FOREWORD<br />

This publication sets forth all of <strong>the</strong> <strong>requests</strong> made <strong>by</strong> <strong>the</strong> Hawaii State Legislature during <strong>the</strong><br />

Regular Session of 2012 to agencies and officials of <strong>the</strong> federal, <strong>state</strong> and county governments and<br />

of quasi-public and private agencies. These <strong>requests</strong> are contained in acts enacted <strong>by</strong> <strong>the</strong><br />

Legislature or bills passed, but which have yet to be approved <strong>by</strong> <strong>the</strong> Governor. These acts or bills<br />

include specific <strong>requests</strong> for submission of information back to <strong>the</strong> Legislature, excluding annual and<br />

o<strong>the</strong>r reports requested on an indefinite basis. These <strong>requests</strong> are also contained in resolutions<br />

adopted <strong>by</strong> <strong>the</strong> Senate or House of Representatives or <strong>by</strong> <strong>the</strong> whole <strong>legislature</strong>. Dates <strong>by</strong> which<br />

reports and o<strong>the</strong>r responses are expected are indicated when specifically set <strong>by</strong> <strong>the</strong> Legislature.<br />

The names of <strong>the</strong> agencies involved in <strong>the</strong> conduct of a study or <strong>the</strong> execution of a request are<br />

underscored.<br />

Requires <strong>the</strong> University of Hawaii shall submit a report detailing its financial plan to fund <strong>the</strong><br />

operating expenses of <strong>the</strong> John A. Burns school of medicine including an itemized list of all<br />

means of funding <strong>the</strong> John A. Burns school of medicine's operating expense to <strong>the</strong> Legislature<br />

no later than twenty days prior to <strong>the</strong> convening of <strong>the</strong> Regular Sessions of 2013, 2014, and<br />

2015.<br />

UNIVERSITY OF HAWAII PROJECTS FUNDED THROUGH REVENUE BONDS. Requires<br />

<strong>the</strong> University of Hawaii to notify <strong>the</strong> Legislature upon <strong>the</strong> issuance of <strong>the</strong> additional revenue<br />

bonds including a detailed listing and description of all projects to be funded through <strong>the</strong><br />

revenue bonds authorized pursuant to this Act.<br />

ACT 63 SB 2774, SD2, HD1<br />

STATE AND COUNTY PUBLICATIONS, AVAILABILITY ON LINE. Requires <strong>the</strong> Chief<br />

Information Officer, with <strong>the</strong> assistance of <strong>the</strong> Office of Information Management and<br />

Technology and <strong>the</strong> Hawaii State Public Library System, and in consultation with <strong>the</strong> counties,<br />

to review <strong>the</strong> technology, personnel, training, fiscal, and o<strong>the</strong>r requirements necessary to<br />

implement a program through which <strong>state</strong> and county agencies would make all of <strong>the</strong>ir<br />

publications available in electronic format for online distribution.<br />

Fur<strong>the</strong>r requires <strong>the</strong> Officer to submit findings and recommendations to <strong>the</strong> Legislature no<br />

later than twenty days prior to <strong>the</strong> convening of <strong>the</strong> Regular Session of 2013.<br />

ACT 78 SB 2822, SD2, HD2<br />

ELECTRIC DEVICES, RECYCLING PROGRAM FOR. Establishes <strong>the</strong> Hawaii electric device<br />

recycling task force within <strong>the</strong> Department of Health to make recommendations for a workable<br />

recycling program for electric devices in Hawaii and keeping in mind <strong>the</strong> conditions and needs<br />

of <strong>the</strong> various islands.<br />

Requires <strong>the</strong> task force to consist of <strong>the</strong> following members:<br />

(1) The Director of Health or <strong>the</strong> Director's designee, who shall serve as chairperson<br />

of <strong>the</strong> task force;<br />

(2) The program manager of <strong>the</strong> Department of Health's Solid and Hazardous Waste<br />

Branch;<br />

(3) The recycling coordinators of <strong>the</strong> counties of Kauai, Maui, and Hawaii and <strong>the</strong> City<br />

and County of Honolulu;<br />

(4) Up to two representatives of <strong>the</strong> Consumer Electronics Association, to be<br />

designated <strong>by</strong> <strong>the</strong> Director;<br />

(5) A representative of <strong>the</strong> Consumer Electronics Retailers Council, which also<br />

includes manufacturers, to be designated <strong>by</strong> <strong>the</strong> Director;<br />

(6) Up to three representatives of major retailers that already conduct take-back<br />

programs for electric devices, to be designated <strong>by</strong> <strong>the</strong> Director;<br />

(7) Up to two representatives of major retailers that do not already conduct take-back<br />

programs for electric devices, to be designated <strong>by</strong> <strong>the</strong> Director;<br />

(8) Up to six representatives of <strong>the</strong> local recycling industry, to be designated <strong>by</strong> <strong>the</strong><br />

Director;<br />

(9) Up to four representatives of <strong>the</strong> inter<strong>state</strong> and intra<strong>state</strong> shipping or freight<br />

transportation industry, to be designated <strong>by</strong> <strong>the</strong> Director;<br />

(10) Up to two representatives of consumer or industrial technology manufacturers that<br />

have experience with recycling programs for electric devices, to be designated <strong>by</strong><br />

<strong>the</strong> Director; and<br />

(11) Any o<strong>the</strong>r members that <strong>the</strong> Director chooses to designate.<br />

Requires <strong>the</strong> Department to submit a report of <strong>the</strong> task force's findings and recommendations,<br />

including any proposed legislation, to <strong>the</strong> Legislature no later than twenty days prior to <strong>the</strong><br />

convening of <strong>the</strong> Regular Session of 2013.<br />

ACT 101 SB 112, SD1, HD1, CD1<br />

SPACEPORT LICENSE APPLICATION. Requires <strong>the</strong> Department of Business, Economic<br />

Development, and Tourism to submit a report on <strong>the</strong> status of <strong>the</strong> application for <strong>the</strong><br />

spaceport license to <strong>the</strong> Legislature no later than twenty days prior to <strong>the</strong> convening of <strong>the</strong><br />

Regular Session of 2013.<br />

(SSCR 432, 712, HSCR 1070, 1489, CCR 164-12)<br />

SB 240, SD2, HD2, CD1<br />

PHYSICIAN WORKFORCE, ASSESSMENT OF. Requires <strong>the</strong> John A. Burns School of<br />

Medicine to submit a report of findings and recommendations detailing its assessment of <strong>the</strong><br />

physician workforce to <strong>the</strong> Legislature, <strong>the</strong> State Health Planning and Development Agency,<br />

and <strong>the</strong> Hawaii Medical Board, no later than twenty days prior to <strong>the</strong> convening of <strong>the</strong> Regular<br />

Session of 2011 and each year <strong>the</strong>reafter. Repealed on June 30, 2017.<br />

HEALTH PROGRAM IN HAWAII, ESTABLISHMENT OF. Requires <strong>the</strong> Insurance Division of<br />

<strong>the</strong> Department of Commerce and Consumer Affairs to prepare a comprehensive study on <strong>the</strong><br />

feasibility of establishing a basic health program in Hawaii including <strong>the</strong>:<br />

(1) Short-term and long-term financial costs and benefits to <strong>the</strong> State;<br />

(2) Immediate and ongoing availability of federal funds to support <strong>the</strong> program and<br />

requirements for long-term sustainability;<br />

(3) Options for selecting providers for <strong>the</strong> program;<br />

(4) Effect of <strong>the</strong> program on relevant existing health care providers and health care<br />

organizations, programs, and agencies, including <strong>the</strong> Hawaii health connector;<br />

(5) Potential benefits to enrollees of <strong>the</strong> program compared to <strong>the</strong> potential drawbacks<br />

to <strong>the</strong>se same individuals if a basic health program is not offered; and<br />

(6) Any o<strong>the</strong>r considerations that may impact <strong>the</strong> overall delivery of health care in<br />

Hawaii.<br />

Fur<strong>the</strong>r requires <strong>the</strong> Division to submit a report of its findings and recommendations including<br />

any proposed legislation to <strong>the</strong> Speaker of <strong>the</strong> House of Representatives and <strong>the</strong> President of<br />

<strong>the</strong> Senate no later than twenty days prior to <strong>the</strong> convening of <strong>the</strong> Regular Session of 2013.<br />

SB 1382, SD2, HD1, CD1<br />

HIGHER EDUCATION ACT OF 1965, EXAMINATION OF. Requires <strong>the</strong> Auditor to examine<br />

<strong>the</strong> federal Higher Education Act of 1965, as amended, and federal regulations pursuant to<br />

that Act, and recommend <strong>the</strong> best available options to <strong>the</strong> State, including a regulatory<br />

framework submit a report of <strong>the</strong> analyses performed to <strong>the</strong> Legislature no later than twenty<br />

days prior to <strong>the</strong> convening of <strong>the</strong> Regular Session of 2013.<br />

SB 2534, SD2, HD2<br />

SCHOOL FACILITIES SPECIAL FUND TO MEET TWENTY-FIRST CENTURY SCHOOL<br />

STANDARDS. Requires <strong>the</strong> Public Land Development Corporation to submit a report<br />

detailing <strong>the</strong> progress made with <strong>the</strong> school facilities special fund, including sites being<br />

considered for non-permanent disposition and <strong>the</strong> process <strong>the</strong> corporation is employing to<br />

select where <strong>the</strong> construction of new facilities and retrofitting of existing facilities to meet<br />

twenty-first century school standards will be done to <strong>the</strong> Legislature no later than twenty days<br />

prior to <strong>the</strong> convening of <strong>the</strong> Regular Session of 2013.<br />

CLEAN AND SOBER HOMES AND HALFWAY HOUSES. Requires <strong>the</strong> Director of Health,<br />

or <strong>the</strong> Director's designee, to chair and convene <strong>the</strong> clean and sober home and halfway<br />

house task force which includes:<br />

(1) The directors of each of <strong>the</strong> county planning departments or <strong>the</strong> directors'<br />

designees;<br />

(2) The Chair of <strong>the</strong> Hawaii Paroling Authority or <strong>the</strong> Chair's designee;<br />

(3) Homeless advocates, as determined <strong>by</strong> <strong>the</strong> Department of Human Services;<br />

(4) Representation from clean and sober homes and halfway houses, as determined<br />

<strong>by</strong> <strong>the</strong> Department of Health;<br />

(5) <strong>Legislative</strong> representatives in equal number from <strong>the</strong> Senate and House of<br />

Representatives, as determined <strong>by</strong> <strong>the</strong> President of <strong>the</strong> Senate and <strong>the</strong> Speaker of<br />

<strong>the</strong> House of Representatives;<br />

(6) Legal representatives, as determined <strong>by</strong> <strong>the</strong> Department of Health, to address<br />

issues such as discrimination, including <strong>the</strong> Attorney General or <strong>the</strong> Attorney<br />

General's designee; and<br />

(7) O<strong>the</strong>rs, as appropriate, as determined <strong>by</strong> <strong>the</strong> Director of Health.<br />

Requires <strong>the</strong> task force to report on <strong>the</strong> scope and nature of <strong>the</strong> accountability plan for clean<br />

and sober homes and halfway houses, <strong>the</strong> process <strong>by</strong> which <strong>the</strong> houses will be monitored, <strong>the</strong><br />

way in which concerns of <strong>the</strong> community members are balanced with <strong>the</strong> concerns of those<br />

requiring <strong>the</strong> support of <strong>the</strong> homes, and how <strong>the</strong> homes will be regulated short of direct<br />

governmental oversight including findings and recommendations of <strong>the</strong> task force and any<br />

proposed legislation that may be necessary to effectuate those recommendations to <strong>the</strong><br />

Legislature no later than twenty days prior to <strong>the</strong> convening of <strong>the</strong> regular session of 2013.<br />

EARLY LEARNING SYSTEM IMPLEMENTATION. Requires <strong>the</strong> Executive Office on Early<br />

Learning temporarily placed within <strong>the</strong> Office of <strong>the</strong> Governor to submit a report on <strong>the</strong> status<br />

of an implementation plan for <strong>the</strong> development of <strong>the</strong> early learning system including a<br />

timeline of <strong>the</strong> implementation plan and any projected funding needs, with a focus on<br />

targeting four year old children to <strong>the</strong> Legislature no later than twenty days prior to <strong>the</strong><br />

convening of <strong>the</strong> Regular Session of 2013.<br />

(SSCR 2004, 2612, HSCR 1221-12, 1661-12, CCR 173-12)<br />

SB 2678, SD2, HD2, CD1<br />

HONOULIULI INTERNMENT-PRISONER OF WAR CAMP SITE, OAHU, EDUCATIONAL<br />

CENTER. Requires <strong>the</strong> Department of Land and Natural Resources to establish a Honouliuli<br />

Park Site Project Advisory Group to develop recommendations to leverage county, <strong>state</strong>,<br />

federal, and private funding for an educational resource center at <strong>the</strong> Honouliuli site<br />

Requires <strong>the</strong> Advisory Group to be composed of:<br />

(1) A member from <strong>the</strong> State Historic Preservation Division of <strong>the</strong> Department of Land<br />

and Natural Resources;<br />

(2) A member from <strong>the</strong> University of Hawaii West Oahu;<br />

(3) A member from <strong>the</strong> Japanese American Citizens League-Honolulu Chapter;<br />

(4) A member from <strong>the</strong> Historic Hawaii Foundation;<br />

(5) A member from Monsanto;<br />

(6) A member appointed <strong>by</strong> <strong>the</strong> Speaker of <strong>the</strong> House of Representatives; and<br />

(7) A member appointed <strong>by</strong> <strong>the</strong> President of <strong>the</strong> Senate.<br />

Requires <strong>the</strong> advisory group to report on recommendations to leverage county, <strong>state</strong>, federal,<br />

and private funding for an educational resource center at <strong>the</strong> Honouliuli site and <strong>the</strong> status of<br />

designating <strong>the</strong> Honouliuli internment-prisoner of war camp site and associated sites within<br />

Hawaii as part of <strong>the</strong> United States National Park Service to <strong>the</strong> Legislature no later than<br />

twenty days prior to <strong>the</strong> convening of <strong>the</strong> Regular Session of 2013.<br />

SB 2695, SD2, HD2, CD1<br />

LIVESTOCK FEED FEASIBILITY PROJECT. Requires <strong>the</strong> Department of Agriculture in<br />

collaboration with o<strong>the</strong>r research institutions to implement a livestock feed feasibility pilot<br />

project that shall:<br />

(1) Explore <strong>the</strong> viability of producing and processing livestock feed within <strong>the</strong> State<br />

through scientific research; and<br />

(2) To <strong>the</strong> extent feasible, produce and process livestock feed on land as determined<br />

<strong>by</strong> <strong>the</strong> Chairperson of <strong>the</strong> Board of Agriculture.<br />

Fur<strong>the</strong>r requires <strong>the</strong> Department to assess <strong>the</strong> implementation of <strong>the</strong> pilot project and report to<br />

<strong>the</strong> Legislature no later than December 31, 2014.<br />

CHILDHOOD OBESITY PREVENTION. Establishes a childhood obesity prevention task<br />

force to develop and recommend legislation related to <strong>the</strong> prevention of childhood obesity to<br />

be composed of:<br />

(1) The Director of Finance, or <strong>the</strong> Director's designee;<br />

(2) The Director of Commerce and Consumer Affairs, or <strong>the</strong> Director's designee;<br />

(3) The Superintendent of Education, or <strong>the</strong> Superintendent's designee;<br />

(4) The Director of Health, or <strong>the</strong> Director's designee;<br />

(5) The Director of Human Services, or <strong>the</strong> Director's designee;<br />

(6) The Director of Taxation, or <strong>the</strong> Director's designee;<br />

(7) A representative from <strong>the</strong> Department of <strong>the</strong> Attorney General;<br />

(8) A representative from <strong>the</strong> State Advisory Council on Early Childhood Education<br />

and Care;<br />

(9) A representative from <strong>the</strong> Board of Education;<br />

(10) A representative from <strong>the</strong> Department of <strong>the</strong> Attorney General;<br />

(11) A representative from <strong>the</strong> University of Hawaii's Department of Public Health<br />

Sciences;<br />

Requires <strong>the</strong> task force to assemble accurate research, fiscal and demographic information,<br />

and justification to support policy development, and track outcomes and research o<strong>the</strong>r <strong>state</strong>,<br />

county, and organizational policy agendas and suggested best practices related to childhood<br />

obesity prevention policies and to report its findings and recommendations, including<br />

proposed legislation, to <strong>the</strong> Legislature no later than twenty days prior to <strong>the</strong> convening of <strong>the</strong><br />

Regular Session of 2013.<br />

SB 2780, SD1, HD2, CD1<br />

INFORMATION TECHNOLOGY PROCUREMENTS. Requires <strong>the</strong> State Procurement Office<br />

and <strong>the</strong> Office of Information Management and Technology to submit monthly reports to <strong>the</strong><br />

Legislature on <strong>the</strong> status of information technology procurements for authorized projects<br />

undertaken <strong>by</strong> <strong>the</strong> office of information management and technology to implement <strong>the</strong> State's<br />

information technology strategic plan.<br />

Requires <strong>the</strong> Office to submit a report on <strong>the</strong> number of information technology procurements<br />

completed on an expedited basis, <strong>the</strong> results achieved in each technology project, as well as<br />

recommendations on <strong>the</strong> feasibility of establishing a new category for information technology<br />

procurements within <strong>the</strong> States procurement laws.<br />

SB 2790, SD1, HD1<br />

DEPARTMENT OF HAWAIIAN HOME LANDS CONSTRUCTION OF HOUSING PROJECTS.<br />

Requires <strong>the</strong> Department of Hawaiian Home Lands to report on <strong>the</strong> status of <strong>the</strong> pilot project<br />

established under part I of Act 187, Session Laws of Hawaii 2010, to <strong>the</strong> Legislature no later<br />

than twenty days prior to <strong>the</strong> convening of <strong>the</strong> Regular Sessions of 2013, 2014, and 2015.<br />

SAFE FACILITIES FOR THE HOMELESS. Requires <strong>the</strong> Department of Human Services, in<br />

conjunction with and with <strong>the</strong> advisement of <strong>the</strong> Hawaii Interagency Council on<br />

Homelessness, to submit a report on its findings and on <strong>the</strong> progress of <strong>the</strong> establishment of<br />

designated safe facilities in various locations throughout <strong>the</strong> State for homeless persons for<br />

overnight stays to <strong>the</strong> Legislature no later than twenty days prior to <strong>the</strong> convening of <strong>the</strong><br />

Regular Session of 2013.<br />

SB 2933, SD2, HD2, CD1<br />

WEST MAUI OCEAN RECREATION MANAGEMENT AREA. Requires <strong>the</strong> Department of<br />

Land and Natural Resources to establish a temporary West Maui Ocean Recreation<br />

to prepare a five-year financial plan which incorporates any or all previous retooling,<br />

restructuring, or strategic plans into one all-inclusive document; provided fur<strong>the</strong>r that <strong>the</strong> plan<br />

shall account for each year of <strong>the</strong> five year period beginning with <strong>the</strong> 2013 calendar year and<br />

shall include:<br />

(1) A detailed description of each agency of <strong>the</strong> department and program ID,<br />

including <strong>the</strong> program objective for each;<br />

(2) A detailed description of department-wide and agency specific goals of current<br />

reorganization efforts;<br />

(3) A cost-benefit analysis of any proposed personnel and/or funding transfer within<br />

<strong>the</strong> department;<br />

(4) A department-wide and agency specific expenditure plan including all means of<br />

financing for each of <strong>the</strong> five years;<br />

(5) Forecasted changes in <strong>the</strong> regulatory environment and <strong>the</strong> department's ability to<br />

(6) Anticipated increases or decreases in demand for services, including anticipated<br />

impact to resource expenditures resulting from those changes and detailed<br />

forecasts in anticipated clientele numbers and corresponding funding needs <strong>by</strong><br />

program ID.<br />

Fur<strong>the</strong>r requires that <strong>the</strong> five year plan shall be submitted to <strong>the</strong> Legislature no later than<br />

November 1, 2012.<br />

PART III, SECTION 18.2<br />

STUDENT TRANSPORTATION. Requires <strong>the</strong> Department of Education to expend funds only<br />

if:<br />

(1) The Department conducts a comprehensive assessment of need for each student<br />

transportation route that considers ridership rates, socioeconomic background of<br />

riders, distances from homes to schools, student safety, and cost effectiveness;<br />

(2) Student transportation routes are provided based upon need;<br />

(3) The board of education approves of <strong>the</strong> expenditure of funds for each provided<br />

route; and<br />

(4) Student transportation routes not mandated <strong>by</strong> <strong>state</strong> or federal law are provided in<br />

all four counties.<br />

Fur<strong>the</strong>r requires <strong>the</strong> Department to prepare a report that includes:<br />

(1) Documentation of all assessments performed and actions taken related to this<br />

section;<br />

(2) Cost savings measures implemented and changes to <strong>the</strong> methods used to procure<br />

student transportation services for fiscal year 2012-2013; and<br />

(3) Planned cost savings measures, changes to <strong>the</strong> methods used to procure student<br />

transportation services, and a comprehensive plan for providing and paying for<br />

student transportation services for fiscal biennium 2013-2015, and submit <strong>the</strong><br />

report to <strong>the</strong> Legislature no later than thirty days prior to <strong>the</strong> convening of <strong>the</strong><br />

Regular Session of 2013.<br />

PART III, SECTION 20<br />

CHARTER SCHOOL FACILITY RELATED EXPENDITURES. Requires <strong>the</strong> Charter School<br />

Administrative Office to prepare a report that shall include a detailed breakout of actual<br />

facility-related expenditures for <strong>the</strong> last completed fiscal year for each charter school and <strong>the</strong><br />

method of funding and an explanation of <strong>the</strong> methodology developed <strong>by</strong> <strong>the</strong> Office to<br />

distribute <strong>the</strong> funds and to submit <strong>the</strong> report to <strong>the</strong> Legislature no later than thirty days prior to<br />

<strong>the</strong> convening of <strong>the</strong> Regular Sessions of 2012.<br />

PART III, SECTION 23.3<br />

JOHN A. BURNS SCHOOL OF MEDICINE, EXPENDITURES OF. Requires <strong>the</strong> John A.<br />

Burns School of Medicine to prepare an annual comprehensive report detailing all<br />

PART V, SECTION 52.3<br />

ENTERPRISE RESOURCE PLANNING PROJECT. Requires <strong>the</strong> Department of Accounting<br />

and General Services to report on its progress in implementing phase 1 of <strong>the</strong> <strong>state</strong>wide<br />

enterprise resource planning project to apprise <strong>the</strong> <strong>legislature</strong> of recommendations of <strong>the</strong><br />

available options for <strong>the</strong> <strong>state</strong>wide enterprise resource planning systems and o<strong>the</strong>r solutions<br />

that best meet <strong>the</strong> needs of <strong>the</strong> State of Hawaii at least twenty days prior to <strong>the</strong> Regular<br />

Session of 2013, and as of June 30, 2013.<br />

PART VI, SECTION 66.1<br />

RENTAL MOTOR VEHICLE CUSTOMER FACILITY REVENUE BOND FUNDS. Requires<br />

<strong>the</strong> Governor to submit a report of all uses of <strong>the</strong> authority to use <strong>the</strong> rental motor vehicle<br />

customer facility revenue bonds funds, for <strong>the</strong> previous twelve month period from December 1<br />

to November 30, to <strong>the</strong> Legislature no later than thirty days prior to <strong>the</strong> convening of <strong>the</strong><br />

PART VII, SECTION 128.1<br />

SUPPLEMENTAL SECURITY INCOME. Requires <strong>the</strong> Department of Human Services to<br />

(1) The number of general assistance recipients who applied for supplemental security<br />

income;<br />

(2) The number of general assistance recipients who signed <strong>the</strong> interim assistance<br />

reimbursement agreement;<br />

(3) The number of interim assistance reimbursement agreements transmitted to <strong>the</strong><br />

Social Security Administration;<br />

(4) The number of general assistance cases that were denied supplemental security<br />

income benefits;<br />

(5) The number of cases where <strong>the</strong> department of human services was not<br />

reimbursed due to <strong>the</strong> missing interim assistance reimbursement agreement;<br />

(6) The total amount of funds not reimbursed to <strong>the</strong> department of human services due<br />

to <strong>the</strong> missing interim assistance reimbursement agreement; and<br />

(7) The total number of overpayment claims established for <strong>the</strong> amount of funds not<br />

reimbursed.<br />

Fur<strong>the</strong>r requires that <strong>the</strong> report include actual data for fiscal year 2011-2012, actual and<br />

projected data for fiscal year 2012-2013, and be submitted to <strong>the</strong> Legislature no later than<br />

twenty days prior to <strong>the</strong> convening of <strong>the</strong> Regular Session of 2013.<br />

PART VII, SECTION 129.1<br />

SCHOOL SYSTEM FINANCIAL ACCOUNTABILITY. Requires <strong>the</strong> Department of Education<br />

to prepare a report on section 302A-1301, Hawaii Revised Statutes, that includes:<br />

(1) Information and calculations for each fiscal year from fiscal year 2009-2010 to<br />

2011-2012 on <strong>the</strong> amount and proportion of <strong>the</strong> department's operating budget that<br />

was expended for administrative costs and <strong>the</strong> amount and proportion of <strong>the</strong><br />

department's operating budget that was expended <strong>by</strong> principals, <strong>by</strong> means of<br />

financing; and<br />

(2) The department's plan that will enable it to comply with <strong>the</strong> requirements of section<br />

evidence <strong>by</strong> an applicant, to consider relevant education, training, or service completed <strong>by</strong> an<br />

individual as a member of <strong>the</strong> armed forces or reserves of <strong>the</strong> United States, <strong>the</strong> national<br />

guard of any <strong>state</strong>, <strong>the</strong> military reserves of any <strong>state</strong>, or <strong>the</strong> navy militia of any <strong>state</strong> as part of<br />

<strong>the</strong> evaluation process toward <strong>the</strong> qualification requirements to receive <strong>the</strong> license.<br />

Requires <strong>the</strong> licensing administrator of <strong>the</strong> Professional and Vocational Licensing Division of<br />

<strong>the</strong> Department of Commerce and Consumer Affairs to communicate <strong>the</strong> intent and<br />

parameters of this Act to each licensing authority and shall submit a report detailing plans for<br />

<strong>the</strong> implementation of this Act to <strong>the</strong> <strong>legislature</strong> no later than twenty days prior to <strong>the</strong><br />

convening of <strong>the</strong> Regular Session of 2013.<br />

CONCUSSION EDUCATIONAL PROGRAM, DEVELOPMENT OF. Requires <strong>the</strong> Department<br />

of Education and <strong>the</strong> Hawaii High School Athletic Association to develop a concussion<br />

educational program that includes:<br />

(1) Educating students, parents, sports officials, school faculty, coaches, staff, and<br />

school administrators about <strong>the</strong> signs and symptoms of a concussion and <strong>the</strong><br />

procedures to follow if a person displays any of <strong>the</strong> signs or symptoms of a<br />

concussion;<br />

(2) Annual educational sessions about <strong>the</strong> signs and symptoms of a concussion for<br />

coaches and athletic trainers;<br />

(3) The need for <strong>the</strong> mandatory removal of a student from <strong>the</strong> athletic activity that <strong>the</strong><br />

student is participating in, if <strong>the</strong> student demonstrates any signs and symptoms of<br />

a concussion;<br />

(4) The need for a concussed student's licensed health care provider to evaluate <strong>the</strong><br />

student and determine whe<strong>the</strong>r <strong>the</strong> student is able to return to a particular athletic<br />

activity; and<br />

(5) The monitoring of a student's return to physical activity <strong>by</strong> <strong>the</strong> school's certified<br />

athletic trainer, if an athletic trainer is employed <strong>by</strong> <strong>the</strong> school. This return to<br />

activity plan is to be based upon peer-review scientific evidence, such as that from<br />

<strong>the</strong> National Athletic Trainer Association or Centers for Disease Control and<br />

Prevention.<br />

Fur<strong>the</strong>r requires that an educational program be developed for every public and private<br />

school that is a member of <strong>the</strong> Hawaii High School Athletic Association on how to develop a<br />

school's concussion awareness plan and that every program shall require:<br />

(1) Annual concussion awareness training for coaches, administrators, faculty, staff,<br />

and sports officials, including:<br />

(A) The signs and symptoms of a concussion;<br />

(B) The need to obtain proper medical attention for a person suspected of having<br />

a concussion; and<br />

(C) Information on <strong>the</strong> nature and risk of concussions, including <strong>the</strong> danger of<br />

continuing to play after sustaining a concussion and <strong>the</strong> proper method of<br />

allowing a student who has sustained a concussion to return to activity;<br />

(2) Annual concussion awareness education for parents and students who participate<br />

in a school's athletic team or programs or both. The parents and students shall<br />

sign a concussion information sheet that <strong>the</strong>y have attended and received this<br />

concussion awareness education;<br />

(3) Immediate removal from a game, practice, or o<strong>the</strong>r activity of any student who<br />

exhibits signs, symptoms, or behaviors consistent with a concussion, such as loss<br />

of consciousness, headache, dizziness, confusion, or balance problems. The<br />

student shall not return to <strong>the</strong> activity until cleared to do so <strong>by</strong> a licensed health<br />

care provider; and<br />

(4) The student to obtain written clearance from a licensed health care provider prior<br />

to returning to academics and athletics, which:<br />

(A) States that <strong>the</strong> student is capable of resuming participation in a particular<br />

sport;<br />

(B) May require <strong>the</strong> student to follow a plan designed to aid <strong>the</strong> student to<br />

recover and resume participation in school and athletic activities that:<br />

(i) Includes, as appropriate, periods of cognitive and physical rest while<br />

symptoms of a concussion persist; and<br />

(ii) Reintroduces cognitive and physical demands on <strong>the</strong> student on a<br />

progressive basis to prevent <strong>the</strong> reemergence or worsening of<br />

symptoms of a concussion; and<br />

(C) Requires that <strong>the</strong> student's return to physical activity be monitored <strong>by</strong> <strong>the</strong><br />

school's certified athletic trainer, if an athletic trainer is employed <strong>by</strong> <strong>the</strong><br />

school.<br />

Requires <strong>the</strong> Department to report on <strong>the</strong> development and implementation of <strong>the</strong><br />

concussion educational program to <strong>the</strong> Legislature no later than twenty days prior to <strong>the</strong><br />

INTEGRATED HEALTH CARE FOR INDIVIDUALS ENROLLED IN BOTH MEDICAID AND<br />

MEDICARE. Requests <strong>the</strong> Department of Human Services is requested to implement a<br />

demonstration project to integrate care for individuals enrolled in both Medicaid and Medicare<br />

in order to improve patient centeredness and quality of care, help reduce provider<br />

administrative burden, and generate savings to <strong>the</strong> <strong>state</strong> and federal governments.<br />

Fur<strong>the</strong>r <strong>requests</strong> <strong>the</strong> Department to optimize participation in <strong>the</strong> integration demonstration<br />

project while preserving consumer choice.<br />

(B) Providing incentives to local entrepreneurs to cultivate Hawaiian sandalwood<br />

species for reforestation programs or sustainable commercial operations;<br />

(C) Providing support for programs that ensure <strong>the</strong> sustainability of commercial<br />

operations for Hawaiian sandalwood resources in <strong>the</strong> State; and<br />

(2) Establishment of requirements for a permitting process for <strong>the</strong> commercial and<br />

noncommercial harvesting of Hawaiian sandalwood, including a sustainable forest<br />

management plan; and<br />

(3) Prohibition of <strong>the</strong> export of native Hawaiian seed banks.<br />

Fur<strong>the</strong>r <strong>requests</strong> <strong>the</strong> task force to conduct a thorough inventory of sandalwood throughout <strong>the</strong><br />

State in order to fully understand <strong>the</strong> status and distribution of Hawaiian sandalwood and to<br />

OPIHI HARVESTING, REGULATION AND CONTROL. Urges <strong>the</strong> Department of Land and<br />

Natural Resources to adopt rules in accordance to chapter 91, Hawaii Revised Statutes, to<br />

regulate and control opihi harvesting, so that <strong>the</strong> opihi stocks may naturally replenish<br />

<strong>the</strong>mselves and support sustainable harvesting and that <strong>the</strong> rules adopted <strong>by</strong> <strong>the</strong> Department<br />

apply to all known Hawaiian opihi, including Cellana exarata (blackfoot), Cellana<br />

sandwicensis (yellowfoot), Cellana talcosa (koele), and Cellana melanostoma (greenfoot).<br />

Resolves that <strong>the</strong> rules adopted also accomplish <strong>the</strong> following:<br />

(1) Restrict at any time <strong>the</strong> taking, harvesting, or possessing of opihi from off shore<br />

islets in <strong>the</strong> State, including those islands listed in <strong>the</strong> Atlas of Hawaii, 3rd Edition<br />

(1998), man-made jetties and breakwaters, fishery management areas, fisheries<br />

replenishment areas, natural area reserves, refuges, and marine life conservation<br />

districts established <strong>by</strong> <strong>the</strong> Division of Aquatic Resources of <strong>the</strong> Department of<br />

Land and Natural Resources;<br />

(2) Restrict at any time <strong>the</strong> taking, harvesting, or possessing of opihi from below <strong>the</strong><br />

waterline of any coastal area or nearshore waters of <strong>the</strong> islands of <strong>the</strong> State;<br />

(3) Restrict during closed seasons <strong>the</strong> taking, harvesting, or possessing of opihi from<br />

above <strong>the</strong> waterline of <strong>the</strong> coastal areas or nearshore waters of <strong>the</strong> islands;<br />

provided that <strong>the</strong> closed seasons be determined jointly <strong>by</strong> <strong>the</strong> Division of Aquatic<br />

Resources and <strong>the</strong> Hawaii Institute of Marine Biology of <strong>the</strong> University of Hawaii;<br />

(4) Allow <strong>the</strong> Kahoolawe Island Reserve Commission to govern <strong>the</strong> taking, harvesting,<br />

and possessing of opihi in <strong>the</strong> Kahoolawe Island Reserve, including <strong>the</strong> islands of<br />

Puukoae and Aleale;<br />

(5) Recognize individuals who are exercising Native Hawaiian ga<strong>the</strong>ring rights and<br />

traditional practices as authorized <strong>by</strong> law, or as permitted <strong>by</strong> <strong>the</strong> Department<br />

pursuant to article XII, section 7, of <strong>the</strong> Hawaii State Constitution, <strong>by</strong> allowing <strong>the</strong>se<br />

individuals to take, harvest, and possess opihi only for those purposes; and<br />

(6) Establish a five-year moratorium on <strong>the</strong> taking or harvesting of opihi from <strong>the</strong><br />

coastal areas or nearshore areas of <strong>the</strong> island of Oahu.<br />

Requests <strong>the</strong> Department to submit an annual report that includes:<br />

(1) Updates on <strong>the</strong> development, adoption, and implementation of rules pursuant to<br />

chapter 91, Hawaii Revised Statutes;<br />

(2) The effectiveness and enforcement of <strong>the</strong> rules adopted to replenish <strong>the</strong> opihi<br />

stocks;<br />

(3) Ongoing discussions and work with <strong>the</strong> Hawaii Institute of Marine Biology of <strong>the</strong><br />

University of Hawaii regarding establishing open and closed seasons for <strong>the</strong> taking<br />

and harvesting of opihi from above <strong>the</strong> waterline of <strong>the</strong> coastal areas or nearshore<br />

waters of <strong>the</strong> islands, ga<strong>the</strong>ring and compiling baseline and subsequent annual<br />

data on opihi stocks, and efforts in replenishing <strong>the</strong> opihi stocks;<br />

(4) Annual data on opihi stocks, including baseline data to be submitted in <strong>the</strong> annual<br />

report to <strong>the</strong> Legislature prior to <strong>the</strong> Regular Session of 2013, and <strong>the</strong> efforts and<br />

any issues encountered in ga<strong>the</strong>ring and compiling such data; and<br />

hold title to or leases of land along <strong>the</strong> elevated rapid transit line route in order to develop a<br />

community development plan for communities along <strong>the</strong> route and that <strong>the</strong> community<br />

(1) Plans to develop public private partnerships to assist with <strong>the</strong> planning,<br />

coordination, and implementation of revenue generating activities and<br />

Urges <strong>the</strong> Department (Health) not to increase <strong>the</strong> non-refundable deposit beverage container<br />

fee until <strong>the</strong> Auditor has completed an updated management and financial audit of <strong>the</strong> deposit<br />

beverage container recycling program in accordance with section 342G-107, Hawaii Revised<br />

Statutes.<br />

Requests <strong>the</strong> Auditor is requested to conduct a management and financial audit of <strong>the</strong><br />

program, pursuant to section 342G-107, Hawaii Revised Statutes, and address:<br />

(1) The concerns reported in <strong>the</strong> November 2005 audit as to <strong>the</strong> Department's lack of<br />

accounting and internal controls for <strong>the</strong> program and special fund;<br />
