If any properly owner In Oaean City
has doubted the authority of common
council to compel the laying of a side-
walk where one does not exist, or
where the sidewalk In question la not
satisfactory to the municipal body, he
Will be Interested In a decision just
handed down by the highest court In
this State. .
The court of errors and appeals de-
cided, a few days ago, that a munlcl-.
pallty has the right to compel the lay-
ing or relaying of any sidewalk on the
public highway. This Is' the first
sidewalk decision handed down In
seventy years, the hut being by Jus-
tice Ford, in 1882. < '
The easels of great Interest to every
community in the State.. The action
was brought by the Suburban Land,
Improvement and Real Estate associa-
tion against the borough of Vallsburg,
contesting the right of the borough
authorities to compel the laying of
what It deemed a! proper sidewalk.
The case has been In thecourts about
wo years. ' •
The decision Is remarkable for two
reasons that It establishes a prece-
dent by making the enunciation In syl-
labus that a decision by the supreme
court upon certlorari, Is binding upon
the court of errors and appeals. .
The opinion In the present case .was
written by Justice Garrison. The liti-
gation began after the common council
or the borough had passed a resolution
requiring the owners or property along
Sooth Orange avenne In the borough
to lay artlflclal stone sidewalks five
feet wide.. The Suburban company
had already put down blue flagstone,
them In compliance with the ordl-
