<strong>of</strong> public service. Generous support from our<br />

alumni and friends is a crucial ingredient in<br />

making this great law school even better. You<br />

are central to this success.<br />

initiatives throughout the <strong>University</strong> <strong>of</strong> <strong>Maine</strong> System. The <strong>Law</strong> <strong>School</strong>, in collaboration<br />

with the Muskie <strong>School</strong> for Public Service (<strong>University</strong> <strong>of</strong> Southern <strong>Maine</strong>), the Margaret<br />

Chase Smith Policy Center (<strong>University</strong> <strong>of</strong> <strong>Maine</strong> at Orono), and the <strong>Maine</strong> Development<br />

Foundation, is establishing a non-partisan public policy center in Augusta to assist<br />

legislators and other public <strong>of</strong>ficials.<br />

Our students continue to shine, with our graduates achieving over a 90% pass rate on<br />

the most recent <strong>Maine</strong> Bar Exam and launching a wide array <strong>of</strong> careers. The <strong>Maine</strong> <strong>Law</strong><br />

<strong>School</strong> continues to be a destination point — for diverse students, excellent faculty,<br />

and visiting scholars and lecturers. Last Fall, international law expert and Yale <strong>Law</strong><br />

<strong>School</strong> Dean Harold Koh delivered a lecture on restoring our human rights reputation.<br />

Kenneth Feinberg shared a moving account <strong>of</strong> his experience as Special Master<br />

for the Federal September 11th Victim Compensation Fund. Former U.S. Senator<br />

George Mitchell was our Graduation keynote speaker in 2007, a role filled in 2008 by<br />

In this <strong>Report</strong>, we look back and look forward. We<br />

retired U.S. Circuit Court Judge Frank C<strong>of</strong>fin. Judith Kaye, Chief Judge <strong>of</strong> New York,<br />

will lecture on law and public service in Fall 2008. Laura Underkuffler, distinguished<br />

celebrate the impressive results <strong>of</strong> the <strong>Law</strong> <strong>School</strong>’s<br />

pr<strong>of</strong>essor at Duke <strong>University</strong> <strong>Law</strong> <strong>School</strong>, will return to <strong>Maine</strong> <strong>Law</strong> next semester as<br />

Directors<br />

2006-2007 <strong>Annual</strong> Fund campaign and foreshadow<br />

the continuing growth in philanthropic support for the<br />

<strong>Law</strong> <strong>School</strong>. Pr<strong>of</strong>iles <strong>of</strong> selected alumni and friends<br />

reflect the strength and commitment <strong>of</strong> our extended<br />

a visiting faculty member, teaching our first-year property law class for a third year in<br />

a row. And, our core faculty sustain <strong>Maine</strong> <strong>Law</strong>’s vibrant educational program and<br />

generate cutting edge scholarship in step with national and global issues.<br />

“Our engagement regionally and<br />

community.<br />

Rebekah Smith (’98) and Patrick Mellor (’98), who<br />

met in law school, sustain the tradition <strong>of</strong> public<br />

service and look back to their rich experience at<br />

<strong>Maine</strong> <strong>Law</strong>. Dr. Edward David (’87), <strong>Maine</strong>’s Deputy<br />

Chief Medical Examiner, made a major donation this<br />

year to recruit and retain distinguished pr<strong>of</strong>essors<br />

and reflects on the value <strong>of</strong> his education. Ira<br />

Waldman (’76) credits his law school years at <strong>Maine</strong><br />

for his successful career in real estate practice in<br />

California. Roger Putnam, recipient <strong>of</strong> the 2008<br />

Muskie Access to Justice Award, reflects the best <strong>of</strong><br />

<strong>Maine</strong> <strong>Law</strong> <strong>School</strong>’s values with a lifetime <strong>of</strong> service<br />

to justice in <strong>Maine</strong>. And, the Bernsteins make it a<br />

family affair, with Louis, Roz, and Andrew Bernstein<br />

As we celebrate the success <strong>of</strong> the <strong>Annual</strong> Fund campaign, we underscore the<br />

importance <strong>of</strong> philanthropy in the wake <strong>of</strong> diminishing government support. In 2006-07,<br />

we exceeded our goal <strong>of</strong> $315,000, with over 800 donations and more than a<br />

few five-figure gifts. We anticipate even greater success as we near the end <strong>of</strong> the<br />

2007-08 campaign. Thanks to you and your generous support, we are able to fund<br />

pr<strong>of</strong>essorships and research grants to retain stellar faculty. The <strong>Annual</strong> Fund enables<br />

us to provide scholarships and attract the best and brightest students from <strong>Maine</strong><br />

and from away. Summer fellowships support law student placement in public interest<br />

legal work, locally and around the globe. We recently launched a new endowment<br />

fund in honor <strong>of</strong> Vincent L. McKusick, former Chief Justice <strong>of</strong> the <strong>Maine</strong> Supreme<br />

Judicial Court, designed to provide support at the <strong>Maine</strong> <strong>Law</strong> <strong>School</strong> for students<br />

from socio-economically disadvantaged backgrounds. With a goal <strong>of</strong> increasing<br />

diversity among law students and lawyers in <strong>Maine</strong>, the Portland law firm <strong>of</strong> Pierce<br />

Atwood has pledged the first $100,000 in our campaign to raise significantly more in<br />

the coming years.<br />

The Bernstein family’s roots in <strong>Maine</strong>’s legal community<br />

extend back to 1915, when Israel Bernstein opened<br />

his solo practice in downtown Portland. He was later<br />

joined by his brother, Louis, then his son Sumner.<br />

Bernstein, Shur, Sawyer, and Nelson, created in<br />

1964, has since become one <strong>of</strong> the leading firms in<br />

Northern New England.<br />

The family connection to <strong>Maine</strong> <strong>Law</strong> began in the<br />

1930s when Louis attended Portland <strong>University</strong> <strong>Law</strong><br />

<strong>School</strong>, a predecessor to <strong>Maine</strong> <strong>Law</strong>. Fifty years later,<br />

Sumner’s wife Roz (’86) attained a life-long goal by<br />

obtaining a law degree at the age <strong>of</strong> 57. “It was so<br />

rewarding to be part <strong>of</strong> a new era when women were<br />

beginning to see law as a possible career.”<br />

Roz and the late Sumner Bernstein are among<br />

Portland’s leading philanthropists, contributing to the<br />

<strong>Law</strong> <strong>School</strong> as well as many educational, arts and<br />

cultural institutions throughout the Portland area.<br />

“One <strong>of</strong> the joys <strong>of</strong> living in Portland and in <strong>Maine</strong> is<br />

that one individual can make a big difference,” said<br />

Roz. “Indeed, it’s a great reason to attend <strong>Maine</strong> <strong>Law</strong>.<br />

Portland is one <strong>of</strong> America’s best small cities.”<br />

Roz serves on the Univeristy <strong>of</strong> <strong>Maine</strong> <strong>School</strong> <strong>of</strong><br />

<strong>Law</strong> Foundation Board, which she joined in August <strong>of</strong><br />

2005. In addition, she served as founding chair <strong>of</strong> the<br />

<strong>University</strong> <strong>of</strong> Southern <strong>Maine</strong> Board <strong>of</strong> Visitors, and<br />

Roz and Sumner were both founding members <strong>of</strong> the <strong>Law</strong><br />

<strong>School</strong> Board <strong>of</strong> Visitors, a board on which Roz still serves<br />

today. In 1997, she received the L. Kinvin Wroth Distinguished<br />

Alumna Award.<br />

Giving Back: A Family Approach<br />

Among the family’s early contributions to <strong>Maine</strong> <strong>Law</strong><br />

were Louis Bernstein’s endowment <strong>of</strong> the <strong>Law</strong> <strong>School</strong>’s<br />

District Court Internship Program and the Israel Bernstein<br />

Scholarship Fund, which was later changed to include<br />

Sumner’s name, posthumously. In 2004, the <strong>School</strong><br />

established the Sumner T. Bernstein Pr<strong>of</strong>essorship <strong>of</strong> <strong>Law</strong> to<br />

honor Sumner’s public and pr<strong>of</strong>essional service, his vibrant<br />

legal practice, community activism, and contributions to<br />

<strong>Maine</strong> <strong>Law</strong>. Beth Bernstein Schneider, Roz and Sumner’s<br />

daughter, hopes this pr<strong>of</strong>essorship will promote<br />

excellence in teaching and research, and foster<br />

intellectual exchange between faculty and students.<br />

“My father loved teaching in his pr<strong>of</strong>essional and<br />

personal life. Rarely a day went by in the Bernstein<br />

house without what is now called a ‘teachable<br />

moment.’ He reveled in working with kindergarten<br />

students and with law students and faculty, and this<br />

openness will, I hope, be the hallmark <strong>of</strong> the Sumner<br />

T. Bernstein pr<strong>of</strong>essors.” Schneider is the Director <strong>of</strong><br />

Education for the Royal Academy <strong>of</strong> Art in London,<br />

and recently received the Distinguished National<br />

Museum Educator Award <strong>of</strong> the National Association<br />

<strong>of</strong> Museum Educators. Pr<strong>of</strong>essor Jennifer Wriggins<br />

recently was named the first Sumner T. Bernstein<br />

Pr<strong>of</strong>essor at <strong>Maine</strong> <strong>Law</strong>.<br />

Roz supports <strong>Maine</strong> <strong>Law</strong> because <strong>of</strong> the rewards it<br />

has brought to her. “I have been enriched by so many<br />

experiences and exposed to a broad range <strong>of</strong> people,<br />

institutions, and friendships. I want to continue to<br />

support institutions that have been important to<br />

me in my lifetime. I was always taught that the only<br />

immortality that we enjoy is the good name that we<br />

leave behind.”<br />

Roz and Sumner’s son, Andy, is a 1977 graduate <strong>of</strong><br />

Bowdoin College and a 1980 <strong>Maine</strong> <strong>Law</strong> alumnus and<br />

lives in Cape Elizabeth. He serves as Vice President and Chief<br />

Counsel for Disability Reinsurance Management Services in<br />

Westbrook, <strong>Maine</strong>. “When I hear the stories <strong>of</strong> students who<br />

don’t have the independent means to go to law school, it<br />

means an incredible amount to me to be able to support them<br />

directly through a scholarship and pr<strong>of</strong>essorship that honor<br />

my father and grandfather.”<br />

Andy has served on the Alumni Association Board since 2006.<br />

He also is the Class Agent for his law school class. While<br />

attending <strong>Maine</strong> <strong>Law</strong>, he served as Comments Editor <strong>of</strong> the<br />

<strong>Maine</strong> <strong>Law</strong> Review. Another <strong>of</strong> his major accomplishments<br />

was the formation, with fellow law students, <strong>of</strong> the oldies rock<br />

‘n roll band, originally named “Danny and the Groovetones”<br />

(for Dan Boutin, ‘80) and later named “The Wingtips.” n<br />

Roger A. Putnam<br />

Roger A. Putnam, special counsel to Portland<br />

law firm Verrill Dana, is one <strong>of</strong> <strong>Maine</strong>’s very active<br />

public servants, having served in numerous<br />

roles, including Assistant Attorney General from<br />

1951 to 1958. He is the 2008 recipient <strong>of</strong> the<br />

Muskie Access to Justice Award for his career-<br />

long commitment to work that has strengthened<br />

<strong>Maine</strong>’s civil justice system for all people.<br />

Verrill Dana, where Putnam started 50 years<br />

ago, is one <strong>of</strong> northern New England’s leading<br />

law firms and also one <strong>of</strong> the largest employers<br />

<strong>of</strong> graduates from <strong>Maine</strong> <strong>Law</strong>. “I haven’t<br />

counted noses around here lately, but I would<br />

say there are a substantial number <strong>of</strong> graduates.<br />

I would encourage any <strong>of</strong> my grandchildren to<br />

give very serious consideration to <strong>Maine</strong> <strong>Law</strong>,<br />

perhaps for the particular reason that I have<br />

had an opportunity to work with many <strong>of</strong> its end<br />

products.”<br />

Putnam is a member <strong>of</strong> the Board <strong>of</strong> Visitors for<br />

the <strong>Law</strong> <strong>School</strong> and was instrumental, along with<br />

Pr<strong>of</strong>essor and former Dean Colleen Khoury, in<br />

creating the Lewis V. Vafiades Scholarship Fund,<br />

which was established in honor <strong>of</strong> a well-known<br />

Bangor lawyer and friend <strong>of</strong> Putnam to assist<br />

students from northern <strong>Maine</strong>. “I give because<br />

I have great faith in those who operate the <strong>Law</strong><br />

<strong>School</strong> and have witnessed the great benefits to<br />

students.” Putnam was a generous donor to the<br />

“Foundations for the Future” capital campaign<br />

and was a member <strong>of</strong> the <strong>Law</strong> <strong>School</strong>’s capital<br />

campaign cabinet.<br />

Currently, Putnam chairs the <strong>Maine</strong> Judicial<br />

Ethics Committee, appointed by the <strong>Maine</strong><br />

Supreme Judicial Court, and is a former member<br />

and past president <strong>of</strong> the board <strong>of</strong> the <strong>Maine</strong><br />

Equal Justice Project. Putnam is a fellow <strong>of</strong><br />

the American Bar Association and <strong>Maine</strong> State<br />

Bar Association, and has served on the board<br />

<strong>of</strong> directors <strong>of</strong> the <strong>Maine</strong> Bar Foundation. He<br />

currently serves as chair <strong>of</strong> the <strong>Maine</strong> Executive<br />

Committee <strong>of</strong> the Newcomen Society <strong>of</strong> the<br />

United States. n<br />

Dr. Edward David<br />

Dr. Edward David (‘87) graduated from Allegheny<br />

College in 1961 and the <strong>University</strong> <strong>of</strong> Pennsylvania<br />

Medical <strong>School</strong> in 1965. He came to <strong>Maine</strong> <strong>Law</strong> in<br />

1984 to further his education in forensic medicine,<br />

having previously practiced medicine as a neurologist<br />

and having served in the armed forces. Appointed a<br />

Medical Examiner in 1980, David was named Deputy<br />

Chief Medical Examiner in the <strong>Maine</strong> Office <strong>of</strong> the<br />

Chief Medical Examiner in 1986.<br />

“When I was a student, it meant a lot to me that<br />

classes were small. We had a close group.” David<br />

also credits the talented faculty and appreciates that<br />

they have practical experience. “This gave a real<br />

world approach and meaning to what was being<br />

taught. It allowed me to get a sense <strong>of</strong> how the law<br />

was pursued outside <strong>of</strong> the classroom. I was a non-<br />

traditional student in my late 40’s with an advanced<br />

degree (M.D.) and had experienced the difference<br />

between the classroom and the real world, so I could<br />

really appreciate the difference.”<br />

David has been contributing to <strong>Maine</strong> <strong>Law</strong> because<br />

he prizes education. “I wouldn’t have received an<br />

education in law but for <strong>Maine</strong> <strong>Law</strong>. I give so that<br />

students can be assured that they are getting the<br />

best quality education possible.” He gives specifically<br />

toward faculty retention and recruitment and has<br />

included the school in his estate plan. “Hopefully,<br />

it will help the school hold on to its accomplished<br />

faculty by encouraging them with financial incentives<br />

to pursue their interests and pass new knowledge<br />

along to students.” n<br />

For <strong>Maine</strong> natives Rebekah<br />

Smith (‘98) and Patrick<br />

Mellor (‘98), the greatest<br />

benefits <strong>of</strong> attending <strong>Maine</strong><br />

<strong>Law</strong> — aside from meeting<br />

one another — are the<br />

close connection between<br />

students and pr<strong>of</strong>essors, as<br />

well as the extensive network <strong>of</strong> graduates throughout<br />

the state.<br />

Mellor is currently a partner at Strout & Payson in Rockland<br />

where he focuses on land use and civil litigation. Smith is<br />

an administrative hearing <strong>of</strong>ficer in special education due<br />

process proceedings as well as a Policy Fellow at the<br />

Margaret Chase Smith Policy Center at the <strong>University</strong> <strong>of</strong><br />

<strong>Maine</strong>, where she is helping to develop a civic leadership<br />

program for college women. They live in Union with their<br />

four-year-old son, Addison.<br />

While at <strong>Maine</strong> <strong>Law</strong>, both Smith and Mellor worked at the<br />

Cumberland Legal Aid Clinic, where they helped criminal<br />

defendants as well as indigent citizens in need <strong>of</strong> estate<br />

planning. This opportunity was a significant asset to<br />

developing their careers. “Our work at the clinic helped us<br />

for attorneys to contribute to public service.” Smith is<br />

active in the Union Library Capital Campaign, vice-chair <strong>of</strong><br />

the Union Democrats and on the development committee<br />

<strong>of</strong> <strong>Maine</strong> Initiatives. She recently completed six years on<br />

the board <strong>of</strong> the <strong>Maine</strong> Women’s Fund. Patrick is on<br />

the board <strong>of</strong> Mid-Coast Magnet and Chair <strong>of</strong> the Union<br />

Planning Board.<br />

Having clerked for Judge Frank M. C<strong>of</strong>fin, Smith finds<br />

particular satisfaction in contributing to the annual C<strong>of</strong>fin<br />

Lectureship. “The speakers provide significant visibility<br />

to the school, while allowing students to benefit from<br />

the knowledge <strong>of</strong> experienced advocates working in the<br />

public interest.” Both Mellor and Smith decided to return<br />

to their roots to study law. “The fit became obvious —<br />

a well-respected school, dynamic small city, great<br />

educational value — all in the great state <strong>of</strong> <strong>Maine</strong>.”<br />

The couple give to <strong>Maine</strong> <strong>Law</strong> because they still feel a<br />

sense <strong>of</strong> community with the school and their classmates.<br />

“We hope that our gifts will play a small part in ensuring<br />

the continuation <strong>of</strong> quality lectureships and encouraging<br />

students to pursue fulfilling careers in law and public<br />

Ira Waldman<br />

When Ira Waldman (‘76) attended <strong>Maine</strong> <strong>Law</strong>,<br />

he found “a first-rate faculty that does firstrate<br />

teaching and produces first-rate lawyers.<br />

The students who graduate from <strong>Maine</strong> <strong>Law</strong><br />

are every bit as capable as the students who<br />

graduate from any other top law school in the<br />

country.”<br />

After graduating, Waldman worked for four<br />

years at Unum as legal counsel servicing the<br />

real estate investment department, then moved<br />

to Los Angeles to practice real estate law. “The<br />

fantastic education I received at <strong>Maine</strong> <strong>Law</strong> at<br />

a more than reasonable cost is what prepared<br />

me for the path <strong>of</strong> my career from Unum to<br />

partnership at a major firm, as well as the work<br />

that I do with various pr<strong>of</strong>essional organizations.<br />

The value <strong>of</strong> that education is incalculable. No<br />

matter how much time or money I give to the<br />

<strong>Law</strong> <strong>School</strong>, it can barely compensate for the<br />

education I received.”<br />

“Although I really appreciate those who choose<br />

to stay in <strong>Maine</strong> and serve the state, I try to<br />

show by way <strong>of</strong> example that there are other<br />

opportunities around the country that can<br />

be plenty rewarding, both pr<strong>of</strong>essionally and<br />

monetarily. Of course, the latter enables one<br />

to contribute cold hard cash more than many.<br />

Unfortunately, given the available funds in the<br />

State, we just need more <strong>of</strong> those who are<br />

willing to seek career advancement out <strong>of</strong> state,<br />

but will not forget the value (and values) they got<br />

from the institution that provided the essential<br />

foundation for their success.”<br />

“I am very proud <strong>of</strong> my education. Whenever I<br />

lecture or am on a panel it is important to me to<br />

be introduced as a graduate <strong>of</strong> the <strong>University</strong><br />

<strong>of</strong> <strong>Maine</strong> <strong>School</strong> <strong>of</strong> <strong>Law</strong>. I want people to know<br />

that, if they appreciate what I am doing, <strong>Maine</strong><br />

Since August 2001, Waldman has served<br />

on the <strong>University</strong> <strong>of</strong> <strong>Maine</strong> <strong>School</strong> <strong>of</strong> <strong>Law</strong><br />

Foundation Board. “It is a way to give back<br />

in more than a monetary way.”<br />

A native <strong>of</strong> New Jersey, Waldman is a partner at<br />

Cox, Castle and Nicholson LLP in Los Angeles.<br />

He lives in Playa del Rey, California, with his wife<br />

Laurie. Their two children, Ethan and Shayna,<br />

are currently students at Bates College. n<br />

The Foundation during the past year:<br />

n Formally committed to assist the <strong>Law</strong> <strong>School</strong> in<br />

raising $100,000 for the purpose <strong>of</strong> planning for<br />

a new law center. This is the initial budget for this<br />

critical planning process and the <strong>Law</strong> <strong>School</strong> will<br />

undoubtedly need access to additional planning<br />

funds in the future.<br />

n Reviewed the formal working relationship between<br />

the Foundation and the <strong>Law</strong> <strong>School</strong> and agreed<br />

on procedures to clarify the parties’ respective<br />

roles and responsibilities and improve the Foundation’s<br />

effectiveness.<br />

n Reviewed the Foundation’s mission and vision with the<br />

benefit <strong>of</strong> six years experience and began updating its<br />

vision to better reflect how the Foundation can achieve its<br />

mission during the next several years.<br />

n Committed to provide financial support to the <strong>Law</strong> <strong>School</strong> to<br />

retain a qualified and experienced Director <strong>of</strong> Development<br />

& Alumni Relations (and Foundation Executive Director) to<br />

succeed retiring Director John Gundersdorf. With support<br />

from the Foundation, the <strong>Law</strong> <strong>School</strong> successfully hired a<br />

new Director <strong>of</strong> Development, Elena Brandt, in February<br />

2007.<br />

<strong>University</strong> <strong>of</strong> <strong>Maine</strong> <strong>School</strong> <strong>of</strong> <strong>Law</strong> Foundation<br />

Preparing For New Challenges<br />

The <strong>University</strong> <strong>of</strong> <strong>Maine</strong> <strong>School</strong> <strong>of</strong> <strong>Law</strong> Foundation in the past year began to take<br />

important steps to prepare for imminent and significant challenges in the pursuit <strong>of</strong> its mission:<br />

To raise, manage and distribute funds for the support and improvement <strong>of</strong> the<br />

<strong>University</strong> <strong>of</strong> <strong>Maine</strong> <strong>School</strong> <strong>of</strong> <strong>Law</strong> and the education it provides, so that it will become<br />

an internationally recognized law school.<br />

The Foundation also began a process to attract new<br />

talent and leadership to the Foundation. Since the first<br />

Board meeting in August, 2001, the membership <strong>of</strong><br />

the Board has been quite stable. With term limits and<br />

other changes looming in the next few years, however,<br />

the Directors recognized that recruitment efforts for<br />

new members and leaders should be augmented<br />

promptly. David Evans was elected President <strong>of</strong> the<br />

Foundation at the annual meeting <strong>of</strong> the Foundation<br />

in August, 2007. He outlined the following goals for<br />

the ensuing year: (1) to strengthen the committees<br />

and the Foundation’s internal processes in preparation for the<br />

expected major fundraising to be undertaken with respect to<br />

the new law center; (2) to assist the Dean in raising planning<br />

funds for the new law center; (3) to serve as vocal promoters<br />

<strong>of</strong> the law center in our communities; (4) to assist the <strong>Law</strong><br />

<strong>School</strong> in its ABA reaccreditation process, and (5) to bring<br />

“new blood” into the Foundation Board to serve as successors<br />

to the first generation <strong>of</strong> Board members who will be reaching<br />

their term limits.<br />

The tangible results <strong>of</strong> the Foundation’s efforts during the past<br />

year, though, are the most important and exciting news <strong>of</strong> all.<br />

The Foundation’s funds grew approximately 30% to almost<br />

$2.7 million in value through receipts <strong>of</strong> pledges, receipts<br />

support <strong>of</strong> endowed pr<strong>of</strong>essorships. These efforts gave rise<br />

to an ambitious plan for a diversity scholarship endowment<br />

in honor <strong>of</strong> Vincent McKusick, former Chief Justice <strong>of</strong> the<br />

<strong>Maine</strong> Supreme Judicial Court, with the pledge <strong>of</strong> a lead<br />

gift from the law firm <strong>of</strong> Pierce Atwood.<br />
