Report

2
Letter from the Dean
The University of Maine School of Law greets 2009
with optimism and resolve. This is a moment, of course,
characterized by serious financial challenge and uncertainty,
in public higher education and in all our lives. Yet, while
we take measures to contain spending and shepherd our
resources wisely, we necessarily focus on our core mission
of excellence in legal education, research, and public
service, and envision an even stronger institution in the
years to come.
Our Commitment to Diversity Enriches the Law School Community
We are pleased to report establishment of a new diversity scholarship program and endowment fund, in
honor of Vincent L. McKusick, former Chief Justice of the Maine Supreme Judicial Court and currently of
counsel at the law firm of Pierce Atwood LLP. This scholarship program is made possible through an initial
pledge of $100,000 from Pierce Atwood, a further gift of $100,000 from Drs. Victor and Anne McKusick,
and numerous gifts from colleagues and admirers of Chief Justice McKusick. We are sad to note that
Dr. Victor McKusick, the Chief’s identical twin brother, passed away recently, shortly after demonstrating
with such a generous donation his love and respect for his brother. The McKusick Fellowship will provide
tuition assistance and other support to Maine law students, particularly to those from socio-economically
disadvantaged backgrounds, in order to increase the diversity of the student body at the Maine Law School
and within the legal community in Maine. The first McKusick Fellowship will be awarded this year. The Fund
is held by the University of Maine School of Law Foundation, which will assist in securing additional support
and in significantly enlarging the endowment in the coming years.
Further bolstering our diversity efforts is a new faculty and student exchange program with Howard
University School of Law in Washington D.C., the metropolitan area with the largest concentration of Maine
Law alumni outside of New England. Beginning next Fall, the Howard-Maine exchange will send one or
two Maine Law students to Howard, and one or two Howard students here as exchange students each
semester. We also will welcome Howard Law Professor Lateef Mtima as the distinguished Libra Visiting
Professor at Maine for the Fall 2009 semester. Professor Mtima is Director of the Institute for Intellectual
Property and Social Justice in Washington, D.C. and is a popular professor at Howard Law School. He will
teach a summer term course here as well – Intellectual Property Issues in the Digital Age – prior to his Fall
semester in residence at Maine Law. Professor Mtima and his colleagues at Howard share our enthusiasm
for the new exchange program.
Faculty Excellence Drives Program Advancements
Along with their deep commitment to student learning, Maine Law’s professors continue to distinguish
themselves in scholarship and public service. I am pleased to include with this letter an impressive update
on recent faculty accomplishments, as our colleagues continue apace in a range of cutting edge research
and in prolific publication. Faculty excellence advances the institution.
Our Marine Law Institute, for example, is gaining momentum and extending its relationships abroad, under
the leadership of Professor Charles Norchi and extending Maine Law Foundation Professor Martin Rogoff’s
continuing work with collaborative institutions in France. We look forward to welcoming Dr. William Brennan
in the coming academic year as a Senior Fellow at the Law School, where he will focus and heighten our
identity as a center of excellence in ocean and coastal law and policy. Dr. Brennan served as Undersecretary
of Commerce and as Administrator of the National Oceanic and Atmospheric Administration (NOAA) until
recently, where he managed a $4 billion agency and was responsible for the nation’s Weather, Fisheries,
Ocean, and Satellite and Data Information Services. He brings over 25 years of experience in government,
private sector, and nonprofit activity in marine policy and related issues.

Courts and commentators have cited Jennifer Wriggins, Sumner T. Bernstein Professor of Law, for her
research on race and torts, and current economic events have drawn a spotlight onto Lois Lupica,
Maine Law Foundation Professor, for her longtime work in bankruptcy and predatory lending. The Law
School is front and center in exploring new means of generating and regulating energy, with a lead from
environmental law Professor Dave Owen and Research Professor Rita Heimes. Our Intellectual Property
Law Clinic in the Maine Patent Program, directed by Leonard Agneta, became one of only six law school
clinics nationwide to be certified to practice before the U.S. Patent and Trademark Office and one of only
four schools that received recognition in both the patent and trademark fields.
We extend many thanks to Professor Jeffrey Maine, who stepped down as Associate Dean for Academic
Affairs in January after three-and-a-half years of excellent administrative and curricular leadership. He has
taken a well-deserved sabbatical this semester, and then will return to the full-time teaching and research
that he loves so much. Stepping into Jeff’s place as Associate Dean is Professor Christopher Knott. As
Director of the Garbrecht Law Library, Chris already has demonstrated excellence in administration and
a creative vision for the future of the Law School.
Next September, Sarah Schindler will join our faculty with a tenure-track appointment as Associate
Professor. Currently a visiting professor at the University of Georgia School of Law, Professor Schindler
previously practiced in the area of land use and environmental law at the firm of Morrison & Foerster LLP
in San Francisco and clerked for Judge Will Garwood of the U.S. Circuit Court of Appeals for the Fifth
Circuit in Austin, Texas. She graduated summa cum laude from the University of Georgia School of Law
and taught as a guest lecturer at U.C. Berkeley School of Law (Boalt Hall) and at U.C. Hastings College
of Law. Prior to law school, she worked as a television actor in Los Angeles, with appearances on several
popular television shows including Beverly Hills 90210, That 70s Show, Third Rock From The Sun, and
others.
Our Students Stand Out
As always, our students are amazing – demonstrating collaborative and spirited involvement inside the
Law School and extensive civic engagement outside of school. There is much good news to report. Our
graduates who took the Maine Bar Exam for the first time last July achieved a pass rate of close to 93%.
They bring diverse backgrounds and expertise to the classroom and support one another in a shared
enterprise of learning and discovery. They engage with faculty in research, they publish articles, and they
edit law journals with a national and international reach.
Our student attorneys in the Law School’s Cumberland Legal Aid Clinic represent clients in federal and
state courts in juvenile justice matters, domestic violence protection, and a range of criminal and civil
litigation, and they participate in important policy initiatives. Students in the Intellectual Property Clinic
assist inventors and entrepreneurs and have a hand in economic development and technology policy in
Maine. Our students clerk and volunteer in public and private sector institutions and graduate to become
leaders in Maine, throughout the nation, and around the world. And, their excellence is recognized
beyond the boundaries of the Law School and the state. The American College of Bankruptcy, for
instance, recognized third-year student Nathaniel Hull as the First Circuit’s Distinguished Bankruptcy Law
Student for the Class of 2009, selected for this honor from many outstanding law students throughout
the First Circuit based on his academic record, public service, and publications. The student-run Maine
Association of Public Interest Law (MAPIL), once again this year, is hosting the annual public interest
auction to raise funds in support of students in a wide array of public interest summer internships. This
April 2nd event is a wonderful community celebration and an important boost to summer public interest
fellowships for our students.
Maine Law Welcomes Distinguished Lecturers and Honorees
In November, we were fortunate to welcome the Honorable Judith S. Kaye, Chief Judge of the State of
New York, to deliver the Frank M. Coffin Lecture on Law and Public Service. Just two months before her
retirement from the bench, her retrospective remarks were inspiring and instructive, and her interaction
(cont’d)
4
with our many Law School constituencies was a pleasure. Maine Law alumnus Hon. John Veroneau also lectured this Fall
at the Law School, as he looked back on his years as Deputy U.S. Trade Representative.
Laura Underkuffler, a distinguished law professor formerly at Duke University and now at Cornell University, spent the Fall
semester in residence at Maine Law as a visiting professor. She taught the first-year property law class, among her other
contributions to the life of the Law School, and we look forward to maintaining this active relationship with a wonderful
colleague.
Maine Law is hosting a symposium series in March and April on the subject of corporate governance and ethics. With
leadership from Board of Visitors member Dan Boxer, an afternoon panel on governance and ethics in business enterprise
was held on March 19th, and a panel discussion on the nonprofit sector is scheduled for April 16th at the Law School.
Participating in the discussions are Maine leaders in corporate enterprise, philanthropy, and nonprofit organizations, including
Robert Monks and Rick Bennett of the Corporate Library, Owen Wells of the Libra Foundation, Suzanne Austin of the
Institute for Civic Leadership, Paul Delva of Fairchild Semiconductor, Linda Conti of the Maine Attorney General’s office, Eliot
Cutler of Akin Gump, and many others.
We hope you will join us for the Maine Law School Commencement ceremony, always an uplifting event as another class
of students graduates from the Law School. This year’s Commencement will be held at Merrill Auditorium in Portland at 10
am on Saturday, May 23, 2009. The Hon. Vendean Vafiades (Maine Law ‘85) will receive the L. Kinvin Wroth Distinguished
Alumna Award, for her wide-ranging public service, including her current role as a Commissioner on the Maine Public
Utilities Commission and her prior service as Maine District Court Judge for over a decade and five years as Chief Judge
of the District Court. Our keynote speaker for Commencement will be Steven Greenhouse, the New York Times labor and
employment reporter and author of a new book, The Big Squeeze: Tough Times for the American Worker. He earned his J.D.
from New York University School of Law and has been a reporter for the New York Times since 1983, covering business,
economic policy, European affairs, and now labor issues. Greenhouse has appeared on National Public Radio, PBS (“The
News Hour”), MSNBC, CNN, and the BBC.
Many of you joined us for the Annual Alumni Dinner on March 28, 2009, at the Portland Country Club. The Alumni Association
awarded its distinguished service award to the Hon. Paula Silsby (Maine Law ’76) for her dedicated support and continuing
effort on behalf of the Law School, particularly in her role on the Board of Visitors of the University of Maine School of Law,
and for her leadership regionally and nationally as U.S. Attorney for the District of Maine.
Your Commitment to Maine Law is More Important than Ever
The difficult economic climate in Maine, as well as beyond the state borders, has intensified our fiscal challenge at the Law
School. Government support for higher education, especially for graduate and professional schools, is shrinking, and our
students face new hurdles in meeting tuition and living costs. Our endowments have lost value, and this year’s Annual Fund
presents a daunting challenge as many of us measure our personal capacity for philanthropy. Yet, we forge ahead and are
more committed than ever to a vision of an even better Maine Law School. Fully cognizant of short-term obstacles, the Law
School’s Board of Visitors has formed a planning committee to advance our progress toward a new law school building.
Your continued support during these challenging times makes an enormous difference to the Law School, helping to ensure
that we can continue to provide the fine training to our students that has made this school such a valuable part of Maine’s
legal community.
The University of Maine School of Law Foundation is working to identify multi-layered finance and philanthropy in furtherance
of our vision. The Alumni Association, once again this year, is energizing our Annual Fund Appeal. Thanks to the generosity of
our alumni and friends, the Law School can count on gift and endowment funds as a hedge against state budget reductions
and as a means of keeping our robust program on track. Most important, your generous support enables us to assist
students with scholarships and fellowships as they face new challenges in financing their legal education. This year, more
than ever, we appreciate your commitment and continued support.
That is all the news for now. Feel free to contact me with questions or suggestions or simply to discuss strategies for building
further support for the University of Maine School of Law. Again, thank you for all you do for the Law School.
Ways to Give
There are many ways that you
can support Maine Law now and
in the future:
Write a check: Support Maine
Law’s Annual Fund through a
cash or credit card gift before
June 30th each year. Give online
at www.mainelawalum.org.
Make a pledge: Pledges may
be payable in single or multiple
installments.
Transfer stock: Publicly traded
securities are an attractive option
because they can provide greater
tax advantages than gifts of cash.
The donor may be able to deduct
the current fair market value as
a charitable gift and avoid capital
gains tax on the appreciation.
Matching gifts: Many companies
match an employee’s gift.
Please consider whether your
or your spouse’s employer offers
matching gifts.
insurance: Gifts of paid life
insurance policies can be attractive
giving options.
Make a planned gift: Leave a
lasting legacy. By making Maine Law
part of your estate planning, you can
make an immense difference in the
future of the Law School.
Establish an honorary or
memorial fund: Honor someone
special – family, friends, an influential
professor, even yourself – through a
gift that has long-lasting meaning to
you and the Law School.
lead by example: Remember
that your gift inspires others to
make their own gifts and increases
the likelihood that foundations,
corporations, law firms, and others
will join us in meeting Maine Law’s
most critical and urgent needs.
We’ve heard you! The Alumni Relations
(either by postcard or email) by PCI,
the marketing firm preparing the
directory. You will be instructed to
