These houses are to be-removed from<br />
their present location because or the<br />
ejectment suits recently Instituted by<br />

The same firm are raising a hotel at<br />
Wlidwood, and will raise the resi-<br />

The court <strong>of</strong> errors and appeals de-<br />
cided, a few days ago, that a munlcl-.<br />
pallty has the right to compel the lay-<br />
ing or relaying <strong>of</strong> any sidewalk on the<br />
public highway. This Is' the first<br />
sidewalk decision handed down In<br />
seventy years, the hut being by Jus-<br />
tice Ford, in 1882. < '<br />
The easels <strong>of</strong> great Interest to every<br />
community in the State.. The action<br />
was brought by the Suburban Land,<br />
Improvement and Real Estate associa-<br />
tion against the borough <strong>of</strong> Vallsburg,<br />
contesting the right <strong>of</strong> the borough<br />
authorities to compel the laying <strong>of</strong><br />
what It deemed a! proper sidewalk.<br />
The case has been In thecourts about<br />
wo years. ' •<br />
The decision Is remarkable for two<br />
reasons that It establishes a prece-<br />
dent by making the enunciation In syl-<br />
labus that a decision by the supreme<br />
court upon certlorari, Is binding upon<br />
the court <strong>of</strong> errors and appeals. .<br />
The opinion In the present case .was<br />
written by Justice Garrison. The liti-<br />
gation began after the common council<br />
or the borough had passed a resolution<br />
requiring the owners or property along<br />
