Letter from the Dean<br />
The <strong>University</strong> <strong>of</strong> <strong>Maine</strong> <strong>School</strong> <strong>of</strong> <strong>Law</strong> greets 2009<br />
with optimism and resolve. This is a moment, <strong>of</strong> course,<br />
characterized by serious financial challenge and uncertainty,<br />
in public higher education and in all our lives. Yet, while<br />
we take measures to contain spending and shepherd our<br />
resources wisely, we necessarily focus on our core mission<br />
<strong>of</strong> excellence in legal education, research, and public<br />
service, and envision an even stronger institution in the<br />
years to come.<br />
Our Commitment to Diversity Enriches the <strong>Law</strong> <strong>School</strong> Community<br />
We are pleased to report establishment <strong>of</strong> a new diversity scholarship program and endowment fund, in<br />
honor <strong>of</strong> Vincent L. McKusick, former Chief Justice <strong>of</strong> the <strong>Maine</strong> Supreme Judicial Court and currently <strong>of</strong><br />
counsel at the law firm <strong>of</strong> Pierce Atwood LLP. This scholarship program is made possible through an initial<br />
pledge <strong>of</strong> $100,000 from Pierce Atwood, a further gift <strong>of</strong> $100,000 from Drs. Victor and Anne McKusick,<br />
and numerous gifts from colleagues and admirers <strong>of</strong> Chief Justice McKusick. We are sad to note that<br />
Dr. Victor McKusick, the Chief’s identical twin brother, passed away recently, shortly after demonstrating<br />
with such a generous donation his love and respect for his brother. The McKusick Fellowship will provide<br />
tuition assistance and other support to <strong>Maine</strong> law students, particularly to those from socio-economically<br />
disadvantaged backgrounds, in order to increase the diversity <strong>of</strong> the student body at the <strong>Maine</strong> <strong>Law</strong> <strong>School</strong><br />
and within the legal community in <strong>Maine</strong>. The first McKusick Fellowship will be awarded this year. The Fund<br />
is held by the <strong>University</strong> <strong>of</strong> <strong>Maine</strong> <strong>School</strong> <strong>of</strong> <strong>Law</strong> Foundation, which will assist in securing additional support<br />
and in significantly enlarging the endowment in the coming years.<br />
Further bolstering our diversity efforts is a new faculty and student exchange program with Howard<br />
<strong>University</strong> <strong>School</strong> <strong>of</strong> <strong>Law</strong> in Washington D.C., the metropolitan area with the largest concentration <strong>of</strong> <strong>Maine</strong><br />
<strong>Law</strong> alumni outside <strong>of</strong> New England. Beginning next Fall, the Howard-<strong>Maine</strong> exchange will send one or<br />
two <strong>Maine</strong> <strong>Law</strong> students to Howard, and one or two Howard students here as exchange students each<br />
semester. We also will welcome Howard <strong>Law</strong> Pr<strong>of</strong>essor Lateef Mtima as the distinguished Libra Visiting<br />
Pr<strong>of</strong>essor at <strong>Maine</strong> for the Fall 2009 semester. Pr<strong>of</strong>essor Mtima is Director <strong>of</strong> the Institute for Intellectual<br />
Property and Social Justice in Washington, D.C. and is a popular pr<strong>of</strong>essor at Howard <strong>Law</strong> <strong>School</strong>. He will<br />
teach a summer term course here as well – Intellectual Property Issues in the Digital Age – prior to his Fall<br />
semester in residence at <strong>Maine</strong> <strong>Law</strong>. Pr<strong>of</strong>essor Mtima and his colleagues at Howard share our enthusiasm<br />
for the new exchange program.<br />
Faculty Excellence Drives Program Advancements<br />
Along with their deep commitment to student learning, <strong>Maine</strong> <strong>Law</strong>’s pr<strong>of</strong>essors continue to distinguish<br />
themselves in scholarship and public service. I am pleased to include with this letter an impressive update<br />
on recent faculty accomplishments, as our colleagues continue apace in a range <strong>of</strong> cutting edge research<br />
and in prolific publication. Faculty excellence advances the institution.<br />
Our Marine <strong>Law</strong> Institute, for example, is gaining momentum and extending its relationships abroad, under<br />
the leadership <strong>of</strong> Pr<strong>of</strong>essor Charles Norchi and extending <strong>Maine</strong> <strong>Law</strong> Foundation Pr<strong>of</strong>essor Martin Rog<strong>of</strong>f’s<br />
continuing work with collaborative institutions in France. We look forward to welcoming Dr. William Brennan<br />
in the coming academic year as a Senior Fellow at the <strong>Law</strong> <strong>School</strong>, where he will focus and heighten our<br />
identity as a center <strong>of</strong> excellence in ocean and coastal law and policy. Dr. Brennan served as Undersecretary<br />
<strong>of</strong> Commerce and as Administrator <strong>of</strong> the National Oceanic and Atmospheric Administration (NOAA) until<br />
recently, where he managed a $4 billion agency and was responsible for the nation’s Weather, Fisheries,<br />
Ocean, and Satellite and Data Information Services. He brings over 25 years <strong>of</strong> experience in government,<br />
private sector, and nonpr<strong>of</strong>it activity in marine policy and related issues.
Courts and commentators have cited Jennifer Wriggins, Sumner T. Bernstein Pr<strong>of</strong>essor <strong>of</strong> <strong>Law</strong>, for her<br />
research on race and torts, and current economic events have drawn a spotlight onto Lois Lupica,<br />
<strong>Maine</strong> <strong>Law</strong> Foundation Pr<strong>of</strong>essor, for her longtime work in bankruptcy and predatory lending. The <strong>Law</strong><br />
<strong>School</strong> is front and center in exploring new means <strong>of</strong> generating and regulating energy, with a lead from<br />
environmental law Pr<strong>of</strong>essor Dave Owen and Research Pr<strong>of</strong>essor Rita Heimes. Our Intellectual Property<br />
<strong>Law</strong> Clinic in the <strong>Maine</strong> Patent Program, directed by Leonard Agneta, became one <strong>of</strong> only six law school<br />
clinics nationwide to be certified to practice before the U.S. Patent and Trademark Office and one <strong>of</strong> only<br />
four schools that received recognition in both the patent and trademark fields.<br />
We extend many thanks to Pr<strong>of</strong>essor Jeffrey <strong>Maine</strong>, who stepped down as Associate Dean for Academic<br />
Affairs in January after three-and-a-half years <strong>of</strong> excellent administrative and curricular leadership. He has<br />
taken a well-deserved sabbatical this semester, and then will return to the full-time teaching and research<br />
that he loves so much. Stepping into Jeff’s place as Associate Dean is Pr<strong>of</strong>essor Christopher Knott. As<br />
Director <strong>of</strong> the Garbrecht <strong>Law</strong> Library, Chris already has demonstrated excellence in administration and<br />
a creative vision for the future <strong>of</strong> the <strong>Law</strong> <strong>School</strong>.<br />
Next September, Sarah Schindler will join our faculty with a tenure-track appointment as Associate<br />
Pr<strong>of</strong>essor. Currently a visiting pr<strong>of</strong>essor at the <strong>University</strong> <strong>of</strong> Georgia <strong>School</strong> <strong>of</strong> <strong>Law</strong>, Pr<strong>of</strong>essor Schindler<br />
previously practiced in the area <strong>of</strong> land use and environmental law at the firm <strong>of</strong> Morrison & Foerster LLP<br />
in San Francisco and clerked for Judge Will Garwood <strong>of</strong> the U.S. Circuit Court <strong>of</strong> Appeals for the Fifth<br />
Circuit in Austin, Texas. She graduated summa cum laude from the <strong>University</strong> <strong>of</strong> Georgia <strong>School</strong> <strong>of</strong> <strong>Law</strong><br />
and taught as a guest lecturer at U.C. Berkeley <strong>School</strong> <strong>of</strong> <strong>Law</strong> (Boalt Hall) and at U.C. Hastings College<br />
<strong>of</strong> <strong>Law</strong>. Prior to law school, she worked as a television actor in Los Angeles, with appearances on several<br />
popular television shows including Beverly Hills 90210, That 70s Show, Third Rock From The Sun, and<br />
others.<br />
Our Students Stand Out<br />
As always, our students are amazing – demonstrating collaborative and spirited involvement inside the<br />
<strong>Law</strong> <strong>School</strong> and extensive civic engagement outside <strong>of</strong> school. There is much good news to report. Our<br />
graduates who took the <strong>Maine</strong> Bar Exam for the first time last July achieved a pass rate <strong>of</strong> close to 93%.<br />
They bring diverse backgrounds and expertise to the classroom and support one another in a shared<br />
enterprise <strong>of</strong> learning and discovery. They engage with faculty in research, they publish articles, and they<br />
edit law journals with a national and international reach.<br />
Our student attorneys in the <strong>Law</strong> <strong>School</strong>’s Cumberland Legal Aid Clinic represent clients in federal and<br />
state courts in juvenile justice matters, domestic violence protection, and a range <strong>of</strong> criminal and civil<br />
litigation, and they participate in important policy initiatives. Students in the Intellectual Property Clinic<br />
assist inventors and entrepreneurs and have a hand in economic development and technology policy in<br />
<strong>Maine</strong>. Our students clerk and volunteer in public and private sector institutions and graduate to become<br />
leaders in <strong>Maine</strong>, throughout the nation, and around the world. And, their excellence is recognized<br />
beyond the boundaries <strong>of</strong> the <strong>Law</strong> <strong>School</strong> and the state. The American College <strong>of</strong> Bankruptcy, for<br />
instance, recognized third-year student Nathaniel Hull as the First Circuit’s Distinguished Bankruptcy <strong>Law</strong><br />
Student for the Class <strong>of</strong> 2009, selected for this honor from many outstanding law students throughout<br />
the First Circuit based on his academic record, public service, and publications. The student-run <strong>Maine</strong><br />
Association <strong>of</strong> Public Interest <strong>Law</strong> (MAPIL), once again this year, is hosting the annual public interest<br />
auction to raise funds in support <strong>of</strong> students in a wide array <strong>of</strong> public interest summer internships. This<br />
April 2nd event is a wonderful community celebration and an important boost to summer public interest<br />
fellowships for our students.<br />
<strong>Maine</strong> <strong>Law</strong> Welcomes Distinguished Lecturers and Honorees<br />
In November, we were fortunate to welcome the Honorable Judith S. Kaye, Chief Judge <strong>of</strong> the State <strong>of</strong><br />
New York, to deliver the Frank M. C<strong>of</strong>fin Lecture on <strong>Law</strong> and Public Service. Just two months before her<br />
retirement from the bench, her retrospective remarks were inspiring and instructive, and her interaction<br />

with our many <strong>Law</strong> <strong>School</strong> constituencies was a pleasure. <strong>Maine</strong> <strong>Law</strong> alumnus Hon. John Veroneau also lectured this Fall<br />
at the <strong>Law</strong> <strong>School</strong>, as he looked back on his years as Deputy U.S. Trade Representative.<br />
Laura Underkuffler, a distinguished law pr<strong>of</strong>essor formerly at Duke <strong>University</strong> and now at Cornell <strong>University</strong>, spent the Fall<br />
semester in residence at <strong>Maine</strong> <strong>Law</strong> as a visiting pr<strong>of</strong>essor. She taught the first-year property law class, among her other<br />
contributions to the life <strong>of</strong> the <strong>Law</strong> <strong>School</strong>, and we look forward to maintaining this active relationship with a wonderful<br />
colleague.<br />
<strong>Maine</strong> <strong>Law</strong> is hosting a symposium series in March and April on the subject <strong>of</strong> corporate governance and ethics. With<br />
leadership from Board <strong>of</strong> Visitors member Dan Boxer, an afternoon panel on governance and ethics in business enterprise<br />
was held on March 19th, and a panel discussion on the nonpr<strong>of</strong>it sector is scheduled for April 16th at the <strong>Law</strong> <strong>School</strong>.<br />
Participating in the discussions are <strong>Maine</strong> leaders in corporate enterprise, philanthropy, and nonpr<strong>of</strong>it organizations, including<br />
Robert Monks and Rick Bennett <strong>of</strong> the Corporate Library, Owen Wells <strong>of</strong> the Libra Foundation, Suzanne Austin <strong>of</strong> the<br />
Institute for Civic Leadership, Paul Delva <strong>of</strong> Fairchild Semiconductor, Linda Conti <strong>of</strong> the <strong>Maine</strong> Attorney General’s <strong>of</strong>fice, Eliot<br />
Cutler <strong>of</strong> Akin Gump, and many others.<br />
We hope you will join us for the <strong>Maine</strong> <strong>Law</strong> <strong>School</strong> Commencement ceremony, always an uplifting event as another class<br />
<strong>of</strong> students graduates from the <strong>Law</strong> <strong>School</strong>. This year’s Commencement will be held at Merrill Auditorium in Portland at 10<br />
am on Saturday, May 23, 2009. The Hon. Vendean Vafiades (<strong>Maine</strong> <strong>Law</strong> ‘85) will receive the L. Kinvin Wroth Distinguished<br />
Alumna Award, for her wide-ranging public service, including her current role as a Commissioner on the <strong>Maine</strong> Public<br />
Utilities Commission and her prior service as <strong>Maine</strong> District Court Judge for over a decade and five years as Chief Judge<br />
<strong>of</strong> the District Court. Our keynote speaker for Commencement will be Steven Greenhouse, the New York Times labor and<br />
employment reporter and author <strong>of</strong> a new book, The Big Squeeze: Tough Times for the American Worker. He earned his J.D.<br />
from New York <strong>University</strong> <strong>School</strong> <strong>of</strong> <strong>Law</strong> and has been a reporter for the New York Times since 1983, covering business,<br />
economic policy, European affairs, and now labor issues. Greenhouse has appeared on National Public Radio, PBS (“The<br />
News Hour”), MSNBC, CNN, and the BBC.<br />
Many <strong>of</strong> you joined us for the <strong>Annual</strong> Alumni Dinner on March 28, 2009, at the Portland Country Club. The Alumni Association<br />
awarded its distinguished service award to the Hon. Paula Silsby (<strong>Maine</strong> <strong>Law</strong> ’76) for her dedicated support and continuing<br />
effort on behalf <strong>of</strong> the <strong>Law</strong> <strong>School</strong>, particularly in her role on the Board <strong>of</strong> Visitors <strong>of</strong> the <strong>University</strong> <strong>of</strong> <strong>Maine</strong> <strong>School</strong> <strong>of</strong> <strong>Law</strong>,<br />
and for her leadership regionally and nationally as U.S. Attorney for the District <strong>of</strong> <strong>Maine</strong>.<br />
Your Commitment to <strong>Maine</strong> <strong>Law</strong> is More Important than Ever<br />
The difficult economic climate in <strong>Maine</strong>, as well as beyond the state borders, has intensified our fiscal challenge at the <strong>Law</strong><br />
<strong>School</strong>. Government support for higher education, especially for graduate and pr<strong>of</strong>essional schools, is shrinking, and our<br />
students face new hurdles in meeting tuition and living costs. Our endowments have lost value, and this year’s <strong>Annual</strong> Fund<br />
presents a daunting challenge as many <strong>of</strong> us measure our personal capacity for philanthropy. Yet, we forge ahead and are<br />
more committed than ever to a vision <strong>of</strong> an even better <strong>Maine</strong> <strong>Law</strong> <strong>School</strong>. Fully cognizant <strong>of</strong> short-term obstacles, the <strong>Law</strong><br />
<strong>School</strong>’s Board <strong>of</strong> Visitors has formed a planning committee to advance our progress toward a new law school building.<br />
Your continued support during these challenging times makes an enormous difference to the <strong>Law</strong> <strong>School</strong>, helping to ensure<br />
that we can continue to provide the fine training to our students that has made this school such a valuable part <strong>of</strong> <strong>Maine</strong>’s<br />
legal community.<br />
The <strong>University</strong> <strong>of</strong> <strong>Maine</strong> <strong>School</strong> <strong>of</strong> <strong>Law</strong> Foundation is working to identify multi-layered finance and philanthropy in furtherance<br />
<strong>of</strong> our vision. The Alumni Association, once again this year, is energizing our <strong>Annual</strong> Fund Appeal. Thanks to the generosity <strong>of</strong><br />
our alumni and friends, the <strong>Law</strong> <strong>School</strong> can count on gift and endowment funds as a hedge against state budget reductions<br />
and as a means <strong>of</strong> keeping our robust program on track. Most important, your generous support enables us to assist<br />
students with scholarships and fellowships as they face new challenges in financing their legal education. This year, more<br />
than ever, we appreciate your commitment and continued support.<br />

Faculty Accomplishments<br />
n Emeritus Pr<strong>of</strong>essor orlando Delogu was a moderator and speaker this March at the 18th <strong>Annual</strong><br />
Rocky Mountain Land Use Conference, a program sponsored by the <strong>University</strong> <strong>of</strong> Denver <strong>School</strong> <strong>of</strong><br />
<strong>Law</strong>. Pr<strong>of</strong>essor Delogu’s article, “The Judicial Branch: Not Just Another Agency, But a Constitutionally<br />
Authorized Department <strong>of</strong> Government” is in the October 23, 2008 issue <strong>of</strong> <strong>Maine</strong> <strong>Law</strong>yers Review.<br />
n In November, Associate Pr<strong>of</strong>essor Christine Galbraith presented her article “Dying to Know: A Demand<br />
for Genuine Public Access to Clinical Trial Results Data” at the Harvard <strong>School</strong> <strong>of</strong> Public Health’s “Cancer<br />
Clinical Trials Symposium.” This article will soon be published in the Mississippi <strong>Law</strong> Journal.<br />
n Research Pr<strong>of</strong>essor Rita Heimes facilitated a panel at the GrowSmart <strong>Maine</strong> Summit ‘08 “Charting<br />
<strong>Maine</strong>’s Future” on October 10, 2008, at the Augusta Civic Center. The panel, speaking on “Can<br />
<strong>Maine</strong> Become the Green Energy State?”, included Cathy Reneault <strong>of</strong> the DECD/Office <strong>of</strong> Innovation,<br />
Angus King <strong>of</strong> Independence Wind, and John Kerry <strong>of</strong> the Office <strong>of</strong> Independence and Security.<br />
Pr<strong>of</strong>essor Heimes’s article, “Managing a Fishery Through Contract: “Legal Issues Raised by Sector<br />
Operating Agreements in the New England Multispecies Fishery,” was published in the fall 2008 issue<br />
<strong>of</strong> the Ocean and Coastal <strong>Law</strong> Journal.<br />
n Associate Pr<strong>of</strong>essor Chris Knott’s article “On Teaching Advanced Legal Research” will be published by<br />
the Legal Reference Services Quarterly in April, part <strong>of</strong> a double issue symposium on legal information<br />
literacy in the law school curriculum. In January, the third edition <strong>of</strong> Where the <strong>Law</strong> Is: An Introduction<br />
to Advanced Legal Research, co-authored with J.D.S. Armstrong, was published by West Publishing<br />
as part <strong>of</strong> their American Casebook Series.<br />
n Pr<strong>of</strong>essor lois lupica’s article “The Consumer Debt Crisis and the Reinforcement <strong>of</strong> Class Position”<br />
has been accepted for publication in the Loyola <strong>University</strong> Chicago <strong>Law</strong> Journal. Pr<strong>of</strong>essor Lupica<br />
presented her article at a faculty workshop on October 31, 2008.<br />
n In January, Pr<strong>of</strong>essor Jeffrey <strong>Maine</strong> presented at the 17th <strong>Annual</strong> Advanced Licensing Institute<br />
at Franklin Pierce <strong>Law</strong> Center in Concord, New Hampshire. His talk focused on tax issues in IP<br />
development and technology transfers.<br />
n Associate Pr<strong>of</strong>essor Charles norchi participated in the program “Leader Development for Sustainable<br />
Peace.” This program, held in January 2009, was sponsored by the Naval-Postgraduate <strong>School</strong><br />
in Honolulu, Hawaii. He delivered a lecture entitled “Afghanistan: History, <strong>Law</strong> and Humanitarian<br />
Imperatives” to an audience <strong>of</strong> academics and military personnel. In October, he chaired a symposium<br />
panel entitled “Nation-Building: A Legal Architecture?” held at the Policy Sciences Institute in Boulder,<br />
Colorado. Pr<strong>of</strong>essor Norchi was elected Treasurer <strong>of</strong> the Admiralty and Maritime <strong>Law</strong> Section <strong>of</strong> the<br />
AALS and also was elected to the Executive Council <strong>of</strong> the Society <strong>of</strong> Policy Scientists.<br />
n Associate Clinical Pr<strong>of</strong>essor Chris northrop conducted site visits last summer in Raleigh County,<br />
West Virginia, on behalf <strong>of</strong> the National Juvenile Defender Center in Washington, D.C. His research is<br />
part <strong>of</strong> a statewide assessment project intended to help West Virginia identify systemic and institutional<br />
barriers that prevent children from receiving effective representation in juvenile courts. The final report<br />
was issued in March.<br />
n Associate Pr<strong>of</strong>essor Dave owen’s article “Legal Constraints, Environmental Variability, and the<br />
Limits <strong>of</strong> Innovative Environmental Governance” was published in Environmental Science and Policy.<br />
Another article, “Water War: Explaining the Klamath Controversy” (book review <strong>of</strong> Holly Doremus and<br />
A. Dan Tarlock, Water War in the Klamath Basin: Macho <strong>Law</strong>, Combat Biology, and Dirty Politics),<br />
was published in Conservation Biology. Pr<strong>of</strong>essor Owen also co-authored (with Joseph Sax) a law
pr<strong>of</strong>essors’ amicus brief in Casitas Municipal Water District v. United States, a takings case before the<br />
Federal Circuit Court <strong>of</strong> Appeals.<br />
n Dean Peter Piteg<strong>of</strong>f was an invited contributor to the Tellus Institute and Ford Foundation workshop<br />
on “Keeping Wealth Local: Alternative Ownership and Control Designs for Rural Communities,” held<br />
in Boston in March. Also in March, Dean Piteg<strong>of</strong>f moderated a panel discussion on “The Courts, the<br />
Economy, and the Way Forward,” a symposium on the future <strong>of</strong> <strong>Maine</strong>’s courts which was co-sponsored<br />
by the <strong>Law</strong> <strong>School</strong> and the <strong>Maine</strong> Trial <strong>Law</strong>yers Association.<br />
n Pr<strong>of</strong>essor Martin Rog<strong>of</strong>f delivered lectures to the Faculty <strong>of</strong> <strong>Law</strong> at the <strong>University</strong> <strong>of</strong> Turin in November<br />
entitled “The Approach <strong>of</strong> U.S. Courts to Choice <strong>of</strong> <strong>Law</strong>” and “The U.S. Presidential Election System<br />
and the Presidential Election <strong>of</strong> November 4, 2008.” While in Turin, Pr<strong>of</strong>essor Rog<strong>of</strong>f also finalized<br />
arrangements for a doctoral candidate from Turin to spend a semester as Visiting Scholar at the <strong>Law</strong><br />
<strong>School</strong>, and opened discussions with Italian colleagues about joint research and other cooperative<br />
activities between the faculty and students <strong>of</strong> our two schools. Pr<strong>of</strong>essor Rog<strong>of</strong>f also is working on a<br />
book, to be published by Carolina Academic Press in 2010, on French constitutional law.<br />
n Associate Pr<strong>of</strong>essor Deirdre smith’s article “An Uncertain Privilege: Implied Waiver and the Evisceration<br />
<strong>of</strong> the Psychotherapist-Patient Privilege in the Federal Courts” was published in the DePaul <strong>Law</strong> Review.<br />
Pr<strong>of</strong>essor Smith presented her article at the annual meeting <strong>of</strong> the <strong>Law</strong> and Society Association in<br />
Quebec last summer.<br />
n In January, Pr<strong>of</strong>essor Deb Tuerkheimer presented “Forfeiture after Giles: The Relevance <strong>of</strong> ‘Domestic<br />
Violence Context’” at a symposium on the Confrontation Clause sponsored by the Lewis and Clark<br />
<strong>Law</strong> Review, which will be publishing a symposium issue later this year. In March, the Texas <strong>Law</strong><br />
Review’s on-line edition will be publishing Pr<strong>of</strong>essor Tuerkheimer’s piece about the confrontation rights<br />
<strong>of</strong> defendants charged with domestic violence homicide. Pr<strong>of</strong>essor Tuerkheimer also recently wrote<br />
a comment on an article by Harvard <strong>Law</strong> <strong>School</strong> Pr<strong>of</strong>essor Jeannie Suk. The piece, “Domesticating<br />
Criminal <strong>Law</strong>: A Normative Defense,” will be included in a volume to be published later in 2009 by<br />
Oxford <strong>University</strong> Press.<br />
n Legal Research and Writing Director nancy Wanderer developed a judicial opinion writing course<br />
with the National Center for State Courts. Her article about the course, entitled “Fostering Public Trust<br />
through Judicial Opinion Writing,” was recently published in NASJNews, the National Association <strong>of</strong><br />
State Judicial Educators quarterly newsletter.<br />
n A newly revised edition <strong>of</strong> Pr<strong>of</strong>essor Tom Ward’s book Intellectual Property in Commerce was published<br />
in October.<br />
n In January, Pr<strong>of</strong>essor Jennifer Wriggins presented a lecture at Suffolk <strong>Law</strong> <strong>School</strong> as part <strong>of</strong> its<br />
“Comparative <strong>Law</strong> & Society Speaker Series” on “Torts, Race, and Inequality: Historical and Contemporary<br />
Perspectives.” Her article, “Damages in Tort Litigation: Thoughts on Race and Remedies, 1865-2007”<br />
was published in the Review <strong>of</strong> Litigation. This article was recently quoted and favorably relied upon by<br />
Judge Weinstein in the case <strong>of</strong> McMillan v. City <strong>of</strong> New York, 253 F.R.D. 247. Pr<strong>of</strong>essor Wriggins also<br />
continues to serve on the Executive Board <strong>of</strong> the AALS Torts and Compensation Section, which met in<br />
January in San Diego.<br />
n Pr<strong>of</strong>essor Mel Zarr was the guest speaker at a meeting <strong>of</strong> all <strong>Maine</strong> state judges in Augusta on October 2,<br />
2008. His presentation, “Some Reflections on Constitutional <strong>Law</strong> Derived from the Most Recent Term <strong>of</strong><br />
the United States Supreme Court,” made use <strong>of</strong> selected recent decisions as a framework for discussing<br />
the Justices’ starkly divergent views regarding the mission and purpose <strong>of</strong> the Supreme Court.<br />
