• “‘violating or attempting to violate, directly or indirectly, or assisting in or<br />
abetting the violation <strong>of</strong>, or conspiring to violate, any provisions <strong>of</strong> this chapter<br />
or any rule promulgated by the board,’ as that clause is used in Section<br />
4731.22(B)(20), <strong>Ohio</strong> Revised Code, to wit: Rule 4731-4-03(B) and (C), <strong>Ohio</strong><br />
Administrative Code, as in effect prior to September 1, 2000.”<br />
• For conduct that occurred prior to March 9, 1999, “‘[c]ommission <strong>of</strong> an act that<br />
constitutes a misdemeanor in this state regardless <strong>of</strong> the jurisdiction in which<br />
the act was committed, if the act was committed in the course <strong>of</strong> practice,’ as<br />
that clause is used in Section 4731.22(B)(12), <strong>Ohio</strong> Revised Code, as in effect<br />
prior to March 9, 1999, to wit: Section 2923.03, <strong>Ohio</strong> Revised Code,<br />
Complicity, to wit: Section 4731.41, <strong>Ohio</strong> Revised Code. Pursuant to Section<br />
4731.99, <strong>Ohio</strong> Revised Code, as in effect prior to March 9, 1999, a violation <strong>of</strong><br />
Section 4731.41, <strong>Ohio</strong> Revised Code, constitutes a misdemeanor <strong>of</strong>fense.”<br />
• For conduct that occurred after March 9, 1999, “‘[c]ommission <strong>of</strong> an act that<br />
constitutes a felony in this state, regardless <strong>of</strong> the jurisdiction in which the act was<br />
committed,’ as that clause is used in Section 4731.22(B)(10), <strong>Ohio</strong> Revised Code,<br />
to wit: Section 2923.03, <strong>Ohio</strong> Revised Code, Complicity, to wit: Section 4731.41,<br />
<strong>Ohio</strong> Revised Code. Pursuant to Section 4731.99(A), <strong>Ohio</strong> Revised Code, a<br />
violation <strong>of</strong> Section 4731.41, <strong>Ohio</strong> Revised Code, constitutes a felony <strong>of</strong>fense.”<br />
• “‘[c]ommission <strong>of</strong> an act that constitutes a felony in this state, regardless <strong>of</strong> the<br />
jurisdiction in which the act was committed,’ as that clause is used in Section<br />
4731.22(B)(10), <strong>Ohio</strong> Revised Code, to wit: Section 2923.03, <strong>Ohio</strong> Revised<br />
Code, Complicity, to wit: Section 4729.51(C), <strong>Ohio</strong> Revised Code, Persons who<br />
may sell, purchase, distribute, or deliver dangerous drugs.”<br />
Accordingly, the <strong>Board</strong> advised Dr. Adamson <strong>of</strong> his right to request a hearing in this<br />
matter. (<strong>State</strong>’s Exhibit 60A)<br />
