campaign, not limited to the following: On April 28, 2008, Freshwater was interviewed on Bob<br />
Burney Live, an AM radio talk show, regarding the school’s actions and the religious displays in<br />
his classroom. (Ex. H, filed manually by leave of Court (Doc. No. 57).) With his attorney, R.<br />
Kelly Hamilton, Freshwater also appeared on the Fox News television program, Showdown, on<br />
July 5, 2008. (Ex. I, filed manually by leave of Court.) In that nationally broadcasted interview,<br />
Freshwater expressed his opinions on several issues, including the Tesla coil incident.<br />
Freshwater again made himself available <strong>for</strong> interview on August 1, 2008, appearing on Point of<br />
View, a radio talk show. (Exhibit J, filed manually by leave of Court; see also Point of View,<br />

The Dennises filed their complaint against the Mount Vernon City School District Board<br />
of Education, Stephen Short, William White, and Freshwater on June 13, 2008, first making their<br />
allegations against Freshwater public. (See Compl. (Doc. No. 2).) Freshwater filed<br />
counterclaims of defamation and intentional infliction of e<strong>motion</strong>al distress on September 2,<br />
2008, shortly after the start of administrative proceedings to terminate him from his Mount<br />
Vernon teaching position. (See Freshwater Counterclaim (Doc. No. 19).) This Court dismissed<br />
the claims against the School Board and its employees other than Freshwater on October 1, 2009,<br />
after those parties settled their differences. (Doc. No. 52.) The controversies between<br />
Freshwater and the Dennises remain, and this Court has ordered all dispositive <strong>motion</strong>s to be<br />
filed on or be<strong>for</strong>e November 16, 2009. (Doc. No. 36.) As is set <strong>for</strong>th below, the undisputed<br />
facts squarely contradict Freshwater’s counterclaims, necessitating that they be dismissed, and<br />
also require <strong>summary</strong> <strong>judgment</strong> on Plaintiff’s battery and Establishment Clause claims.<br />
