <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g>-NATO<br />

plan.<br />

At present work is being undertaken <strong>on</strong> the<br />

c<strong>on</strong>clusi<strong>on</strong> of security agreements and an agreement<br />

<strong>on</strong> Ukrainian participati<strong>on</strong> in EU crisis management<br />

operati<strong>on</strong>s in the c<strong>on</strong>text of the EU Security and<br />

Defence Policy. The implementati<strong>on</strong> of these<br />

agreements will increase co-operati<strong>on</strong> between<br />

<str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> and the EU in the security sphere.<br />

The cerem<strong>on</strong>y for the signing, by the Foreign<br />

Minister of <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> and the Secretary General of<br />

NATO, of an agreement (in the form of an exchange<br />

of letters) between <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> and NATO <strong>on</strong> the terms<br />

and c<strong>on</strong>diti<strong>on</strong>s for <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g>’s participati<strong>on</strong> in NATO’s<br />

"Active Efforts" operati<strong>on</strong> took place <strong>on</strong> 21 April<br />

2005. The agreement covers questi<strong>on</strong>s c<strong>on</strong>nected<br />

with appropriate Ukrainian support in the carrying<br />

out of naval operati<strong>on</strong>s in the Mediterranean Sea.<br />

<str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> takes part in the work of the CIS Anti-<br />

<strong>Terrorist</strong> Centre, which is the standing specialised<br />

branch body resp<strong>on</strong>sible for coordinating the<br />

interacti<strong>on</strong> between the competent bodies of CIS<br />

member states in the field of countering terrorism.<br />

On 7 April 2004, the Verhovna Rada of <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g><br />

ratified the "Protocol about the approval of Statute<br />

regulating the order of organisati<strong>on</strong> and c<strong>on</strong>ducti<strong>on</strong><br />

of comm<strong>on</strong> antiterrorist measures <strong>on</strong> the territory of<br />

CIS member-states" with the aim of developing<br />

<str<strong>on</strong>g>Ukraine</str<strong>on</strong>g>’s co-operati<strong>on</strong> within the CIS framework.<br />

<str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> signed the Agreement <strong>on</strong> the creati<strong>on</strong> of the<br />

GUUAM Virtual Centre in the field of the fight against<br />

terrorism, organised crime, drug proliferati<strong>on</strong> and<br />

other dangerous crimes and the GUUAM Interstate<br />

Informati<strong>on</strong> Management System (HAS).<br />

At present, the states have finished c<strong>on</strong>ducting<br />

organisati<strong>on</strong>al measures and begun the practical<br />

work of the Virtual Centre and the HAS.<br />

The State Financial M<strong>on</strong>itoring Committee of <str<strong>on</strong>g>Ukraine</str<strong>on</strong>g><br />

has adopted 24 Memoranda of mutual understanding<br />

with foreign financial intelligence services with<br />

regard to exchanges of financial informati<strong>on</strong> in the<br />

sphere of m<strong>on</strong>ey laundering and the financing of<br />

terrorism.


In accordance with internati<strong>on</strong>al agreements,<br />

<str<strong>on</strong>g>Ukraine</str<strong>on</strong>g> may take part in comm<strong>on</strong> anti-terrorist<br />

measures by means of assistance to foreign states or<br />

interstate associati<strong>on</strong>s in the re-deployment of<br />

troops, special anti-terrorist formati<strong>on</strong>s,<br />

transportati<strong>on</strong> of weap<strong>on</strong>s or by the provisi<strong>on</strong> of its<br />

own forces and means in accordance with domestic<br />

legislati<strong>on</strong>.<br />
