Europe in <strong>the</strong> <strong>soci</strong>al <strong>and</strong> cultural fields;<br />

Having regard to <str<strong>on</strong>g>Resoluti<strong>on</strong></str<strong>on</strong>g> (96) 35 <str<strong>on</strong>g>of</str<strong>on</strong>g> 2 October 1996 revising <strong>the</strong> Partial Agreement in <strong>the</strong> Social <strong>and</strong> Public<br />

Health Field, <strong>and</strong> resolved to c<strong>on</strong>tinue, <strong>on</strong> <strong>the</strong> basis <str<strong>on</strong>g>of</str<strong>on</strong>g> revised rules replacing those set out in <str<strong>on</strong>g>Resoluti<strong>on</strong></str<strong>on</strong>g> (59)<br />

23, <strong>the</strong> activities hi<strong>the</strong>rto carried out <strong>and</strong> developed by virtue <str<strong>on</strong>g>of</str<strong>on</strong>g> that resoluti<strong>on</strong>, aimed at, inter alia, integrating<br />

people with disabilities into <strong>the</strong> community; <strong>and</strong> defining – <strong>and</strong> c<strong>on</strong>tributing to <strong>the</strong> implementati<strong>on</strong> at European<br />

level – a model coherent policy for people with disabilities, based <strong>on</strong> <strong>the</strong> principles <str<strong>on</strong>g>of</str<strong>on</strong>g> full citizenship <strong>and</strong><br />

independent living, implying <strong>the</strong> eliminati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> barriers to integrati<strong>on</strong>, whatever <strong>the</strong>ir nature (psychological,<br />

educati<strong>on</strong>al, family related, cultural, <strong>soci</strong>al, pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>al, financial or architectural);<br />

C<strong>on</strong>sidering that <strong>the</strong> aim <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> Council <str<strong>on</strong>g>of</str<strong>on</strong>g> Europe is to achieve greater unity between its members <strong>and</strong> that<br />

this aim may be pursued, inter alia, by <strong>the</strong> adopti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> comm<strong>on</strong> rules in <strong>the</strong> disability policy field for <strong>the</strong><br />

purpose <str<strong>on</strong>g>of</str<strong>on</strong>g> promoting <strong>the</strong> protecti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> political, civil, <strong>soci</strong>al, cultural <strong>and</strong> educati<strong>on</strong>al rights;<br />

Bearing in mind <strong>the</strong> C<strong>on</strong>venti<strong>on</strong> for <strong>the</strong> Protecti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> Human Rights <strong>and</strong> Fundamental Freedoms (ETS No. 5),<br />

<strong>and</strong> its Protocol (ETS No. 9) establishing <strong>the</strong> right to educati<strong>on</strong> (Article 2) as well as <strong>the</strong> European C<strong>on</strong>venti<strong>on</strong><br />

<strong>on</strong> <strong>the</strong> Exercise <str<strong>on</strong>g>of</str<strong>on</strong>g> Children’s Rights (ETS No. 160);<br />

Bearing in mind <strong>the</strong> revised European Social Charter (ETS No. 163), in particular Articles E (Part V), 15 <strong>and</strong><br />

17, <strong>and</strong> <strong>the</strong> Additi<strong>on</strong>al Protocol to <strong>the</strong> European Social Charter Providing for a System <str<strong>on</strong>g>of</str<strong>on</strong>g> Collective<br />

Complaints (ETS No.158);<br />

Bearing in mind its <str<strong>on</strong>g>Resoluti<strong>on</strong></str<strong>on</strong>g> ResChS(2004)1 <strong>on</strong> collective complaint No. 13/2002 by Autisme-Europe<br />

against France <strong>and</strong> <strong>the</strong> decisi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> European <str<strong>on</strong>g>Committee</str<strong>on</strong>g> <str<strong>on</strong>g>of</str<strong>on</strong>g> Social Rights <strong>on</strong> <strong>the</strong> merits <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> complaint;<br />

Nati<strong>on</strong>s C<strong>on</strong>venti<strong>on</strong> <strong>on</strong> <strong>the</strong> Rights <str<strong>on</strong>g>of</str<strong>on</strong>g> Pers<strong>on</strong>s with Disabilities (2006);<br />

Having regard to <strong>the</strong> Internati<strong>on</strong>al Classificati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> Functi<strong>on</strong>ing, Disability <strong>and</strong> Health (ICF) (2001), <strong>and</strong> to <strong>the</strong><br />

Internati<strong>on</strong>al Classificati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> Diseases (ICD-10) <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> World Health Organisati<strong>on</strong>;<br />

Reaffirming <strong>the</strong> universality, indivisibility <strong>and</strong> interdependence <str<strong>on</strong>g>of</str<strong>on</strong>g> all human rights <strong>and</strong> fundamental freedoms,<br />

<strong>and</strong> <strong>the</strong> need for people with autism spectrum disorders, regardless <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> severity <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong>ir disorder, to be<br />

guaranteed <strong>the</strong>ir full enjoyment without any discriminati<strong>on</strong>;<br />

C<strong>on</strong>vinced that ensuring equal opportunities for members <str<strong>on</strong>g>of</str<strong>on</strong>g> all groups in <strong>soci</strong>ety c<strong>on</strong>tributes to securing<br />

democracy <strong>and</strong> <strong>soci</strong>al cohesi<strong>on</strong>;<br />

C<strong>on</strong>sidering that failure to promote <strong>the</strong> rights <str<strong>on</strong>g>of</str<strong>on</strong>g> citizens with autism spectrum disorders <strong>and</strong> to ensure equality<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> opportunities is a violati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong>ir human dignity;<br />

Emphasising <strong>the</strong> need for coherent policies at nati<strong>on</strong>al level <strong>and</strong> co-ordinated acti<strong>on</strong>;<br />

Referring to <strong>the</strong> work carried out by <strong>the</strong> Council <str<strong>on</strong>g>of</str<strong>on</strong>g> Europe <str<strong>on</strong>g>Committee</str<strong>on</strong>g> <strong>on</strong> <strong>the</strong> Rehabilitati<strong>on</strong> <strong>and</strong> Integrati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

People with Disabilities (CD-P-RR) <strong>and</strong> by its subordinate body, <strong>the</strong> <str<strong>on</strong>g>Committee</str<strong>on</strong>g> <str<strong>on</strong>g>of</str<strong>on</strong>g> Experts <strong>on</strong> <strong>the</strong> Educati<strong>on</strong><br />

<strong>and</strong> Integrati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> Children with Autism (P-RR-AUT);<br />

Noting that autism spectrum disorders cannot, as yet, be identified at birth, <strong>and</strong> that <strong>the</strong> evoluti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

epidemiological data provides an indicati<strong>on</strong>, inter alia, <str<strong>on</strong>g>of</str<strong>on</strong>g> public awareness, <strong>the</strong> availability, accessibility <strong>and</strong><br />

quality <str<strong>on</strong>g>of</str<strong>on</strong>g> diagnostic services;<br />

Emphasising <strong>the</strong> need for a combinati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong>rapy <strong>and</strong> learning in <strong>the</strong> way <strong>the</strong> educati<strong>on</strong> system caters to<br />

<strong>the</strong>se children;<br />

Reiterating <strong>the</strong> need to closely involve children <strong>and</strong> young people with autism spectrum disorders, al<strong>on</strong>g with<br />

<strong>the</strong>ir families, in decisi<strong>on</strong>s affecting <strong>the</strong>ir lives;<br />

Recommends that <strong>the</strong> governments <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> States members <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> Partial Agreement in <strong>the</strong> Social <strong>and</strong> Public<br />

Health Field, with due regard for <strong>the</strong>ir own nati<strong>on</strong>al, regi<strong>on</strong>al or local structures <strong>and</strong> respective resp<strong>on</strong>sibilities,<br />

encourage <strong>the</strong> educati<strong>on</strong> <strong>and</strong> <strong>soci</strong>al inclusi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> children <strong>and</strong> young people with autism spectrum disorders<br />

<strong>and</strong>, to this end:<br />

a. take account, as appropriate, in <strong>the</strong>ir policies, legislati<strong>on</strong> <strong>and</strong> practice <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> principles set out in <strong>the</strong><br />

appendix to this resoluti<strong>on</strong> <strong>and</strong> implement <strong>the</strong> measures advocated;<br />

b. with reference to <strong>the</strong> Council <str<strong>on</strong>g>of</str<strong>on</strong>g> Europe Disability Acti<strong>on</strong> Plan, take appropriate evaluati<strong>on</strong> <strong>and</strong> follow-up<br />

measures;<br />

c. involve n<strong>on</strong>-governmental organisati<strong>on</strong>s representing children <strong>and</strong> young people with autism spectrum<br />

disorders <strong>and</strong> <strong>the</strong>ir families in <strong>the</strong> implementati<strong>on</strong> <strong>and</strong> m<strong>on</strong>itoring <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> measures advocated;<br />

d. promote <strong>the</strong> implementati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> this resoluti<strong>on</strong> in areas which are not <strong>the</strong> direct resp<strong>on</strong>sibility <str<strong>on</strong>g>of</str<strong>on</strong>g> public<br />

authorities, but where <strong>the</strong>y have a certain influence or play a role;<br />

e. ensure <strong>the</strong> widest possible disseminati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> this resoluti<strong>on</strong> to all parties c<strong>on</strong>cerned, for example through<br />

awareness-raising campaigns <strong>and</strong> co-operati<strong>on</strong> with civil <strong>soci</strong>ety.<br />

Appendix to <str<strong>on</strong>g>Resoluti<strong>on</strong></str<strong>on</strong>g> ResAP(2007)4<br />

Pers<strong>on</strong>s with autism spectrum disorders are full citizens <str<strong>on</strong>g>of</str<strong>on</strong>g> Europe. If provided with <strong>the</strong> appropriate level <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

educati<strong>on</strong>, <strong>the</strong>y can be integrated into, <strong>and</strong> c<strong>on</strong>tribute to, <strong>soci</strong>ety.<br />

I. Introducti<strong>on</strong><br />

1. Autism spectrum disorders are biologically based developmental disorders, which, although occurring with<br />

varying degrees <str<strong>on</strong>g>of</str<strong>on</strong>g> severity, always have a potentially devastating effect <strong>on</strong> <strong>the</strong> <strong>soci</strong>al integrati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong><br />

individuals with this disorder, <strong>and</strong> <strong>the</strong>ir families.<br />

2. Inclusi<strong>on</strong> depends <strong>on</strong> <strong>the</strong> recogniti<strong>on</strong> that pers<strong>on</strong>s with autism spectrum disorders present specific needs<br />

that are qualitatively 2 different from o<strong>the</strong>r special needs <strong>and</strong> require specific underst<strong>and</strong>ing <strong>and</strong> approaches to<br />

meet <strong>the</strong>m.<br />

II. General c<strong>on</strong>siderati<strong>on</strong>s<br />

1. Member states should adopt legislati<strong>on</strong> <strong>and</strong> policies <strong>and</strong> provide enabling structures to mitigate <strong>the</strong> effects<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> disorder <strong>and</strong> to facilitate <strong>the</strong> <strong>soci</strong>al integrati<strong>on</strong>, improve <strong>the</strong> living c<strong>on</strong>diti<strong>on</strong>s <strong>and</strong> promote <strong>the</strong><br />

development <strong>and</strong> independence <str<strong>on</strong>g>of</str<strong>on</strong>g> individuals with this disorder.<br />

2. In line with <strong>the</strong> instruments <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> Council <str<strong>on</strong>g>of</str<strong>on</strong>g> Europe <strong>and</strong> <strong>the</strong> UN C<strong>on</strong>venti<strong>on</strong> <strong>on</strong> <strong>the</strong> Rights <str<strong>on</strong>g>of</str<strong>on</strong>g> Pers<strong>on</strong>s with<br />

Disabilities, member states should ensure not <strong>on</strong>ly that educati<strong>on</strong>, <strong>soci</strong>al welfare <strong>and</strong> o<strong>the</strong>r public policies do<br />

not discriminate against people with disabilities, including people with autism spectrum disorder but that<br />

equality <str<strong>on</strong>g>of</str<strong>on</strong>g> opportunity <strong>and</strong> appropriate educati<strong>on</strong>al interventi<strong>on</strong>s are provided.<br />

3. Member states should support wide-ranging early <strong>and</strong> accessible identificati<strong>on</strong> <strong>and</strong> diagnosis, individual<br />

assessment, public awareness <strong>and</strong> training for parents <strong>and</strong> <strong>the</strong> pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>als c<strong>on</strong>cerned. They should also<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g>fer support for equal educati<strong>on</strong>al <strong>and</strong> training opportunities <strong>and</strong> support for <strong>soci</strong>al inclusi<strong>on</strong>.<br />

III. Specific c<strong>on</strong>siderati<strong>on</strong>s<br />

1. Member states should provide a legal framework, which ensures <strong>the</strong> rights <str<strong>on</strong>g>of</str<strong>on</strong>g> children <strong>and</strong> young people<br />

with disabilities, including people with autism spectrum disorders to receive educati<strong>on</strong> – within general<br />

schemes wherever possible – that is appropriate to <strong>the</strong>ir needs, is n<strong>on</strong>-discriminatory <strong>and</strong> works towards<br />

<strong>soci</strong>al inclusi<strong>on</strong>. There is a need to ensure that resources are sufficient for <strong>the</strong> full implementati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> relevant<br />

legislati<strong>on</strong>.<br />

2. Agencies should work toge<strong>the</strong>r to provide a co-ordinated services for children, young people <strong>and</strong> <strong>the</strong>ir<br />

families. Autism spectrum disorders require a multidisciplinary approach to diagnosis, assessment<br />

<strong>and</strong> educati<strong>on</strong>.<br />

3. With regard to suspected autism spectrum disorders, public authorities should provide services in order to<br />

prevent additi<strong>on</strong>al problems <strong>and</strong> resp<strong>on</strong>d to <strong>the</strong> needs <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> individual <strong>and</strong> his or her family, while awaiting<br />

c<strong>on</strong>firmati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> diagnosis if <strong>the</strong> functi<strong>on</strong>al ability <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> pers<strong>on</strong> is reduced.<br />

4. There should be a tiered system that provides diagnosis based <strong>on</strong> recognised internati<strong>on</strong>al criteria so that<br />

most diagnoses are made at local level in a timely manner (no later than six m<strong>on</strong>ths from suspici<strong>on</strong>).<br />

5. Following diagnosis, educati<strong>on</strong> for children <strong>and</strong> young people with autism spectrum disorders should be<br />

based <strong>on</strong> detailed assessments that identify <strong>the</strong> needs <strong>and</strong> strengths <str<strong>on</strong>g>of</str<strong>on</strong>g> each individual. Special attenti<strong>on</strong><br />

should be paid to <strong>the</strong> educati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> young children with autism spectrum disorders. Steps should <strong>the</strong>refore be<br />

taken to ensure that services dealing with young children are aware <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong>se problems as early as possible.<br />

6. Families should be fully informed <strong>and</strong> involved in all stages <str<strong>on</strong>g>of</str<strong>on</strong>g> identificati<strong>on</strong>, diagnosis, assessment <strong>and</strong><br />

educati<strong>on</strong>. In order to avoid exclusi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> child, families should be supported to enable <strong>the</strong>m to maintain<br />

<strong>the</strong>ir child within <strong>the</strong> family <strong>and</strong> <strong>the</strong> community ra<strong>the</strong>r than in an instituti<strong>on</strong>, even where he or she displays<br />

behavioural problems.<br />

7. Training should be available to parents to enable <strong>the</strong>m to facilitate <strong>the</strong> development <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong>ir child <strong>and</strong><br />

pre-empt or manage any challenging behaviour. Parents should also have access to c<strong>on</strong>tinuing support from<br />

expert services <strong>and</strong> opportunities for c<strong>on</strong>tact with o<strong>the</strong>r parents, where an expert assessment is requested,<br />

according to defined eligibility criteria.<br />

8. Initial <strong>and</strong> c<strong>on</strong>tinuing training programmes should be introduced for pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>als liable to be involved in <strong>the</strong><br />

educati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> children <strong>and</strong> young people with autism spectrum disorders.<br />

9. Political <strong>and</strong> administrative decisi<strong>on</strong> makers need to be made aware <str<strong>on</strong>g>of</str<strong>on</strong>g> autism spectrum disorders so that<br />

any relevant decisi<strong>on</strong>s can be taken in full knowledge <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> facts.<br />

10. Interventi<strong>on</strong> to meet individual needs should be through an individual plan, which is regularly reviewed <strong>and</strong><br />

comprises educati<strong>on</strong>, support <strong>and</strong> leisure. This individual plan should facilitate a co-ordinated approach to <strong>the</strong><br />

transiti<strong>on</strong>s in <strong>the</strong> educati<strong>on</strong> system <strong>and</strong> towards adulthood <strong>and</strong> <strong>the</strong> employment market.<br />

11. Children <strong>and</strong> young people with autism spectrum disorders should be given specific teaching in<br />

mainstream schools wherever possible <strong>and</strong> provided with opportunities to learn skills <strong>and</strong> gain underst<strong>and</strong>ing<br />

in order to engage in <strong>soci</strong>ally inclusive situati<strong>on</strong>s.<br />

12. A range <str<strong>on</strong>g>of</str<strong>on</strong>g> schooling opti<strong>on</strong>s, in no particular order, should be available to meet <strong>the</strong> diverse needs <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

children <strong>and</strong> young people with autism spectrum disorders. Support <strong>and</strong> opportunities for <strong>soci</strong>al integrati<strong>on</strong><br />

should be provided in whatever situati<strong>on</strong> best fits <strong>the</strong>ir current needs.<br />

13. If possible, a database which is accurate, up-to-date <strong>and</strong> based <strong>on</strong> internati<strong>on</strong>ally-recognised criteria <strong>on</strong><br />

children <strong>and</strong> young people with autism spectrum disorders should be used <strong>and</strong> made available to service<br />

planners <strong>and</strong> providers in accordance with data protecti<strong>on</strong> legislati<strong>on</strong>.<br />

14. Processes <str<strong>on</strong>g>of</str<strong>on</strong>g> internal <strong>and</strong> external evaluati<strong>on</strong> should be put in place in order to assure <strong>the</strong> availability <strong>and</strong><br />

quality <str<strong>on</strong>g>of</str<strong>on</strong>g> educati<strong>on</strong> <strong>and</strong> inclusi<strong>on</strong> for children <strong>and</strong> young people with autism spectrum disorders <strong>and</strong> to provide<br />

recommendati<strong>on</strong>s <strong>and</strong> support at central planning <strong>and</strong> local service levels.<br />

15. Training <strong>and</strong> <strong>on</strong>going support should be provided to families <strong>and</strong> educati<strong>on</strong>al services in order to help<br />

<strong>the</strong>m to underst<strong>and</strong> <strong>and</strong> manage challenging behaviour. Parents <strong>and</strong> service providers need to underst<strong>and</strong><br />

that challenging behaviour is not intrinsic to autism spectrum disorders, but arises from <strong>the</strong> interacti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong><br />

child with <strong>the</strong> envir<strong>on</strong>ment. Typical strategies for dealing with challenging behaviour should be adapted to<br />

meet <strong>the</strong> needs <str<strong>on</strong>g>of</str<strong>on</strong>g> those with autism spectrum disorders.<br />

16. Comorbidity, dual diagnosis <strong>and</strong> additi<strong>on</strong>al problems are comm<strong>on</strong> in autism spectrum disorders. This fact<br />

must be understood <strong>and</strong> recognised in <strong>the</strong> process <str<strong>on</strong>g>of</str<strong>on</strong>g> diagnosis <strong>and</strong> assessment with a view to meeting <strong>the</strong><br />

individual’s educati<strong>on</strong>al needs.<br />

17. Specific educati<strong>on</strong> <strong>and</strong> support for children <strong>and</strong> young people with autism spectrum disorders should be<br />

provided to help prevent sec<strong>on</strong>dary c<strong>on</strong>sequences <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong>ir difficulties such as anxiety disorders <strong>and</strong><br />

depressi<strong>on</strong>. If <strong>the</strong>se, <strong>and</strong> o<strong>the</strong>r, mental health disorders do arise, those c<strong>on</strong>cerned should have access to <strong>the</strong><br />

same medical <strong>and</strong> psychological treatment that are generally proven to be effective, but adapted to take<br />

account <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong>ir autism spectrum disorders.<br />

18. Research should be carried out in support <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> educati<strong>on</strong>al, <strong>the</strong>rapeutic <strong>and</strong> inclusi<strong>on</strong> strategies because<br />

reliable informati<strong>on</strong> helps to identify new problems which must be addressed, to develop soluti<strong>on</strong>s <strong>and</strong> to<br />

obtain satisfactory results.<br />
