“no ac on.” An “ac on” consists of a no ce of intent, addi onal inves ga on, or expert<br />

reviewer(s). A “no ac on” consists of closing the c<strong>as</strong>e.<br />

Depending on the result of an inves ga on, a c<strong>as</strong>e may not be subject to a disciplinary<br />

ac on. However, if the LEC determines that there are suffi cient facts and legal<br />

grounds to proceed, it will direct the Regula on Department staff or the OSBEELS’<br />

Assistant A orney General to prepare a no ce of intent for disciplinary ac on. Such<br />

no ces are governed by the Oregon Administra ve Procedures Act, namely the ORS<br />

183.415. The no ce of intent is a formal no ce sent to the respondent, sta ng the<br />

ac ons that are in viola on of OSBEELS regulatory authority, a proposed disciplinary<br />

ac on, and informs the respondent of their rights to a hearing. Addi onally, complainants<br />

may be requested to provide tes mony for the c<strong>as</strong>e.<br />
