(3) By November 1 each year, the Department of Health shall<br />
provide nonidentifying information to the prescription drug<br />
monitoring program’s Implementation and Oversight Task Force<br />
regarding the number of physicians who are registered with the<br />
prescription drug monitoring program and who also use the<br />
database from the prescription drug monitoring program for their<br />
patients in their medical practice.<br />
Section 7. Paragraphs (a), (f), (g), (h), and (k) of<br />
subsection (1) and paragraphs (a) and (c) of subsection (2) of<br />
section 458.3265, Florida Statutes, are amended, and paragraphs<br />
(f) and (g) are added to subsection (5) of that section, to<br />
read:<br />
458.3265 Pain-management clinics.—<br />
(1) REGISTRATION.—<br />
(a) “Pain-management clinic,” hereinafter referred to as<br />
“clinic,” means a publicly or privately owned facility where in<br />
any month a majority of patients are prescribed opioids,<br />
benzodiazepines, barbiturates, or carisoprodol, for the<br />
treatment of chronic nonmalignant pain. “Chronic nonmalignant<br />
pain” means pain unrelated to cancer or rheumatoid arthritis<br />
which persists beyond the usual course of disease or the injury<br />
that is the cause of the pain or more than 90 days after<br />
surgery. All privately owned pain-management clinics,<br />
facilities, or offices, hereinafter referred to as “clinics,”<br />
which advertise in any medium for any type of pain-management<br />
services, or employ a physician who is primarily engaged in the<br />
treatment of pain by prescribing or dispensing controlled<br />
